Personal injury lawsuits filed over car accidents, slip and fall injury, workplace injury and so on depend a lot on objective and accurate medical records review .This makes medical record review for attorneys a valuable service, with many law firms making use of the same. The evaluation of damages in a personal injury case involves understanding what the injuries have cost the plaintiff – mentally, physically, and monetarily.Whether the defendant’s conduct deserves punishment is also an important consideration. The money damages are paid to the plaintiff by the defendant who is found legally responsible for the accident and subsequent injury. Sustaining an Injury While on Another Person’s Property One instance when a personal injury claim may be filed is when one person sustains an injury while on another person’s property.Consider a scenario in which someone (A) gets hurt when he/she is on another person’s (B’s) property.B’s home insurance should in most cases cover the cost of the medical expenses and claim for damages, if a case (third-party claim) is filed in court. This includes medical bills, wages lost due to hospital stay or staying at home unable to work, suffering, pain and so on.Coverage will, however, be within the limits of the amount B signed up for. Most of the injuries are categorized under “negligence,”which is used to signify the homeowner’s inability to maintain a safe environment for the plaintiff to be in. The injured person will have to prove that the homeowner did not have safe conditions in that area. This makes it very important to ensure everything is under control and all precautions are in place to prevent such injuries. How the Insurance Company Evaluates Damages The insurance company follows a certain formula to evaluate damages and determine compensation. When claim negotiations begin, the insurance adjuster would add up the total medical expenses related to the injury to decide on the “medical special damages” or “specials”. It is on the basis of this that the insurance adjuster figures out how much to pay the injured person for pain, suffering and other non-monetary losses or “general damages.” For relatively minor injuries, the adjuster multiplies the amount of special damages by 1.5 or 2. For serious, painful, and long-lasting injuries the amount of special damages is multiplied by up to 5. In extreme cases, the multiplier may even be 10. There are some instances when negligence claims cannot be contradicted such as when a person sustains a dog bite on another person’s property in a state where dog bites are strict liability. The injured person can file a third-party insurance claim against the property owner,

and the insurance company is expected to compensate for damages without having to disprove negligence. A home insurance policy will not provide coverage if the homeowner intentionally assaults and injures someone on their property without sufficient reason .Neither will it cover injuries to the homeowners themselves and other family members if they are injured on the property.Individual insurance policies describe what types of claims are covered. The coverage may vary by policy type, state, and insurer.
