COVID-19 is a severe acute respiratory illness that has spread through direct, indirect or close contact with infected people. Public health agencies found various ways to assess the number of cases, the ability of the healthcare system to respond to cases, and the ability to prevent future cases. Simultaneously, the plaintiffs’ bar attempted various ways to stop public health agencies’ efforts, from an injunction based upon an alleged violation of an administrative procedures act to Section 1983 actions alleging violations of the First, Fifth and Fourteenth Amendments. That number is expected to more than double within the next several years. In May of 2015, Attorney General Loretta Lynch unveiled a $20 million federal pilot program designed to equip approximately 50 different law enforcement agencies with body cameras. Additionally, the Department of Justice has allocated an additional $1 million to study the impact of the cameras. Body cameras can present many potential benefits, as well as risks. However, many agencies utilizing body cameras do not have adequate policies and practices in place. The primary objective of the session will be to identify potential benefits and risks and outline best practices for developing and implementing a police body camera program that maximizes the benefits and minimizes risk.

Use of force incidents involve dynamic human performance factors. If these factors are not explained properly post-incident, a false narrative may become truth for the media and public – and consequently risk managers. For example, an officer using conclusive facts implies the officer made a conscious, cognitive decision. Add in video appearing to contradict those statements and the issue becomes more convoluted – without considering the use of force may have been an impulsive, heuristic response. When risk managers make policy or settlement decisions without fully understanding the incident’s realities, more risks arise. Proper incident narratives help guide effective post-incident mitigation efforts.
