Whenever politicians are going From the Desk up for re-election or running for Of the PUBLISHER office for the first time, they want to tackle the most important problems that has been plaguing New York City residents in their communities for decades, and one of these is landlord-tenant disputes. Mayor Bill de Blasio has suddenly woken up to the fact that tenants are being harassed in many ways. But the fact is that landlords have been very versatile in what they do. The tenants, on the other hand, are sometimes new to the situations that landlords put them through, so when the landlord and his lawyer appear in court, they are confident that they will win. On the other hand, the tenants are nervous and they are often either unprepared or have been given the wrong advice, unless they have money to pay a good lawyer. It’s not beyond New York City landlords to try to evict tenants for their own personal gain, but in recent years, the city government and courts have started to come down hard on all kinds of shady practices by landlords. Tenants now have access to the internet. Get acquainted with laws that protect tenants by googling NYC housing laws. It is illegal for building owners to force tenants to leave their apartments or surrender their rights. Tenants, always make notes of things that your landlord is doing or saying to you, take pictures and get witnesses.

Harassment is when landlords start doing things like: • Taking away services provided in the lease (such as parking or laundry). • Shutting down utilities such as gas or electric. • Entering an apartment without proper notice. • Offering money to a tenant to move out, and threatening an eviction if the tenant says no. • Performing unnecessary inspections too frequently or at inconvenient times for the tenant. • Giving a “three-day notice” or other eviction notice that is based on false charges. • Refusing to do repairs that are required by law • Intentionally disturbing tenant’s peace and quiet

• Interfering with a tenant’s right to privacy • Refusing a lawful rent payment. Tenants should always write to the owner and keep copies of all correspondence in a file.

Tenants Need to be Prepared In Case of Landlord Harassment If you deal with a property manager, talk to that manager or the owner of the management company. Clear and active communication can effectively solve a lot of problems and may settle a simple misunderstanding. If you have tried to work things out and still feel harassed by your landlord, you should talk to an attorney about filing an official complaint and possibly seek damages.

Harassing a tenant with the intent of making their living situation so uncomfortable that they want to move is illegal. Bear in mind, however, that things like the following are NOT considered harassment: • Routine inspections with proper notice. • Entering your apartment in the case of an emergency, such as a gas leak or flood. • Outdoor security cameras for safety. • Calling you to remind you to pay past-due rent. • Sending you notices to rectify a lease violation. • Giving you an eviction notice for failure to pay rent. • Collecting money for property damage beyond normal wear and tear if it’s caused by the tenant. • Not repairing a washing machine that is owned by the tenant. Unfortunately, some landlords have turned to harassment in order to get tenants to move out of rentcontrolled units. It was a fine day for protesting at Lafayette Square in Washington, D.C., where folks were enjoying their right to free speech in a productive and peaceable manner. Lafayette Square sits directly across Pennsylvania Avenue from the White House. The park was packed with a variety of people the Saturday morning I visited nearly a decade ago. A large group of Hispanic protesters was demanding "living wages," acceptance of bilingual education and amnesty for illegal immigrants. A dozen other protesters stood on the other side of Pennsylvania Avenue. They called themselves "Freepers," for "freedom protesters." Each became a Freeper through freerepublic.com, an online forum for independent grassroots conservatives working to roll back decades of government overreach and to root out fraud and corruption. "It's not like we don't have other things to do with our time," said one woman, who told me she drove three hours every Saturday to voice her beliefs. "But someone has to speak up to defend our Constitution." Crossing back over Pennsylvania Ave. to talk with anti-nuclear-bomb activists, I was almost knocked over by a rollerhockey player. Two games were going on amid tourists and protesters, but the Park Police didn't care; hockey players have as much right to the park area as any other American citizens do. Between two anti-nuclear-bomb signs sat an elderly woman with a sunburned face. According to her handout, she came from Spain in the late 1960s, married, had a daughter, got divorced and lost custody of her daughter. She essentially lived across from the White House, protesting nuclear bombs 24 hours a day. As I chatted with her, two women dressed as ninja warriors approached. They carried a white sheet with a message written in Spanish.

"What does that say?" I asked one of the ninja warriors. "No hablo Ingles," she said to me. The Spanish anti-nuclear-bomb woman read the ninjas' sign. She told me they were protesting the evils of capitalism. Suddenly, the protesters who had been demanding amnesty, living wages and bilingual education began marching toward me on their way to the White House. They were blowing whistles and cheering, while reiterating their demands through a megaphone. Suddenly, Pennsylvania Ave. was a sea of tourists, protesters of every stripe and hockey players in the heat of competition. The energy, noise and enthusiasm were astounding. Nobody brought clubs. Nobody fought. Nobody tried to silence anyone else on that Saturday morning. Everyone freely exercised his or her right to speak freely. One of my history professors at Penn State marveled over the magnificence of our political system. America, at its best, is organized chaos — in which different opinions continually collide and work themselves out in a peaceful and constructive manner. Every citizen has the right to peaceably assemble and protest. We can criticize our political leaders with megaphones or in print or on YouTube. We have the right to stage revolutions. All we have to do is vote. Every citizen has the right to speak freely — even the right to say things that, to the majority of us, are hateful and ill-informed. Of course, that is the challenge with freedom. It opens the floodgates to everything that is good in the human heart — justice and integrity and generosity — but it also opens the floodgates to everything that is bad in the human heart. In any event, the First Amendment, when properly respected and practiced, is a wonderful thing. I witnessed it in all its glory in Lafayette Square one sunny Saturday morning not so long ago.

First South Asian-American Magistrate Judge Appointed To Brooklyn’s Federal Court By Rob Abruzzese Brooklyn PHOENIX

The U.S. District Court for the Eastern District of New York (EDNY) appointed its first South Asian-American magistrate judge — Hon. Sanket Bulsara — Chief Judge Dora Irizarry announced this week. He is the first South Asian-American to serve as a judge within the Second Circuit. Just before his appointment to the bench in EDNY, Bulsara served briefly as the acting general counsel of the U.S. Securities and Exchange Commission (SEC). Before that, he was deputy general counsel for Appellate Litigation, Adjudication and Enforcement within the SEC. “We are thrilled to welcome Judge Bulsara into the Eastern District family,” Irizarry said. “Judge Bulsara was chosen by the Board of Judges from among five highly qualified and stellar candidates recommended by the Magistrate Judge Merit Selection Committee composed of members of the bar and citizens of the Eastern District. “Judge Bulsara has outstanding credentials and experience,” Irizarry continued. “We have no doubt that he will make significant contributions to the administration of justice as is the tradition of the Eastern District bench.”

Bulsara was born in the Bronx after his parents immigrated there from India and was raised in Queens. After he graduated from Harvard Law School in 2002, Bulsara clerked for Hon. John G. Koeltl, U.S. district judge for the Southern District of New York. Bulsara then went on to become an associate in the litigation department at Munger, Tolles & Olson, LLP and later he became the manager of planning and data analysis at the NYC Department of Education. In 2005, Bulsara joined the firm of Wilmer, Cutler, Pickering, Hale and Dorr, LLP and was named partner in 2012. During his time at Wilmer Hale, Bulsara litigated complex commercial matters and defended Fortune 500 companies and individuals in white collar crimes. Bulsara also served as Special Kings County Assistant District Attorney while he was at Wilmer Hale and successfully tried felony and misdemeanor cases. Bulsara received several awards related to his numerous pro bono matters that have included working on prisoner rights cases and a Hague Convention child abduction matter.

Celebrating its 50th anniversary, the West Indian American Day Parade made its way down Eastern Parkway and through Crown Heights on Monday with spectacular costumes on display. For the third year in a row, members of the Metropolitan Black Bar Association (MBBA) marched alongside it. MBBA President Paula Edgar led a group of roughly a dozen attorneys, who mostly wore “Black Lawyers Matter” Tshirts, during the parade that drew more than one million people to Crown Heights including local politicians like Gov. Andrew Cuomo, Mayor Bill de Blasio and Sen. Chuck Schumer. “The celebration is fantastic. When I'm out there, I feel so great about our culture and community, particularly in the light of all of the hate and the repeal of DACA [Deferred Action for Childhood Arrivals]. We saw so many people who were able to be out there in peace and love and celebrating the beauty of the Caribbean. That's what it's sup-

posed to be about. Edgar explained that MBBA initially got involved as many of its members share a West Indian background, but she said that they are hoping to make a positive impact on the community. “As a diverse bar, we are not just trying to affect the community, we are a part of the community,” Edgar said. “My family is from Jamaica and Barbados. Not only do we want this to be a wonderful event as leaders and lawyers, but also as community members and having more visibility, connect to other community groups that's a good thing. “People see us out here in our ‘Black Lawyers Matter’ t-shirts and it’s important,” Edgar continued. “It's a conversation starter, given the numbers of black people in the legal community, we want to show that we encompass a segment of that and lawyers can look like us. We are a community resource.” For the past three years, MBBA has marched alongside Cuomo, which made it impossible for it to ignore the violence con-

nected to it, and especially J’Ouvert, a celebration that takes place the morning before. That is because of Carey Gabay, the governor’s assistant counsel, who was shot to death at the festivities two years ago. “Carey Gabay was a member of the black legal community who was killed, a Caribbean American, but we believe that the issue is not the Caribbean community,” Edgar said. “It's the other folks who come in and want to celebrate and also commit crimes at that time.” Since then, local politicians discussed canceling J’Ouvert (not the parade), but instead decided to move its start time from 4 a.m. to 6 a.m. while also bringing a heavy NYPD presence. Like many of the participants, Edgar had mixed reactions to the change of the start time. “I'm a little conflicted on this,” Edgar admitted. “As a New Yorker and Brooklynite, I want everyone to be safe and I also understand J'Ouvert, the origins of it, you're supposed to see day breaking. The word means ‘day break’ and moving it

takes away some cultural significance.” This year there was no violence connected to J'Ouvert, but police said that there was one stabbing and one shooting, but no deaths, near the parade route late on Monday. They did not say what the motivation of those crimes were, and did not say if the perpetrators were there attending the parade. No arrests were made. Edgar was quick to point out that in the past the violence didn’t stem from those involved in the parade. Instead, supporters of the parade often claim that local gangs use the large crowds as excuses to settle scores. “There should be more focus on our culture and less on violence that people try to affiliate with what is happening,” Edgar said. “There is so much more good than bad in this culture. Yesterday people stopped me, saw my shirt, and said, ‘Black Lawyers Matter, that's awesome.’ We're not doing this in response to J'Ouvert. We're a part of the community and we want to affect change and be a resource.”

See Dyker Heights Without its Famous Holiday Lights

These aren’t vacation snapshots of villas on the Mediterranean. But if you glance quickly, you might think so. There are waterfalls, graceful statues, palm fronds in the landscaping and stone and stucco mansions. Unless you live in the neighborhood where these homes can be found, you might not recognize this scenery in the light of day. Welcome to Dyker Heights. Many residents of the tri-state area know what this neighborhood looks like at night, around Christmas, when it’s decked out with its famous holiday lights. If you haven’t seen the Dyker Lights, they are every bit as amazing as people say they are. But when you’re looking for a stellar spot for a warmweather stroll, Dyker Heights is a great choice. The best place to find suburban eye candy is the area between 10th and 13th avenues and 80th and 86th streets. “Suburban” is a fitting adjective because the man who developed Dyker Heights more than a century ago wanted homebuy-

Wonderful Waterfalls and Stunning Statues A good place to start is the intersection of 11th Avenue and 83rd Street, where two houses have wonderful waterfalls and stunning statues. One house, 8220 11th Ave., belongs to Emanuele Alaimo and Lina Alaimo, city Finance Department records indicate. The owners of the other house, 8302 11th Ave., are Salvatore Basile and Josephine Basile, Finance Department records show. Another eye-pleasing 11th Avenue property with statues on its lawn is called Villa Abitino. It’s located at 8124 11th Ave. on the corner of 82nd Street. It is named after its owners. According to Finance Department records, Mario Abitino and Anna Abitino bought it for $1.7 million in 2007. One of 12th Avenue’s many attention-grabbing homes, 8220 12th Ave., has a dramatic porch with columns and is situated on a hilltop. Plus it has a gazebo — and a three-car garage, which is useful since subway stations are far away. This house, which is on the corner of 12th Avenue and 83rd Street, belongs to Roger Loughlin and Lucretia Loughlin,

See Dyker Heights Without its Famous Holiday Lights Continued from page 3 His father, Frederick Henry Johnson, had bought property in what was then New Utrecht with the intention of building a suburb, architectural history writer Suzanne Spellen says in a 2014 Brownstoner.com series about Dyker Heights. But Frederick Henry Johnson died in the early 1890s without getting his plans off the ground. Walter L. Johnson carried out his father’s vision. He started selling homes in the neighborhood in the late 1890s. The first three Dyker Heights houses Walter L. Johnson built were on the southwest corner of 82nd Street and 11th Avenue. The house the developer lived in burned down in a fire. A street sign that says “Walter L. Johnson Corner” is a reminder that his house stood there. According to “The History of Dyker Heights,” a 2014 documentary made by Christian Zaino and Angelo Bonsignore, one of those first three houses Johnson built is still standing. Its address is 1050 82nd St. The house was originally covered with shingles but now has a white-and-blue-brick facade. It belongs to Salvatore Peloro and Maria Peloro, Finance Department records indicate.

Houses Designed by Constantine Schubert and John J. Petit The designer of hundreds of houses Johnson built was Constantine Schubert, who studied architecture at Cooper Union. Schubert lived in a Dyker Heights house whose address is 1124 85th St. Its facade isn’t shingle-covered now like it was when the architect resided there. But a giant letter “S,” a reference to his surname, is attached to its chimney. This house belongs to The Theresa Marino 2011 Trust, Finance Department records indicate. In the documentary, Zaino — who wrote his NYU undergraduate thesis about Dyker Heights — also mentions that Saitta House at 1135 84th St. is “virtually unchanged” since its construction in 1899. The Queen Anne-style house, which is listed on the National Register of Historic Places, was designed by important Brooklyn architect John J. Petit. According to Finance Department records, its owners are Rosanne Muldoon, William R. Santo, Frank J. Santo Jr. and Jennifer Santo, and Irene Santo has a life-estate interest in the property. One other Dyker Heights historic building you’ll want to see is a church rather than a house. St. Philip’s Episcopal Church held its first worship service in 1900. A Look at Recent Dyker Heights Home Sales House on Corner Lot Sold for $3.15M By Lore Croghan Brooklyn Eagle

Dyker Heights, the neighborhood with the famous holiday lights, is full of eye-catching homes. They sell for big bucks, though prices in the neighborhood are lower than in landmarked Brownstone Brooklyn neighborhoods. Here’s a roundup of some recent Dyker Heights house sales. We gleaned purchasers’ names and the sums they spent from city Finance Department records. • The man who developed Dyker Heights, Walter L. Johnson, lived in a house on the southwest corner of 11th Avenue and 82nd Street more than a century ago. But it burned down. The handsome home that currently stands on that site was sold in May for $3.15 million. Its address is 1074 82nd St. Emanuele G. Alaimo purchased the home in an estate sale. According to online info posted about the property during the two years it was on the market, there’s a six-bedroom house and an in-ground saltwater swimming pool on a 100-by100-foot lot.
