Indian industry is flying on the wings of technology and data is driving the business. Data, however, is the new commodity that is at the centre of a new regulatory mechanism called the Data Protection Act 2021. It is natural for organizations to be uncomfortable with any

new regulation; more so when the regulation requires a re-structuring of some of theexisting business architecture. But there are certain regulations which are the global norms and are inevitable. They can be delayed but not avoided. The Data Protection Regulation is one such legislation which is likely to arrive soon in the industry environment. This is a regulation that holds a penalty risk of 4% of our turnover for non compliance. We can only ignore it at our peril. DPA 2021 has already made its entry as the Due Diligence under ITA 2000.

The world was shaken up in 2018 with the advent of GDPR. It changed the way business entities world over structured their data related business. It changed the way companies handled their personal data of not only its customers but also its employees. It was not only the tech giants that faced the penalties for GDPR noncompliance but also many non tech companies.

What is more important for us to realize is that DPA 2021 is not on the distant horizon but has already entered into our day-to-day obligations as “Due Diligence” under Information Technology Act 2000 (ITA 2000) . DPA 2021 is the due diligence under Section 43A of ITA 2000 and is effective as of now, though we have not recognised it.


Compliance perspective of DPA 2021 unveiled DPA 2021 is a complex law that tries to address the protection of the right of privacy of an Indian citizen as a fundamental right guaranteed in the constitution. At the same time, it affects the law enforcement and national security requirements of Cyber Crime prevention, Intelligence gathering, and Surveillance. Additionally, it does have an impact on business, both in terms of new obligations and cost. In view of these diverse interests that need to be addressed in the legislations, there are bound to be disagreements and conflicts that surface from time to time in the form of opposition for early introduction of the law.

Business is the focus, and compliance is the target For industry, controversies are an unwanted diversion. Ensuring that the new regulation does not adversely affect the business is the priority. At the same time, innovative businessmen have to consider how they can harness the wind to their advantage by re-orienting the sails.

If GDPR is already assimilated by the global industry, there is no reason why DPA 2021 cannot be assimilated by the Indian industry. Starting early with an open mind to understand the regulation is the best way to address the challenge. Towards this objective, the MMA-FDPPI seminar on “DPA 2021-The Compliance View” will introduce the essence of DPA 2021 from the industry perspective and bring the views of experts on how the regulation can be complied with and new business opportunities can be opened up.
