Chamber headquarters: members always
welcome
The Chamber’s predominant form of communication is email. Members should be receiving The Chamber’s epost on Thursday afternoon as well as regular announcements and invitations. If you are not please send your email address to info@montgomerycountychamber.org and be sure to include your name and business affiliation.
but need an appointment
Members of the Chamber are always welcome at The Chamber’s headquarters, the historic King Of Prussia Inn but many ask why is an appointment required? The reason is insurance. The historic 310 year old building has low head clearances and some uneven flooring and for those reasons guests must be escorted in the building much as you would in a private museum. Monday through Friday, 8:30 to 4:30 and can make arrangements by calling (610) 265-1776.
Chamber reservation
policy: Reservations for Chamber events are generally required two to three days before the actual event. They are required to allow for adequate food service, seating and scheduling. Payment is required at the time of registration and can be refunded up to The Chamber’s reservation deadline. ‘Walk-in’ attendance can not always be accommodated, especially when the catering is very specific. You can always reserve at www. montgomerycountychamber. org and members may reserve by calling (610) 2651776 or (610) 277-9500.

TRANSPORTATION
Infrastructure:
To Fund or Not To Fund? by Shayne Trimbell, GVF Earlier this summer a $2.5 billion transportation funding bill advanced through the Pennsylvania Senate, only to stall in the House of Representatives. The bill was based on the recommendations of the Transportation Funding Advisory Commission Report, released in 2011 by the Transportation Funding Advisory Commission. The report was commissioned by Governor Tom Corbett to find a method of funding transportation infrastructure across the commonwealth. The failed to pass the house, largely due to disagreement on total funding amounts, and the methods to collect the funding. The implications of inadequate funding are beginning to take effect. In Mid-July Transportation Secretary Barry Schoch announced that 1,200 bridges statewide would have new weight restrictions imposed, a stop gap measure for extending the life of a structurally deficient bridge; there are 43 such bridges in Montgomery County. SEPTA was forced to close the viaduct that carries the Norristown High Speed Line from the Norristown Transportation Center into Bridgeport. The viaduct, which is over 100 years old, required emergency repairs. At the local level, the Arcola Road Bridge over the Perkiomen Creek has a 3-ton weight limit imposed and emergency replacement is being scheduled. Engineers fear that if nothing is done soon, the bridge will become unsafe for all traffic. The outlook for the future is not too bright if this issue is not addressed. The Delaware Valley Regional Planning Commission released Connections 2040, the regional long range plan and the guiding document for infrastructure improvement in July; the plan extends to the year 2040. Their estimate is that there will be a $63 billion deficit in infrastructure need. It is projected that 55% of all roadway lane miles will have deficient pavement and 20% of all bridges will be structurally deficient. The projections were based on cur-

rent funding amounts, adjusted for inflation. Whether it be moving goods across states on the Interstate Highway or railroads, delivering goods to their retail store, or allowing the region’s workforce to get to work safely day in and day out, infrastructure is vitally important to the success of our economy. Transportation infrastructure is a complex system, not easily separated by mode of travel. For example: each day SEPTA carries 1 million passengers on their buses, rail, subways, and trolleys. If service cuts result from inadequate funding, the affected passengers would be forced onto the region’s highway network. The additional traffic adds to the already congested roads, further stressing structurally deficient bridges, slowing deliveries, and making your commute just that
much longer. When this issue is addressed it will likely mean we all have to pay a little more in transportation costs. PennDOT estimates that the cost might be $2.50 per week for a typical driver, however they estimate that the cost per driver for doing nothing is equal to or more than the incremental cost associated with funding infrastructure. Whether or not action is taken to properly fund transportation infrastructure, every driver is going to pay more to get to their destination. The question to ask is: would you rather invest in an improvement, or spend while it gets worse? Shayne Trimbell works as a Manager of Projects and Development with GVF. To reach Shayne by email: strimbell@ gvftma.com, or by phone: (610)354-8899.

Municipal MINUTES All municipalities in the Chamber’s service area are welcome to provide information of interest to residents and businesses. We look forward to providing information about upcoming projects, plans, events and celebrations in all future issues!
East norriton township East Norriton Township has started to use Blackboard Connect, a phone call notification system, for the residents of East Norriton Township. This system has allowed the Township the ability to send out phone messages, e-mails and texts to all of its residents and businesses regarding both emergency situations in the Township as well as a tool to help us reach our residents about upcoming important special events, activities and meetings that our residents should be aware of. The Township is encouraging residents to set up and manage their own account with Blackboard Connect. By setting up your own account you will be able to add other phone numbers, (cell phone, business or alternate numbers) and set preferences as to how you would like to receive the different types of messages being sent out by the Township. Residents should go to the Township web site at www.eastnorritontwp.org and click on the Blackboard Connect portal, located under the Township Newsletter on the home page and set up your own personal account to manage the messages that are being sent to you. If you do not have Internet access, you should contact the Township at 610-275-2800 for assistance. East Norriton Township is also encouraging its residents to “GO GREEN” and sign up for the Township Newsletter via e-mail. Throughout Greater
Philadelphia International Airport (PHL), the only major airport serving the greater Philadelphia region, is embarking on a major capital program to enhance the Airport’s position as a global gateway. The Capacity Enhancement Program (CEP) is a multibillion-dollar series of projects designed to transform the Airport landscape and improve passenger experiences while bolstering the Airport’s role as a leader in the global air service market. The capital investments contained in the Extension Agreement include a 1,500foot extension of a runway to increase the total runway length to 12,000 feet. This extended runway would provide the capability to accommodate large aircraft that are capable of flying long-haul flights. Also included among the capital investments is a redesigned and enhanced Terminal B and C ticketing area -- utilized by US Airways, our hub carrier -- with a new automated baggage handling and screening system and a new passenger security screening checkpoint; replacement of the rental car facility surface lots with a new, multi-level consolidated rental car facility; an intial design for an automated peoplemover system between concourses; and new airside taxiway improvements to improve aircraft operations.
Expansion at PHL signals opportunity for businesses throughout the region, including Montgomery County Chamber members. In addition, PHL’s award-winning Disadvantaged Business Enterprise (DBE) program welcomes minority-owned and operated firms to participate in construction projects and other business opportunities at the Airport.

Many people know the Wacker Neuson name for their rammers, tampers and trench rollers, but few people in the construction business know a lot, if anything, about Wacker Neuson’s “Compact Equipment” line. This state of the art machinery was displayed for any curious customer during our Wacker Neuson roadshow event held back in June at our Plymouth Meeting location. The Montgomery County Public Works Association general members meeting held that morning helped to bring hundreds of attendees to the event. Norris Sales was thrilled to host this event not only to showcase these products but also to show Norris Sales’ continued dedication to bringing innovative products to our local markets.” said Karen Zajick, vice-president of Norris Sales. The Norris Sales’ Sicklerville, New Jersey show was nothing to ignore either. Ron ‘Jaws’ Jaworski made an appearance at the event to sign autographs, take pictures, and talk to customers. With a tremendous lunch provided by the Bridgeport Rib House and a variety of giveaways, both events turned out to be outstanding successes. Visit either our Plymouth Meeting or Sicklerville stores to browse and demo our new and innovative Wacker Neuson product line.

A New
Approach
to PENSIONS
by Josh Shapiro Chair, Montgomery County Board of Commissioners When trying to pare budgets and be more efficient economically, go where the money is.
sion board voted at the end of 2012 to move 90 percent of pension fund assets to a portfolio of low fee, passively managed index funds offered by Vanguard, a Pennsylvania-based, investor owned, non-profit with hundreds of employees in our county. This shift, which was completed by July 1, will reduce the fund’s management fee expenses by more than two-thirds, a savings of over $1 million annually. The switch also enables the county to eliminate one consulting firm and over a dozen asset managers, greatly simplifying and streamlining the system. The combination of lower management fees and lower personnel costs gives the passively managed funds at least a full percentage point advantage on alternative investments. From a pure performance perspective, the S&P index beat our fund’s annual performance in eight of the past 10 years. The combination of reduced costs and higher returns is the proverbial win-win for Montgomery County residents, employees and retirees.
That is why MontgomJosh Shapiro, Chair ery County, the Commonwealth’s third largest county, closely examined the costs associated with its $450 million public employee pension fund. Public pensions are an area of significant potential savings not unique to our county and an area of particular importance to state and local governments around the country. Pennsylvania is not immune to the problem, with a reported shortfall of $41 billion. Many other states’ liabilities are significantly higher. Unless there is another solution, these shortfalls will ultimately need to be filled by diverting funds from other programs, raising taxes, borrowing more money, or a combination of all Governments have an obligation to three. be stewards of the public money in While that solution is the subject of all respects. And recent results demonstrate that the funds are not getting returns that justify the higher management costs. The Pennsylvania State Employees’ Retirement System fund earned approximately 12 percent on its investments in 2012, compared to the S&P 500 that returned 16 percent. In 2012 alone, that pension fund would have been approximately $1.25 billion better off if it was solely invested in the S&P. Even if the actively managed funds were able to match the returns of the passive funds, the savings in fees to the pension fund would still be in the hundreds of millions of dollars.
but performance and savings trump clout in Montgomery County.
None of this is to say that there won’t be market ups and downs. Of course Bruce L. Castor, Commissioner there will. That is the nature of the market and, as we’ve recently seen, down times can be very painful. But over the long haul the overall market has an impressive record that almost no managers can beat - the S&P 500 (going back to the original S&P 90) has average annual returns of approximately 9.85% since its inception in Pennsylvania is not alone in experi- 1926), and at a fraction of the cost. encing disappointing returns in 2012. Want A Better JOB?
Smile!
Get a better
It’s an old saying. “You never get a second chance to make a first impression”. That’s likely true if you’re sitting across the table from a potential new boss. Your teeth might be saying things about you without you even realizing it. What do your teeth say about you if they are crooked?
A unique digital perception study, developed by Kelton Research contrasted images of men and women with straight and crooked teeth. The survey was taken by 1,047 nationally representative Americans. In the study, respondents were shown images of people with varying tooth issues and asked to get their honest opinion about them, unaware that they were comparing people with straight teeth to crooked teeth. Results of the study indicated Americans perceive people to have more desirable qualities than those with crooked teeth, including attributes such as being happy, surrounded by
loved ones, and professionally successful. Those thoughts also extend to perceptions regarding an individual’s potential for professional and financial success. When looking at images, Americans perceive those with straight teeth to be 45% more likely than those with crooked teeth to get a job when competing with someone who has a similar skill set and experience. They are also seen as 58% more likely to be successful, as well as 58% more likely to be wealthy. What do your teeth say about you if they are yellowed, stained or misshaped? Having obvious caffeine or nicotine stained teeth might tell a potential employer that you don’t prioritize taking care of your body or health. Youth and confidence are prized in the business world and a bright and attractive smile instantly conveys both. What do red, puffy gums and breath that is not fresh say about you? Healthy gums are an important part of your beautiful smile. Gingivitis is a very common form of gum disease that causes irritation, redness and swelling (inflammation) of your gums. The most common cause of gingivitis is poor oral hygiene.

How Your Dentist Can Help About Invisalign Adults and teens now have a modern choice for straightening their teeth. Invisalign is the clear alternative to metal braces that uses a series of virtually invisible aligners that gradually move teeth over time. The benefits include, no food restrictions, ability to easily maintain healthy dental brushing habits, minimal interference with sports or other activities and teeth get straightened without most people knowing you are in treatment.
Whitening. Teeth whitening is a simple and easy way to transform your smile and give you a sparkling new look. Done either in the dental office or at home, tooth whitening can give you a healthy, attractive, confident smile. Bonding. Resin bonding can instantly improve the appearance of teeth that are chipped, broken, cracked, stained or have spaces between them. Cosmetic Tooth Contouring. Similar to filing your nails, tooth contouring can be done to even edges of teeth, and smooth minor chips. Preventative Care: Good oral health habits, such as regular professional checkups and daily brushing and flossing, can help prevent gingivitis and improve gum health. What do your teeth say about you if you smile naturally and with confidence? When you smile and speak confidently, you project an image of self-assurance and likability.

SUPREME COURT Decides Who Is a
Supervisor
in Discrimination Cases
by Barry A. Furman, Esquire In Vance v. Ball State University, the Supreme Court clarified the definition of “supervisor” for purposes of vicarious liability under Title VII of the Civil Rights Act. The Court, in a 5-4 decision, ruled that a person must be able to hire and fire someone, or otherwise take some tangible action against the victim, to be considered a supervisor in discrimination lawsuits, making it harder to blame a business for a coworker’s racism or sexism. Under Title VII, an employer is liable for the actions of a harassment victim’s co-worker only when the plaintiff can prove that the employer was negligent in responding to the victim’s complaints. Different rules apply, however, when the co-worker is the victim’s supervisor. When a supervisor is involved, employers can be held liable for more than the employer’s own negligence. They can be held vicariously liable for the supervisor’s discriminatory or harassing behavior. Maetta Vance, who was a catering specialist at Ball State University, accused a co-worker, Shaundra Davis, of racial harassment and retaliation. Vance sued the university under Title VII, the Civil Rights Act of 1964, alleging that the university was liable because Davis was her supervisor. The District Court dismissed her lawsuit, holding that since Davis could not fire Vance, she was only a coworker, and since the university had taken corrective action, it was not liable. The Seventh Circuit affirmed the District Court and Vance took her case to the Supreme Court. While some courts followed a narrow interpretation of supervisor for Title VII purposes, requiring traditional management duties of hiring, firing, promoting, or otherwise impacting the employee in a meaningful manner, other courts followed a broader definition of supervisor as advocated by Vance and the Equal Employment Opportunity Commission (“EEOC”). EEOC Enforcement guidelines define a supervisor as an employee exercising sufficient authority to assist the
employee in harassing the victim. The Supreme Court affirmed the Seventh Circuit, rejecting the more lenient definition of the EEOC and adopting the restrictive definition of supervisor. The Court explained that defining “supervisor” as only capable of taking tangible action against the victim is a clear, workable standard compared to the nebulous standard advocated by the EEOC. As Justice Ginsburg wrote in her dissent, the Court’s decision strikes from the supervisory category employees who harass by controlling the day-to-day schedules and assignments of others. Nor any drop to drink. by Pamela M. Tobin Depending on the township, however, if you plan to install a new addition, you will usually have to obtain township approval of a storm water management plan at least with respect to the new addition.
Samuel Coleridge’s famous passage could easily describe summer time in Montgomery County. With the onslaught of summer storms, we regularly face creek flooding, wet basements, spongy lawns. Summer flooding is a good time to take stock on what you can do to better manage the storm water run-off on your property. Developers, of course, must obtain municipal approval of a storm water management plan for their properties before they can put shovel to ground. Owners of buildings dating before storm water management ordinances do not have an affirmative obligation to retrofit their properties to comply with these ordinances.

What if storm water discharges from a neighboring property onto your property, causing erosion and/ or flooding damage to your property? Do you have any recourse? The answer is: “It depends.” Under the common law, all property owners have a right to allow the storm water which naturally occurs on their property to naturally flow onto adjoining property. The common law, however, also recognizes certain critical exceptions to this general proposition. If an owner changed the grade of his property and thereby altered the natural flow of storm water, the owner is responsible for managing his storm water to prevent damage to an adjoining property. Owners are also prohibited from allowing storm water to pool on their property and then point discharging the collected water onto a neighboring property.

Picture, for instance, two adjacent properties separated by a berm. For years, the berm prevents the storm water from the higher property from cascading onto the lower property. Later, the berm begins to leak, causing erosion and flooding damage to the adjoining property. The owner of the damaged property has a potential claim against the adjoining owner for storm water trespass. Owners should therefore be vigilant to detect storm water problems to hopefully effectuate an early remedy. Owners can implement strategies from Pennsylvania’s best practices for storm water management such as installing vegetated swales and reducing or disconnecting impervious surfaces. My neighbor recently planted a “rain garden” which re-directs run-off into the ground, rather than discharging into the street and ultimately the township’s overburdened storm water system. “Water, water, every where” is less problematic if managed properly and illegal discharges are caught at the outset. You might think that having your company’s website partially optimized for mobile will help your business. You figure that even with a few glitches, or if a few pages aren’t mobile-ready, it’s better than nothing. At least it’s a step in the right direction, right? Wrong. As it turns out, a poorly developed mobile website could be hurting your business. Google recently announced the upcoming implementation of new search rules to optimize search results for mobile users. As part of Google’s efforts to provide a better experience for users accessing their search service from smartphones, websites causing a frustrating mobile experience run the risk of being bumped from showing up in search results. In their announcement of the new rules, Google highlighted several issues that they’ll be penalizing, one of which was faulty redirects. This problem occurs primarily on websites where the homepage and a few additional pages have been optimized for mobile, but the rest of the site has not. If, for example, a user clicks a link to a specific page on your site from an outside source, if that particular page isn’t mobile-optimized, the user might be redirected to the site’s homepage. Because users are forced to bypass the page they were actually trying to reach, these faulty redirects can be inconvenient and exasperating for users, as they’re prevented from finding the informa-

tion they want to access on your site. Google will also be cracking down on websites that display 404 error message to all users accessing the site from a smartphone. Even though a mobile version of these websites hasn’t been developed, the sites detect which users are accessing them from a smartphone, and instead of displaying the desktop version of the site show an error page instead. Whether you’re considering developing a new mobile version of your site, or you already have a partially optimized site, be sure to work with a design and development partner that will follow best practices. Ensure that your website will benefit your business by not only providing a seamless user-experience, but will boost its position in search rankings, rather than hurting it. (Submitted Copy)

If the company does not get many visitors it can make sense. Certain multi-tenant office buildings all offer common, on demand conference rooms that tenants can reserve. This eliminates the tenant to have to plan a conference room in their own usable suite when in reality it would go unused most of the time. Many firms are moving their phones and IT to the cloud. This eliminates or shrinks the need for IT room in the suite deisgn. A great, real-life, large, example is Glaxo Smith Kline’s move to the Navy Yard. They are moving 1,300 employees into 205,000 square feet. By changing to an open floor plan they GSK was able to drive the per employee average to 158 square feet per person. If using the old formula, GSK would traditionally take 260,000 square feet. This new plan saved them 55,000 square feet at $25 per square foot or $1,375,000 per year. GSK signed a 15 year lease for a total average savings of $20.5 Million. This savings can be leveraged and redeployed to hire more employees, invest in new equipment or fund future research.

niques. Some firms are eliminating private offices and moving to an open floor plan. These spaces can look like cube farms or even large rooms with unassigned, picnic bench style seating. Small “break out” rooms are usually added for needed privacy or small meetings. Offices suites are also shrinking or altogether losing the reception area when designing them.

BABY CARE 101:
Safe Sleep
Since newborns sleep about 16 hours a day, it’s important to know how to help protect them from Sudden Infant Death Syndrome (SIDS) and other sleep related dangers, like suffocation. SIDS is the sudden and unexpected death of an apparently healthy infant under one year of age that cannot be attributed to other causes. Most SIDS deaths occur when a baby is between two and four months old. Approximately ninety percent of all SIDS deaths occur before a baby is six months old. Suffocation often occurs when heavy bedding material, like blankets or crib bumpers, blocks fresh air flow to a baby’s mouth and nose. Some infants have suffocated by being wedged into the edges of the bed or couch. Sadly, many infants have been suffocated when a larger person rolls on top of them when sharing a bed.
the baby refuses it. Don’t hang a pacifier around a baby’s neck or attach it to their clothing. • There is no proof that any special products, such as wedges, reduce SIDS. There is no evidence that monitors help reduce the risk of SIDS in healthy babies. • Overheating infants is not safe, so keep the room at a comfortable temperature. Dress babies in light sleep clothes. Remove strings or ties from their clothes and keep their heads uncovered. A blanket sleeper will keep the baby safe. • Remove any hanging window cords and electrical wires where a baby can get tangled and choke. • Feed babies breast milk or formula for at least six months. No solid food is recommended until the infant is six months old. • Do not smoke, drink alcohol, or take drugs, unless prescribed by a doctor, during pregnancy. • Take babies to all their well-baby visits and make sure they get their vaccinations on time. • Give babies “tummy time” every day. “Tummy time” is when a baby is placed on his or her stomach on a firm surface for a brief period of time. This position helps the baby develop his or her neck, shoulder, and arm muscles. The Montgomery County “Cribs for Kids Program” is available for those who cannot afford a safe place for their baby to sleep. The Montgomery County Health Department (MCHD) receives referrals for this program from community agencies. This is a donation and grant based program, and “pack ‘n play” style cribs are distributed as they are available. To learn more about the “Cribs for Kids Program,” and information on other child safety programs offered by MCHD, please visit http://www.montcopa. org/health.
Here are some tips to keep babies safe and reduce the chances of SIDS or other sleep-related dangers: • During pregnancy, get early prenatal care checkups. • The best place for a baby to sleep is in his or her bassinet or crib, placed close to a parent’s bed at night. Share the bedroom with the baby, not the bed. • Always place the baby to sleep on his or her back until age 1 on a flat, firm surface, with a tight fitting crib mattress covered with a fitted sheet. Use the mattress specifically designed for the babies’ crib. • Don’t use cribs with drop-side rails, since they have been recalled. Don’t try and fix a crib that has broken or has missing parts. • Create a sleep safety zone by removing all soft, fluffy, or loose bedding, blankets, bumpers, wedges, and toys from the crib. Never place additional padding under an infant. • Don’t let a baby sleep in his or her carrier, swing, car seat, or stroller. Babies who sleep in these items can suffocate if the position of their necks blocks their air flow. If a baby falls asleep in one of these places, take him or her out and place them in a crib as soon as possible. • Give the baby a pacifier for naps and at bedtime. Pacifiers may help protect against SIDS. Don’t force the use of a pacifier if

THEArt OF GIFTING by Suzanne Wisnik Since the 1990s, we have seen many changes in the art of communication. We first experienced email, then texting, tweeting, etc. With each new technology, talking to friends, family, and business associates has become more and more impersonal. Unless you are of a certain age, picking up the phone to invite someone to dinner is considered old-fashioned. That same “Hurry up; I’m in a rush” and “Impersonal is okay” attitude affects other areas of our lives, too. One such area is the art of gifting. How many times have you dashed off a check or run out for a gift card at the last minute and stuffed it in an envelope? Did you ever consider that this says, “I really didn’t stop to think about what to get you?” Compare that with the best gifts you received as a child – and now receive as an adult. Do you remember the cash gifts; the gift cards? Probably not. You remember the tangible gifts. The presents you can see, feel, and enjoy. The treasured items that remind you of a particular occasion or of a special person. How do you move from the impersonal to the personal? From the trivial to the treasured? Here are my thoughts on the art of gifting: Extend the circle of gifting Family, friends, and significant others are the people we commonly purchase gifts for, but don’t forget: • People on the job: employees, vendors, maintenance folk, etc. Everyone needs a thumbs-up for a job well done! • People at home: babysitters, house cleaners, the postman, the landscapers, etc. Sure, you’re paying most of these people, but a special “thank you” goes far toward getting great service! Expand your thinking on when to gift Give gifts for … • Holidays: Any holiday can be a special gift-giving opportunity, from New Year’s Day to New Year’s Eve! For example, you could really break the winter blahs with a fun Groundhog Day gift! • Occasions: A gift can truly memorialize your best wishes at graduations, baby showers, weddings, and birthdays. • Appreciation: Grow your business by sending your clients a gift they will always

remember – not just in December, when they’ll be inundated with cards and goodies, but also at other points throughout the year. Determine the perfect gift It just takes a little time and a little talk to find out what people like and enjoy. Once you know someone’s tastes, think about what would really make an impact with them. Bear in mind: • Personally selecting something that is handmade and one-of-a-kind will deliver a “Wow!” factor every time, and will truly make a memory! • A gift doesn’t have to be expensive to be well-received; a great gift is one that has value and meaning to the recipient. • A perfect gift is one you love giving as much as the other person loves receiving! Remember: you give gifts to people because you like and appreciate them. So make your gifting personal! Suzanne Wisnik is the owner of Collectible Knits & Gifts (www.collectibleknits.com), your source for hand-made knitted items for personal fashion and unique gifting. Collectible Knits & Gifts’ customknitted hats, scarves, slippers, blankets, baby gifts, and gift baskets are a refreshing alternative to impersonal gift cards and mass-produced department store merchandise. We have all heard increasing stories of big companies being hacked. If large companies can't protect themselves how will small companies protect their computers and assets? It IS possible to create a secure network but it is important to understand a hacker’s goals and their modus operandi because they are not all the same. There are digital criminals who are intent on stealing your money and there are political “hacktivists” who hack to make a statement. They achieve it through vulnerabilities based on lack of computer training or proper maintenance on your equipment. Security can and must be a priority if you want to avoid becoming an FBI statistic.
