In accordance with Section 608 of the Local Government Act, 1993 and other relevant legislation, Council charges and recovers approved fees and charges for any services it provides as contained within the document entitled 'Mosman Council Pricing Policy - 2013/2014'. The fees and charges are generally intended to be imposed on the following services provided by Council under the Local Government Act or any other Act or regulations: • • • • •
Supply of a product, service or commodity Giving of information Providing a service in connection with the exercise of the Council's regulatory functions, including receiving an application for approval, granting an approval, making an inspection and issuing a certificate Allowing admission to any building or enclosure Allowing use or benefit from Council's assets, possessions, etc
Mosman Council's general policy in determining the amount of fees to be charged for goods and services considers the following factors: • • • • • • • • •
The cost of providing the service The importance of the service to the community Prices fixed by the relevant industry body/ies Any factors specified in the Local Government regulations Equity factors User pays principle Financial objectives Impact of Tax Reform (GST)* Market Prices
In cases where the amount of fees and charges for service is determined under another Act or regulatory bodies, Council's policy is not to determine an amount that is inconsistent with the amount determined under the other Act or regulatory bodies. All of Council's fees and charges not subject to statutory control are reviewed on an annual basis prior to finalisation of Council's annual operating budget. However, in special circumstances, fees and charges can be reviewed and approved by Council in accordance with the Local Government Act and Regulations. * The GST on all Council’s fees and charges is currently being reviewed by an external contractor and any adjustments will be made in order to conform to ATO legislation.

SECURITY DEPOSITS - Administrative Charge/Interest Payment Council requires that applicants lodge a security deposit or bond in relation to certain conditions of various approvals. Bonds are generally in the order of $500 and applicants have the option of lodging a bank guarantee in lieu of a cash deposit. Section 97 of the Local Government Act, 1993 requires that interest must be paid on security deposits repaid to depositors. Given that interest is not payable on bank guarantees lodged and in view of the significant amount of work required in administering these deposits and the insignificant amounts of interest involved, the payment of interest at the optimum rate earned by Council is not appropriate, nor is the payment of small amounts of interest. Further, it is considered that a flat administration charge should also be applicable in cases of interest payments. The interest rate payable for 2013/2014 is 0.45%, subject to no interest being paid when the amount would be less than $35, together with a flat charge of $35 on interest payments, subject to no deduction being made from the deposit principal. No interest payable where a full or partial deduction has been made for restoration costs. i.e. 2013/2014 - Interest paid at 0.45% per annum, subject to no interest being paid when the amount would be less than $70.
