The President Should Not Need a Babysitter

I

In the United States of America, a presidential democracy is a form of government in which the executive branch is elected separately from the legislative branch. The chief executive, the president, is elected for a fixed term and cannot be removed except by extraordinary measures. The powers vested in the president are usually balanced against those vested in the legislature.

In the American presidential system, the legislature, consisting of the House of Representatives and the Senate, must debate and pass bills. The president has the power to veto a bill, preventing its adoption. However, the legislature may override the president’s veto if it can muster enough votes. It is important to compare the American system of government to that of other countries. The United States’ formal democratic institutions are considerably different from those of most other democracies. For example, unlike most of these countries, the United States is a federal democracy, meaning that the federal government shares power with the states. And unlike in most other democratic countries, where the chief executive is the leader of the ruling party, the president, as we have mentioned, is elected independently of the House and the Senate.

Americans who have not studied other countries often assume that the United States provided the model for the rest of the world’s democracies. While there is little doubt that the United States and its story have inspired democratic ideals worldwide, most democratic governments have chosen to design their institutions in different ways. The world is watching the United States of America. Let us show the world we have what it takes to get things into perspective. The White House is not operating as a day care center for the Trump family. We should listen to the saying, “once a man, twice a child.” We need someone who is competent, not someone who needs a babysitter to watch over them 24-7 and keeps making excuses (“he’s just a baby, let him have his way”) for the president’s mistakes as if he is a child. If we don’t take the matter into hand, we could be the laughing stock of the world. Let us not have Ringling Brothers Barnum and Bailey retiring to the Oval Office.

GUEST EDITORIAL Don’t Make Passengers Pay for Subway Violence By Michael Shannon

A select group of Bay Area Rapid Transit (BART) passengers discovered what happens when government ignores the “Broken Windows” theory of policing in favor of the “Let It All Hang Out” philosophy. “Broken Windows,” introduced by James Wilson and George Kelling, held that a community starts to deteriorate when political leadership de-emphasizes enforcement of “quality of life” ordinances. Wilson and Kelling used the example of a building with a couple of broken windows. If the windows aren’t repaired, vandals will continue to break windows until there is no glass at all. Failure to repair the first few signals that there won’t be any consequences for breaking more in the future. Deterioration continues until vandals break into the building and destroy the inside, too. The social scientists contended the same thing happens in cities. If law enforcement ignores “quality-of-life” crimes like public urination, drinking in public, littering, graffiti and vandalism, then disorder spreads and escalates. By 1990 William Bratton, chief of New York City’s Transit Police, was tired of supervising the transit equivalent of Subway from Hell so he ordered his troops to crack down on quality of life offenders. Plainclothes cops started arresting fare jumpers, aggressive panhandlers and vandals. Crime plummeted as a result of enhanced enforcement.

For most of us that’s a lot of money, but for some BART board members it was a small price to pay if it kept BART cops from harassing minorities.

A sensible solution would be to let the data determine where to enforce. I think the term for that is science, and the left claims to be the party of science.

BART board member Lateefah Simon — a former fare jumper herself — is convinced there are just as many upperincome seniors jumping fares as there are minority leapers, but BART cops will concentrate their enforcement on “teens, minorities and the homeless.”

The system has cameras in the stations and it can determine which stations are hotspots and at what time incidents occur. This common-sense research might have prevented the taking of the BART train, since it occurred right after a juvenile-heavy event ended.

“We don’t want to create more problems than we solve,” she explained.

There is no indication the board will even try to mine the data. Adopting a “Broken Windows” policy might result in too many minority arrests, so the board is willing to risk a few broken heads.

So, while the board was dithering, a problem created itself. Five days after Simon pooh-poohed a plan for fare enforcement, a mob hijacked a BART train. As reported by SFGate.com, “A mob of 40¬60 young people streamed onto a BART train in Oakland Saturday night, robbing multiple riders of bags and cell phones and injuring at least two people. “Juveniles jumped the fare gates and rushed aboard at least two cars of a Dublin-bound train at Coliseum Station shortly before 9:30 p.m. Some members of the group held doors open, stalling the train, while others ran through cars and some robbed and assaulted passengers.” BART management was contrite: “Before all else, our hearts go out to the passengers who were victims of Saturday’s robbery.”

Quality-of-life laws aren’t designed to inflict discrimination; they’re designed to establish a baseline for public behavior. These laws protect the elderly, the infirm, the young, the female and the wimpy, while restraining the unruly. Once the sympathy was out of the way, BART reverted to practices that put a higher priority on political correctness than keeping the peace. It lied. “Overall, crime has been on the decline, and we want to stress that this robbery is neither reflective of the safety of our system nor of public transportation generally. We strive to provide a safe place for our passengers....”

New York’s subway system became safe enough for politicians to ride.

Only crime isn’t down. Crime is up 22 percent in the first quarter of 2017. In fact, crime is so obvious and out of control that Acting Chief Jeffery Jennings has declared a state of emergency.

In 2017 BART discovered it, too, has a problem with fare jumpers. The San Francisco Chronicle reports “22,000 people a day may be illegally riding BART for free — and depriving the transit system of as much as $25 million a year.”

Sympathy after the fact would not have been necessary if BART management practiced competence before the incident. Ignoring an obvious and expensive problem like rampant fare jumping only encourages the practitioners to push the limits and escalate their law breaking.

New Law Allows Merchants to be Notified of Complaints Continues from page 1 On May 10, the mayor signed legislation sponsored by Councilmember Robert Cornegy Jr. (D-Bedford-Stuyvesant) requiring the New York City Department of Information Technology and Telecommunications to create a notification system that would inform business owners of any complaints lodged against them with city agencies within 72 hours. Business owners will be able to sign up for the notification program voluntarily.

Flatbush Man Gets 2 1/2 Years For Shooting By Paul Frangipane

The bill will make life easier for the city’s merchants, according to Cornegy, chairman of the council’s Committee on Small Business. “Today marks the end of a long road traveled. When I first became chair of the Committee on Small Business, I set a goal to leave the small businesses of our great city in a better place than when I started,” Cornegy said in a statement. While the city does provide a mechanism through which business owners can search for rules and regulations, a database known as the Open Data Portal, the system has not served merchants well, Cornegy said. “Business owners are frustrated with the city’s Open Data Portal. They should not have to spend time searching for complaints against their business. This law solves a 20th century problem with a 21st century solution utilizing technology,” Cornegy said. The original intent of the bill was to help bar and restaurant owners who were hit with noise complaints through the city’s 311 system by informing them of any complaints made against their establishments before they sought renewal of their liquor licenses.

Business leaders praised the new businessfriendly law. “This bill is the bridge Brooklyn business owners need to receive important information quickly and conveniently,” Brooklyn Chamber of Commerce President and CEO Andrew Hoan said in a statement. “When service providers can act upon a complaint or request in a timely manner it benefits their bottom line, as well as the consumer and the rest of the community.” Rotimi Akinnuoye, owner of Bed-Vyne

Brew, said the new law is an important step in protecting business owners. “As a business owner of a couple of bars in Bedford-Stuyvesant, I would like to thank Councilmember Cornegy for being a visionary and providing business owners with muchneeded relief. As a business owner, we really did not have any recourse because anyone with any kind of ill will toward a business could literally just call all day, everyday and that was insane,” Akinnuoye said.

A 25-year-old father of three was sentenced to 2 1/2 years in prison last Monday for shooting six times down Newkirk Avenue at the corner of Newkirk and East 25th Street in Flatbush. Murray Lawrence sat next to four family members, including his mother holding his 1-year-old son, as Judge Jack B. Weinstein sat across from them in Brooklyn’s Federal Court, deciding the term of his sentence. “[This is a] very difficult case,” Weinstein said while looking down at a book of court documents. “The critical question on the table is … whether there can be a reintegration to the family.” The mother of Lawrence’s son dropped the baby off at court 20 minutes before the sentencing and left for a doctor’s appointment. Lawrence’s other two children, 4 and 6, born to another mother, did not attend. “I’m disturbed that the wife isn’t here,” Weinstein said. “The 4-year-old and the 6year-old who are able to show affection are not here. There’s no family.” Lawrence’s attorney, Samuel Jacobson of the Federal Defenders, argued that he had been taking care of his family while out on bail for around 18 months. “I think it’s important, the fact that he spent the 18 months out on bail. [He is] a good father,” Jacobson said, referring to letters by family and community members supporting Lawrence. “I’ve never seen a case with this many letters.” Lawrence, who had previously been convicted of criminal possession of a weapon on Oct. 12, 2012 at Brooklyn Supreme Court, was caught on NYPD video surveillance with another man at 10:03 p.m. on June 12, 2015, pulling guns out of their waistbands and firing down the street. “This is not a case about a 15-year-old who stole a loaf of bread,” Federal Prosecutor Allon Lifshitz said to Weinstein. “He was running wild in the streets. He didn’t care about his children when he was running around trying to murder people.” The surveillance video shows Lawrence shooting six times and hitting the man in front of him in the back four times. Lawrence and the man entered SUNY Downstate Medical Center for the man’s gunshot wounds, three in his left shoulder and one in his left arm. Lawrence was then arrested at the hospital and the man was transferred to Kings County Hospital. Lifshitz argued for the maximum sentence of 10 years in prison. “The most important factor is to protect the community from being murdered,” Lifshitz said. “As soon as he is released, he will do the same thing.” Lawrence said in court that he intends to enroll at Brooklyn College after his release for a degree in business and management.

City Council Candidate Calls for State Review of Lead In Brooklyn Public Schools’ Drinking Water By John Alexander Brooklyn PHOENIX

Ede Fox, who is challenging incumbent Laurie Cumbo for the District 35 City Council seat, has called for a state review of lead in New York City public school drinking water. Fox is a community advocate who lost to Cumbo in the 2013 Democratic Primary. Responding to growing concern from parents over these elevated lead levels, including one central Brooklyn school with recent test results exceeding those in Flint, Michigan, Fox has launched a petition calling on the New York State Department of Environmental Conservation to intervene and conduct an investigation into the crisis. Fox believes that the city agencies have downplayed the hazards posed to area students. On March 2, the Brooklyn PHOENIX featured a detailed examination of this issue, and about Brooklyn Borough President Eric Adams joining other borough presidents in addressing a letter to NYC Schools Chancellor Carmen Fariña, urging the Department of Education to take action on this matter. The article listed borough schools that were found to have elevated levels of lead in one or more of their fixtures including P.S. 8 in Brooklyn Heights, P.S. 29 in Cobble Hill, Automotive High School in Bedford Stuyvesant, P.S. 372 The Children’s School in Carroll Gardens, George Westinghouse High School in Downtown Brooklyn, Brooklyn Latin School in Williamsburg and Brooklyn Tech High School in Fort Greene. Additionally, I.S. 259 McKinley High School in Dyker Heights and P.S. 289 in Crown Heights have been found to have a excessive levels of lead in their drinking water. “Lead contamination poses too great a risk to our children to wait and see if they were affected by this recent exposure in city schools,” said Fox. “It’s time the state step in and conduct a thorough investigation of this growing crisis and prevent the kind of irreversible harm children in Flint and other cities have faced. This will help put parents’ minds at ease and ensure the health and safety of our single greatest resource — our children.” Fox’s request comes amid growing concern after testing conducted between December and February showed as many as one in 20 taps in city elementary schools with elevated lead levels. This includes a classroom at P.S. 289 George V. Brower that showed lead levels reaching as high

as 15,000 parts per billion, more than 1,000 times the amount permitted by federal regulators and more than levels found during the recent crisis in Flint, Michigan.

“I am outraged that the city would allow our children at P.S. 289 to drink water with lead levels thousands of times greater than permitted,” said Fox. “As we saw in Flint, this is a crisis that has disproportionately affected communities of color. A whole generation of kids in that community will not live up to their fullest capacity because of the impact of lead in their bodies. “We don’t yet know how many Brooklyn children were exposed to lead and for how long, but it’s unconscionable that there are kids who were put at risk because no one thought their school was good enough to be concerned about their water supply. It’s time the city value their health and safety as much as we here in the community do,” added Fox. District 35 includes Fort Greene, Clinton Hill, Prospect Heights and parts of Crown Heights and Bedford-Stuyvesant. Also running for the City Council seat are Democrat Greg Schwartz and Green Party candidate Jabari Brisport.

African Dance Master Choreographer Chuck Davis Dies at Age 80

Burch said. “He just wanted to make sure everybody felt that joy and that energy and that love.” A wake is scheduled for June 2 at Fisher Memorial United Holy Church of America in Durham, Burch said. A funeral is planned for June 3, although the location hasn’t been finalized, he said.

Davis died Sunday at his home in Durham, said Dr. B. Angeloe Burch Sr., executive director of the African American Dance Ensemble, which Davis founded. Davis had been diagnosed with cancer about two years ago and had been treated, Burch said. He said the cause of death wasn’t known. Davis founded the African American Dance Ensemble in 1983 and was founder and director of Dance Africa, which is celebrating its 40th anniversary this month at the Brooklyn Academy of Music. He also founded the Chuck Davis Dance Company in New York in 1968. Burch and Davis had planned to attend Dance Africa, called BAM, later this month, Burch said, adding that his death, in that sense, was sudden. “He was still choreographing ... and he was looking forward to going to BAM,” Burch said. Burch said he was still a boy when he met Davis, who was known as “Baba Chuck.” “He was larger than life in everything he did, in the love he gave us,” Burch said. “So many of us, I don’t know what direction our lives would have taken had it not been for Chuck Davis.” Performing and bringing joy to people were more important to him than his health, Burch said. “I have seen this man perform in excruciating pain, then get to his dressing room, and he would just sit there,”

Kings Beer Hall to Host Evening Of Beer and Food Pairing May 22

Beer and food pairing is an art, and the Kings Beer Hall (KBH) has mastered it. The expoerts there have found the secret to matching any meal with just the right beer that will best enhance your dining experience. On Monday, May 22, KBH will host an evening of beer and food pairing. “This dinner is about introducing Brooklyn foodies to our brand new menu,” said bar manager and “Beer Maestro” Kenneth Jimenez. “We’ve expanded our selection and have added awesome new items like our beef on weck (roast beef dipped in au jus with horseradish served on a salted caraway seed bun) and the chicken and waffle tenders served with a spicy maple dip. We want to show off our new menu alongside our expansive draft beer selection.” “The perfect beer for a main course depends on the course you’re having,” he added. “Easily, as with wine, red or darker cuts of meat go with darker beers — a porter with steak or a white with fish — which can become far more complex depending on the preparation of the dinner. Even the preparation of the dinner will alter one’s choice for its finest pairing, as a coffee stout will suit a dinner with mole sauce, or an IPA with citra hops instead of mosaic hops for fish and chips.” Jimenez has been at KBH for a year and a half and admits that he has not seen an establishment grow as fast as this one. This will be the hall’s first food and beer pairing event, and KBH hopes to soon be introducing regular tasting nights at the beer hall. Jimenez offered some specific examples of some foods he would pair with a particular kind of beer: Continued on page 4INB

There are indeed breakfast, coffee and espresso stouts, best served room temperature or slightly chilled and sipped over the course of a full breakfast. These tend to have rather high ABV, but with the inclusion of coffee roasts, it does tame it a bit of the booziness. Nonetheless, [it is] a wonderful way to start a very comfortable Sunday to stay in.” As for lunch, Jimenez said he would “highly recommend seeking a sessionable beer (usually labeled ‘Session’) for its

low-ABV, but still very flavorful.” Session ales [go well] with a salad, he explained, while session pale ales and IPAs pair nicely with heartier lunches such as sandwiches or a burger. After dinner becomes interesting, according to Jimenez, because of the many available choices in dessert beers. “They aren’t very well recognized to the palate of most beer drinkers, with strong flavors of chocolate, caramel, vanilla, sometimes peanut butter or tiramisu. [They are] the type of beer to enjoy over an extended period of time and as a nightcap.” You can rest assured that the “Beer Maestro” has something memorable planned KBH’s first food and beer pairing event. So mark your calendar for Monday, May 22 at 7 p.m., when for just $40, you can enjoy the finest food matched with the perfect beer.

Nifty Buildings Near the Sunset Park Ferry Dock

This Brooklyn Army Terminal building is one of many eye-catching industrial properties near the new Sunset Park ferry dock. By Lore Croghan INBrooklyn

People with jobs at the Brooklyn Army Terminal know their way around this terrain. For the rest of us, it’s uncharted territory. We know Sunset Park’s landmark-worthy brownstone blocks well, and we go to Industry City to shop for Li-Lac Chocolates. Even so, we were unfamiliar with the streets near the new Sunset Park ferry dock until we walked around the area the other day. We saw lots of interesting buildings. Here are some of them:

• The Brooklyn Army Terminal is a 55-acre industrial complex at First Avenue and 58th Street. It was designed by Cass Gilbert, the Woolworth Building’s architect. BAT is operated by the EDC (namely the New York City Economic Development Corporation). Twice a month, public tours are offered. • From Pier 4, where the Sunset Park ferry dock is located, you can see a former industrial building with a whale’s tail painted on it. This is the Brooklyn Whale Building, whose address is 14 53rd St. Hunt Slonem, one of the coolest artists on the planet, has a studio in the building. He keeps 30 to 100 birds of various species — including parrots — in an aviary in his studio, and often paints with a bird or two perched on his shoulder. Capital, bought the property for $82.5 million in 2015, city Finance Department records indicate. • Lutheran Halal Café is in a classic red-brick building with horizontal bands of yellow brick and a green cornice. The concept behind the café is not a melding of religions. Zabihah.com, a guide to Halal restaurants and markets, says a hospital located nearby inspired the inclusion of the word “Lutheran” in the café’s name. The eye-catching residential building where the restaurant is located, 5121 Second Ave., has belonged for the past two decades to Spencer Operating Corp., whose secretary is Bukurije Marke, Finance Department records indicate. • The hospital that inspired Lutheran Halal Café’s name is NYU Lutheran Medical Center at 150 55th St. It takes up an entire block between 55th and 56th streets and First and Second avenues.

Make Like a Tourist on the Sunset Park Ferry to Wall Street Continued from page 7INB Seen from the vantage point of the ferry deck, the island appears to have skyscrapers sprouting out of it, though of course they’re really in Lower Manhattan. Then, back on the Brooklyn shoreline, there’s 360 Furman St., which formerly belonged to the Jehovah’s Witnesses and is now the condo building known as One Brooklyn Bridge Park. Next, there’s the skyline of Brooklyn Heights — a mix of low-rise brownstones and taller apartment houses — with Downtown Brooklyn high-rises in the background and Brooklyn

Bridge Park along the water’s edge. Right before the ferry docks at Wall Street’s Pier 11, we get a good look at the Pierhouse condo complex and the Brooklyn Bridge. Behind Pierhouse, just a snippet of the former headquarters of the Jehovah’s Witnesses is visible. The complex with the red neon “Watchtower” sign on it now belongs to the company that Jared Kushner headed until he stepped aside to be senior adviser to his father-in-law, President Trump. The Brooklyn Bridge, and the Manhattan Bridge behind it, both look pretty great from the deck of the ferry.

Such a ferry fine shoreline. The new Sunset Park ferry allows us to see beloved Bay Ridge from the waters of New York Harbor. We know that the principal purpose of the recently inaugurated Rockaway-Sunset Park-Wall Street route is to serve commuters. See related story on page 7. But for real-estate nerds, it’s great fun to ride the ferry and look at buildings and other scenery, just like the tourists do. Moments after the boat leaves Sunset Park’s Pier 4, we see the leafy greenery of Owl’s Head Park and then the 69th Street Pier — where Bay Ridge’s NYC Ferry dock is being constructed. Service is scheduled to start there this summer. Shore Road’s fine houses and Fort Hamilton High School, with its distinctive tower and columns, draw the eye. Though we’ve taken lots of pictures of the Verrazano-Narrows Bridge, it’s a new experience to photograph it from a boat. After sailing along the shoreline of Bath Beach, suddenly we can see the beachfront homes in Sea Gate, the private community on the western end of Coney Island. Then we see amusementpark rides including the iconic Parachute Jump and Wonder Wheel, with sober-looking Coney Island apartment buildings serving as a backdrop. We spot the distinctive architecture of the Kingsborough Community College building at the tip of Manhattan Beach. Later, we sail beneath the Marine Parkway-Gil Hodges Memorial Bridge, which connects Brooklyn’s Floyd Bennett Field and the Rockaways’ Jacob Riis Park. The Rockaway ferry dock is at Beach 108th Street and Beach Channel Drive.

Truman Capote’s Brooklyn: The Lost Photographs of David Attie In the spring of 1958, a young photographer named David Attie was led through the streets of Brooklyn Heights and to the Brooklyn waterfront by an unexpected guide: 33-year-old Truman Capote. The images Attie took that day were to illustrate Capote’s essay for Holiday magazine about his life in Brooklyn. Decades later, these largely unseen photographs are being exhibited for the first time.
