In our office we have seen many of the mistakes when people write their own Wills. For example, Florida has one of the strictest execution requirements in the nation. If the Will is not executed precisely according to the law, then a person ends up dying without a valid Will. Another common mistake is not disposing of all the estate assets. In other words, a “catch-all clause” or residuary clause is often missing. This means that the bulk of the estate may pass as if there was no Will, so that the persons you intended to benefit do not receive what had been specified for them. Yet, another common mistake is not adding provisions to take into account what happens if there are beneficiaries who die before you or your nominated executor dies before you and you have not named a successor. Finally, some people may believe that it is too costly to work with a qualified attorney to prepare your Will. This is not the case when you consider all the downsides if any one of many common mistakes occur.
