The Supreme Court ruled a provision of federal law that requires the deportation of immigrants who have been convicted of some “crimes of violence” is unconstitutional. However, the president of the Kings County Criminal Bar Association (KCCBA) warned attorneys not to ignore other potential unintended consequences when dealing with non-citizen clients. GUEST EDITORIAL No, I Don’t Hate Conservatives. I Disagree With Them By John L. Micek
Not too long ago, an anonymous commenter on one of my columns concluded that I took my stance on a particular issue because I “hate conservatives.” A couple of days later, a progressive friend who wanted to warn me about a hateful tweet aimed at a Muslim lobbying day at the Pennsylvania Capitol, jokingly observed that she tried to keep her feed “a happy bubble of the like-minded” but this one had slipped through. These two incidents speak volumes about where we are as a country these days. We’re deeply entrenched in our own worldviews, taking comfort among those who agree with us, and peering cautiously over the battlements at those who believe differently from ourselves. The schism is years in the making. But it feels more pronounced now in a time where bias confirmation is king, and whole communities of the like-minded (on the left and right) are no further than a click away. An October 2017 Pew poll found fewer Americans, in the time of peak Trump, harbor a mix of conservative and liberal viewpoints than they did during the Bush era in 2004. Overall, not quite a third of Americans (32 percent) now take a roughly equal number of conservative and liberal positions, that’s down from 38 percent in 2015, and off the cliff from the 49 percent who did in 1994 and 2004, Pew pollsters found. “Reflecting growing partisan gaps across most of the individual questions in the scale — even those where both parties have shifted in the same direction,” Pew pollsters concluded. “Republicans and Democrats are now further apart ideologically than at any point in more than two decades.” I’ve written at length about the breakdown in our culture when it comes to agreement on the basic facts that underlie our political debates, and the corrosive effect that social media has on our shared dialogue. 2 • Brooklyn PHOENIX • Friday, April 27, 2018
And now that we know that foreign agents were actively working to inject misinformation into the 2016 campaign, maybe that breakdown is more easily explained. Though it’s no less unsettling. Still, in the five-plus years since I made the jump from being a political beat reporter to an opinion columnist and editorial writer, I’ve been struck by this notion, harbored by some (on the left and right alike) that it’s no longer enough to merely disagree with someone, you have to “hate” them as well. The premise that I hate conservatives is laughable on its face. And though It feels ridiculous to even have to say it loud, I’ll say it anyway: “No, I don’t hate conservatives, I disagree with them.” That’s because hating someone requires you to actually know them. And I have too many friends from across the spectrum for that ever to be the case. Yes, my conservative friends and I disagree on matters of policy. And, yes, we debate those policy points vigorously. But we’re just as likely to kick back on our bar stools and talk about shared interests in film, music, books, baseball and, oh yeah, our children and families. One of the great perks of my job as an opinion page editor is that I get to read — and publish — some of the best opinion journalism from all across the political spectrum. Sometimes, the stances taken by the writers I publish drive me absolutely batty. Sometimes, they make smile or move me. But I always come away having learned something new, my horizons expanded. Yet, here we are, with some of us claiming that we “hate” people we’ve never met simply because we disagree on politics, which, as has been observed time and again, isn’t for the faint of heart.
Disagreements about politics have been with us since Pericles. Still, they can be healthy because the right kind of disagreement results in the kind of compromise that makes for good policy and law. The “my way or the highway” that colors our politics right now isn’t the way forward. The encouraging thing is that potential solution — actual knowledge — lies no further away than the newsstand, your public library, laptop or your mobile phone. All you have to do is reach out for it and make an honest effort to engage in ideas different from your own. It’s no further away than an earnest conversation with someone who disagrees with you. It requires you to actually listen, but the hard work is worth it. It’s always worth it. SCOTUS Ends Automatic Deportations but KCCBA Prez Cautions Attorneys Continued to page 1 “Criminal attorneys have long struggled with the Immigration and Nationality Act’s vague standards of what constitutes an ‘aggravated felony’ or ‘crime of violence’ when advising clients of potential immigration consequences of a particular disposition,” Cibella said. “The Supreme Court’s decision now recognizes this constitutional defect in the Act, giving hope to legal non-citizens previously convicted of potential deportable offenses. “Nevertheless, criminal defense attorneys will still need to heed Padilla v. Kentucky and advise non-citizen clients of the potential of immigration consequences from these offenses until greater clarity is given by Congress in fixing the law,” Cibella
continued. Collateral consequences involving immigrant defendants has been a focal point in Brooklyn thanks to District Attorney Eric Gonzalez. After Gonzalez took over for the late Ken Thompson, one of the first things he did in office was hire two immigration attorneys for the office to advice prosecutors on how to deal with unintended consequences cases involving non-citizens. “If it’s a case where we are looking for a non-custodial plea, the thought of having someone deported because they pled to a misdemeanor is ridiculous,” Gonzalez said in January 2017 when he announced the hiring.

“There are things that we can do in the Brooklyn DA’s Office that will help keep immigrants safe and will be fair and just and proportional to the crimes that they have been alleged to commit and won’t impact them in a disproportionate way,” Gonzalez went on to say. Cibella said that he doesn’t expect the Supreme Court’s decision to make a big impact in the number of deported individuals. Gonzalez and other local elected officials have repeatedly requested U.S. Immigration and Customs Enforcement (ICE) to stay out of Brooklyn’s courthouses, however, the Office of Court Administration maintains that it cannot legally ban government officials from a public building.

addition that livens a long-dead area,” said Gib Veconi of the Prospect Heights Neighborhood Development Council. “When you walk down that street, it’s very dead. This will make Flatbush Avenue much friendlier for pedestrians. I’m delighted.” The entrances will be between Grand Army Plaza and the Prospect Park Zoo, where the park is inaccessible behind an iron fence. They will be the first park entrances to be built since the 1940s.

The western perimeter of the park — in fashionable Park Slope — has multiple access points, plus a low stone wall that is easily traversed. But the eastern edge of the park has long been underutilized because of limited entry points. The plan calls for doubling the width of an existing pedestrian walkway inside the park, installing decorative fencing and adding a row of street
trees, the Brooklyn Phoenix previously reported. The Parks Department approved the new pedestrian entrances after 965 people voted through its Parks Without Borders Initiative, which picks projects by popular demand. “It’s good to see that public money is used for something that so many people were supporting,” said Veconi, who lives five minutes from the proposed improvements.

Yemeni-American bodega owners across Brooklyn shuttered their essential stores for an hour on Tuesday after to protest the Trump administration’s so-called Muslim travel ban. In Bay Ridge, the ban is personal. Shamgah Allahabi, owner of 80th Street Deli on Fifth Avenue, pulled down the gate of his store shortly after 3 p.m. yesterday in solidarity with fellow Yemeni merchants, but also to illustrate his own anguish. His mother, Mahlia Allahabi, 66, fled war-torn Yemen for neighboring Djibouti, but the U.S. will not give her a visa to join her son here. Allahabi said he talks to his mother on the phone, but hasn’t seen her in years. “I feel so sad. I miss her,” he told the Brooklyn Phoenix. The bodega strike took place on the eve of Supreme Court arguments Wednesday in Trump v. Hawaii, which will decide the legality of President Donald Trump’s executive order barring citizens from seven countries: Yemen, Iran, Libya, North Korea, Somalia, Syria and Venezuela. Critics say Trump is unfairly targeting Muslims. The Trump administration has maintained that the
president has the right to set immigration policy. Borough President Eric Adams and Councilmember Justin Brannan (D-Bay Ridge) joined Allahabi and members of the Islamic Society of Bay Ridge, Muslims Giving Back and the Pakistani American Youth Society outside the bodega. There are approximately 4,000 Yemeni-owned stores in New York City, 1,700 of which are in Brooklyn, according to Adams’s office. The Trump travel ban has torn families apart, separating mothers from children, Adams said. “These families are crippled. They’re not just numbers. These are lives,” he said. Brannan recalled the discrimination his grandparents faced when they came to the U.S. as immigrants from Ireland. “A couple of generations pass and we start acting like we own the place,” he said. Immigration advocates said newcomers seeking refugee status are already subject to a strict vetting process. But Trump enacted his travel ban via executive order soon after taking office in 2017, citing national security. The ban was blocked the federal courts, but the Supreme Court allowed part of a rewritten ban to go into effect until a final decision is made.
