State Capitol Week In Review

When Arkansas voters go to the polls for the primary elections on May 22, or if they vote early beginning May 7, they will have to present a government-issued photo ID in order to get a regular ballot. The photo ID is required under Act 633 of 2017, which passed in the Senate last year by a vote of 25-to-8, with two senators not voting. An Arkansas registered voter challenged the constitutionality of Act 633 in a lawsuit. The initial ruling by a circuit judge was that it was unconstitutional. However, state election ofﬁcials appealed to the Arkansas Supreme Court, which overturned the circuit judge’s injunction. That means the photo ID requirements will be in effect for May’s primary elections. In the coming months, a couple of developments will affect whether Arkansas has a permanent photo ID requirement for voters. First of all, the Supreme Court stay only applies to voting in the May primaries. The Supreme Court did not decide on the constitutionality of Act 633, it simply overturned the lower court judge. Before the November general election, the Supreme Court is expected to hear arguments on the constitutionality of Act 633. Another factor could establish photo ID requirements as Arkansas law, regardless of the litigation prompted by Act 633. In November, Arkansas residents will vote on a proposed constitutional amendment that requires voters to present a photo ID. The measure was placed on the ballot by the legislature and is known as Issue Two. If voters approve Issue Two, it would put the photo ID requirement in the state Constitution and supersede any rulings that arise from the lawsuits challenging Act 633. Act 633 is the legislature’s second attempt to require a photo ID. In 2013 lawmakers enacted a similar voter ID law, but it too was challenged in court and the Arkansas Supreme Court ruled it unconstitutional. Supporters then focused on writing the ID requirement into the Constitution, through an amendment approved by voters in a statewide election. The legislature may refer three proposed constitutional amendments to voters, and the photo ID requirement was one of two referred during the 2017 regular session. The other, Issue One, is a tort reform measure.

Last week I reported erroneous revenue figures for the Department of Transportation. The $308 million total should be for the fiscal year-to-date up to and including March, and not just for the month of March. The revenue is mostly from motor fuels taxes, and also includes registration fees on trucks and heavy vehicles, permit fees and penalties and revenue from a severance tax on natural gas. Relying so much on traditional revenue from motor fuels taxes, paid at the gas pump by drivers on a per gallon basis, presents a financial challenge to highway officials. That’s because motor vehicles every year are manufactured with greater fuel efficiency. Four-door sedans that used to get 15 miles per gallon routinely get 30 miles to the gallon.

POLK COUNTY OFFICIALS PROCLAIM HISTORIC PRESERVATION MONTH

Polk County Judge Brandon Ellison, Hatfield Mayor Linda Denton and Mena Mayor George L. McKee are among 166 officials in 74 counties who have declared May as Historic Preservation Month and Arkansas Heritage Month. “As we enjoy these month-long celebrations of our Arkansas heritage, we hope all of the people of Arkansas will take time to reflect on the importance of their local historic sites, especially those listed on the National Register of Historic Places,” Department of Arkansas Heritage Director Stacy Hurst said. (A list of Polk County’s National Register properties can be found at http://www.arkansaspreservation.com/Historic-Properties/National-Register/search-national-register-listings.) The proclamations from Ellison, Denton and McKee note that historic preservation is an effective tool for managing growth, revitalizing neighborhoods, fostering local pride and maintaining community character while enhancing livability; and that historic preservation is relevant for communities across the nation, both urban and rural, and for Americans of all ages, walks of life and ethnic backgrounds. The officials declare that it is important to celebrate the role of history in our lives and the contributions made by dedicated individuals in helping preserve the tangible aspects of the heritage that shaped us as a people. Noting that "This Place Matters! " is the theme for National Preservation Month 2018 and “Off the Beaten Path: Explore and Enjoy Arkansas’s Natural Heritage” is the theme for Arkansas Heritage Month, cosponsored by Polk County, Hatfield, Mena, the Arkansas Historic Preservation Program, the Department of Arkansas Heritage and the National Trust for Historic Preservation, the officials proclaimed May as National Historic Preservation Month and called upon their constituents to join their fellow citizens across the United States in recognizing and participating in the special observance. Student Garden Planted AMY BULT

he student community garden at the outdoor classroom at Cossatot River High School is ready for spring. Mark Duggan, of Grannis, spearheaded the idea to create a student garden at the outdoor classroom earlier this year. Mark and Karen Kutait generously donated their time and equipment to disc and rototill the garden area in April. The garden was then fertilized according to soil test results by the Rich Mountain Conservation District. Students from Monte Fain and Scott Morgan’s agricultural classes and from Nicole Evans’s class took advantage of the spring weather to come out and plant the garden this past week. Steve Swall, of the Natural Resources Conservation Service (NRCS), instructed students on gardening basics, soil amendments, and planting techniques. Crops planted include sunﬂowers, lettuce, spinach, strawberries, peas, okra, tomatoes, pumpkins, peanuts, and cotton.

ASA (Court Appointed Special Advocate) is a local 501c3 organization that advocates on behalf of children placed in foster care and depends on the support of grants, the local community, and volunteers to serve the more than 60 children currently in foster care in Polk and Sevier Counties. Executive Director Cynthia Martin is asking for the community’s continued support for their upcoming spring fundraiser that they hope will give everyone an opportunity to donate and to learn more, “CASA is grateful for the past support that our wonderful community has given our program. In 2017, your generosity enabled 27 caring individuals to advocate on behalf of 100 children in foster care. We are now asking for your continued support.” CASA volunteers serve as a crucial resource for the children, “Whatever the age, children removed from their home because of abuse or neglect face a frightening, profound unknown. THE TRUTH THAT SETS US FREE

Sometimes, some of us get the wrong idea of freedom. We need to know what the Bible teaches, not someones opinion. Jesus said “you shall know the Truth, and the Truth will make you free (Jn 8: 32). Yes! But this freedom is not absolute, there are limits, there are restrictions. For example freedom does not mean that we are free to hate, even those who may “deserve” hatred. We are not free to murder someone. We are not free to break the civil and criminal laws under which we live. We are not free to disobey the authorities that God has set over us. Sin is still sin, even for those of us who “know the Truth.” There is no such thing as freedom without responsibility. And even though in Christ we are “free from the law” of “sin and death,” we are not free from the social and civil consequences of our behavior. During my seminary years in California I worked for a while at San Quentin prison, and for a time I worked on death row. I remember one inmate on death row who prayed to receive Christ after I shared the Word with him. He received freedom in Christ, but the next morning he was still behind bars on death row in San Quentin prison. Freedom is not absolute. Sinful behavior, though forgiven, may still bring severe consequences. We are not free to disobey God, nor are we free to disobey the laws of the society in which we live. So, if Truth has all of these restrictions, what did Jesus mean when He said that the Truth would make us free. The Truth which Jesus spoke of cannot be expressed in one simple sentence, no more than we can fully express Him in one simple sentence. Here are several parts of the One Thing of which He spoke… the thing of which He is the very essence: Truth. Truth # 1: we, all of us, 100% of us, have sinned against the God of our creation. Truth # 2: the wage that sin inevitably pays is death, and among other things that death will be an eternal separation from the God who created us. Truth # 3: no one will escape the “wages of sin.” Truth # 4: God Himself chose to transfer our sin burden to Someone Else, but that Someone else must have been Himself, without sin. Truth # 5: God sent His only begotten Son to this little planet to be our sin-bearer. Truth # 6: When Jesus died on the cross “He became sin for us, who knew no sin, that we might become the righteous of God through Him” (II Cor. 5: 21). Truth # 7: obedience to the Law cannot get us right before God for none of us has ever been perfectly obedient… except Jesus! Truth # 8: God has chosen to transfer the penalty of our sin to Jesus, and He chose to accept us back if we would accept the Truth of who Jesus was, what He did, and call out to Him, acknowledging our need for Him. The Cross was that transference! Truth # 9: when we do, in honesty, call upon Him, He will come into our lives, forgive us, and make us the children of God. Truth #10: now we have the freedom of which Jesus spoke: Sin cannot kill us! In Christ we are now alive to God. “If we confess our sin He is faithful and just to forgive our sin and cleanse us from all unrighteousness” (I John 1: 7). Fact: not theory. The Truth DOES free us, once we accept it. But it is never forced upon us. And it is never license to live in an irresponsible and ungodly manner.

William (Bill) Gutierrez, better known as “Cowboy”, age 75, of the Kiamichi Wilderness in Oklahoma and Mena, Arkansas went to be with the Lord Sunday, April 22, 2018 at the Little Rock VA Hospital. He was born on Thursday, August 27, 1942 to Bill and Patricia LaForge Sweet of Lawrence, Kansas. Bill served in the United States Army and was stationed in Germany during his tour of duty. In 1964, Bill married Sherry Wilson and had two daughters, Lori and Linda. In 1977, Bill started his own A/C, heating and refrigeration business known as B-G Air Conditioning in Dallas, Texas. He was selftaught and was able to analyze and find a solution for any HVAC problem. Bill worked hard at his craft for 20 years and retired to the Kiamichi Wilderness. In 2015, Bill married Robin Lang and was a member of Christ Church at Mountain Fork, AR. Bill liked old country western music, tinkering on anything mechanical and making improvements on his cabin. He served as the Fire Chief for the Kiamichi Volunteer Fire Department for 10 years. He orchestrated the remodeling and building of the firehouse. He reconstructed two old army trucks to make an all-terrain truck that could maneuver through the woods. Bill also made improvements using his own equipment to the roads and trails for easier accessibility. Cowboy loved his little cabin in the woods and he called it his “little piece of Heaven”: Bill was a proud member of the American Legion and Polk County Honor Guard. Cowboy was a loving husband, father, grandfather, brother, uncle and great friend who will be missed by all who knew him. Bill was preceded in death by his parents and two grandchildren, Cassie Dyess and Trevor Barkley.

WILLIAM “MIKE” PEEK Mr. William “Mike” Peek age 78 of Mena, Arkansas passed away Saturday, May 5, 2018 in Mena surrounded by family. Mike was born on June 5, 1939 in DeQueen, Arkansas to the late William Loit Peek and the late Mary Dell Graves Peek. He was happily married to Patricia Gail Peek for 58 years. Mike was a partner of Hatfield Lumber Company for 40 years. He enjoyed fishing with family and friends and watching all kinds of sports. The highlight of his life was spending time with his family and friends. He was a thoughtful and loving husband, father, grandfather, great-grandfather, brother and friend to all. He is survived by his wife Patricia “Pat” Gail Peek of Mena, Arkansas; sons Michael Scott Peek and wife Lisa of Danville, Arkansas, Trent Peek and wife Paula of Mena, Arkansas. His daughter Shannon Charise Mendoza and husband Avel of Mena, Arkansas. Grandchildren:Kayla Morris, Chase Peek and Tori Peek of Danville, Arkansas, Corie Bush and Taylor Peek of Cove, Arkansas, Tate Mendoza of Mena, Arkansas, Reed Mendoza of Lincoln, Arkansas. Great-Grandchildren Preslea and Landry Morris, Emmitt and Fletcher Peek, Avenlei and Malloree Bush, Jaxon Mullen, Blair and Rhodes Mendoza. Funeral service was Tuesday, May 8, 2018 at 10:00 a.m. at Beasley Wood Chapel with Brother Daniel Morris officiating. Interment followed in Pinecrest Memorial Park under the direction of the Beasley Wood Funeral Home. Family and friend’s visitation was Monday. May 7, 2018 at 5:307:30p.m. at Beasley Wood. Pallbearers were Chase Peek, Tate Mendoza, Reed Mendoza, Matt Bush, Quentin Meredith and Danny Hurst.

BETTY JANE WILSON PATE Mrs. Betty Jane Wilson Pate age 79, formerly of Mena, Arkansas passed away Wednesday, May 2, 2018 in Rockaway Beach, Missouri. Betty was born on May 12, 1938 in Norman, Arkansas to the late Elmer Lee Wilson and the late Jimmie Ruth Abernathy. She was married to Elijah C. Pate for 53 wonderful years. Betty enjoyed telling people about the Lord and would share His blessings. Never meeting a stranger to share Jesus’ love for all. God and family always guided her life and were the most important to her. Betty was a loving and thoughtful wife, mother, grandmother and friend to all. She will be dearly missed. She is survived by her husband Elijah Pate, her daughter Elizabeth (Lisa) Tarver and husband James of Rockaway Beach, Missouri. JUDY CAROLINE RHODES Judy Caroline Rhodes age 65 of Mena, Arkansas passed away Saturday, May 5, 2018 in Mena. Judy was born on June 7, 1952 in Mena, Arkansas to the late Leon May and the late Millie Johnston May. She

was married to Bill Rhodes and was a thoughtful and loving homemaker. Judy and Bill loved to travel in the RV, enjoying the beautiful sights and just being together. She was a wonderful cook and liked to cook for family and friends. Most of all she loved spending time with grandchildren and family. Judy loved her dog and special companion, “Buddy.” She was a devoted wife, grandmother, sister, aunt and friend to all who knew her. Niece Cindy Dean; nephew Justin Whisenhunt, and a special friend Phyllis White. She was preceded in death by her parents Leon and Mille May, son Bradley Rhodes and a daughter Tammy Johnson. The “Just for Fun Players”, a new division of Ouachita Little Theatre, are preparing for their performance of the classic comedy “Harvey.” Dinner theater performances will be held July 20th and 28th at the Mena Mountain Resort. Three performances will be held at the OLT August 3rd through 5th. Auditions are being held Friday, May 18th from 6-8 PM at the Mena Mountain Resort Event Center and at the OLT on Saturday May 19th from 9-11 AM. There are parts for 3 or 4 females ranging in age from 20 to 60 years old, and 2 or 3 males in the same age range.

rkansas Attorney General Leslie Rutledge is warning consumers about a lethal opioid that may be lurking in their kitchen pantries – unwashed poppy seeds. After meeting with parents who lost a child to these seemingly innocent seeds, Attorney General Rutledge wants to ensure that all Arkansans are educated about the dangers. While washed poppy seeds are a safe and popular ingredient in everything from baked goods to salad dressings, some individuals are engaging in the dangerous behavior of making a “tea” with the unwashed seeds to settle their nerves or to get a high. “The brewing and consumption of unwashed poppy seed tea is a dangerous trend with potentially lethal consequences,” said Attorney General Rutledge. “Unwashed poppy seeds are available from many online retailers and could be easily confused for the commonly-used washed variety. Arkansans should ensure that they are purchasing and using the correct variety of poppy seeds since the unwashed seeds can be dangerous, addictive and even lethal.” Attorney General Rutledge released the following tips for consumers shopping online who may have purchased unwashed poppy seeds instead of washed by mistake. • Thoroughly review the order to ensure you are ordering the product(s) you searched for. • Carefully research the product by reading manufacturer information, consumer reviews and other literature to determine whether the seeds are washed or unwashed. • Read and understand the refund and shipping policies before you make your purchase. Look closely at disclosures about the seller’s refund and shipping policies. • If possible, use credit cards for payment. Credit card purchases are the most secure and easiest to return. And under federal law, you can dispute the charges if you do not get what you were promised. Arkansas consumers should also be aware of the overdose risks that may come with unwashed poppy seeds. Recent research found that the unwashed seeds can have an opium latex on them that is activated during the tea brewing process. Morphine levels vary widely among unwashed seeds, ranging from trace to lethal amounts, and consumers should be cautious and thoroughly research the products they are purchasing. Relay For Life FROM FRONT PAGE

he Polk County Relay for Life event had to be moved to the CMA Iron Mountain facility Friday due to the threat of rain, but the effort wasn't dampened a bit. $6,145.57 was raised bringing the year-to-date total to $47,309.16. The money raised is for cancer research. Relay For Life is the signature fundraiser for the American Cancer Society. Relay is staffed and coordinated by volunteers in thousands of communities like Mena and Polk county, and 27 countries. Volunteers give of their time and effort because they believe it's time to take action against cancer. Jud Parker and Marian Witham were named co-caregivers of the year. There will be a Relay for Life Yard Sale May 18th at the college in Mena. The sale will be from 8am until noon with a “bag sale” beginning at 10am. The location for the sale will be around the main entrance.

Local Track Teams Compete In State Ladycats Finish 2018 Softball Meets Season L L

ast week, the local Acorn and Mena High School track teams competed in their respectful state track meets. To begin the week, on Tuesday, May 1st, the Mena High School track team competed in the 4A State Track Meet at Pocahontas. For the Ladycats, Lauren Sikes placed sixth in the finals of the 100M Hurdles event, after placing eighth in the prelims. In the 4x400M Relay competition, the Ladycats relay team placed ninth in the finals, as in the 4x800M Relay event the Ladycats placed thirteenth. For the Bearcats, Devin Adams placed third in the finals of the 800M race, as Robert McIntyre came in fifteenth place in the 1600M race and eleventh in the 3200M race. The Bearcats relay team finished tenth over in the 4x800M Relay competition, before Braxton Bahr placed seventh overall in the finals of the Discus event for the Bearcats. On Wednesday, May 2nd, the Acorn High School track team competed in the 1A State Track Meet in Mineral Springs. The Lady Tigers finished the day as State Runner-Up, just as they did in Cross Country earlier this year. They finished Runner-Up, the Acorn Senior Girls did claim first in the 4x800M Relay and in the 4x100M Relay. The Acorn Senior Boys track team went on to finish sixth in the 1A State Tournament. The Tigers won their first race of the day in the 4x800M Relay, and then placed second in the 4x400M Relay.

ast Thursday, May 3rd, the Mena Ladycats (8-18, 1-6) 2018 softball season came to an end as the Ladycats fell short to DeWitt 8-2, in the opening round of the 4A South Regionals Tournament. The Ladycats loss to the number one seed DeWitt Lady Dragons in Regionals, comes just days after Mena defeated the number one seeded Arkadelphia Lady Badgers (7-3) in their District Tournament. Mena went on to lose to Nashville (12-2) and Ashdown (2-1) to ﬁnish their District Tournament performance. Congratulations to Coach’s Ray Hunter and Tia Fryar, seniors: Sarah Lynch, Anna Beth Hunter, Hattie Hunter, Olivia Lockhart, and Antonio Sievers, as well as the rest of the Ladycats on ﬁnishing up the 2018 season.

he Mena Elks Lodge has donated a handcrafted piece of American art crafted by Thomas Copelin who is a member of the Mena Elks Lodge to the Polk County Veteran Service Ofﬁce. The art work was displayed at the Mena Elks Lodge for many years. Thomas wanted the piece to inspire and be enjoyed by many veterans so it was decided to donate the work of art to the Polk Count Veterans Service ofﬁce.
