Producers of alcoholic beverages in Australia exist in the most unique and highly diverse regulatory landscape in the world. On the one hand Australia has the highest excise rate of $86.90 for every litre of pure alcohol in spiritous liquor, while for wine producers the regulation is so lighthanded that a bottle of wine can retail for as little as two dollars. This arrangement is broadly advantageous to the Australian Federal Government. Spirits and liqueurs distributed in Australia are generally the product of large, and very effective, vertically integrated, multi brand, global corporations against which it is difficult for local producers to compete. However the wine industry is one in which Australia producers are amongst the world’s most efficient. In this way Australia meets its Free Trade obligations while maximising local producer benefits in its home market.

In 1999 legislation was passed to create the category of goods known as Wine Product with the express intention of encouraging innovation in Australian producers. Such innovation was to broaden the range of products included under the favourable Wine Equalisation Tax system, creating opportunities for local producers to build new brands for flavoured, wine based products in the same alcohol percentage range as wine and fortified wine offerings. Addition of flavours in imitation of existing beverage categories, such as Whisky or Rum, was not permitted. Generally, and particularly in view of the available tax benefits, growth in the Wine Product sector was slow. A range of flavoured liqueurs and cream liqueur type products emerged and found favour with budget conscious consumers while comprising only a small percentage of
the overall domestic market for alcoholic beverages. In 2010 Divas Beverages entered the market with a new vision for what the Wine Product category could become, given the application of state of the art clarification technology and techniques. The move from traditional winemaking practice to a process-engineering approach permitted the systematic removal of wine characteristics from the product in pursuit of a more neutral base that could be used more flexibly in the market. The first, and most formidable, offering to the market to arise from this approach was Divas VKAT. Divas VKAT is a 22% ABV Wine Product which has been extensively clarified to produce a beverage suitable for use as a mixer in a diverse range of applications which were previously the prerogative of white spirit type mixers, such as vodka
or white rum. VKAT quickly found a niche at the budget end of the spectrum and, as production techniques improved, began to find its way into broader market acceptance. VKAT was swiftly identified as a serious competitive threat by the large corporate distributors that dominate the mixer category. Concerns were raised with the Australian Tax Office via industry consultation groups over “Borderline Products” and so began a long and tortuous legal dispute with the ATO which, in short, was eventually successful in establishing that the removal of flavour from a product was not in fact giving it a flavour, even if the resulting product came to resemble an existing product.
