Attacking Obamacare Won’t Solve Health Care Problems

W

hen a sitting president keeps telling the nation he will let Obamacare die, you know he has no good intentions, especially when he is adamant in undoing all of former President Obama’s legacy and signature legislation.

In general, the president is actually saying “drop dead” to people who need health care. Health care is expensive, no matter who is benefiting, so what lawmakers should do is work to remedy those parts of the program that are failing. Is President Trump going to blackmail Republicans into voting for a health plan that will hurt Americans in the long run? When the government starts talking about cutting money from health care, it is the worst possible action to take. Instead, it should take a serious look at what is lacking in the current health plan and what changes should be made. What are the factors that are driving the need for changes? How is health care going to help every American

and not just some Americans? How can we make changes that lower costs and improve care? Is the government looking at the rising cost of medication? Is the government looking to find those areas where people are being ripped off by fly-by-night companies? Insurance companies are pulling the plug on Obamacare as the Trump administration is promising the American people better health care, but the Republicans in seven years cannot prove they have something better than Obamacare. Everyone hopes for the best healthcare system, one that every deserving American can benefit from. So far, nothing coming from the Republicans is proving to give the American people what they are seeking. So instead of insurance companies helping to fix the problem, they are rushing to abandon the present Affordable Care Act to save as much money as they can. When politicians stop the infighting and the competition and start working for the people who help get them elected, maybe the government will achieve more.

Obamacare is working for most people, but when the president says let it die, it’s like telling the people of the United States of America that if you can’t afford health insurance, the Republican Party will not work in a bipartisan way to help fix the problems with Obamacare. President Trump is also saying to the people who are benefiting from Obamacare, “Sorry, we can’t help you.”

Can they find the right structure and individual plans to help those Americans who need proper health care? There’s a lot the current administration has to do to establish the American people’s trust. Countries that have better health care took years to work on their own systems before they were able to develop a plan that people thought was working for them. Democracy works when people starts by getting rid of their selfishness and work for the betterment of everyone

Also, it is also important for the government to look into reducing negligence costs and workplace accidents by having surprise checks at companies to make sure they are following the rules for a safer environment and proper working conditions.

They come to our neighborhoods in a van, or other times in cars. They spread out across the blocks and, one by one, they knock on doors. Or they call. And call. And call. They knock on our door and call when we are eating or sleeping, or trying to spend time with our family. They are called retail Energy Service Companies (ESCOs), and they make their money by getting people — and in some instances tricking consumers — to switch their energy service provider. The ESCO sales pitch varies, but it usually contains a promise to save you money on your energy bills. Sometimes they say they are from the “energy company,” or even pretend to be from your local utility, which is not true. Sometimes they say a new law requires you to get electric or gas service from them, which is also not true. Sometimes they say a recent law has given you competition and choice, and if you will just show them your bills, they will tell you how to save money. You show them your bills, only to find out later that they switched your account to their company — without asking.

The knocking on your door, the calls from anonymous phone numbers, the untruths told to get your business and the broken promises to save you money are the characteristics of ESCOs. Additionally, based on an analysis of thousands of complaints obtained from the state regulator, the Public Service Commission (PSC), by the Public Utility Law Project of New York (PULP), it appears that ESCOs also focus these high-pressure and often deceptive sales tactics in zip codes containing large numbers of low and fixed-income households, the disabled, seniors and customers with English fluency challenges. According to the PSC’s most recent numbers, hundreds of thousands of low-income households across upstate and downstate New York are under siege and being overcharged by these ESCOs. In New York City, PULP found that in 2015-2016 more than 90 percent of ESCO customers paid more for service than if they had not been hoodwinked into leaving — or transferred against their will — (i.e., “slammed”) from their usual utility service. PULP also found that between 2012 and 2014, 64 percent of the complaints in New York City cited overcharging, 32 percent concerned “slamming” and an additional 31 percent contained allegations of fraud. In February 2016, the PSC and Gov. Andrew Cuomo took strong steps to reform the ESCO market by requiring them to actually save retail and small commercial consumers money on their bills — and to put that promise in writing or be barred from serving those customers. Instead of keeping their industry’s promises, however, the ESCOs sued to block the PSC’s reforms, claiming that their industry would suffer irreparable harm by actually having to deliver on their claims, and that the possible harm to their industry outweighed the real harm being inflicted by ESCOs. On June 30 of this year, after 18 months of ESCOs fighting in court rather than cease charging excessive prices, Justice Henry Zwack of New York State Supreme Court delivered a strong decision protecting consumers, and stated that “the ESCO market is in need of reform to protect low-income consumers …” We believe the ESCOs will appeal this decision, and that they will claim they offer competition and choice. Somehow, in the avaricious world of the ESCOs, choice is more valuable than affordability. Further, they seem to believe that loyalty points and gift cards are added value for consumers sufficient to justify overcharging them. The reality, as pointed out by the PSC is that the ESCO market cannot function competitively. As such, their lowincome customers are more likely to have their electric and/or gas service terminated because of unaffordable energy costs like theirs. And once a household’s credit is ruined by such terminations, it is harder in the future to pursue any of the many things that require spotless credit. Until the PSC and governor finish the job of comprehensively regulating ESCOs and protecting consumers, as a state legislator, and as a consumer advocate, we advocate that low- and fixed-income New Yorkers avoid taking energy service from ESCOs. It is time for the ESCOs’ deceptive tactics and anonymous harassment calls in low- and fixed-income neighborhoods in New York City and across our state to stop.

In June, federal law enforcement ripped him away from his wife and two kids for living undocumented in the U.S. Acting Brooklyn District Attorney Eric Gonzalez and New York Attorney General Eric Schneiderman demanded Thursday that U.S. Immigration and Customs Enforcement (ICE) stay out of New York courts and stop arresting immigrants like Hurtado. “The federal authorities claim they are

making America safe again, but the truth is that their immigration enforcement policies are making all of us less safe,” Gonzalez said in a statement. There have been about 60 arrests or attempted arrests in New York courts this year, with at least eight arrests in Brooklyn, according to a survey by the Immigrant Defense Project. There were 11 court arrests statewide in all of 2016. Gonzalez and Schneiderman said these raids instill fear in immigrants to not come forward as witnesses and victims of crimes. “We must not allow a large number of our residents to live in the shadows and stop

cooperating with law enforcement,” Gonzalez said at a press conference. Attorney Lee Wang of the Immigrant Defense Project said ICE almost always comes into courts with two to four agents in street clothes, often without visible badges. “They are really operating as rogue operators in the courts,” Wang said. Wang added that she doesn’t know how ICE has been able to track immigrants in family courts. Two of the 60 arrests or attempts occurred in family courts, according to Wang. “We are committed … to using every tool in our legal and constitutional toolbox to protect from overreach, bad public poli-

cies or backsliding from Washington,” Schneiderman said. Alongside immigration activists, Gonzalez and Schneiderman advocated that ICE consider courts “sensitive locations,” such as sanctuary spots like schools, hospitals and places of worship. “When you attack our courthouses and you undermine them, you are weakening a central pillar of our community,” said Steven Choi, executive director of the New York Immigration Coalition. President Donald Trump attempted to defund sanctuary cities, but San Francisco Judge William Orrick ruled against the order on April 25 on a temporary basis.

Clarke and Hakeem Jeffries all stood beside Gonzalez at a press conference in DUMBO on Wednesday and cited his resistance to President Donald Trump and his administration as one of the biggest reasons for supporting him. “At a time when people across the political spectrum recognize the need for criminal justice reform, Donald Trump’s Attorney General Jeff Sessions wants more mandatory minimums and more policies that unfairly target low-income people and people of color,” said Velázquez. “The Trump administration has created a climate of fear in immigration communities around the country and here in New York,” Velázquez continued. “People are afraid of an old warrant coming back to haunt them and putting them at risk of deportation.” Gonzalez first spoke out against Sessions in an editorial he published in May on cityandstateny.com that claimed the success his office has seen proves Session’ policies wrong. The members of Congress also pointed to his work with immigrants and drug addicts, as well as his continued efforts with the gun buyback program and the recent dismissal of approximately 143,000 old summonses in Brooklyn as proof that he will stand with them against Trump.

“[Gonzalez] is pushing back against the Trump agenda by treating drug use as a health issue rather than a criminal justice issue,” Nadler said. “Eric is providing drug addicts with the treatment they need to provide addicts with the help they need.” Gonzalez has hired immigration attorneys to advise assistant district attorneys on how to handle cases to avoid collateral charges for immigrants that could lead to deportation. He has also spoken about the need to keep U.S. Immigration and Customs Enforcement (ICE) officers from interfering with the local justice system (see above story). Jeffries also pointed to the fact that Gonzalez’s Conviction Review Unit, which was started with his help under late DA Ken Thompson, has become a national model. “All of the candidates are claiming to stand upon the legacy of Ken Thompson, but only one took Ken Thompson’s vision of a conviction integrity unit and implemented it so that it became the most successful in modern prosecutorial history in the USA,” Jeffries said. Each of the representatives said that they wouldn’t second-guess Gonzalez’s decisions on individual cases when it came to holding prosecutors accountable or even when Thompson recommended no jail time for Police Officer Peter Liang, who was convicted of killing Akai Gurley.

Eagle photo by Rob Abruzzese “Some of those individuals responsible for some of these wrongful convictions have long left the DA’s Office, long left the police force and the statute of limitation has long expired,” Jeffries said when he was asked if he was satisfied that Gonzalez had appropriately sought to hold former ADAs accountable for wrongful convictions. “The fact that people are attempting to use this as some sort of political weapon is disingenuous when you look at the law and the facts.” Jeffries admitted that the law does need to be changed to better hold prosecutors accountable for wrongful convictions.

Gonzalez said that what made him most proud of the endorsement of the four Democratic U.S. representatives was the fact that they had previously backed his predecessor, Thompson. “They do so much fighting for us in Washington, D.C. against Trump’s agenda because they understand that mass deportations and this call back to the old ‘tough-on-crime’ days that led to mass incarceration is wrongheaded and they need to stand for us,” Gonzalez said. “You can treat people with respect, fairness and dignity in the criminal justice system and still be an effective prosecutor’s office.”

Jane’s Carousel Plays Host to its 1,000th Birthday Party Nearly a Century Old, Jane Walentas’ Labor of Love Continues to Bring Joy to Families By Andy Katz Special to Brooklyn Eagle

Jane’s Carousel played host to its 1,000th birthday party on July 23. Opening in 2011, the landmark of the revamped park celebrated the feat in just over half a decade. This day’s guest of honor, Maxim Jafri, was the epitome of dapper in his white oxford shirt with a Winnie the Pooh emblem and three-quarter camo fatigue trousers. His fine black hair was parted neatly on the left, and his dark brown eyes missed nothing as he watched mom, Samantha Wolner; dad, Rab Jafri; and grandmother, Farah Jafri hustle about the balloon-decorated picnic tables shoring up last-minute preparations for what would soon be the debonair toddler’s 1st birthday party. “We wanted his 1st to be someplace special, someplace historic,” Wolner explained as she tacked up the last of the balloons. “We’d never been here before.” Built by the Philadelphia Toboggan Company in 1922, the carousel’s 48 wooden horses — handcarved by artists John Zoller and Frank Carretta — first called the Idora Amusement Park in Youngstown, Ohio home. In 1975, the carousel became the first of its kind to be listed in the National Register of Historic Places. Less than a decade later, Idora set to auction off the carousel’s key features — horses, chariots and a Wurlitzer Band Organ — when Jane and David Walentas purchased it complete for $385,000, bringing it to Brooklyn for restoration. Jane’s Carousel workers Katie Bell, Hannah Winkler and Helena Smith were busy during the party. As 11 a.m. approached, the carousel’s usual opening time, a line had already formed. Last-minute checks were made. A few of the waiting riders were teens with smartphones at the ready for the inevitable selfies they’d made while in motion, but the majority were parents with small children. “We come here pretty much every weekend,” Evan Reynolds explained once the ride began. Reynolds kept his hands at the ready to help his 3-year-old daughter Mavis

Operated by the nonprofit Friends of Jane’s Carousel, riders pay $2, which goes entirely to maintenance and operation. “Most of the birthday parties we do are for children,” Winkler explained, “but not all. The eldest I can remember right now was a man celebrating his 73rd.” David Walentas, a co-founder of Two Trees Management, and

his wife Jane, former art director for Estee Lauder, painstakingly restored the carousel, with Jane herself doing much of the intricate, maddeningly precise work. One of the original forces behind the postindustrial revitalization of DUMBO, the Walentas’ vision put the carousel at the edge of Brooklyn Bridge Park, protected and enhanced by a Plexiglas “jewel box” enclosure designed by French architect Jean Nouvel. Although the path to its current spot nestled between the Brooklyn and Manhattan Bridges wasn’t altogether a smooth one — Walentas had to overcome resistance from the Brooklyn Heights Association over the carousel’s precise location — by September 2011, it was open to the public. After besting the formidable Brooklyn Heights Association, Jane’s Carousel next faced the wrath of nature. Barely a year after opening, the carousel found itself a victim of Superstorm Sandy, its enclosure damaged by a rising East River. With all of Maxim’s guests finally arrived, it was time to take on the gaily colored wooden team of painted ponies. With help from mom and paternal grandmother Rose Chin, Max made his first go ’round balanced on a stationary horse. Family members, wearing pink entry bracelets supplied by carousel staff, cheered him on. By the time the music faded and the carousel stopped turning, the birthday boy was ready to tackle one of the “big boy” steeds, a jumper, which he rode with the calm and panache of one far-advanced in years. His first carousel ride a rousing success, Max returned to the picnic area where cake and presents awaited the young man who shared the milestone of a venerable amusement park ride designed to bring joy to children of all ages with a very special one of his own.

The old-timers remember this was an urbanrenewal site. Boy, are those days over. The wedge-shaped lot on Flatbush Avenue, Ashland Place and Lafayette Avenue is now graced with a gleaming mixed-use building designed by high-profile architect Enrique Norten. It cost $170 million to develop. The new building at 300 Ashland Place belongs to Two Trees Management. The Walentas family’s real-estate firm was selected by the city several years ago to develop the property, which was an urban-renewal site that was being used as a parking lot. Two Trees Management’s site is across the street from both the Brooklyn Academy of Music’s iconic Peter Jay Sharp Building and the Mark Morris Dance Center. Readers with good memories will recall that in earlier phases of its construction, the new building was referred to as 286 Ashland Place. Construction continues on spaces for cultural institutions and retailers at 300 Ashland, an eye-catching 35-story building with an aluminum composite facade that flashes in the sunlight. It has 379 rental apartments, 76 of them affordable-housing units that were made available to low-income residents by a lottery and the rest market-rate units. Tenants have been selected for the affordable units, David Lombino, Two Trees

Management’s managing director of external affairs, told Eye on Real Estate. More than 70 percent of the market-rate apartments have been rented, he said. When we checked 300 Ashland’s website recently, available apartments included a studio with a $2,525-per-month net effective rent and a two-bedroom, two-bathroom apartment with a $5,229-per-month net effective rent.

The Williamsburgh Savings Bank Is ThisClose to the Roof Terrace By the way, cultural institutions and retailers will share the building’s first nine floors. The apartments are located on the building’s top floors. The cultural tenants include four BAM Cinema theaters, a 651 ARTS dance and performance studio, the Museum of Contemporary African Diasporan Arts (MoCADA) and a Brooklyn Public Library branch. The spaces the cultural institutions occupy will belong to the city. One retailer that’s moving to 300 Ashland is 365 by Whole Foods Market, a gourmet grocery store with a smaller product lineup than traditional-format Whole Foods Markets. Also, it has been widely reported that Apple is opening a store at 300 Ashland. We’ve been watching construction progress at the property since February 2014, when workers with heavy machinery started tearing up the pavement of the parking lot that had

We also got an eyeful of Downtown Brooklyn’s new towers, the Red Hook shoreline and the waters beyond it and the Verrazano-Narrows Bridge. Betcha that number will be higher by the time you read this story. “It’s going very well,” Zoe Elghanayan, a company principal and vice president, told Eye on Real Estate during a visit we made recently to 33 Bond St. She said a satellite office the development firm opened at 442 Atlantic Ave. has been helpful in marketing the apartments. That office has gotten a lot of walk-ins. Hosting broker breakfasts has been helpful too, she said. The Manhattan-based residential and office landlord, which was founded by brothers Tom and Fred Elghanayan, has recently developed a number of apartment buildings on the Long Island City, Queens waterfront.

Just three years ago, the site was a parking garage — a huge, hulking parking garage with retail spaces filled with tenants including IHOP. TF Cornerstone purchased the garage, whose address was 276-300 Livingston St., for $70 million in 2013, city Finance Department records indicate. Handel Architects was the designer of 33 Bond. There are a total of 714 apartments in the 25floor building, 180 of them affordablehousing units and the rest market-rate apartments. Initially, 20 percent of the building’s apartments — 143 of them — were affordable. A lottery has already been held to select tenants for them. Now 33 Bond has opted into the recently revived 421-a housing program, requiring a 5 percent increase in affordable units. A second lottery will be held to accommodate the additional 37 affordable apartments.

We’ve been watching the progress of construction at 33 Bond since the parking garage was demolished. It was quite an experience to step inside the nearly finished building. We saw spacious model apartments with floor-to-ceiling windows that maximize light and views. On 33 Bond’s 16th floor, where a setback in the building creates big terraces, the views are really something. Continued on page 5

Continued from page 4 One of the niftiest sights is the dome of the iconic Dime Savings Bank, a city-designated landmark at 9 DeKalb Ave. City Point and other recently constructed Downtown Brooklyn residential towers are nearby. In other directions, we saw the Red Hook shoreline and the landmarked Williamsburgh Savings Bank tower. Construction continues on 33 Bond’s outdoor amenities, which are located on the building’s second floor. They will include barbecue grills and a putting green. Elghanayan mentioned an unusual amenity

foot gym, which is expected to open in spring 2018, that will be built by high-profile Manhattan sports facility Chelsea Piers.

And this fall, a coffee roaster from Colombia called Devocion will be moving into retail space at 33 Bond.

Green-Wood Cemetery Hosts Unique Tisha B’Av Lamentations Service By Francesca Norsen Tate Brooklyn Eagle

Green-Wood Cemetery hosted a new event on Monday — Lament at Green-Wood — to commemorate one of the most solemn days on the Hebrew calendar. Lament at Green-Wood commemorated The Ninth of Av (Tisha b’Av), in partnership with Because Jewish, an organization that curates emotional, intellectual and spiritual explorations of God, faith and Judaism in the modern world. Tisha b’Av marks the destruction of both Temples in Jerusalem and the loss of an ancient and sacred civilization. A stunning and historic site, Green-Wood’s grounds provided participants with a unique entry into the meaning of this holy day and the sacredness of life. Tisha B’Av is traditionally a day of fasting and reciting the Book of Lamentations. Lament at Green-Wood featured traditional and contemporary meditations on mourning, remembrance and hope.

Describing himself as a revivalist, Rabbi Dan Ain of Because Jewish explained that his goal was to “reach out to people through art, music and meaningful conversation and venues that speak to the community. We create vibrant events and experiences for people who want to come together and commune and reimagine and reinterpret what the Jewish holidays mean for us.” Ain led the service, with music contributions by Jeremiah Lockwood and Shoko Nagai. Yael Shy led a meditation and Green-Wood’s Death Educator Amy Cunningham read selected poetry. Green-Wood’s Harry Weil led a walk through a portion of the historic grounds where Leonard Bernstein, Charles Ebbets and Jean-Michel Basquiat are buried. Ain told the Brooklyn Eagle last week that the event would begin at the landmark entrance to Green-Wood Cemetery on Fifth Avenue and 25th Street at 7 p.m., with the tolling of a bell. The group was then to walk up to the ceme-

tery chapel. The guided meditation focused on the “concept of walls falling in society and walls falling in our own lives, how to begin to accept those losses and move on.” Ain said, “I get the sense that a lot of society and culture is in this sense of being stuck. People are looking backward, people are saying, ‘What if?’ The idea that there is hope on the horizon is a harder concept for people to grasp this year than in recent years. By creating a space to observe this holiday, we are going to acknowledge all the obstacles and try to begin to understand the role that loss has in our lives.” Ain said that the staff at Green-Wood “opened the doors to us” and have been immensely helpful in the planning. 2017 Building Brooklyn Awards Celebrated Brooklyn Chamber of Commerce Looks Confidently to Continue Year’s Progress with Federal Planning Grant By Andy Katz

“We’re trying to accomplish something,” said Katepalli Sreenivasan, Dean of the NYU Tandon School of Engineering upon accepting his honor. “That’s the spirit of the Brooklyn Chamber of Commerce, and that’s the spirit of Brooklyn. I’m very happy to be part of it. I know Brooklyn hasn’t always been like this. The people who made this transformation possible worked very hard for it and made their vision come true.” “It really wasn’t that many years ago that Brooklyn had a much different feel to it,” said Chamber of Commerce Board member Peter Meyer while introducing honoree, Timothy King. “A second class mentality. And many people accepted that.” “Let’s talk about great art,” honoree Timothy King, Managing Partner, CPEX Real Estate, told the audience. “The people behind the projects being honored tonight might not pick up a chisel or a paintbrush. Their canvas is the mean streets of Brooklyn, and the masterpieces they bring out are every bit as enduring and beautiful as

those which hang in museums.” “We now need to focus on sustainability,” said Brooklyn Board of Commerce Chair, Denise Arbesu. “Our mission is to help businesses create jobs and make Brooklyn a better place to live, play and do business.” Announcing the procurement of a $100,000 federal grant compliments of Brooklyn’s Congressional delegation, Chamber President Andrew Hoan said, “Starting tomorrow the Chamber will begin consultations with elected officials, thought leaders, economic development corporations, hospitals, community boards, real estate developers to plan the economic future of Brooklyn … We’ll be calling on everyone in this room for their input.” Given the number and variety of projects that were also honored that evening, plaques were distributed to each project’s principals prior to the start of the program. The audience watched a short film depicting each one of the worthwhile projects, highlighting aspects that made each one special. After the viewing the audience retired for food and drinks and socializing. With the scope of successful achievements on display, it was impossible to miss the sense of pride and accomplishment that filled 1 Hotel Brooklyn Bridge Park that evening. The power of Brooklyn’s motto: “Unity Brings Strength,” was never more in evidence. Meanwhile, just outside the hotel, parked conspicuously under an awning on Furman Street, a gleaming race car awaited the moment it would compete in New York City’s first ever Formula E road race — to be held, of course, in Brooklyn.

The Brooklyn Chamber of Commerce celebrated a year’s worth of accomplishment with its annual Building Brooklyn awards, honors emphasizing the collaboration between architects, realtors, developers and attorneys in creating state-ofthe-art commercial, cultural, educational, community and residential centers.
