The Montgomery County Chamber of Commerce Board of Governors sets the policy of the Chamber. Bob Bifolco - Continental Bank

Robert J. Bifolco is Executive Vice President and Chief Lending Officer of Continental Bank. Mr. Bifolco has over 40 years of extensive banking experience. Prior to joining Continental Bank, he served as Executive Vice President for Commercial Banking at Penn Liberty Bank. He served as Executive Vice President, Senior Lending Officer with responsibility for the Commercial Banking Division for the former Progress Bank from 1993 until its acquisition by FleetBoston in January 2004.

Joseph Campbell is a Senior Vice President in the Global Commercial Bank. He is a Senior Client Manager for Business Banking covering the Pennsylvania market focusing on serving commercial clients credit, liquidity, trade, and treasury needs of businesses in the Greater Philadelphia area. Mr. Campbell has been with Bank of America since 2004 and has been in the banking industry since 1986 in a variety of roles. Since 1992, he has primarily focused on the Business Banking sector of the banking industry. Mr. Campbell earned a Bachelor of Science in Business Administration from La Salle University. He has served on the board of directors of the Montgomery County Chamber of Commerce since 2007 and was appointed to the Chairman’s role in September of 2011.

Sam Augustine is a lifelong resident of Montgomery County. He grew up in Trooper and graduated from Bishop Kenrick High School. For the past 22 years, he has resided in Limerick Township, where he currently serves on the Zoning Hearing Board. Earl A. Clairmont, Jr., CPA, PFS, CFP is President and shareholder of Clairmont, Paciello & Co., P.C., a regional certified public accounting firm, CPC Financial Planning, Inc. a fee only financial planning company, and Tanglewood Financial Services, Inc. an insurance and investment product implementation firm, which are all based in King of Prussia, PA. He received his BS in Accounting from Villanova University in 1970, and has been practicing public accounting for more than forty years He received his CFP designation from the College for Financial Planning, Denver, Colorado in 1994 and has been managing money since. Mr. Clairmont received his Personal Financial Specialist (PFS) designation from the American Institute of Certified Public Accountants (AICPA) in 1996. The PFS designation, established in 1987 by the AICPA, recognizes CPAs with considerable professional experience in financial planning. Mr. Clairmont is also an Investment Adviser Representative registered with the Pennsylvania Securities Commission and Royal Alliance.

Suzanne is also responsible for raising the community awareness of PECO and its programs.

Through her leadership, PECO has initiated strategic partnerships with several community partners including Montgomery County Community College, Valley Forge National Historic Park, Montgomery County WIB, Youth Empowerment and Career Development Center, the Montgomery County Cultural Center, Montgomery County Lands Trust, the Elmwood Park Zoo, the Schuylkill Canal Association, Montgomery County Department of Public Safety and the Wissahickon Valley Watershed Association, as well as many community organizations.

Suzanne S. Ryan serves as regional external affairs manager in Montgomery County for PECO, In this role, Suzanne is responsible for establishing and maintaining relationships with County, mu-

Suzanne has been employed by PECO for nineteen years. After beginning in an administrative function for the utility’s Governmental Affairs Department, she has increased her role and responsibilities through the years to her current position, which she held for the last eight years. Suzanne serves on the Montgomery County Workforce Investment Board, the Valley Forge Convention and Visitors Bureau Board and the Montgomery County Chamber of Commerce Board. She also is a member of the Montgomery County Greenprint Committee and the Whitemarsh Township Media and Communications Advisory Board.

Suzanne resides in Lafayette Hill, Pennsylvania with her husband, Jim and children, Shannon and Jimmy. She received her bachelor’s degree from Rosement College.

The historic 310 year old building has low head clearances and some uneven flooring and for those reasons guests must be escorted in the building much as you would in a private museum. Members are welcome Monday through Friday, 8:30 to 4:30 and can make arrangements by calling (610) 265-1776.

policy: Reservations for Chamber events are generally required two to three days before the actual event. They are required to allow for adequate food service, seating and scheduling. The celebration kicks of on Saturday, March 31, with a family fun day hosted at Elmwood Park Zoo. An “old-fashioned” community carnival will be held on the grounds of the former Kennedy-Kenrick High School on April 18, 19, 20, and 21, complete with rides, food and games of chance. Our international festival takes place on Marshall Street on Saturday, May 12. Come experience the variety of food, culture and entertainment that makes Norristown an exciting multi-cultural community. A professional bike race comes to Norristown on May 19, when top area racers test their skills and endurance. Mexican Independence Day is September 15. Come learn about Mexican history and culture at this all-day celebration and experience the best Mexican food in the region. The birthday celebration ends in September when the Pennsylvania Fireman’s Convention and Parade comes to town on the 27, 28, and 29. During this three-day event fire departments from all across Pennsylvania will gather in Norristown. The event culminates with an all-day parade showcasing fire apparatus from across the state, marching bands, and other attractions. These are only some of the great events that will make Norristown a great place to visit in 2012. Starting in 2010, a dedicated crew of elected and community leaders have been working to plan the events and raise donations to make the celebration possible. You can help by making a donation. Bridgeport Borough of Bridgeport’s Streetscape Improvements Project – Phases I and II The Borough of Bridgeport has completed Phases I and II of their 4th Street Revitalization Project This $2.1 million project was funded partially by $1.4 million in local and regional grants. As a result of this improvements project, Bridgeport has become a more walkable, accessible community; new jobs will be created; and residents and visitors will realize increased safety and security.

System The United States Environmental Protection Agency (EPA) issued a National Combined Sewer Overflow Control Strategy in 1989 as an attempt to minimize the impacts of combined sewer overflows (CSO) on water quality, aquatic life and human health. The majority of the Bridgeport Borough is served by such a combined sewer system constructed in the early 1900s. This system conveys both sewage and stormwater runoff, therefore the term “combined sewer.” During some rainfall events, this combined sewer “overflows” to the river and the canal. In mid-1991, EPA initiated a process to accelerate implementation of its CSO Control Strategy. The initiative resulted in development by EPA of a CSO Control Policy in 1994. The CSO Control Policy contained provisions for developing site-specific NPDES Permit requirements for all combined sewer systems. In order to comply with EPA’s CSO Control Policy, the Borough of Bridgeport (Borough) was required to prepare and submit a CSO Long-Term Control Plan (LTCP) to the Pennsylvania Department of Environmental Protection (DEP) for review and approval. Approval was granted on May 10, 2004. Four of the six overflow points will be converted to connections between to the new interceptor system. The size of the interceptor will allow it to convey greater flows to the River Road Pumping Station and the Borough’s wastewater treatment plant (WWTP). The interceptor system will convey flows to the River Road Pump Station. The system is sized (24 through 60 inches in diameter) to capture and deliver to the pump station 85% of total flows from the existing Borough drainage area and the anticipated flows from the waterfront properties. The funding of this Capital Project was secured by the Borough in several ways. Nearly $600,000 in Federal appropriations was secured, and through the efforts of Council, the Borough secured $2,000,000 from the State of PA. The Borough completed the funding by borrowing $2.3 million. The project will be complete and operational the first quarter of 2012.

East NORRITON FEMA TO UPDATE FLOOD PLAIN MAPS The Federal Emergency Management Agency (FEMA) has provided preliminary copies of updated flood plain maps to the Township. FEMA has not updated the flood plain maps for most areas of East Norriton Township since 1976. The preliminary version of the updated maps have been produced with more detailed information and with better computer modeling than was available in 1976. The revised maps will more accurately reflect the actual 100-year flood plain.

Portable / outdoor fireplaces must also be used in accordance with the manufacturer’s instructions. The Fire Code Official may order the extinguishment of a fire in a portable / outdoor fireplace if it creates or adds to a hazardous or objectionable situation.

According to the Pennsylvania Department of Environmental Protection, radon exposure is the second leading cause of lung cancer and the United States Environmental Protection Agency has established a radon level of 4 picocuries per liter as an action level that warrants radon mitigation. Radon reduction systems are commonly installed to reduce indoor levels of radon gas when testing shows that the gas is present at or above the action level established by the United States Environmental Protection Agency.

A new adaptive traffic control system was recently installed on Dekalb Pike (Route 202) in Upper Merion Township and it is already improving traffic flow while easing congestion on this busy artery. The traffic control system, which is called InSync, has been installed at 10 intersections from Gulph Road to the Dannehower Bridge. InSync, adapts to real time traffic conditions by using sophisticated digital video cameras and computers at each intersection. The system makes decisions every second about how to best serve the traffic at and approaching each intersection. This means less stop-and-go traffic and more green lights as vehicles move up and down Dekalb Pike.

UPPER MERION (Cont.) Since completing the project, traffic management officials at the Township have noticed improved traffic movement, but a formal traffic engineering study will be completed in the spring of 2012. Based on the initial success of the InSync system, Upper Merion plans to install this technology at other intersections as funds become available or as signals are upgraded because of land development.

LOWER PROVIDENCE Lower Providence Township started 2012 focused on continuing the business development momentum that was gained last year. In 2011, 40 new businesses opened their doors in Lower Providence. In addition, major employers PJM Interconnection and Quest Diagnostics signed long-term leases in the Park Pointe at Lower Providence business park – retaining over 1200 jobs. Some 440 jobs were created as result of this influx of new businesses. They included Horizon Services, Reilly Foam Corporation, Star Career Academy, Safe-Guard Technologies and Chickie’s and Pete’s. Main Line Health will soon join them, opening an office in the business park. The Township welcomed newly-elected Supervisors Jason Sorgini and Jill Zimmerman to its Board of Supervisors. Ms. Zimmerman has been appointed to the Township’s Business Development Committee. The committee is continuing work to implement the business park master plan and carry through with its Township-wide branding/marketing initiative. The Womens Resource Council hosted a luncheon at Green Valley Country Club on December 9th. Dr. Kristin Legnola, Community Chiropractic Center, provided tips on dealing with stress—a very timely topic during the holiday season! Ladies of the Chamber enjoyed a fabulous lunch and learned a lot from Dr. Legnola’s presentation. The next Womens Resource Council luncheon is scheduled for Thursday, April 5th at Pepper’s in King of Prussia.

Sonic Carhops were on roller skates and ready to serve at the Grand Opening of Sonic Drive In in Cedars Shopping Centers’ Swede Square in East Norriton. During the Ribbon Cutting Ceremony, Owner Don Welsh handed the gold-plated scissors to the shift supervisor for the honor of opening the restaurant.

Members of the Montgomery County Chamber of Commerce Board of Governors, Ambassadors Club and Staff attended the grand opening of Sonic on January 19th, along with dignitaries, community groups and the family and friends of the Sonic owners.

Cornerstone Records Management hosted an Open House and Ribbon Cutting November 18th to celebrate the opening of their facility on Industry Lane in West Norriton. Plant tours of the refurbished facility highlighted the latest document destruction equipment in the area. The event offered refreshments from Chamber member Crocodile Catering. Executives and sales staff were on hand to explore solutions for records and information management challenges. Advancing the Needs of the Community The US 422 Corridor was hot in the news during 2011, thanks in large part to a proposal to toll US 422. The proposal drew significant attention from the media, from the politicians, and from the business community, and from residents. No one expected the opposition to be so motivated and vocal, but no one had proposed a measure such as this before either. The proposal languished for many reasons, but central to them all was that there were opposing views on how to fund infrastructure improvements for the corridor, and what funding the projects could mean for future growth and prosperity. The overwhelming majority of people on the corridor are in agreement one thing, something needs to be done to address traffic congestion. Whether you sit, bumper to bumper driving to your office, driving to a client meeting, or making a delivery, the traffic congestion on US 422 is costing you money. The solutions to the problem are varied, but all are expensive. The major pinch point on the corridor, the river crossing at Valley Forge is nearly a $150 million project. When complete, there will more lanes crossing the river, but none leading up to the crossing; that could cost another $150 million. Those projects assume everyone wants to drive alone, but what about the people that would like to take a train instead of drive? That cost will be over $360 million, and only provides limited service. And these two projects only deal with traffic on the east end of the corridor. Reconstructing US 422 from Berks County to Sanatoga is another $300 million plus project. If you weren't counting, that is over $1 billion in projects, just on US 422 alone; we are only one of many corri-

dors and regions in Pennsylvania and the United States searching for funding to build our projects. Considering that the entire annual state budget for transportation projects is $2.3 billion, it is fair to say, we can't get it all; or can we?

The proposal to toll US 422 was an answer to the needs of the corridor. The available funding at the state and federal levels are not such that the corridor will be able to see all these projects come to fruition, we may be lucky to see two of them (the river crossing at Valley Forge and the US 422 construction in Pottstown). It was because of this reality that the tolling concept was explored. Moving forward from this point is going to take a collaborative effort from the business community, working with government to develop, design, fund, and construct the needed improvements. The key involvement will be in setting priorities. What MUST we have, what can we wait to have, and what can we live without? These are challenging questions; each decision may carry consequences that are realized decades in the future.

Fortunately there exists a group that is advocating for change and improvement to the corridor's infrastructure. The US 422 Corridor Coalition is a group of local government officials, county and regional planners, PennDOT, SEPTA, and the business community. We meet periodically throughout the year to discuss, learn, and advocate for projects. The coalition was pivotal in developing the US 422 Master Plan, has been a long time advocate for restoring train

YPSN is for seasoned professionals, as well as those just starting out. The success of the coalition has been the diversity of participants with the solidarity of a single voice. With 2012 underway, and many of the major projects slated to begin construction later this year, the coalition will play a crucial role in planning the next stage of growth for the corridor. Our long term outlook will look grim if we don't collaborate to advocate. I encourage you to get involved and to learn more about how we are working to improve the prosperity of the US 422 Corridor.

Things to consider regarding the conversion of eligible retirement accounts such as traditional IRA’S, rollover IRA’s, SEP-IRA’s, Simple IRA’s, SAR-SEP IRA’s, 401(k) and 457(b). • Beginning in 2010, virtually all taxpayers can convert those retirement accounts to a ROTH IRA without any concerns about previous income limitations. • The converted amount is fully taxable, but in 2010 the amount may be included equally over 2 years, 50% in 2011 and 50% in 2012. • You may be able to make partial conversions. • The converted amount must be maintained in the ROTH account for 5 years or until age 59 ½ is attained whichever occurs later, before distributions can be made. • Any distribution from a ROTH IRA is TOTALLY NON-TAXABLE. • ROTH funds are not subject to RMD, required minimum distributions.

• If after the conversion it is found not to be beneficial, the conversion can be re-characterized until April 15, 2011 or October 15, 2011 if the 2010 return is under extension. • The ROTH funds may be passed income tax-free, not inheritance tax, to heirs. • It would be best to transfer the converted amount directly from trustee to trustee. • The tax due would be best to be paid from assets other than the converted amount to take full advantage of the conversion. • If you are concerned that income tax rates will increase and/or are at the lowest levels currently, this may influence your decision. • Please consult with a qualified independent financial professional for both tax and financial considerations. In the last issue of Montgomery County Chamber Magazine issue, I wrote about how tenants can and should take advantage of the depressed commercial real estate market. Don’t worry landlords, this time I am here for you. Recently, I have had discussions with some building owners that bought fully-leased buildings a few years ago and they are now dealing with their first recession and as a result, their first vacancies. Vacancy is

The best way to fill up your buildings is to keep them full, and the best way to handle vacancies is not to be caught off guard. This means physically checking up on your current tenants, walking their space and observing your surroundings. Calls and mail can be forwarded and emails can be read from anywhere. As an owner, you and/or your broker need to see the spaces and tenants regularly to know what is happening with their busi-

ness. Have they had layoffs? Are their many empty desks or offices in their space? Have they been uncharacteristically late with rent checks? How does the morale seem in the office? Has communication with your tenants been open, regular and honest? The moral of story, if you’re going to have any vacancy, you want to get in front of it immediately. In a good market, space can sit vacant for 6 to 18 months. In a bad or slow market, it can sit for 12 to 24 months from the last tenant leaving. Let’s fast forward. You have vacancies, what do you do?

should include contact lists, email lists, mailing lists, a sign company, printer and a group of effective websites of where to list your property. Your broker will also be in charge of handling inquiries, phone calls, qualifying leads, giving tours, drafting proposals and structuring a strong market deal. Next is the architect. They will be in charge of drafting floor plans and drawings. This is an important step because a creative architect will help the potential tenants imagine themselves in the space and those plans will also be used and submitted for the tenants to get a certificate of occupancy. Third, the real estate attorney will draft a lease, review the tenant’s lease comments and help compose mutually beneficial documents. The accountant will review a potential tenant’s financials and let you know how financially viable (profitable or not profitable) a company actually is. The bank, especially in a tough market, can play a critical role. In many office leasing deals, the cost for build outs and commissions are fronted by the landlord and then amortized over the life of the lease. Having a good relationship with a lending institution that understands the capital that will be needed can make a strong partner. Nothing is more aggravating than getting a deal, having the owner submit proposals and promises only to find out they cannot get the deal funded. It can be a deal and reputation killer for landlords. Finally, having a commercial construction/project manager that can deliver build outs on time and within a budget is priceless. Real estate leases start and end on predetermined dates. Hitting those dates and keeping tenants happy can be invaluable to getting your building filled.

First, gather all the information that you have on your property to anticipate any and all questions that may come up about your building, the space and the area in general. Items you should have readily on hand include: location maps, site plans, floor plans, tax maps and local amenity information. Second, get your team in place to move quickly to win any potential deals that may come to the building. Your team should include your real estate broker, a sign company, printer, architect, attorney, accountant, banker and construction project manager. I will explain their roles briefly below. Third, decide on the amount of time, money and effort you want to spend if you decide to do this in-house. Some owners attempt to do one or all of these steps themselves and often lose valuable time, resources and potential tenants learning how to market their building correctly and competitively. Asking the wrong questions will get you the wrong answers

The question starts innocently enough: “how do I….?” As we talk, it turns out they are already invested in an online tool, and is trying to figure out why it isn’t producing results. Trying out the latest website or tool may seem harmless, but you’re on the path to one of the biggest mistakes you can make in marketing – focusing on tools and tactics before strategy.

I need to be on Facebook It’s not only questions. One of the most frequent statements I hear is: “We need to be on Facebook.” Without hesitation, I ask why. The answer is usually a variation of “everyone else is.” At the risk of sounding parental – just because everyone else is doing something doesn’t mean you should also. Maybe it is the right answer, but you need to answer some other questions first.

Don’t let tactics and tools drive your online marketing It’s easy to “go tactical” – just jump right in and do something. We love the forward motion. Tools are even more fun. Today’s online marketing tools are easy to use and virtually, if not literally, free. For some reason, online marketing tools have this ability to turn off our sense of reason – we don’t even consider our why we are using them. Too often we just jump in and “just do it” (thank you for that pearl, Nike). If you hand someone a hammer, they don’t run off and whack the first thing they see. But give them a social media site, and they’re posting updates like there’s no tomorrow. The reason most people wield a hammer is to get something done. Whether it’s building something or pulling a nail, spoken or unspoken, there’s a goal in mind. Your online marketing needs to have rationale too.

It’s the “who” that really matters Audience. Audience. Audience. And one more time – AUDIENCE. That’s who you are trying to reach. If you don’t know your audience, tactics are immaterial. If you do nothing else, figure out who you want to “talk” to, and the message you are trying to convey. Then you might be ready to think about where you are going build that connection and deliver your message.

Tools come last Tools and tactics are only important in the context of audience and message. Selecting your tools is one of the last things you do in the planning process. You have to assess if it can reach your audience and deliver your message. Advertising on a website that doesn’t serve your audience demographic is a waste of time and money. Once you’ve chosen the right tool for the job, you are ready to consider how you can make it work – you’re ready to ask me “how do I….?”

The most important part of your company (next to your employees), is your company data. Your company data includes your customer information, orders, inventory, documents, etc. What would the cost to your company be if you lost this data? From a personal perspective, how would you feel if you lost your family pictures? As soon as you finish reading this article, perform a data backup. Goal The goal behind a data backup is to get your data in more than one location. Once your data is in more than one location, take your backup offsite (If you are backing up your company data, take your backup home. If you are backing up your home computer, take your backup to work – or keep a copy in a safe deposit box). Recovering data from a failed computer hard drive can be very expensive. Data recovery services can cost anywhere from a few hundred dollars to a few THOUSAND dollars. PC’s are not the only computers that can have a hard drive failure. Mac’s have hard drives that can fail too! How do you do this? How do you accomplish a data backup? • Copy it to another location • Burn it to a disk • Run backup software • Pay for an automated service that does it for you Where should you backup to? There are two main categories of backup – local and online (“the cloud”). There are several options for local backups. Local backups can be made to a flash drive, external hard drive, another pc, server, tape, network storage device or optical drive (CD or DVD). Each option has its own pros and cons. Some options are more costly (flash drive), more expensive and complicated to setup (server), slow but cheap (optical drive) and more susceptible to failure (external hard drive). The number of options for online backups is steadily increasing. A few examples include Carbonite, Norton online backup, iCloud and our own online backup solution. • Pros: If you have a fire, your data is safe; most are automatic – there is no user intervention after it is setup. • Cons: Can be expensive if you have a lot of data. Where is your data - really? Is it safe? What is a “cloud” and why would I want my sensitive information in a “cloud”? Restoring/backing up large amounts of data can take hours, even days. Frequency People ask, “How often should I backup?” I ask, “How much data would you be willing to lose (in the event of a failure)?” A day? A week? How much would it cost you to recover/re-enter that much data? Some data may not be re-creatable (like family photos). Test This step may be as important as doing the actual backup. Periodically, test your backups. Test a restore. Make sure that restored files are readable. If an IT professional handles your backups, challenge them to restore a file from a backup. Just make sure that they restore the file to an alternate location - not the location where your existing file resides. Summary Finally, until hard drive manufacturers create drives that never fail or until all of our data is stored “in the cloud”, it is crucial – rather vital – that you backup your data. If you’re over 40 and you haven’t had a mammogram, get your first one now. If it’s been more than a year, it’s time to call. Current guidelines from the American College of Radiology (ACR) and Society of Breast Imaging (SBI) recommend screening mammography every year for women, beginning at age 40. According to a recent report, getting a mammogram every year reduces the risk of dying from breast cancer by 30 to 60 percent.

In addition to mammography, ultrasound and MRI are used to evaluate suspicious densities or calcifications in the breast.

Contrast enhanced Breast MRI is not a replacement for mammography but rather a supplemental tool for detecting and staging breast cancer and other breast abnormalities. It may also be beneficial for screening patients at particularly high risk for breast cancer due to genetic predisposition or strong family history, and planning treatment for breast cancer. Breast MRI plays an important role in following treatment for breast cancer. PET/CT is another imaging study which is used for patients that have been diagnosed with breast cancer. The most effective use of PET/CT for breast imaging is to evaluate for cancer elsewhere in the body following a diagnosis of breast cancer and to determine if therapy for breast cancer is effective. I have lived in six different Southern states and all of them claim corn as a favorite ingredient. Although there are many different varieties of corn, all are good in chowder.

Melt the butter in a Dutch oven over low heat. Saute the onion and celery for 3 to 5 minutes.

Add the potatoes, chicken stock and nutmeg. Cover and simmer until the potatoes are tender.

Combine the flour and the milk in a small bowl; whisk until smooth. Add to the potatoes and stir until thickened.

Stir in the corn, heat through and serve.

Pork and peas is a favorite combination in Hawaii, as is the unique blend of seasonings in this almost complete meal. Just cook some rice and your meal is done.

Expectations are powerful. From birth we are subject to them. We are expected to roll over, crawl, walk, babble, talk and eat with utensils on a somewhat rigid schedule. If we are not on schedule, parents, doctors and specialists intervene to see what is going wrong. As we get older we are expected to act in a certain way by our parents, our friends, teachers and coaches. Some parents expect their kids to be doctors; some expect them to be craftsmen or politicians. If we decide to do other than what is expected of us, then usually there is stress involved as we try to break free from the expectation. Unfortunately this trend continues into adulthood. We absorb expectations unconsciously from the world around us. Consequently we have a certain belief about what is possible and that belief is based on our everyday experience of the world. We bring this process to our job as salesperson. We have a certain belief about how much we can earn and how much can be sold in a given year. We tell ourselves that these beliefs are reality based on the actual data. For proof we say things like: “The average salesperson in this industry makes $95,000. I think I am a little better than average so I am doing well at $105,000.” When I suggest to a salesperson who has that mindset that they should be able to earn $200,000, they explain how I don’t understand the industry, or reality or what the obstacles are that prevent that from being possible. If I point out that someone in another company is doing it, they politely explain that her situation is different because of some factor real or imagined. No one becomes a champion by accident. In every World Series or Super Bowl winning locker room the winners say “We set this as a goal at the beginning of the year. No one else believed in us, but we believed on ourselves and in each other.” You never hear the winners say “We don’t know how we got here. We never actually thought we would get this far. We would have been happy to win half of our games.” So take a lesson from that. If you are failing, expect to succeed. If you are succeeding expect to excel. And if you excel, expect to dominate. If you dominate you already do what I suggest in this article. Napoleon Hill said it best 65 years ago “Whatever the mind can conceive and believe it can achieve.” The trick is to set your expectation high and then believe that it is possible. Once you do that you have been trained since birth to achieve that expectation. A tenant's right to Assign or Sublet a Commercial Lease

by Barbara Anisko, Esquire Over the past several years as businesses struggle to ride out the tough economic times, they have had no choice but to downsize. Tied to commercial leases for more office or retail space than they need, an assignment of the lease or the subletting of the extra space seems like an attractive way of saving on expenses. In making the decision whether to assign or sublet, the tenant should first carefully examine its lease to determine whether the lease contains any provisions prohibiting or restricting assignment or subleasing. Commercial leases, like any other contracts, are governed by their terms. Therefore, whether a tenant has the right to assign a lease to another party or to sublet the leased premises to another tenant depends on the language of the tenant’s lease with the landlord. If the lease does not contain language prohibiting or restricting the assignment or transfer of a tenant’s interest, a tenant is free to assign or transfer all or part of its interest. A tenant is not required to obtain prior consent of the landlord, unless the lease contains language requiring the tenant to obtain prior consent of the landlord.

In making the decision whether to assign or sublet, the tenant should also understand the legal differences between the two concepts. An assignment of a lease is the transfer by the tenant of all of the tenant’s rights and interest in the lease. In an assignment, although the assignee tenant effectively steps into the shoes of the assigning tenant, the assigning tenant continues to remain liable to the landlord on the lease. With an assignment, if the assignee breaches, the landlord has the right to enforce the terms of the lease against the assigning tenant or the assignee tenant.

We Use Water-Fed Poles …They are Safe and Environmentally Friendly When working above the first-story level our cleaners often use water-fed poles, a “system” using purified water in conjunction with a brush tool. The system is a safe, effective way to clean windows without using a ladder, which can be impractical and/or too dangerous for hard-to-reach windows. The “water-fed” pole uses regular tap water that is hooked to our mobile de-ionized water filtration unit. The de-ionizer is used to reduce calcium, salt and other particles found in regular tap water from about 400 particles per million (ppm) to about 1 ppm—creating essentially “pure” water. NOTE: The typical bottled water that you buy in the store, contains about 225 ppm and is perfectly safe to drink, but if you were to see this water evaporate on a piece of glass, you would notice that it leaves some “residue.” De-ionized water will not leave residue—No Spots! …Cleaning with a Water-Fed Pole Is Thorough Water from the de-ionized unit is pumped through the brush tool and squirted on the window while the cleaner uses the brush to agitate any dirt or debris on the window. According to the EPA, over 3 million tons of e-waste was generated in 2008 and only 13.6% was recycled. The other 86% ended up in landfills. E-Waste accounts for 70 percent of the overall toxic waste currently found in landfills. Examples of toxic wastes are lead, nickel, cadmium, and mercury. Televisions and CRT monitors can contain up to seven pounds of lead. Recycling your electronics will keep toxic wastes out of the landfills and the materials can be recycled. According to the EPA, recycling 1,000,000 laptops saves the energy equivalent to the electricity used by 3657 homes in a year.

Earth Day is right around the corner. Earth Day started back in 1970 and is celebrated every year on April 22. Earth Day is celebrated to educate and raise awareness about the earth and the issues that affect it. 4th Annual Fundraiser

Mission Kids is holding its 4th annual fund-raiser, Mission Possible, on April 19th at the Philadelphia Marriott West in Conshohocken. Hosted by Pat Ciarrocchi of CBS3 and co-chaired by DIna Fink and Pauline McDaniel, the event is a cocktail party with a Silent and Live Auction. Mission Kids is the Child Advocacy Center of Montgomery County. Although a nonprofit organization, all child abuse victims under the age of 18 are interviewed at Mission Kids for their forensic interview. Mission Kids provides a multidisciplinary center for the team investigation of child abuse, following standards established by the National Children's Alliance and the federal Department of Justice. Mission Kids centralizes the necessary support services, easing the criminal justice process for child victims and their families. In this child-friendly setting, trained forensic interviewers conduct one interview, which is observed by a multi-disciplinary team, greatly reducing the number of times a child victim must tell his story. Since opening its doors in September of 2009, over 800 children have been interviewed at Mission Kids. Mission Kids was founded by Montgomery County District Attorney Risa Vetri Ferman and the late W. Norriton Chief of Police John McGowan.
