Idaho Wild and Waiting – and I must add to that, Waiting for YOU. As you well know, NASCLA’s Annual Conference is going to be August 26th through August 29th in Idaho. As always, the hard-working staff and NASCLA Program Committee have put together another outstanding conference. If you haven’t already registered, I would like to personally invite you to join us in Idaho to attend this unique exceptional event. Let me highlight why you do not want to miss this opportunity. There are few sources within the regulatory profession that share information regarding regulation in general, but NASCLA is the only organization that is specifically focused on contractor regulation. The construction industry has its own very unique constraints that demand very specialized attention. You will not find a program at any other event that concentrates on specific issues within the construction industry. This conference will provide you with the education and resources that you can take back to your state. It is because of this unique program that attendees are Executive Directors and their Staff from regulatory agencies all across the United States. Hence you have a wealth of information sharing opportunities. There are very few problems that you are confronting within your state that have not already been addressed by other states. If there is not an acceptable solution for problems then let’s pull together in typical NASCLA tradition and see what we can do. With all this hard work you might think that there will be no time to relax. But Idaho is a very beautiful state and I’m sure that you (and hopefully your spouse) will enjoy Coeur d’ Alene. The area is rich in mining and historical history to complement the beautiful setting. I look forward to the opportunity to be able to share ALL of this with you. Tucked in the Northwest corner of the country, the Oregon Construction Contractors Board (CCB) serves both the commercial and residential construction industries by licensing construction businesses, as well as some specialty trades.

Oregon Construction Contractor Board (CCB) licensing ensures a measure of contractor accountability by identifying and tracking the 100,000+ individuals operating construction businesses in Oregon, allowing the CCB to hold business owners accountable and provide redress through the contractors’ surety bond, if needed.

construction industry as well.

1971 when it was exclusively servicing residential contractors, the agency’s name was changed to the Construction Contractors Board in 1989 when its scope of operation was expanded to cover the commercial

complaints involving contractor fraud, Unfair Trade Practices (UTPA) laws and other special cases. Dispute Resolutions Services: The agency holds contractors accountable for their business practices by providing mediation to resolve construction disputes involving breach of contract or negligent or improper work complaints. CCB staff also makes possible the recovery of monetary damages by persons harmed by contractors through access to the contractor bonds when a contractor is unable or unwilling to pay damages ordered by the Board.

Over its 42 year history, the agency has adapted to changes sought by its stakeholders, which included new services mandated by the Oregon Legislature.

Education: Oregon’s CCB maintains several education programs for contractors and those with special certifications.

Licensing: CCB licenses contractors in residential and commercial construction. The agency also provides testing and certification for home inspectors and locksmiths, and licensing of lead-based paint activities that involve renovation, inspection, risk assessment and abatement.

Pre-licensure training and testing began in 1999. CCB currently works with 30 approved education providers that trained over 3,000 contractors in 2012. In 2007, Oregon Legislature passed laws requiring continuing education for construction contractors. While some of the required continuing education is provided by approved education providers, the CCB designs, produces and provides online and live education on laws, regulations and business practices. To date, the CCB has provided over 67,000 hours of continuing education.

In 2010, Oregon sought, and was granted, authority to administer the federal EPA’s lead-based paint Renovation, Repair and Painting (RRP) program. The agency partnered with the Oregon Health Authority. Together, both agencies oversee lead-based paint regulations in the State of Oregon. The agency has approximately 39,000 licensed construction businesses, and several additional thousand individual trade licensees.

Field Investigation and Enforcement Section: Promoting and working towards a level playing field for properly licensed contractors benefits both contractors and consumers. The CCB field investigators visit approximately 6,000 jobsites, and handle more than 1,000 complaints of illegal activity each year. On average, the CCB compliance officers issue 1,500 civil penalties and 1,300 administrative warnings each year and suspend, revoke or refuse to issue approximately 700 contractor licenses. The agency’s Special Investigations Unit (SIU) handles 3

NASCLA 2013 Budget Meeting

The NASCLA 2013 Annual Budgeting Meeting was held in Jackson Hole, Wyoming on May 1617 at the Wort Hotel. The NASCLA Executive Committee and Fiscal Policy and Procedures Committee Members were in attendance to review the interim financials for the National Association of State Contractors Licensing Agencies and NASCLA Educational Resources and Publications.

NASCLA Committee Reports Find Out What The Committees Current Projects Are For FY 2012/2013!

NASCLA Accredited Examination Program Committee; Heidi Lincer-Hill, Chair FY 2012/2013 Committee Projects

• The committee is exploring additional accredited examinations and developing a survey for the NASCLA State Members and Non-Members on other potential accredited examinations. The committee will report the results to the NASCLA Board of Directors in FY 2012/2013. • The committee will be updating the NASCLA Accredited Examination Brochure on the Commercial General Building Contractors Examination in FY 2012/2013. • The committee finalized the new test specifications that have been developed based on the new job occupational analysis that was completed on June 28, 2012. • The new job occupational analysis will be used by the approved accredited examination providers starting on April 1, 2013.

Committee Update

The committee held a conference call on April 15, 2013. On the conference call the committee reviewed the accredited examination survey results from the state agencies. The staff will further analyze the survey data from the states and report back to the committee. The committee reviewed the updated NASCLA Accredited Examination Brochure; the brochure will be completed and printed in early May 2013. The committee reviewed the new occupational analysis and testing with PSI. PSI is testing on the new occupational analysis for the NASCLA Accredited Examination for Commercial General Building Contractors.

• The NASCLA Submarketing Committee will be working on a new strategic plan for the accredited examination program. The committee will be reviewing the states that have a trade examination in place and have the commercial general contractor classification. The committee met by conference call in November 2012. They developed a marketing plan and reviewed the states that had the trade examination classification. They will be developing a marketing PowerPoint presentation with voice over for marketing purposes.

The committee has finalized the new marketing strategic plan and state research for the accredited examination program. The marketing PowerPoint presentation with voice over has been completed for state agencies. Currently, targeting 3 new potential states to utilize the NASCLA Accredited Examination for Commercial General Building Contractors. 5

• The NASCLA Education Program Module for State Agencies on Prelicensure, Continuing Education and Remedial Education. Next steps, is to continue working with CETArchive in finalizing the education program and database. • Alabama Heating, Air Conditioning and Refrigeration Contractors Board should be launched by May 2013 as the first state to test the education program. Launch other states in 2013. • Review Standards, FAQ’s, Applications and Applications for Course Providers • Develop a Marketing Plan for NASCLA State Members.

Committee Update

The committee held a conference call on April 11, 2013 to review the NASCLA Education Program status with CETArchive. The committee reviewed and finalized the NASCLA Education Provider /Course Applications, FAQ’s and Standards. The committee discussed launching Alabama which is now scheduled for May 2013.

• NASCLA has received 11 new members for FY 2012/2013. • NASCLA 50th Year New Membership Marketing Campaign, New State Members $50.00 for 2012/2013 Membership Dues, Start Date June 1, 2012 – August 31, 2012, Plan Completed. • NASCLA Membership Plan Promotion for State Members/Local Jurisdictions, new first time state members will have a complimentary membership for the first year only. • NASCLA Membership discount to new first time business, contractor, associate and affiliate members; they will receive a 50% membership discount off the regular membership dues rate. Effective September 1, 2013. • George Whalen, Committee Chair, & Angie Whitaker, NASCLA Executive Director, to send a membership promotional letter to targeted non-member states, completed. • NASCLA Staff to create Membership Promotional Flyer & E-Blast, completed. • NASCLA Membership Committee Conference Call was held on January 11, 2013 to review the membership promotion, recruitment of non-state and state members outreach. • The committee will look into applying special publication discounts for NASCLA Members.

The committee held a physical committee meeting at the NASCLA 2013 Mid Year Meeting in Alexandria, Virginia on Thursday, March 14th. The committee discussed the membership marketing plan and outreach to state members. The committee is promoting the new state membership promotion for FY 2013/2014 that offers 1 year complimentary membership at no cost to the state agencies. NASCLA has received 11 new memberships for FY 2012/2013. 6

The committee held a physical committee meeting at the NASCLA 2013 Mid Year Meeting in Alexandria, Virginia on March 13th and 14th. The committee members worked on the NASCLA Investigative Training Program Module. The committee worked on four different modules (1) Investigative Process: Evidence Collection/Principal of Evidence, Interviewing Techniques, Professional Conduct, Customer Relations Skills, Public Relations, Technology Trends/Security Privacy, Arbitration, Mediation and Negotiation Skills, and Preventing Abuse (2) Report Writing & Testifying (3) Dealing with Unlicensed Contractors: How to Approach the Statue Violator, Criminal Proceedings and How to Conduct a Proper Sting Operation (4) Understanding Construction Standards, Rules & Regulations and Codes: Regulatory Process, Including Administrative Proceedings, Principles of Administrative Law and Overview of Inspections and Inspection Procedures. The committee will be finalizing this program over the summer and will have it ready for the NASCLA Board of Directors at the NASCLA 2013 Annual Conference. The next committee task will be developing laws for the NASCLA Resources Committee Toolkit for Contractor Regulators on Elderly Abuse Prevention and Natural Disasters. The committee held a physical meeting in Pine Mountain, Georgia July 10-11, 2013. They will be ready to discuss at the NASCLA 2013 Annual Conference.

The committee reviewed nominations for the NASCLA Secretary and Treasurer Elect Position for FY 2013/2014. The committee will be held a conference call in June 2013 to finalize the nominations that will be made at the NASCLA 2013 Mid Year Meeting.

• The NASCLA 2013 Mid Year Meeting will be in held in Alexandria, Virginia on March 13-15. 1. Approved the new meeting format for the NASCLA 2013 Mid Year Meeting. 2. Marketing materials sent to NASCLA State Members. 3. Special invitation letters sent to both NASCLA State Members and Non-State Members that are close to the Alexandria, Virginia area. 4. Special invitation letters sent to Trade Association in the Washington D.C. area. They will be attending on March 14th. • The NASCLA 2013 Annual Conference will be held in Coeur d’Alene, Idaho on August 26 – August 29, 2013. 1. The committee has started formulating the program agenda and speaker list via conference call in November 2012 another conference call will be held in February 2013. 2. The committee already identified some potential speakers for the annual conference and staff has been in touch with the appropriate speakers to confirm their availability. • NASCLA 2014 Mid Year Meeting held in Las Vegas, Nevada, February 4-6, 2013 1. NASCLA to be a NAHB Supporting Sponsors during the NASCLA 2014 Mid Year Meeting. NAHB holding International Home Builders & Kitchen and Bath Industry Show in Las Vegas, Nevada February 4-6, 2014. 2. NASCLA Board of Directors approved on date and location on the NASCLA Board of Directors Conference Call scheduled on June 27, 2013. • NASCLA 2014 Annual Conference held in Newport, Rhode Island, August 25-28, 2014 1. NASCLA Board of Directors approved the Hotel Viking in Newport, Rhode Island, as the hotel for the NASCLA 2014 Annual Conference.

The committee held a conference call on Friday, April 12th to review the planning and preparations for the NASCLA 2013 Annual Conference. The committee confirmed the program agenda, speakers and topics for the NASCLA 2013 Annual Conference in Coeur d’Alene, Idaho on August 26th – 29th. They also reviewed the draft copy of the conference meeting guidelines and best practices.

Committee Update

The NASCLA Educational Resources and Publications Brochure has been finalized by the committee members and printed. The committee has been sent the website pricing for the new navigation features and redesign for the NASCLA Bookstore. Continue to target new state and code publications.

NASCLA Residential Committee; Janet Baumberger, Chair FY 2012/2013 Committee Projects

• NASCLA Contractors Disciplinary Database, Market to NASCLA State Members so states can import their contractor revocations and disciplinary actions to the database. The association’s Contractor Disciplinary Database now contains the names of over 21,000 individuals who were listed as principals on revoked contractor licenses. The database can be accessed at https://ned.nascla.org on the internet. The Contractor Disciplinary Database is a very effective and useful tool. Many of the NASCLA State Members use the Contractor Disciplinary Database on a daily basis to pre-screen contractor applicants. The Contractor Disciplinary Database can be accessed on the NASCLA Members Only portion of the website located at https://ned.nascla.org. States can search multiple fields: first/last name, company name or do a general search by state. If an applicant’s name appears in the Contractor Disciplinary Database the state board should contact the state that the applicant’s license was revoked in and verify that the information is valid. 1. The committee to review allowing the database service to be available to all NASCLA Contractor Members; to be included in their membership benefits. These members would not be able to see private information or import data, but could obtain information on contractors for their own use. This topic will be discussed in further detail at the NASCLA 2013 Mid Year Meeting.

During the NASCLA 2013 Mid Year Meeting the committee was tasked with a new project to work with the trade associations on the NASCLA Elderly Abuse Awareness Program and have brochures that all parties pledge to abide by in both the public and private sector. 9

The module will include the following; Consumer Information, Consumer Brochures, Recovery Funds, Strategic Plans, Licensing Applications and Information, Newsletters, Important Forms, Continuing Education and Complaint Filing Information, completed. • NASCLA Staff to prepare a survey for NASCLA State Members to see who is using the NASCLA Toolkit for Contractor Regulators, completed November 5, 2012. • NASCLA Resources Committee to hold Social Media Learning Lab during the NASCLA 2013 Annual Conference

The committee held a physical committee meeting at the NASCLA 2013 Mid Year Meeting in Alexandria, Virginia on Thursday, March 14th. The committee reviewed the Government Affairs/Legislator Partnering Plan for NASCLA State Members that they would like to include in the NASCLA Toolkit for Contractor Regulators. The committee reviewed the research on state member consumer information that will be uploaded to the NASCLA Toolkit for Contractor Regulators. The committee will be looking at social media and including information from states on developing a Business Assistance Program that states can utilize.

Louisiana State Licensing Board for Contractors Revamps Examinations Process BULLETIN: 13-06 June 15, 2013 The Louisiana State Licensing Board for Contractors (LSLBC) achieved major improvements in the assessment process by which contractor licenses are obtained in Louisiana. The LSLBC partnered with Learning Sciences Corporation to develop an assessment engine for enhanced testing convenience, assessment administration and data management. Testing is no longer limited to one location and with the outdated use of pencil and paper. Proctors at various locations throughout Louisiana will administer online exams, and test-takers will obtain assessment results immediately rather than waiting for printed results mailed by the LSLBC. This project also includes enhanced assessment-building and administration. Peter Ranzino, president of Learning Sciences Corporation, explained, “We created an application that gives the LSLBC the ability to create and modify custom and specialized assessment tools for every specialty and trade.” Test-takers soon will be able to choose from 5 different testing locations: the LSLBC office in Baton Rouge, Delgado Community College in New Orleans, Bossier Parish Community College in Bossier City, LSU Alexandria in Alexandria, and SOWELA Technical Community College in Lake Charles. The LSLBC partnered with RegisterBlast to provide online exam registration and scheduling for pre-approved applicants. “The purpose of the LSLBC is to protect the public and the integrity of the construction industry by regulating all contractors who bid on or perform work in Louisiana,” said Michael McDuff, Executive Director of the Louisiana State Licensing Board for Contractors. “Not only does this project expand our reach throughout the contracting community, but it streamlines our operations. NASCLA State Member News New Codes in South Carolina

On July 1, 2013, the following codes will be implemented in South Carolina: 2012 International Residential Code (with modifications) 2012 International Building Code (with modifications) 2012 International Fire Code (with modifications) 2012 International Plumbing Code 2012 International Fuel Gas Code (with modifications) 2012 International Mechanical Code 2011 National Electrical Code (with modification) The 2009 International Energy Conservation Code (IECC) will remain in effect. Also, the following updates that have passed the SC legislative process. 1. The moratorium prohibiting any regulation that would require an automatic residential fire sprinkler system in one or two family dwellings has been extended to July 1, 2015; 2. A moratorium prohibiting the enforcement of Section R501.3of the IRC (Fire protection of floor assemblies) until July 1, 2015; and 3. Notwithstanding Section 402.4.3 of the 2009 IECC, new wood burning fireplaces shall have tight-fitting flue dampers and outdoor combustion air. The actual legislation enacted is: Section 6-9-55. Council to promulgate certain regulations. (A) The council shall promulgate as regulations, in accordance with the procedure and requirements contained in Article 1, Chapter 23, Title 1, any provision of or amendment to any building code that would affect construction requirements for one-family or two-family dwellings. No building code provision that would otherwise become effective after the effective date of this section concerning construction requirements for one-family or two-family dwellings shall be enforced until the effective date of the regulations required to be promulgated by this section. (B) Notwithstanding subsection (A), a regulation mandating the installation of an automatic residential fire sprinkler system in one-family or two-family dwellings shall not become effective at any time before July 1, 2015. (C) Notwithstanding subsection (A), Section 501.3 of the 2012 International Residential Code must not be enforced at any time before July 1, 2015.� Section 6-10-35. Notwithstanding Section 402.4.3 of the 2009 Edition of the International Energy Conservation Code, new wood-burning fireplaces shall have tight-fitting flue dampers and outdoor combustion air.� Effective June 14, 2013 (signed by the Governor.) 12


NASCLA State Member News Joint Board Meetings, A Great Partnering Opportunity

By Margi Grein, NSCB Executive Officer and Chair of the NASCLA Resources Committee As executives of our Boards, it is not uncommon for an issue or circumstance to arise that leaves us questioning the appropriate action to take. While many of us have the options of turning to our counsel or senior staff for advice, I have found over the years that just as much can be gained by reaching out to my counterparts in nearby states. The difference in our operations or contracting laws and regulations should not deter you from picking up the phone and discussing your issue with another director. Many times, others are familiar with the issue and have strategies in place to address it. The benefit of partnering is the ability to share information and ideas with one another; to keep yourself from reinventing the wheel and wasting precious resources. Just as it is important for us as executives to partner with one another, I have found great benefits from connecting my Board members with members from other states. Whether it is the opportunity to have your Board members attend a NASCLA function or participate in other joint efforts, my members have always appreciated sharing their insights with their counterparts, engaging in thoughtful discussions, and hearing of the differences in operations and issues faced by each Board. They see that the matters we deal with in Nevada are not unique, for the most part, from what other states experience. And the most rewarding part of all are the relationships gained. Over the last four years, the Nevada State Contractors Board has partnered with the California State License Board for an annual joint Board meeting. Our goals are simple, but effective. We strive to understand the environment of the industry respective to each of our states. We find commonalities among our industries and address the challenges we encounter relative to the underground economy. And at the end of the day, we leave having identified areas of opportunity to explore together. From these meetings, our states have come together for joint sting operations targeting unlicensed contractors. Our staff members leading the daily operations in our departments have had the ability to meet and exchange ideas with their counterparts, which has improved the efficiency and timeliness of our processes. Each opportunity we afford our Board members and management staff to think outside the box and learn of new and creative ways to handle similar issues, is one more opportunity to make us a better agency. As the Executive Officer, I most appreciate hearing the advice or direction offered by my counterparts in other states. They often help me better understand the issue at hand, address my concerns, and brainstorm the actions that are most appropriate. Together, we are able to communicate openly and problem solve together. Partnering and joint opportunities should not be solely with a goal of establishing face time with one another. These experiences create thoughtful discussions and are meant to push the envelope of thinking and raise innovative questions and ideas.
