Florida Senate and House Bills That Acupuncturists Can’t Ignore
The proposed Florida Senate Bill 230 redefines which health care professions can include the term “physician” in their practitioner title. If this bill is enacted into law, licensed acupuncturists will no longer be permitted to legally use the professional title Acupuncture Physician after July 1 of this year.
Any licensee who uses or advertises the title after this date could be subject to disciplinary action.
Florida State Oriental Medical Association (FSOMA) has been tracking this legislation and lobbying with senators and representatives for several years. The Association urges licensed acupuncturists interested in keeping and using the professional title Acupuncture Physician to act and encourage others to call, email, snail-mail or contact their local Florida State Senator’s office to voice opposition to the current version of SB 230.

In addition, House Bill 583 is the House “companion” bill to SB 230. The language and principal objectives of HB 583 are very similar to SB 230. Both branches of the Florida Legislature are working to create new statutory language within Florida Chapter 456 Health Professions and Occupations: General Provisions to redefine which licensed health care practitioners can use and include the term “physician” in their professional title. At this time, the current language in HB 583 also redefines which Florida licensed health care practitioners can use and include the term “doctor” in their professional title.

Florida Lawmakers Aim for State Regulations on Kratom Use
Currently, there are no Florida state or federal regulations on the distribution, sales or preparation of kratom products. Many Florida lawmakers would like to change that. The Florida Kratom Consumer Protection Act would set a 21 and over age limit for the purchase and consumption of kratom, in addition to banning processors from selling, preparing or distributing certain kratom products—such as those adulterated with other herbal or illegal substances. The proposal also specifies that packaging would need to include serving sizes and directions for use.
Kratom, an herbal extract that can produce stimulant or sedative effects, comes from a tree in the coffee family commonly found in Southeast Asia and Africa. While traditionally consumed as a tea or by chewing its leaves, these days kratom can be found in powder, pill, extract, tincture and other forms.
Many people use kratom as a pain reliever, a nervous system tonic, to increase mental focus, or to overcome opioid addictions, due to the way kratom binds to the brain’s opioid receptors.
While many regular kratom users have beneficial experiences with the substance, side effects can range from mild nausea, sweating and dry mouth, to insomnia, anxiety and hallucinations. According to an article written by Marcus Rojas and published on Health News Florida, “Supporters of the bill argue that kratom has the potential to be addictive, while opponents say it is a healthier alternative to most recreational drugs. With no federal legislation on the substance as more research emerges, states are left to draft their own regulations.”
