Making sense of cohabitee disputes

More than six million couples in the UK cohabit, according to the Office for National Statistics – more than double the number 20 years ago.
However, contrary to popular belief, a common-law spouse or partner carries no legal status in English law. This means the distribution of
cohabitees’ assets can end in lengthy and costly disputes. So, if your that would allow married couples to claim against one another.
he law relating to the separation of cohabitants is extremely complicated and during the exciting period when you are purchasing your property together, understandably, you would not normally consider your relationship breaking down. However, it’s important to understand that the laws governing cohabitees are completely different to those which provide protection to married couples or couples in a civil partnership. It’s crucial to get the financial side sorted before you cohabit with a partner. If you’re considering buying a property with your partner and you are not married or in a civil partnership, it’s important to discuss and agree from the outset how you wish to own the property. Cohabitation agreements set out who owns what from the beginning, including savings, property and personal belongings. They can also set out how much someone has contributed to the mortgage deposit and repayments. Dealing with cohabitation cases when an agreement has not been drawn up can be extremely costly and complicated. The court fees and legal fees to deal with such a complex area of law can quickly reduce any equity that you should receive from the property should a dispute arise which results in a court application. The most common agreement that couples come to is that the property will be jointly owned. In this case, you cannot sell the property without your partner’s consent and vice versa. You and your partner can negotiate to buy out the other’s interest in the property. This will likely involve raising a lump sum, often through a re-mortgage or other means, and transferring the property from joint names into the name of the party buying out the interest. However, in the instance that the property is held in the name of your partner, it is also possible to apply to the court for a declaration of the extent of your beneficial interest in the property. You can ask the court for an order to force the sale of the property or alternatively, to order a lump sum be paid to you on the basis of the division decided by the court.

In this case, you would need to prove that you have financially contributed to the purchase of the property, or significantly increased its value, for example by paying the deposit, contributing to the mortgage, substantial renovations and other outgoings on the property. We know that people do not enter buying a home with their partner lightly and with the expectation of the relationship ending. However, it's always sensible to take legal advice before you buy and take legal advice if you split. By seeking the advice of a professional in either circumstance, you can ensure that both parties’ best interests are adhered to and avoid the need for a potentially stressful and damaging negotiation process.

A list such as this wouldn't be worth its sea salt without mentioning that one of the UK’s most celebrated stretches of coastline can be found right here in the Liverpool City Region. Formby beach, bordered by dramatic sand dunes and lush pinewoods, makes the perfect spot for a family day out come rain or shine. And the dunes offer more than just an impressive backdrop, they’re in fact home to a trio of protected wildlife species – if you’re lucky you might spot a natterjack toad, sand lizard or great crested newt nestled amongst the pools and beach grass. For some more ancient animal hunting, head down to the beach during low tide and see if you can find one of the amazing prehistoric mammal footprints preserved in the sediment beds.

Good news for ‘Do It Yourself’ builders Q: My husband and I are considering building our own dream home. We have recently purchased a plot of land with planning permission and will hope to start to build soon. It seems very unfair that the materials we need to build our house, some of which are expensive imported tiles from the continent, have 20% UK VAT charged on them. If we employed a building firm to do the work, they tell us that they would not need to charge us the VAT. Is there anything we can do? A: Good news! A special VAT scheme puts DIY builders and converters in a broadly similar position to a commercial developer selling a new domestic property, by refunding them the VAT on their main construction or conversion costs. NEWS Volunteers team up with housing group for Wavertree street clean Volunteers were prepared to get their hands dirty
A quiet residential street in Wavertree became a hive of activity recently as volunteers joined forces to freshen up the local area. The volunteer team was made up of members from the Your Housing Group community regeneration team, local businesses including Bell Group Painters & Decorators, Liverpool City Council officers and Councillor Clare McIntyre. They gathered at the entrance to Heygreen Park, Your Housing Group’s new development on Edington Street, with a focus on giving the surrounding streets a once over. Armed with brushes, shovels and bin liners, the team kicked into action and within two hours the skip, provided by the council, was bursting at the seams awaiting removal. Heygreen Park is a new development of 48 properties, made up of one-bedroom apartments and two and three-bedroom houses. It’s available for private rent and built with couples and young families in mind. The first phase of two and three-bedroom properties is now available for early bird reservations, with the show home scheduled to open in early August. Dingle ‘rent to buy’ homes snapped up after launch
All 14 ‘rent to buy’ homes at a new development in Dingle have been reserved within hours of their launch. Harrington Row, which is being marketed by Redwing Living, is a collection of three-bedroom properties on Park Street, L8. The homes have been made available through ‘rent to buy’ – a concept which allows you to rent a home at a reduced cost, using the money left over to save for a deposit to buy. t’s been a busy year for Stewart Milne Homes as it reports continued growth and turnover after 2018’s record figures. Over the next five years the company has plans to grow the business from its current level of 350 units per year – delivering more than 2,500 homes in the region. In the last financial year it has constructed over 300 new homes and introduced five new developments to its portfolio, including its impressive Callenders Green site in Prescot, Knowsley. Callenders Green is a collection of 68 family homes, with a mixture of two to four-bedroom units. It is located on a brownfield site which was once home to the British Insulated Callenders Cable (BICC) factory - one of the largest employers in the area, providing jobs for more than 14,000 local people. Paul Challinor says: “Callenders Green has been a special site for us to launch, not just in terms of sales rate and demand from customers, but for the direct impact it will have on the regeneration of the local area. “The fact that it was a brownfield site was an instant attraction for us, as we have a proven track record of investing and transforming land into thriving communities. “It was important that our masterplan at Callenders Green supported the key objectives of Knowsley Borough Council.”

Paul adds: “Our ethos as a housebuilder is perfectly aligned with Knowsley’s Place Strategy, which believes that the ‘right place offer can underpin growth and encourage economically-independent people and families to move to Knowsley’. “By encouraging the creation of thriving communities across the region, we hope to be able to contribute to the placemaking strategy for the region, which makes Knowsley a sought-after place to live, work and invest. “As a housebuilder, we will contribute to providing the homes required to support this growth. “Callenders Green is Stewart Milne’s first development in Knowsley and we are currently progressing planning for a second development in Whiston, creating an additional 200 new homes in the area which will directly support the borough council’s aims of creating more than 8,000 new family homes by 2028.” And so far the development is proving to be a hit with residents, with 75% of the homes at Callenders Green already sold. As part of its contribution to placemaking, Stewart Milne will also create direct employment opportunities locally, employing more than 30 workers from the surrounding area with local trade contracts exceeding the value of £2 million. Aside from contributing quality residential developments, Stewart Milne Homes is keen to give back to local communities surrounding the houses it builds. Paul says: “The company prides itself on being more than just a housebuilder. “Our mission is to make a lasting, positive impact on the communities where we work. To do so we work with local community groups, voluntary organisations, schools and businesses,
identifying where we can provide support and resources to make a difference. “Over the last 12 months we’ve provided £12,000 worth of funding to help more than 300 people across the region – our biggest level of funding to date.” In Prescot, where Callenders Green sits, the housebuilder has committed to a two-year sponsorship deal with one of the North West’s oldest football clubs, Prescot Cables FC. The housebuilder has also supported schools across the region, including Woodchurch High School in Wirral, by upgrading six paddocks on the farm to protect up to 30 animals from foot problems during the winter months. More than 500 books were also given to Millfield Primary School and in North Wales, Stewart Milne paid for more than 100 reusable water bottles to be given to pupils, supporting the school’s environmental strategy.
It is actions like this which saw the developer win last year’s ‘Community Award’ at the NWPAs. Reflecting on the win, Paul says: “Receiving the ‘Community Award’ at the NWPAs in 2018 recognises the efforts of our team which works hard to ensure we make a lasting positive impact on the local communities around the sites we develop. Since winning the award we have received enquiries from several community groups, who we are now working closely with. “The North West is a key growth area for us as a business. Big screen moment for Woolton landmark Beaconsfield Road-based Beatles landmark, Strawberry Field is currently having a big screen moment in the much talked about movie ‘Yesterday’. The Salvation Army, which owns and is currently transforming the Woolton site beyond its famous red gates, welcomed director Danny Boyle and the crew to film during the demolition and reconstruction phase of its project. Due to open later this year, the revived Strawberry Field, which was treasured by John Lennon, will feature a training hub for young people with learning disabilities as well as the development of a haven for spiritual exploration and reflection. A new exhibition on the place, the Fab Four’s famous song ‘Strawberry Fields Forever’ and John Lennon’s early life around Strawberry Field will also open at the site. A spokesperson for The Salvation Army says: “It was a firm ‘yes’ from The Salvation Army when we were approached by the ‘Yesterday’ production team. It was a great privilege to welcome Danny and let them experience the special place where John climbed trees and dreamed his dreams. “We had some great conversations with Danny and explained our vision to create a training hub for young adults with learning disabilities and to open the gates for generations of Beatles fans across the globe for the very first time. Danny wished us well with the plans and was keen to get into the t-shirt we presented him with to thank him for the opportunity to be involved.” ‘Yesterday’, which is currently in cinemas, also features a mural by Woolton-born street artist Paul Curtis – the man behind the Abbey Road artwork and the popular ‘For All Liverpool’s Liver Birds’ wings in the Baltic Triangle.

Artworks by influential etchers James McNeill Whistler and Joseph Pennell are going on display at Sudley House this month. The exhibition at the Mossley Hill Road-based museum is expected to be the last time the prints will be displayed collectively for the next 10 years, due to their light-sensitive and fragile condition. Entitled ‘Whistler and Pennell: Etching the City’, the collection of more than 30 prints captures the changing landscape of New York and London in the final years of the industrial revolution. Open from 5 July 2019 until March 2020, the South Liverpool showcase follows the exhibition’s successful stint at Wirral’s Lady Lever Art Gallery, where it was seen by more than 65,000 visitors. Alex Patterson, curator of the exhibition, says: “The prints in this exhibition are bursting with detail, showing the bustle and energy of two major cities experiencing extraordinary growth and change. It is fascinating to study the work of two great artists who admired the working life of the metropolis and shared a passion and a belief for the medium of etching. “It will also be interesting to consider the exhibition in the context of the Holt family, who prospered as ship owners during the industrial revolution and were avid art collectors, in their family home, Sudley House, full of fantastic artworks and great views over Liverpool.” YM Liverpool 25

As ‘Catch-22’ screens on Channel 4, the rising Liverpool-born star tells us about his love of Bond movies, downing vodka Fanta Lemon and getting a pushbike from George Clooney.

Which part of Liverpool are you from? I was born in Halewood and attended Plantation Primary School. From there I went to Halewood College, but six months into my A Levels I left to play a rapist called Frasier Kane in ‘Shameless’. When did you decide you wanted to become an actor and how did you get into it? I studied drama at school and one day I started making my classmates and teacher laugh. I got a kick out of it. My teacher sent me to an open audition to play one of the scout boys in Dogberry’s brigade in a production of ‘Much Ado About Nothing’ at the Playhouse. It was there I fell for acting and became completely in love with it. I only had a small part but watching grown up actors like Simon Merrells and Stephen Billington bring a script to life every night fascinated me. My chaperone Jenny gave me the name of Sherril Parsons who runs YULA Drama School, which became my staple for a while. She also acted as a small casting agency which got me my first feature film, ‘The Be All and End All’. Nina Gold, a casting director, saw that and put me in ‘Nowhere Boy’ (2009 drama depicting John Lennon's teenage years). That got me my London agents who I’ve been with ever since. Where there any particular actors you looked up to? There’s far too many to name. From a Liverpudlian perspective I’d love to have half the success that Paul McGann or David Morrissey have had. I admire them both so much. But I have respect for any actor, whether they are a leading man or lady or a day player. The profession is near enough impossible and anybody who has the drive to stick with it and try and succeed I have to take my hat off to. What were your favourite films growing up? Growing up I’d love watching the old ‘James Bond’ films with my nan and granddad. My dad used to let me stay up late and watch action films as well like ‘Die Hard’. When I was in my late teens I used to watch films like ‘Whale Rider’ and ‘Fish Tank’ and think I was being clever. Now I’ve gone back to my roots and I’ll just stick a Bond film on. You play a character called Dunbar in ‘Catch-22’. Can you tell us a li2le about your role and the show? Dunbar is the main character’s right hand man. He genuinely believes war is pointless and the whole thing is a joke. He’s constantly laughing and being lazy. He doesn’t believe in parades or any of the high command. The programme itself is honestly one of the best things I’ve ever been a part of. It stays faithful to the original source material yet [the writer] Luke Davies has breathed new life into it and has really fleshed out the characters. [Joseph Heller’s] book is a hard read, but this series makes [the story] much more understandable.

What was it like to work with a Hollywood icon like George Clooney? George is one of the nicest blokes I’ve ever met. Firstly he’s such an amazing director because he moves so quickly that you don’t have time to dwell on what you’re doing or about to do. He’s extremely trusting and leaves you to your instincts and if something doesn’t work, in the gentlest way he’d just have a quiet word. But he was also big on keeping the comrades together. He’d take us for dinner most weekends and he bought us pushbikes with our characters’ names on so we could get around the air base and ride around Sardinia during our downtime. You played Rob Dawson in ‘Benidorm’ for three series. What was it like being on the set? Was it as fun to film as the show looks? Benidorm was great fun - what a job! I was very lucky to be a part of the Dawson family. We really did become like a real family.
Steve Edge, who played my dad Billy, and I became such good mates. We used to have nights out with Bobby Knutt, who played my granddad Eddie. Knutty would cook us a curry or we’d have a cheese and wine night - he introduced me to James Cagney films. Actually being on set was great. Some days we’d just be in the back of shot so we’d literally get paid to lie on sunbeds. In our downtime we’d squeeze in as much karaoke and vodka Fanta Lemon as possible - a drink invented by my on-screen mum, the wonderful Julie Graham. Tony Maudsley (Kenneth Du Beke) was brilliant too. My mum and sister are big fans of the show and when I was cast they were so excited to meet Tony. On his day off he took my mum, my sister and me on a road trip which was so lovely of him. Will you be reprising your role as Raff in the new series of ‘Last Tango In Halifax’? I will indeed. We start filming at the beginning of September but I don’t think I can say any more than that. I’ve read the first two episodes and they’re absolutely fantastic. Sally Wainwright (writer) is just on another level. Her scripts are just genius, so I’m very excited to start and see all the gang. [Last Tango in Halifax] is another show I’ve been so privileged to be a part of. It feels like such a family and I love working with Nicola Walker, who plays my mum, and Derek Jacobi my grandad in the show. The amount of stuff I’ve learnt from the two of them I couldn’t buy at any overpriced drama school. What can you tell us about any other projects you’re working on? Off the back of ‘Catch-22’ I’ve signed with Gerard Butler’s American manager so I’m going to Los Angeles in August for a load of meetings with casting directors and producers. America was never on my radar and it’s hard enough trying to work consistently in the UK, but having done ‘Catch-22’ I think ‘why not?’ I’ve got nothing to lose! I’ve also got a feature film coming out some time in October called ‘A Good Woman Is Hard to Find’ with Sarah Bolger and Edward Hogg. It’s a low budget independent film but the script was fantastic and I loved working with the director, Abner Pastoll. YM Liverpool 27

AFRICA OYÉ BRINGS FUN-PACKED CELEBRATION There was fun for visitors of all ages
The 27th Africa Oyé festival took place in South Liverpool’s Sefton Park, bringing two-days of free music and entertainment. Festival-goers of all ages enjoyed a packed line-up celebrating African music and culture, with Jamaican legend Horace Andy among the headlining performers for 2019. Crowds picnicked and partied in the sunshine as they watched a host of local and global artists during the popular event, which also featured free workshops in the Oyé Active Zone and DJ sets at its Trenchtown and Freetown stages. This year the festival also coincided with Windrush Day, which celebrated the Caribbean community’s contributions to British society. Back in February 2018 YM Liverpool first reported that Bundobust was eyeing a space on Bold Street. The Indian street food and craft beer specialist had already built up foodie followings in Leeds and Manchester and so, after more than 15 months of waiting, anticipation here in Liverpool was high for its recent opening. My partner and I paid a visit to see if the new addition to our city’s food and drink offering lived up to expectations. Warmly welcomed with a vibrant colour scheme and the smell of incense, which made a cheerful change from the unseasonably drab weather outside, we snapped up one of the upper floor venue’s smaller tables. With an order-at-the-bar arrangement – an efficient approach in a venue so big - we got straight to work on studying the menu, which was ready and waiting alongside disposable cutlery and paper plates. The food is also served in throwaway pots at Bundobust, the reasoning for which appeared unexplained although I’d presume it’s to further push the ‘street food’ concept. The menu does boldly state, though, that it’s all plastic-free and fully compostable. Entirely without meat, Bundobust’s food offering is brimming with choices for diners seeking a vegan or gluten free feast, and there’s also a range of set ‘combo’ platters for those who are happy to have the difficult choice of which dishes to go for taken out of their hands. My dinner date and I were keen to handpick our meal from the small plate-esque selection which, on paper, sounded flavour-packed and ideal for a couple of spicy food fans like ourselves. I was advised during ordering that two to three picks per person works for a meal, depending on how hungry you are, and two-and-a-half plates is

actually the perfect serving so sharing works well. By this point though, we were so set on our carefully chosen three dishes each that we couldn’t possibly compromise one of them. I ordered the Bundo Chaat (£4.75) – layers of samosa pastry, chickpeas, potato, tamarind chutney, yoghurt, onion, turmeric noodles and chilli sauce; the Pav Bhaji (£6.50) – mashed cauliflower, potato and peas flavoured with garam masala and served with a spiced toasted brioche bun; and the Idli Sambhar (£5) – a lentil, aubergine and bottle gourd soup with steamed rice cakes and a mustard seed and curry leaf chutney. The Bundo Chaat was a refreshing mix of flavours and textures, with the tamarind and spices gently warming the cool dish. It was a great accompaniment to my other choices, which slowly built up some heat. The tasty, vegetable-filled Pav Bhaji’s brioche was beautifully soft; while the steamed rice cakes soaked up the soup of the Idli Sambhar to create hearty perfection. My partner, meanwhile, chose the Paneer and Mushroom Tikka (£6.50) – skewers of barbecued paneer, peppers and mushrooms marinated in yoghurt curd and tikka masala, and served with red pepper ketchup and spinach chutney; the Chole Saag (£6.50) – Bundobust’s version of a traditional chickpea and spinach masala which came with a portion of the deep fried Puri bread; and Gobi Mushroom Manchurian (£5.50) – mushroom and cauliflower pakoras in an Indo-Chinese sauce. The tikka dish’s red pepper ketchup and spinach chutney toppings were a particular hit, credited with bringing the plate to life. Meanwhile the Gobi Mushroom Manchurian was satisfying with its sticky sauce; and the Chole Saag, with its tried and tested combination of chickpeas and spinach, didn’t disappoint.

When it comes to drinks, Bundobust’s selection is broad. Wines, cocktails – both alcoholic and non-alcoholic – and Indian-style beverages like the House Chai and Mango Lassi provide a tipple to suit all tastes, but we felt inclined to check out the bar’s speciality – its beer selection. Craft creations by guest breweries from Liverpool and beyond were on offer, varying from sours and stouts to pilsner and IPA. Playing it safe on a work night, the strengths went some way to dictate our choices. Steering well clear of the 12% Marshmallow Pyscho, I went for Northern Monk’s 4.1% Eternal session IPA (£3.20 for 2/3 pint) and my partner picked De Molen’s 3.5% Hugs and Kisses session IPA (£5 for 2/3 pint). Although somewhat pricey for under a pint, our brews of choice were both deliciously thirst quenching with well-balanced flavours. My dinner date, who would usually opt for a higher percentage, was pleasantly surprised by the taste. The inclusive, well thought out drinks selection and pots of comfort food with great flavours are combined with a casual, friendly atmosphere at Bundobust and, as a result, it brings an offering which, in my view, truly enhances Liverpool’s food and drink scene. You can make a meal of it and go there for the food, or simply drop by for drinks and satisfy that sudden peckish pang with a tub of easy to order, efficiently served, Indian inspired cuisine. Either way, there’s quality across the board.
