Happy New Year- 2014! I hope everyone enjoyed the holiday season with friends and family as we now look forward to the coming year. It doesn’t seem possible that it has been over four months since we last met in Coeur d’Alene, Idaho. We have held several productive meetings in the past few months and planning has progressed on many of our projects. The new addition to our office space is in the works and we should have a closing by the time you read this article. The operation continues daily with our talented staff who are very productive and keep NASCLA running smoothly. We appreciate their hard work and dedication to our association. We would also like to remember those who served our association who were called to a better place this year. Several members passed but one in particular, Miss Joy Evans, a pivotal member of NASCLA in our first 50 years. Her hard work and dedication will certainly be missed. Our prayers go out to their families and we thank them for their service to our association. It is also the time of year to reflect on those who have served our country, as well as their families. We are most grateful for their service and the freedoms they afford us. In early December, the Executive Committee held a strategic planning meeting in New York City to prepare for the Board of Directors Strategic Planning Meeting in Las Vegas. The meeting in Nevada will be facilitated by Mr. Michael Barrett who, as some members may remember, worked with our association back in 2010. Mr. Barrett had a very positive impact on our operation and we look forward to working with him again as we set the course and vision for the future of our association. The ground work has been set by our Executive Committee, enabling our mid-year meeting to be productive and efficient. Work continues in all committees with chairs actively engaged on all fronts: obtaining new publications (Kentucky Code Books), securing new memberships, achieving better security for our database, putting finishing touches on the mid-year meeting, and planning this year’s annual conference. Other committees have meetings scheduled in the upcoming months. We are very fortunate to have such dedicated members who take time out of their busy schedules to participate in all these activities. The National Association of Home Builders (NAHB) and the National Kitchen & Bath Association (NKBA) will launch Design and Construction Week February 4-6 at the Las Vegas Convention Center as the International Builders’ Show and the Kitchen & Bath Industry Show co-locate for the first time, which was the rationale for holding our mid-year meeting in Nevada. We hope this will give us the opportunity to foster new and stronger partnerships within the industry. It has been almost ten years since Newport, Rhode Island, has hosted NASCLA for an annual conference. Both the staff and the program committee have already logged in many hours planning this event. We are hoping all will bring their families, board members and staff to participate in the conference in New England this year! The Newport conference will be both educational and exhilarating for all. Best wishes for a very happy, healthy and prosperous 2014!

The State of Alabama Board of Heating, Air Conditioning, Roofing and Sheet Metal Contractors was originally created in 1974; however, in 1992, it was enacted to relieve the Board of the duties of regulating roofing and sheet metal. In 2001, the Heating & Air Conditioning Board appointed Executive Director, Kathy LeCroix. She immediately revamped the record system, complaint process and began researching how the Board could more effectively serve the public interest. There have been several acts amending the purpose, duties and administrative capacity of the Board, but after several years of legislative disappointments, Mrs. LeCroix was able to get the latest piece of legislation, Act 2009-486, through and it became effective August 1, 2009. This act gave the Board jurisdiction to license and regulate commercial refrigeration contractors as well as commercial and residential heating and air conditioning contractors. In this new legislation the Board was renamed the Alabama Board of Heating, Air Conditioning & Refrigeration Contractors. The Board’s purpose is to license heating, air conditioning and refrigeration contractors. It is also the Board’s duty to investigate, and ultimately determine, if a certified heating and air conditioning or refrigeration contractor should have his license suspended, revoked, or a fine imposed for providing substandard or dangerous service, repair or installation, or who otherwise violates a provision of the law. Pursuant to its duly adopted policy, the Board investigates consumer complaints only if the contractor held a certification at the time he entered into a contract with the consumer in question or during the installation and/or repair activity. When the Board receives a complaint on an unlicensed contractor, it determines if the contractor is required to be certified under the Board’s licensure law and will take appropriate civil or criminal action under the circumstances. Though the Board is a self-funded consumer protection agency, it is not immune to political interests. The Board is compiled of twelve members whereas four are appointed by the Governor, three are appointed by the Lieutenant Governor, two are appointed by the Speaker of the House and one is appointed by the President pro Tempore. Since the appointments are staggered in length and different executive branch members make the appointments, it alleviates many of the difficulties other agencies face due to party interests in the construction/regulatory processes within the State of Alabama. NASCLA STRATEGIC PLANNING MEETING
December 5-6, 2013 New York, New York
The NASCLA Executive Committee and NASCLA Educational Resources and Publications (NERP) Board of Directors held the NASCLA Annual Strategic Planning Meeting in New York, New York at the Element Hotel on December 5-6, 2013. During the two-day meeting the committee members had the opportunity to review the current NASCLA 3-Year Strategic Plan. The committee started to prepare for the NASCLA Strategic Planning Workshop by drafting the new association mission statement, vision and values that will be discussed at the NASCLA 2014 Mid Year Meeting in a few weeks. The NASCLA Executive Committee would like for all the NASCLA Board of Directors for FY 2013/2014 to participate in the NASCLA Strategic Planning Workshop on February 5th. The NASCLA Board of Directors will be creating a new NASCLA Strategic Plan for 2014, 2015 and 2016 that will pave the association’s future for the next three years. Michael Barrett with Resonance, LLC will be facilitating the workshop. Other items of discussion during the two-day meeting were business and financial related items for both NASCLA and NASCLA Educational Resources and Publications (NERP). NASCLA would like to thank and recognize all the committee members for making this meeting such success!

Committee Update The committee held two conference calls on October 8th and 16th, 2013. The committee is targeting the electrical examination as the next accredited examination program. The committee is working on scheduling a meeting with the National Electrical and Communications Association (NECA) for early 2014 to discuss the national acceptance of a NASCLA Accredited Examination Program for Electrical Contractors. The committee will also be working with NASCLA Member states and non-member states that provide electrical examinations to get their commitment to the program as well.

As of December 2013, the Nevada State Contractors Board is now accepting the NASCLA Accredited Examination Program for Commercial General Building Contractors.

Committee Update On November 13th, Vernon Stout and John Curl attended the South Carolina Residential Builders Commission Board Meeting where we had the opportunity to present and review the NASCLA Education Program and Platform with the board members. The board is currently reviewing the program and training courses further for remedial training and potential pre-licensure.

Committee Update Melissa McBride and staff have worked on updating the NASCLA Membership Plan for 2014 and the non-state member targeted list. Outreach calls have already been made by Melissa McBride, George Whalen and Angie Whitaker to a few potential new state members and existing states for membership renewals. The committee will be scheduling a conference call in early 2014 to review the new membership plan.

Executive Director Robbie Brooks to Retire Robbie Brooks, Executive Director of the North Carolina State Board of Examiners of Electrical Contractors, will retire July 1, 2014 after over 34 years of service. Joining the Board in 1979 as Field Representative, he held that position until July 1, 1982 when he was promoted to Field Representative Examination Supervisor. In March of 1984, he was promoted to Assistant Executive Director to Executive Director Curtis Kennedy; he then succeeded Mr. Kennedy upon his retirement on July 1, 1985. Robbie has served on the NASCLA Board of Directors since 1985 and served as President in 1996. The NASCLA family congratulates Robbie on the completion of his long and distinguished service to the Board and citizens of North Carolina, NASCLA wishes him and his wife Kim, much happiness in his well-deserved retirement.
Executive Director Verna Oda has Retired Verna Oda, Executive Officer of the Hawaii Contractors License Board, retired on December 31, 2013 after 30 years of service to the state of Hawaii. Verna commenced her government career in October 1983 at the Department of Health, then at the Department of Labor and Industrial Relations where she was a Fair Employment Specialist. On June 1, 1990, she became a Regulatory Boards and Commissions Executive Officer with the Department of Commerce and Consumer Affairs, responsible for the Board of Public Accountancy, Pest Control Board, Board of Examiners in Optometry, and the Cemetery Program. In November of 1998 Verna became the Executive Officer of the Contractors License Board, a position she held for 15 years until her retirement on December 31, 2013. Verna has served on the NASCLA Board of Directors since 1998. Verna is also a NASCLA Honorary Member for her tenure on the NASCLA Board of Directors. The NASCLA family congratulates Verna on her commitment and service to the Board and citizens of Hawaii. NASCLA wishes Verna much happiness in her well-deserved retirement.

Laura Guthery’s experience with a kitchen remodeler last summer was so “nightmarish” that she felt it went beyond a contract dispute. So she reported it to both the Minnesota Department of Labor and Industry and the Bloomington Police Department. Now the botched kitchen project in Guthery’s home has turned into a criminal charge against the remodeler, Mark M. Kotek. The department told Bloomington police that a little-known and rarely used Minnesota statute makes it a crime for someone to do contracting work without a license. In a summons filed Nov. 21 and made public Monday, Kotek, 37, ofMinneapolis, was charged with a misdemeanor after an investigation by Bloomington police detective Cory Cardenas. “I’ve been a detective for 10 years and I had never heard of this,” Cardenas said. “A lot of these people don’t think they’re going to fall into the criminal realm.” In August, the Department of Labor and Industry issued a cease-and-desist order to Kotek, fined him $10,000 and his company, Kotek Construction, $20,000, penalties that remained unpaid as of Monday. But the department’s director of contractor licensing and enforcement, Charlie Durenberger, welcomes the criminal case and hopes other cities will take similar action. “Our experience has been, historically, cities are not interested in charging contractors, and it’s long been a frustration for us and homeowners,” Durenberger said. In the past five years, the department has issued 596 cease-and-desist orders to unlicensed residential building contractors, but only a very small percentage have faced criminal charges, Durenberger said. Kotek could not be reached for comment Monday. If convicted, he faces 90 days in jail and a $1,000 fine, although he could receive a harsher sentence if he is found to have violated his probation for a 2009 theft-by-swindle conviction. Guthery hired Kotek in April after Kotek Construction popped up in a Google search for granite installers. During their first meeting, Kotek recommended new cabinets and appliances in addition to the granite, but he wasn’t pushy, Guthery said. The next day, he brought samples of what he said were Amish-built cabinets from Indiana and a CAD drawing of the kitchen remodeling plan, she said. “He seemed very detail-oriented and very personable, and he wasn’t intimidating,” Guthery said. Guthery paid Kotek $5,100. Kotek promised the project would be completed within two weeks, but six weeks in, Guthery had a bare kitchen. When the cabinets finally came, they were not the custom-made, Amish cabinets he promised, and they were the wrong size. The granite countertop was also too short and could not be installed. ‘Kept blaming everyone else’

Guthery said she realized she had hired the wrong person when Kotek would not answer her phone calls and a subcontractor put a lien on her house. She had sold all her kitchen appliances, and did not have a sink, because she thought the process would be done quickly. For months, she bought takeout and washed dishes in her bathtub. “He kept blaming everyone else,” Guthery said. “Then I looked him up in the Minnesota court lookup and I had a small heart attack.” Kotek “has a history of criminal charges and convictions for issuing worthless checks, wrongfully obtaining unemployment insurance benefits, theft by swindle, child neglect and domestic abuse,” the Department of Labor and Industry wrote in its disciplinary action against Kotek after Guthery filed a complaint. Kotek Construction was licensed under someone else’s name. “Had the department been aware of Kotek’s involvement with [the company], it would have sought the denial of the company’s license application,” according to the enforcement order. Get him off the streets’ For Guthery, who is in the final stages of remodeling her kitchen, the charges give her hope that her ordeal will soon be over. “We need to get him off the streets and stop him from taking people’s money,” she said. Cardenas said he found out about the 21-year-old criminal statute only after speaking with the labor department investigator. He said the Bloomington Police Department plans to present more of these cases to the city attorney’s office. Durenberger said the department used to regularly refer cases to city attorneys, but the “response was completely underwhelming.” “When we had conversations, what we basically heard was that it was not important, or ‘we don’t have the resources and this is really a civil matter.’ We gave up on sending them out because no one ever charged them.” Durenberger said he was “gratified but surprised” that Bloomington decided to press charges. “The whole issue of unlicensed activity is a real sore spot in the industry,” Durenberger said. “We’ll support anything that discouraged unlicensed activity, especially against those that are taking money or harming consumers in other ways.”

NASCLA 2014 Contractor’s State Licensing Information Directory NASCLA is currently in the process of updating the NASCLA Contractors’ State Licensing Information Directory. In order to make the update as complete and accurate as possible, we are requesting all state licensing boards update and complete the registration requirements for contractors imposed in their states. State members encourage you to review the information that will be sent out next month including the summary. Please make any changes you deem necessary to properly reflect the current information on the laws and procedures affecting the regulation of contractors by your agency.
