Special Session : Arbitration: The Nuts and Bolts

This session will provide the audience with an explanation of how arbitration currently functions as a mechanism for the resolution of disputes and how it operates to prevent disputes from being litigated in Court proceedings. It will explain why arbitration proceedings move much faster than Court proceedings and how this translates to benefits for businesses. The difference between institutional arbitration and ad hoc arbitration will also be considered and key features and concepts such as the importance of the seat of arbitration and the finality of the award explained. Attention will be given to conducting arbitrations of sector specific disputes, including in sectors such as manufacturing, technology, projects and infrastructure, logistics, maritime, and commodities The session will conclude with a discussion on the drafting of arbitration clauses, with the essential elements of such clauses explained.
