After filing a motion to have both of his felony charges of child pornography dismissed on Oct. 27, Minnesota State University, Mankato head football coach Todd Hoffner took the stand in a pre-trial hearing last Wednesday at the Blue Earth County Justice Center. Once Hoffner was on the stand, his lawyer, Jim Fleming, began asking the veteran head coach simple questions about his occupation and his tenure at the university before moving into details of his arrest on Aug. 21.
According to Hoffner’s testimony, he was trying to download new software on his school-issued blackberry to help him communicate with his players, recruits and recruits’ families faster, and that his phone wasn’t working correctly. A few days later, he was escorted off the practice field, told by officials that he was being put on administrative leave and needed to pack up his belongings and leave the campus. Hoffner didn’t know why he was put on leave but did as the officials requested and went home. Hoffner later explained that
he and his wife had agreed to cut back on unnecessary expenses once he returned home, disconnecting their phone service as Hoffner believed he was being fired. The family also cancelled their cable service, as well as their golf membership at the Mankato Country Club. On Aug. 21, Hoffner was working on chores around the house and was about to return their Charter Cable equipment when Mankato detective Jerry Billiar approached him, arresting Hoffner on charges related to child pornography. Fleming later began questioning Hoffner about
the three videos specifically, starting with the first, recorded on June 26, 2012. On June 26, Hoffner was working on football related in his family room after he sent his kids upstairs to take a bath in their Jacuzzi tub in the master bathroom, when his three children came downstairs asking him to record a “show” they have been working on in the bathroom, and that’s when the first video started. The “show” consisted of the three children dropping their towels and singing and dancing. Hoffner’s son was trying to disrupt their show and that is when he was grabbing his penis. Shortly afterwards all three of the children bent over and showed their anuses. Video two consisted of the two girls singing and dancing naked, then about half way through, the boy flashed through the background naked with one of Hoffner’s alumni helmets on his head. His son was trying to disrupt the girls’ performance, according to Hoffner. Hoffner stated that it was his kids’ idea for him to record them in the first two videos as they were trying to perform an act they have been practicing on their own. He also stated he never gave the kids any instructions or choreographed their show. In the third video, Hoffner explained the video as a simple act of good parenting; helping his daughter overcome
a bed-wetting problem. This video was taken after Hoffner woke up his daughter and videotaped her while she was walking to the bathroom. In his testimony, Hoffner stated his daughter wanted him to help her with her bed-wetting problem and to videotape her. When the video was focusing on her as she walked to the bathroom, her head was cut off from the frame, and that was because Hoffner was going back and forth from looking at her and looking through the phone. He also stated he never zoomed in. “There’s nothing inappropriate about those videos,” Hoffner said. Fleming started the pretrial stating that they want all of the charges dismissed due to a lack of probable cause. After both Fleming and Blue Earth County prosecutor Blue Earth County Michael Hanson handed in their evidence, including a DVD copy of the videos, they asked for witnesses to testify. Fleming started the examinations with Matt DuRose, Commander of Mankato Public Safety. DuRose stated when he first saw the videos he didn’t think that they constituted child pornography, but he wanted to send it to the sheriff’s department for further investigation, which isn’t out of the ordinary.

Why I Am Going To Vote and Why You Should Too
We live in an apathetic society where we are bombarded with commercials, ads, flyers, Facebook posts, news articles and other information sources. These sources spam us about the things they think we should care about, the things that we should spend our money on and even how we should spend our time. Alas! There exists one place where no one can tell us how to think – the polls. The choice is yours and that choice was not easy to get. Even after passing the 15th
Amendment, which prohibited the government from denying citizens equal rights to vote, many states suppressed the voting power of minorities. The Voter Rights Act of 1965 made discriminatory voting practices illegal. Throughout the course of US history, Asian Americans faced an uphill battle for equal rights. Asian Americans were not able to vote due to laws prohibiting them from naturalizing as citizens. Even after voter discrimination was deemed
illegal, Asian Americans still face discrimination at the polls because of a lack of the required language assistance for limited English proficient populations or excessive demands for identification. We hear these things constantly: You should vote for the issues. You should vote for the people that can’t. You should vote because your future depends on it. I am voting for two reasons: because I have the choice and because I care. I may never be able to thank
the people that have made my life so much easier by fighting for my rights. Ultimately, I choose to thank them by caring about my future and the people that will come after me, simply by voting. This Election Day, exercise your right to vote because you can and no one can stop you.

Mankato Police Captain Rich Murray also believed the videos were disturbing. “It was very disturbing, what I saw,” Murray said. The three officials collaborated on the issue and decided to send the videos to the sheriff’s department and ask Hanson if the videos were enough to arrest Hoffner. “Adults should not make lewd videos of children,” Hanson said. “And there’s no parental exception.” Once the officials were
done with their testimonies Fleming brought Holly Barkeim, the child assessment investigator who investigated the Hoffners, to the stand. She was sent by the BEC Human Services to investigate whether the Hoffner children were in danger and if they needed to leave their parents. Barkeim concluded that no services were needed and that sexual abuse had not occurred. Barkheim has viewed the videos three times. Right before a break in the trial, Fleming called Hoffner’s neighbor, Johanna Galles to the stand, who has been taking care of his kids for three years. They finished her testimony saying the kids played
well with each other and with other kids. She also stated she has videotaped her own children naked. After the defense attorney and prosecutor’s closing statements, Blue Earth County District Judge Krista Jass made a decision, concluding she will accept briefs from both parties before Nov. 14 and make a subsequent ruling. Hoffner remains free after posting $40,000 bond following his arrest, and has occupied his time volunteering with area football programs. His Mavericks, meanwhile, are 10-0 and will face conference foe Upper Iowa this weekend, hoping to secure a share of the conference title.

Addicted nun robs New York Church
BUFFALO, N.Y. (AP) — A nun with a gambling addiction was accused of stealing $128,000 from two rural parishes where she worked. Sister Mary Anne Rapp was treated for a gambling addiction and is in recovery, her order said Monday, but she still faces a criminal charge of grand larceny following the thefts from the St. Mary and St. Mark congregations. She was expected to plead not guilty at an initial appearance in Kendall Town Court on Monday evening. "She's been a nun for a very long time, been a very good person, never in any trouble
before," said her attorney, James Harrington. "She did great work wherever she was assigned." In 2010, the two linked parishes were assigned a new pastor who sought a routine audit, said Kevin Keenan, spokesman for the Roman Catholic Diocese of Buffalo. Rapp is accused of taking the money between 2006 and 2010, Keenan said. Officials believe Rapp spent the money at casinos. She is a member of the Sisters of St. Francis, based in Lewiston, north of Buffalo. Sister Edith Wyss, provincial minister of the 138-member order, said that when Rapp was placed on leave,
she agreed to seek treatment for a gambling addiction. "She spent 9 1/2 months in an in-patient treatment program and has maintained her recovery in the year since," Wyss said. Wyss said the order does not condone the conduct but continues to pray for Sister Mary Anne as she deals with her addiction. Orleans County District Attorney Joseph Cardone declined to detail how the alleged theft occurred or comment on the motive. "We're not at this point focused on what she did with the money, we're focused on the money itself," he said.

staff writer The Minnesota State University, Mankato football team brought a little sunshine to a gloomy Saturday afternoon with a 27-13 victory over no. 17 University of Sioux Falls. The win clinched the Mavericks at least a share of the NSIC regular season championship title. Since the 2009 team did it, this victory marks the second time the football program started their season 10-0. The no. 6 Mavericks started right out of the gate, compiling a fast five-play drive capped off with a two-yard touchdown run by junior quarterback Jon Wolf. Two plays before the touchdown, Wolf kept the drive going with a 67-yard completion to redshirt freshman Kyle Riggott on third and six, the longest play from scrimmage this season. Wolf would finish the contest with 200 yards on 11 completions and one touchdown.
Sioux Falls, who came in to this contest with an 8-1 record, would retaliate with a 20-yard field goal by Braden Wieking. Junior kicker Sam Brockshus would take their 20-yard field goal and raise them a 44yarder in the second quarter to give the Mavericks a 10-3 lead. Then it was all Mavericks the rest of the half. After catching his second career interception, junior defensive end Chris Schaudt ran the ball back to the Cougars six-yard line to set up freshman running back Connor Thomas for his sixth rushing touchdown of the season. After sophomore receiver Keyvan Rudd blocked the Cougars punt late in to the second quarter, the Mavericks started with the ball at the Cougars 25-yard line and drove down the field for Brockshus to end the half with a 22-yard field goal. After a scoreless third quarter, Wieking gave the Cougars three points from 22-yards out to bring the score to 20-6

Senior receiver Adam Thielen seemed quiet through the first three quarters, and then the Mavericks put together a classic Wolf and Thielen drive with the two connecting for 28 yards and a 40-yard touchdown to extend the Mavericks lead to 21 points. Thielen, who came in to this matchup with a team leading 804 yards, ended the game with 93 yards on five catches. “If you give Adam a chance to go up and catch the football, more times than not he is going to come down with it,” Acting head coach Aaron Keen said. Saturday wasn’t the first time that the Minnesota State University, Mankato men’s hockey team has downed the University of Minnesota, but with a full house and the return of the school’s raucous pep band, it may have been one of the most exciting. The Mavericks were reeling following a road route at the hands of conference rival St. Cloud State, who rolled over MSU 5-1 in both games. The team responded in heroic fashion however, playing the no. 2 ranked Golden Gophers to a tight 3-2 loss on Friday night at Mariucci Arena, before returning home Saturday and upending the reigning WCHA regular season champions, 5-3. scoring on the road Friday night, when sophomore forward Jean-Paul Lafontaine fed fellow sophomore Zach Palmquist, who beat Minnesota freshman Adam Wilcox for a 1-0 lead at 4:50 of the first period. The Gophers Travis Boyd leveled the score just five minutes later, adding to the Mavericks’ special teams woes with a power play goal midway through the frame. Freshman Teddy Blueger continued his impressive rookie campaign midway through the second period, batting a Max Gaede rebound past Wilcox for his second goal of the season and a 2-1 Maverick lead. The Gophers however would shut out the Mavericks for the next 30 minutes, before taking the lead for good early in the third

Junior Nate Schmidt blasted a power play goal past senior goaltender Phil Cook with just five minutes remaining in the period, using junior Zach Budish’s impressive 6’3” frame as a screen to tie the game 2-2. The 214-pound Budish would find the back of the net himself early in the third period, sliding Rau’s rebound past Cook to give the Gophers a 3-2 lead. Despite the loss, head coach Mike Hastings remained positive. “It was a good hockey game, we [need to] find a way to kill a penalty though,” he said. MSU entered the series near the bottom of the WCHA in both penalty kill and powerplay efficiency.

The Mavericks entered the series with just four power play goals on the season, despite their 27 attempts, while averaging 16 penalty minutes per game. MSU’s offense however kept pace with the high-flying Gophers throughout, as the Mavericks were outshot just 32-25. “We [need to] continue to make steps,” Hastings said. “Tonight was a step on the compete end, but at the end of the day, it’s about wins and losses.” The Mavericks would make several of those steps the following night, returning home to the Verizon Wireless Civic Center in Mankato to a sellout crowd of almost 5,000, as well as the return of MSU’s athletic pep band. Junior defenseman Josh Nelson, who appears to have taken huge strides in the offseason, gave the Maverick faithful plenty to cheer about just six minutes into the game, blasting a point shot past Wilcox high on the stick side for a 1-0 lead. Junior Zach Lehrke proved to be the antidote for the team’s special teams woes just a few minutes later, converting on a wrist-shot after a pass from sophomore Matt Leitner. The Gophers’ Erik Haula threaded the puck past Cook with 4 minutes to play in the period, cutting the Mavericks’ score in half, before junior Nick Bjugstad evened things up early in the second period. Bjugstad, a 2010 firstround selection of the Florida Panthers, connected with Rau once again, converting the diminutive forward’s centering pass to make it 2-2 just 56 seconds into the frame. The Mavericks, however, were quick to respond. Junior Johnny McInnis, who has quickly made a name for himself as one of MSU’s premier goal-scorers, collected freshman defender Jon Jutzi’s rebound in front of the net, before firing it past Wilcox to give the Mavericks the lead once again. Cook recorded 25 saves in the win, while Margonari collected first star honors. “It’s a great weekend, especially for our team,” Margonari said following the win. “The sky’s the limit for this team.” Margonari’s optimism will be tested once again next weekend, as the Mavericks play host to the no. 3 ranked University of Denver Pioneers. The Pioneers are tied for first place in the WCHA with the St. Cloud State Huskies, who they split with over the weekend. The Mavericks return to action Friday at 7:37 p.m.

After dropping to second in the NCAA Super Region rankings, the Mavericks took over the rankings after Henderson State defeated Southern Arkansas University 44-36. With the playoffs around the corner, the Mavericks want to finish their regular season strong with the 2-8 Peacocks of Upper Iowa University coming to town. et’s face it, Election Day is about as enjoyable and looked forward to as a yeast infection. You get bombarded every day months before hand with pandering, propaganda, and outright lies all for one day in early November where you take time to go fill out a piece of paper with your preferences and hope your voice makes a difference in the end. The whole song and dance is a pain but it is also a requisite centerpiece in our democracy. So, in a last ditch effort to spice up your Election Day non-festivities, we’re taking a look back and suggesting some of the most holiday(?) appropriate movies, music, and television. The most recent movie that fits snug into this category is the Will Ferrell/ Zack Galifianakis comedy The Campaign. Hitting home video last week, the duo’s first outing stars Ferrell as a four term North
Carolina congressman and Galifisomething as his hapless, corporate-interest backed opponent hits on the outrageous, obvious material politics provides on an almost daily basis. Audiences probably shouldn’t expect much deep, subtle, or overall clever statements on the current state of our elections from the director of the Austin Powers and Meet the Parents movies, but there is baby punching. That counts for something, I guess. A political comedy of sorts that has stood the test of time is 1999’s aptly named Election. One of director Alexander Payne’s (Sideways, The Descendants) early films, Matthew Broderick stars as a frustrated Nebraska high school teacher who attempts to sabotage an obsessively overachieving student’s (Reese Witherspoon) bid for student president by backing a loveable, popular idiot as her opponent. Payne’s trademark dark character
humor is in full swing with this one, making it a smart, witty and viciously amusing movie. But politics is only so often a laugh-riot. One of the most talked about political dramas to come out in the last year is George Clooney’s The Ides of March. Based off the stage play Farragut North and receiving a good amount of awards buzz this time one year ago, Ryan Gosling plays Stephen Meyers, a junior campaign manager trying to propel his candidate, Mike Morris (Clooney), to victory in the Democratic Primary, thus securing the role of Democratic nominee. But as he starts a relationship with one of the interns and is tempted by the opposition, Meyers learns firsthand about the seedy underbelly of politics. The acting and writing in March are outstanding and watching Gosling’s character’s idealism be slowly broken by the moral
decay of politics is dramatically powerful. In a similar vein is 1972’s The Candidate. Robert Redford stars as a charismatic community organizer, disenchanted with politics due to his father being a former governor, who is coaxed into running for senate on the promise that he won’t be able to win. While nowhere near as hopeless as The Ides of March, The Candidate provides another view of an idealistic upstart as he becomes acclimated to the business-as-usual state of the political process. Also starring Robert Redford, check out All the President’s Men. Given the talent and opportunity at hand, good kid, m.A.A.d city shines past all preconceived notions of an upstart rapper swimming through a sea of watered down music. Tracks on good kid, m.A.A.d. city are pieces of a puzzle that complement each other to the best of their ability; in that sense everything is a standout. “Sing About Me, I’m Dying of Thirst” however is
something special. Lamar takes on the voices of others and puts their stories out in a deeply personal structure that makes the listener feel as if they know them. Lamar, speaking as a friend, raps “And if I die before your album drop I hope-” before gunshots go off. The moment is emotional without being dramatized and lures the listener to think about the plight of those he speaks of. Later, Lamar takes on the persona of a woman intending to stay strong but clearly striking a chord of lament explaining her situation. It is not only Lamar’s content that is on point, but the rapping on good kid, m.A.A.d. city is top notch. It is a success within itself that there is no divide in aptitude of what is able to be done
on one album. The thought provoking moments are substantial and the wordplay, astounding. Lamar is from Compton, CA but his story is universal; a major reason why good kid, m.A.A.d city is so successful. Lamar’s story is not just his. It is built to be relatable, something the best art has always been composed of. Being young and wise can often lead to an outpour of moments that sound grander than they truly are; a type of pandering that makes good on boasts instead of ability. The album positions itself as a pinnacle moment in hip-hop, where the hero is a 25-year-old kid that showed up to share some moments from his life. There will undoubtedly be no shortage of listeners.
