Council requires that applicants lodge a security deposit or bond in relation to certain conditions of various approvals. Bonds are generally in the order of $5,000 and applicants have the option of lodging a bank guaranteeinlieuofacashdeposit.
Section97oftheLocalGovernmentAct1993requiresthatinterestmustbepaidonsecuritydepositsrepaidto depositors.
Given that interest is not payable on bank guarantees lodged and in view of the significant amount of work required in administering these deposits and the insignificant amounts of interest involved, the payment of interest at the optimum rate earned by Council is not appropriate, nor is the payment of small amounts of interest.Further,itisconsideredthataflatadministrationchargeshouldalsobeapplicableincasesofinterest payments.
Afeeof$35willapplytotheinteresttobepaidonallbondsrefundedbyCouncil.Whereinterestearnedona bond is not enough to meet the fee, it will be accepted in full satisfaction of the fee. Any amount of interest above$35willberefundedwiththebond.Tocontributetothemanagementofthebonds.
