President’s Pen It’s a New Year for Membership, Education and Event Opportunities This past year was truly a reflection of growth and triumph for the Triangle Apartment Association. As President, I am excited about the wealth of opportunities TAA has to offer since relocating to the new space. The 2012 year will definitely provide the ability for you as members to actively engage in promoting and increasing membership participation. I would like to encourage and challenge each of you to assist in recruiting non-members to join TAA throughout the year. Keep in mind, there are various committees available for you to become involved in to showcase your passion, skills, and talents. The committees include: Education, IROC, Membership, Product & Services, Public Relations & Community Outreach, and Special Events—So let your zeal shine through! Please refer to TAA’s website for more details involving each committee. Additionally, the convenience and location of the new TAA office space is unsurpassed and offers members access to the resource library, business center, and conference room. As a member, feel free to drop by to enjoy the comforts of an open work space or feel free to stop by and check your email. The location can also accommodate space for your next corporate meeting or event.

We are thrilled about the upcoming educational and event opportunities that are slated to take place during the 1st and 2nd quarter of 2012. TAA Hosts Holiday Open House and Celebrates New Education Center & Offices

Everyone was in the holiday spirit on De-

cember 9th as more than 150 members and guests attended TAA’s Open House and celebration of its new office space and education center. Floating through from 12-5pm, members received a tour of the education center, the large and small conference rooms, resource library and business center, staff offices, and expansion space. A slideshow in the education center highlighted the journey from the acquisition through the construction. Slideshows in the reception area and large conference room showed photos of the many apartment communities that comprise the association, and 2011 in review, respectively. With appetizers and refreshments throughout members received treats all along the way, ending with a parting “Thank You” gift of a new TAA mug filled with holiday goodies. _A brief ceremony was held at 1pm where 2011 President Ken Sherman (Camden) spoke of the 2-year timeline, and the process of purchasing the space. He also took this opportunity to thank the 2011 Board, and the many partners that helped TAA reach this pinnacle in its history.

TAA Board Member Vicki Franciosi to join the TAA Staff Team T_ AA is pleased to announce that Vicki Franciosi joined the TAA staff team with the start of the New Year. Vicki’s scope of responsibilities will include: coordination and management of the association’s meetings and special events; serving as editor of the ApartMentor magazine, managing the website and social media outlets; and serving as facilities manager, overseeing the leasing of the association’s expansion space and rentals of the training center, large and small conference rooms. Vicki has been an active member of the TAA since 2006. She has served on the Special Events Committee for six years and served as the Co-Chair in 2010. She also Co-Chaired TAA’s Trade Show in 2008 and 2009. In January of 2011, Vicki was elected to the Triangle Apartment Association Board of Directors for 2011 and 2012. Vicki graduated from West Virginia University with a B.A. in Psychology and then went on to George Mason University where she earned her M.Ed. in Counseling and Development, Higher Education specialization. She began her professional career at Boston College where she worked as a Residence Hall Director for 3 years. Vicki then moved into property management where she worked at Oakwood Worldwide for 7 years. In 2004, Vicki moved to North Carolina and began working for Equity Residential where she remained for 6 years until they exited the North Carolina market. In February of 2010, Vicki went to work for TradeMark Residential. Vicki and her baby (dog, Cameron) reside in Cary. Vicki has long been an ambassador on the volunteer side for TAA. We welcome her to the association management side of the TAA team!

Get To Know Your Board Members OFFICERS

Latoya T. Patterson, CAPS, CAM, HCCP (President) is a regional property manager with Ginkgo Residential in Durham. She has been affiliated with property management for 13 years and holds a NC Real Estate Brokers License, the NAAEI Certified Apartment Portfolio Supervisor (CAPS), and Certified Apartment Manager (CAM) designations, and the Housing Credit Certified Professional (HCCP) designation. She is a proud graduate of North Carolina Central University and holds a Bachelors of Business Administration degree. Latoya is a member of the Public Relations and Outreach Committee, Finance Committee, and the Triumph Achievement Awards Judging and Criteria Task Force. Cliff Webster, Jr. (Vice President) is a regional property manager with Kettler Management, based out of McLean, VA, and has been affiliated with the apartment industry for 9 years. Cliff is a graduate of East Carolina University (ECU) where he earned his BSBA in Marketing and MBA in Management. He also served as a member of the ECU Board of Trustees. With TAA, Cliff has served as the TAA PAC (Political Action Committee) Chair, two years as co-chair of the Government Affairs Committee, the Finance Committee, and on the Office Options Task Force. Additionally Cliff represents TAA on the AANC PAC Board of Trustees. Bob Metzger, CAM (Treasurer) is a director of property management with Northwood Ravin (formerly Crosland) in Durham, and has worked in the apartment industry and been a member of TAA for nine years. Bob is a graduate of Bloomsburg University of Pennsylvania earning his BSBA in Management. He also has earned the NAAEI Certified Apartment Manager (CAM) designation. Bob has served on the Government Affairs Committee; and most recently the AptXchange Task Force and Nominating Committee.

Danny Young (Secretary) is a commercial accounts manager with Prosource Fitness Equipment in Raleigh. Danny has been with Prosource and an active member with TAA for five years. Danny has served on the Special Events Committee and just completed a two-year term as co-chair of the Products and Services Committee. Ken Sherman (Immediate Past President) is a district manager with Camden Properties in Raleigh. He has served in the apartment industry for 26 years and previously worked with Oakwood Worldwide as a regional manager. At TAA Ken has served on the Membership, Finance, Bylaws and Policies and Procedures, Office Options Task Force, and Nominating Committees. On the national level, Ken currently serves on the National Apartment Association Education Institute’s (NAAEI) Communications Committee.

She has been affiliated with property management and TAA for 24 years and holds a NC Real Estate Brokers License, the NAAEI Certified Apartment Portfolio Supervisor (CAPS), and Certified Apartment Manager (CAM) designations, Shanlyn has served on the Awards Banquet Task Force and served two years as a judge for the Leasing Consultant and Manager of the Year awards. Bunny Blake, CPM, CAPS, CAM, is regional director with PRG Real Estate in Raleigh. In the apartment industry for 13 years, Bunny is a Certified Property Manager (CPM) through IREM; has earned the Certified Apartment Portfolio Supervisor (CAPS), and Certified Apartment Manager (CAM) designations through NAAEI; and holds a NC Real Estate Brokers License. Courtney Duffy Coyle, is the property manager at Villas at Centerview in Raleigh, and has been affiliated with the apartment industry for 8 years and TAA for six. She served most recently as a TAA Director in 2009-2010; took a year off and is back for more! She also served a 2-year term as co-chair of the PR & Community Outreach Committee and team leader for four years of TAA’s Susan G. Komen Race for the Cure efforts. Elizabeth Godwin, CAS, is an account executive with AFR Furniture Rental in Raleigh. She has worked in the apartment industry and been active with TAA for eight years. Elizabeth has earned NAAEI’s Certified Apartment Supplier designation. She began her career onsite with Fairfield Residential, before moving to the vendor side with AFR Furniture Rental in 2007. Elizabeth has served on the PR Committee for five years and this will make her 3rd year serving as co-chair. In 2011, Elizabeth served on the Triangle Relocation Council on the Supplier Membership Committee. Sharon Hatfield is a director of real estate for Greystar in Durham. She has been affiliated with the apartment industry for 14 years and TAA for four years. Sharon actually began her career at a lease-up property in Durham in 1998 near Duke University and eventually rose to the level of regional property manager. With TAA, Sharon was active in the late 90’s and early 2000’s before relocating out of state. Prior to joining Greystar, Sharon was the Vice President of National Marketing and Communications with Archstone. She recently returned to the Triangle market and currently serves on the PR & Community Outreach Committee. Sharon holds the NC Real Estate License. She is involved with the Center for Creative Leadership and volunteers with Junior Achievement. Katie Kosnar is a regional vice president with Colonial Properties Trust in Raleigh. She started in the apartment industry 8 years ago as leasing specialist for a Cornerstone community in Savannah, GA. There she served as co-chair of the education committee and on the Board for the Savannah Apartment Association in 2007. Katie moved to Raleigh in 2009 and became active in the TAA in 2010.

Walter V. Morgan is a national account manager with HD Supply Facilities Maintenance in Morrisville, NC, and has been in the apartment industry and a member of TAA for seven years. Walt has served on the Special Events Committee for two years and participates annually in AANC Legislative Days. Amanda Nicklow Martinez (CAM) is a property manager with Fairfield Residential, and has been in the property management field for 14 years. Amanda has earned her NAAEI Certified Apartment Manager (CAM) designation, and is a Notary Public. She has been an active member of the association for the past ten years working on the Trade Show Task Force, Public Relations & Community Outreach Committee and the Education Committee, where she served for 3 years as co-chair. Amanda currently serves on the Membership Committee. Barbara O’Steen is vice president of operations for Kettler Management and has been affiliated with the apartment industry for 22 years and with TAA for 4 years. Barbara began her career in Richmond, VA working for Insignia and Archstone, then worked in the Northern Virginia market for eight years with Summit Properties, Trammell Crow Residential and the Van Metre Companies. She most recently worked with Greystar in the Carolinas. Barbara specializes in new construction and development and is leading Kettler’s expansion into the Carolinas. Kettler will open one Lease-up in 2012 and two more in 2013. Chad Price, CPM, CAS, is the general manager for Cary Reconstruction’s operations in North and South Carolina, and has been in the apartment industry for 10 years and a member of TAA for four. Chad is a Certified Property Manager (CPM) through IREM and holds a NC Real Estate Brokers License, and Sales License. He also earned the Certified Apartment Supplier (CAS) designation through NAAEI. With TAA, Chad has served on the Special Events and Government Affairs Committees. He also has served on many Board of Directors over the years including BOMA from 2008-09, IFMA and TAHMA in 2009, and NCPWA in 2010. Julie Spencer is a regional property manager with Greystar, and has been involved in the apartment industry for nearly sixteen years. She has served in a variety of roles including marketing, operations, land acquisitions and development. Prior to joining Greystar, Julie worked with HHHunt as their Business Development Analyst and devised strategies to grow the company’s apartment and senior living portfolios through ground up development in key markets from Baltimore to Savannah. Julie has worked on TAA’s Legislative, Public Relations and Membership Recruitment Committees over the years, and served as a Director from 2004-2006. Most recently, Julie served as moderator and presenter for the 2011 Economic Forum. She views her second term on the Board as “a way to give back to an industry and professional business community that has taught her so much over the years.”


Government Affairs LOCAL NEWS City of Raleigh Strategizes the Recovery of Rental Registration Fees ALERT: Councilor Thomas Crowder has been tasked by Former Mayor Charles Meeker to strategize lawful ways to recoup the more than $750,000.00 lost in the City coffers due to the enactment of Senate Bill 683. The TAA Government Affairs Committee asks that all Raleigh owner/operators vigilantly monitor any possible new developments and when a new program or fee is in the pipeline, please help us help you by attending City Council meetings, contacting councilors as well as notifying your residents of the consequences of new onerous programs and fees.

Duke Energy/Progress Energy: Merger Status and Other Apartment Industry Areas of Interest The proposed merger between Duke Energy and Progress Energy will undergo an overhaul to assure federal regulators that the two power companies won’t manipulate electricity prices in North Carolina. Both companies have vowed to act swiftly to make their merger agreement acceptable to the Federal Energy Regulatory Commission. Progress spokesman Mike Hughes said that executives are confident they can appease the concerns of the regulators. The commission gave the utilities until December to remedy numerous worries that their proposed merger raises about market power concentration and monopoly control. Charlotte-based Duke and Raleigh-based Progress had expected to finalize their merger this year and are hoping to limit costly delays that now are likely to put their $26 billion deal behind schedule. But changes will alter the economics of the merger, which recently went through three days of public hearings before the N.C. Utilities Commission. The state commission will probably have to review the deal again—and possibly hold another round of public hearings—once the federal 8

commission approves a definitive merger proposal to consider. State regulators are charged with determining if the merger’s benefits outweigh the costs and risks in North Carolina. “It may very well be that we’d have to reopen the proceedings that we have just concluded, or at the very least receive new information to make an appropriate decision,” said Edward Finley Jr., chairman of the state commission. “It’s a different context than it was before. There’s no question about it.”

September 30 Meeting Between AANC & Energy Leaders An AANC team consisting of Blue Ridge’s Mindy McCorkle, Drucker & Falk’s Lisa Price, AANC Legislative Counsel Colleen Kochanek, Ginkgo Residential’s Scott Wilkerson, AUM Executive Vice President and General Counsel Jeff Peterson, and AANC’s Executive Director Ken Szymanski met with leaders of Progress Energy, Duke Energy, and the NCUC Public Staff to discuss Apartment Association energy-related interests and concerns, including: • Benchmarking & Energy-Efficiency: obtaining Utility Consumption Data for Apartment Communities, Buildings, and Dwellings to Better Document to Consumers the Before-and-After Effects of Energy Efficiency Improvements. • Incentives & Energy-Efficiency: a number of PUC’s around the country encourage their utilities to incent apartment owners to make energy-efficiency improvements that will result in lowered energy consumption for apartment residents. While there are numerous approaches to pay for this, one common approach is a small surcharge on every customer’s (customers of all account types) monthly bill. • Proposed 17% Rate Hike: this is a matter of concern to not only apartment residents, but to apartment owners, as well. Apartment consumers can reasonably be expected to pay up to 30% of their income for housing and utilities. • Transitioning Accounts from Owner to Resident to Owner: how can apartment owners and utilities better streamline transitioning accounts and hold residents more accountable when they are slow to

establish their own utility accounts or when they disconnect their utility services early?

Report: More States, Cities Passing Measures Requiring Use of E-Verify According to the National Conference of State Legislatures (NCSL), legislation mandating the use of the free federal EVerify system has proliferated throughout the states. “We’ve been tracking these bills for the last six years or so, and the intensity is increasing, largely because of federal inaction,” said Ann Morse, NCSL’s program director for the Immigrant Policy Project. In 2011, 10 states have enacted some kind of E-Verify provisions (including California, where Gov. Jerry Brown signed a law prohibiting its use) and eight more already had E-Verify provisions in statute. Most of these laws require public sector employers, not private businesses, to use the system to check the immigration status of new hires. While the program was developed to be voluntary, states such as Utah, Washington and Alabama have passed laws requiring its use. Some of these mandates have punitive measures built in; Arizona’s law requires employers to use E-Verify or have their business license suspended or revoked (the

U.S. Supreme Court upheld the law in a May ruling). All the activity at the local level is frustrating employers, who face an increasingly complex patchwork of laws and regulations when it comes to checking a new hire’s legal status. Businesses operating across state and county lines may be subject to conflicting rules. Supporters of E-Verify view it as a more humane first step in addressing illegal immigration because it targets the employers and not the individuals seeking employment. NCSL expects this to be a very active area of debate in the 2012 state legislative sessions. Criminal Screening and Evictions for Criminal Activity—Not Required After All? By Will Brownlee, Brownlee Law Firm, PLLC

Yes, you read the title of this article correctly. And no, I didn’t believe it either. Frankly, I’m still not sure I believe it. More on that in a moment. It is fair to say that the rental industry rightly takes a hard line when it comes to crime and the attempts to reduce the chances of it happening in its rental homes, whether the home is an apartment, a single-family house, or any other type of rental in-between. It is fair to say that the rental industry rightly takes a hard line when it comes to crime and the attempts to reduce the chances of it happening in its rental homes, whether the home is an apartment, a single-family house, or any other type of rental in-between. In terms of screening, we want to know the character and propensities of the persons who are applying to live in the home; we want to know if they are capable of violent crimes; whether they are likely to engage in illegal drug use or the sales of such drugs; or whether or not they are a registered sex offender, among other things. We believe that by engaging in such screening, we do ourselves and our other residents a service, as we only want to accept those persons who have a relatively clean criminal record—in the hopes that this will reduce the chances of crime happening on our properties. If we fail to do any sort of criminal screening at all, we worry that some future victim may seek to sue us, claiming that we were negligent in our leasing practices. On the other side of the coin, many landlords reasonably believe that in the event criminals are found living in our rental properties, we should immediately evict those persons if possible. I suspect there are two reasons underlying a decision to evict. First, we want people to know that we take a zero tolerance policy for criminals living in our communities. Second, and perhaps more relevant to this discussion, we are worried that knowing a criminal is present could invite liability claims, particularly if that same criminal strikes again, making another resident their victim – and that victim may wish to blame us and seek to make us liable for being a negligent landlord. All of these things make perfect sense, of course. And all of these things may have been turned upside down, courtesy of the North Carolina Court of Appeals via the case of 14

THE DAVENPORT CASE

The alleged facts of the Davenport case read like something from a television show or movie. According to the Court’s recounting of events, the Plaintiff—Mr. Davenport—was a tenant at a mobile home community. Another tenant in the community, Mr. Herrin, in the community began an altercation with Davenport in the community when Herrin allegedly drove his car on top of the tire of a bicycle on which Davenport’s wife was sitting. Herrin later saw Davenport’s wife riding the bicycle and, after grabbing its rear wheel, attempted to wrestle the bicycle from Davenport’s wife. Davenport’s wife grabbed the front wheel and handlebars and attempted to pull the bicycle back. When Davenport’s wife let go of the bicycle, Herrin and the bicycle landed in a drainage ditch. When Mr. Davenport attempted to retrieve the bicycle, Herrin stomped on the bicycle’s wheel and shouted at Davenport, placed his hand on his utility knife, and threatened Davenport. In response, Davenport put his hands to Herrin’s neck and pushed Herrin back into the drainage ditch. When Herrin got out of the ditch, he punched Davenport in the jaw. Davenport then left Herrin, went inside his trailer, and called the police. Shortly thereafter, Davenport and his wife saw Herrin swinging a shovel at their pets and went outside to confront him. Davenport and his wife fought Herrin with a shovel and a rake for several minutes until Herrin discovered that he was bleeding. Herrin shouted, “I’m burning y’all!” He then retrieved a container of gasoline from his property, ran at Davenport with the gasoline and a lighter, and set Davenport on fire. Davenport sustained severe burns. Davenport then sued the mobile home park to recover for his injuries, claiming that

the landlord was negligent in several respects. Among those respects, Davenport alleged the landlord negligently leased property to Herrin (i.e., through a failure to do criminal screening), and negligently failed to evict Herrin.

A. Duties to Screen for Criminals?

Davenport argued that the landlord was “obligated to ensure a reasonable procedure for screening potential residents.” In reviewing Davenport’s claim, the Court took a surprising direction, leaning on a recent Massachusetts case (Anderson v. 124 Green St. LLC, decided Jan. 21, 2011) to find the opposite of Davenport’s allegation. The Davenport court actually cited the Massachusetts Anderson case verbatim: “A landlord cannot reasonably be expected to control the interpersonal relationships of tenants or to predict from a criminal record whether one friend poses a threat to another friend, both of whom live in the same apartment building. To impose liability [in such a case] would induce landlords to decline housing to those with a criminal record in the absence of evidence of an actual threat to cotenants or individual tenants. That would only export the “problem” somewhere else. The resulting unstable living conditions or homelessness may increase the chances of recidivism to the detriment of public safety....” Based on this logic, the Davenport court stated that the landlord could not be held liable for their allegedly negligent leasing of property to a tenant based on lack of criminal screening.

Land B. Duties to Evict Criminals?

Davenport essentially argued that by failing to evict Herrin for past criminal acts and violations of the lease, the landlord was negligent. The Davenport Court generally agreed that it is an “extension of a general landowner’s duty to protect those lawfully on his property from foreseeable third-party criminal acts, foresee-


ability of a future criminal act by the third-party tenant/assailant—as shown by evidence of relevant prior criminal acts by the third-party tenant on the premises.” The Court also found that courts in other states, such as New Jersey, Massachusetts, and Tennessee, had recognized situations where the foreseeability of a crime could impose a duty to evict someone. Surprisingly, the Court noted that prior interactions between Davenport and Herrin did not reveal any behavior that would have foreshadowed such a violent act. The Court also quoted the same Massachusetts court again, stating that a “ ‘landlord cannot reasonably be expected to control the interpersonal relationships of tenants’. . . We conclude that imposing liability on Defendants under these circumstances would place just such an unreasonable burden on landlords in North Carolina.” The Davenport Court went even further, stating that the Article 7 of Chapter 42—the Expedited Eviction of Criminals Act—only “provides landlords with the power to evict tenants engaged in certain criminal activity, but neither mandates eviction nor imposes liability on a landlord for failing to evict.” (emphasis added). The Court did not stop there, choosing to address the question of whether the landlord had a duty to evict Herrin because he was in breach of his lease. It stated that “[W]e conclude that [the landlord] cannot be held liable for Davenport’s injury based on their alleged failure to evict Herrin.” As the closing of the opinion, the Court dismissed all of Davenport’s negligence claims filed against the Landlord, finding that his claims had no merit.

WHAT THIS MEANS FOR YOU

The temptation in reading a new, surprising legal opinion like Davenport is to act suddenly and enjoy a newfound freedom, perhaps abandoning criminal screening and criminal evictions altogether. Whoa—not so fast. I am tempted to do so as well—and to be frank, Davenport appears to be a refreshingly pro-landlord decision—but there are certain aspects of Davenport that one must consider before making a policy change. As to the screening aspect, it is true that Davenport appears to leave little to the imagination and is perhaps the most surprising aspect of the case. Indeed, the Court left little doubt that North Carolina landlords are not required to perform criminal screening, and that they are not to be found liable for failing to do

so. That said, there are practical aspects to consider. Modern-day tenants likely expect, if even demand, the comfort of knowing that they, and their fellow neighbors, have been screened for their criminal background. Second, even though landlord may not be required to perform such screenings, I fear that future cases may challenge Davenport and seek to penalize landlords who choose to turn a blind eye to what could be an obvious threat. After all, maintaining an aggressive screening policy can only serve you well, and it may put you in a better position to rebut allegations that the landlord recklessly allowed a known violent offender to live in the community. As to the duty to evict aspect, the Davenport court’s decision was based, in part, on the fact that the lease used by the landlord did not contain a specific default provision. Specifically, the Court stated that “the portion of the agreement in the record does not provide for the consequences of ‘an event of default.’” In contrast, most commonly used leases (such as the AANC Lease or the NAA Lease, for example) have clear default provisions that specifically set forth the consequences of a default: eviction. This aspect could distinguish the Davenport case from a future one, in which a future victim of a crime could claim that a landlord using a competent lease had the power to evict the wrongdoer under the lease contract, whereas the Davenport landlord did not. That said, the Davenport court was very specific in stating that Article 7 (the Expedited Eviction of Criminals Act, N.C. Gen. Stat. § 42-59 et seq.) of Chapter 42 did not require the eviction of a resident for criminal activity, even though it granted the landlord the power to do so. It may well be that the Davenport court intended that position to be true of any time a landlord had the power to evict, whether through Article 7 or via a strong lease containing a specific default provision. It remains to be seen if the Davenport’s “power but not obligation” rationale will be applied to a more specific lease provision permitting eviction for criminal activity. At a minimum, however, landlords now at least possess—through Davenport—a goodfaith argument that the law does not require them to evict someone for criminal activity. Last, as I write this article, the Davenport case is less than thirty (30) days’ old, within the framework for a possible appeal to the N.C. Supreme Court. It may well be that the Davenport decision is appealed and that the higher court may reverse the Court of Appeals and find the

exact opposite is true – where screening and evictions may be required after all. Time will tell, of course, but until the Davenport decision is final, it may be best to avoid policy changes for the time being.

THE BOTTOM LINE

If there is one constant in life, it is—ironically—change. Davenport is a good example of this, where the Court of Appeals challenged long-held assumptions in the rental industry and legal world regarding screening and evictions. The key to dealing with change is to be aware of it, be open to it, and thus it will be easier to adapt and flourish in the new world that the change has wrought. In participating in your local apartment association, reading this publication and other industry resources, being active in government affairs, and seeking to improve yourself through education, it is my hope that you will be better prepared for changes like Davenport and those that await us all in 2012. Independent Rental Owner Seminar Available Online in February 2012 The NAA Education Institute (NAAEI) will hold online education seminars for its Independent Rental Owner Professional (IROP) Certificate Series beginning Feb. 2. This Webinar series will run every Thursday in February from 2 p.m. to 5 p.m. ET. The series is based on the IROP course, which addresses: alternative income opportunities, resident move-ins and move-outs, lease terminations, key control, resident and neighbor relations, physical versus economic occupancy, emergency planning and more. Cost is $349 for members or $499 for non-members for the four-week program. Pricing for individual modules is available. Affordable Housing Program Seminar Available Online in February 2012 The NAA Education Institute (NAAEI) will hold online education seminars for its Specialist in Housing Credit Management (SHCM) Certification in February. The Webinar content is based on the National Affordable Housing Management Association’s (NAHMA) “Practical Guide to Tax Credit Housing Management” workbook. The course is ideal for affordable housing management professionals and helps them to master the complex requirements of the LIHTC program. The program begins 3 p.m. ET on Feb. 6, 2012, and runs every Monday in February at that time with instructor Anita Moseman. Education TAA has offered over 22 education seminars/ courses, which included Emergency Disaster Preparedness, Fair Housing Compliance in 2011, Power Leasing, World Class Customer Service, Maximum Marketing: The Ultimate Focus to Increase Occupancy, HVAC 101 Basics, R-410A, Fundamentals of Plumbing, (2) Legal Issues seminars and the NAAEI/IREM Fair Housing & Beyond seminar. TAA moved into its new facility just in time to house the October and November Legal Issues seminars. The association had 101 attendees in attendance between both seminars. TAA’s new “State of the Art” Education Center seats 85 classroom style. TAA had 58 students participant in earning their NAAEI designations: Certified Apartment Portfolio Supervisor (CAPS), Certified Apartment Manager (CAM), National Apartment Leasing Professional (NALP), and Certificate For Apartment Maintenance Technician Program (CAMT). The association will still continue to offer traditional, non-traditional and need-it-now educational opportunities for the apartment industry professionals. The Triangle Apartment Association’s Education Committee has been busy this year as well. They kicked off the year with the sale of TAA’s 2011 and 2012 Maintenance Personnel Calendar and the “Battle of the Baskets” fundraiser with proceeds to benefit the Education Scholarship Fund. The committee raised over $528 and sold over 60 Maintenance Personnel calendars; and raised $741 from the “Battle of the Baskets” silent auction totaling $1,269. With funds from the Scholarship fund, the association was able to underwrite the cost of 4 candidates to take NAAEI designation courses. They hosted 1 Managers Breakfast Roundtable with over 20 managers in attendance; and 1 Maintenance Breakfast Roundtable with over 23 maintenance supervisors/technicians in attendance; and for the first time a Leasing Breakfast Roundtable with 20 leasing professionals in attendance. The committee continues to up date TAA’s Resource Library with relevant materials free of charge to TAA members. As we move into 2012 the Education Committee looks forward to working with Triangle Apartment Association Education Foundation (TAAEF).

Networking TAA’s Special Events Committee began 2011 offering a series of TAA AfterWork Networking events for members the 3rd Tuesday of the month. Initially offered in 2010, Special Events again provided this as a low cost, no cost way for members to network in a casual setting at the end of their day. The first event was held in March at Wild Wings Café in the Brier Creek area in


Raleigh with over 45 members in attendance. That was followed up by moving out to Top of the Hill Restaurant in Chapel Hill in April; and Champps Americana at Southpoint in Durham in May. Members networked with colleagues while enjoying complimentary drinks and appetizers. TAA’s annual Trade Show held in April in the Expo Center at the NC State Fairgrounds was the largest attended in the association’s history with over 1200 enjoying “TAA’s Wide World of Sports”. TAA vendor members were able to display their products and services to the Triangle’s multifamily housing decision makers and site personnel and network with their current and prospective clients. Back for a 2nd year was the hugely popular “TAA’s Got Talent.” With 7 acts and 175 spectators – it was an exciting night of showcasing the diversity of our members’ hidden talents. The Longbranch Saloon was the backdrop for the evening and members were treated to singers, soloists and bands. It definitely was a night to remember. The Fall Golf Classic held at Hedingham Golf Club in Raleigh provided another opportunity for members to get together. With sold out sponsorship opportunities and 124 golfers – it was a great way to network between owner/operators and vendor partners. Special Events finished out the year by hosting the 4th annual Maintenance Mania event with its high octane energy for TAA’s maintenance personnel competing for bragging rights and to label themselves TAA Maintenance Titans. Held at Heaven and Earth Landscaping for the 2nd year, the competition was all a buzz with spectators cheering on their favorites to victory. 2011 was a busy year for Special Events with a diversity of networking venues. The Committee looks forward to surpassing expectations in 2012!

Communications TAA finally got on the social media bandwagon and launched its presence on FaceBook, Twitter and started a Blog. This new way (for us) of communicating with members has proven to be a wise investment for the association as our members “like” us on FaceBook, and “follow” us on Twitter; thereby allowing us to update them almost instantaneously on the affairs of the association. Whether that’s Government Affairs Alerts when we need help contacting legislators or just posting photos from events as they are happening. We look forward to continuing to engage our members with these forms of communication. The website, www.triangleaptassn.org remained the 24/7 information resource for the membership. The ApartMentor, the association’s bi-monthly magazine, continues to serve as one of the main vehicles to disseminate information to the members about trends in the apartment industry, upcoming events and continuing education. Each issue features the President’s

Pen, a spotlight on vendors, education and event offerings, and legal and government affairs information. E-News & Legislative Updates are emails distributed monthly to TAA members to keep them abreast of TAA news and legislative issues affecting the apartment industry.

Community Outreach • Komen: 2011 marked the 5th year for TAA’s PR Committee to lead the association’s participation in the Susan G. Komen Race for the Cure in Raleigh. More than 100 Team TAA members walked for the cause and collectively raised over $7,500, which will be used to help fight breast cancer in the Triangle. • Mission Possible: TAA asked its members to accept the mission and they did. Over the 2011 holiday season members collected new items for children for TAA’s Tots Tubs of Love campaign. More than 1000 items were donated to the Raleigh and Durham Rescue Missions, and Orange County Social Services to help the homeless and needy in the Triangle community.

Career Fairs / Renting 101 Another part of the Public Relations and Community Outreach Committee’s mission is to educate students about careers in property management and renting that first apartment. Participating in Career Fairs and the “Real World” met those goals. • Career Fairs: Committee members attended two Career Fairs in 2011. One at NC State in the spring and at North Carolina Central University (NCCU), in the fall. Over 100 resumes were collected and made available to TAA members. • Triangle United Way “Real World” Experience: For the 2nd year, members of the PR Committee participated in the Triangle United Way’s Real World experience, a one-day simulation of the real world designed to teach independent living skills to foster care youth, ages 16-18. TAA volunteers staffed the 3 housing provider booths with information on the costs

Products & Services Council The focus for the TAA Associate Members is to support the property Owners and Management Companies with services to help maintain the standard of excellence in the Triangle multi-housing market. The Products & Services Committee’s task is to create networking opportunities with the TAA Associate Members and the Regionals and Owners in the Apartment Industry. The TAA Trade Show was held on April 27, 2011 and hosted 132 Exhibitors and over 1,000 attendees. The PSC encourage first time exhibitors to participate in the Trade Show by assigning a “buddy” to help them learn the ins and outs of a successful trade show booth. They also received one set of O/O mailing labels and $10 credit toward a future TAA event or seminar in 2011. We had 19 first time exhibitors participate! The PSC also offered a TAA Annual Trade Show “Free” Exhibitor Workshop where exhibitors were given tips and techniques on how to attract customers, sell their products, and make the most of their time at the Trade. The Products & Services Committee once again sponsored the “All in the Family” Contest. Communities were challenged to do business with TAA Members and to refer non-members for potential TAA membership. The top two Owner/Operators doing the most business with TAA Vendors starting January 1, 2011 through June 30, 2011 won $500 in TAA cash bucks. TAA Bucks can be use toward the registration of any Educational Opportunity or Networking Event hosted by TAA. They may also be redeemed toward ApartMentor or website advertising On October 27, 2011 the 4th Annual 5 Star Dinner was held at the Brier Creek Country Club. The evening served as a “networking” social opportunity to get to know the Regionals and Owners; and as such, there were no sales presentations or pitches during the evening. Each Regional received a notebook at the end of the evening especially designed for them by the sponsoring Associate Sponsors.
