Daffodil Of Hope By Daniel SAHYOUN KYLIE Mather said she was “over the moon” when she found out her daughter’s cancer was in remission. “When Sophie was diagnosed, the doctors told us she only had a 60 percent chance of beating it,” Kylie said. “There are no words that can really explain just how happy we felt when we found out she was clear.” Eleven-year old Sophie was diagnosed with medulloblastoma when she was just seven years old. She endured six weeks of radiation treatment, followed by six months of heavy chemotherapy. During treatment, Kylie said the family had to live apart so Sophie’s brothers and sisters could still attend
school. “I stayed at Ronald McDonald House because we lived so far away, I needed to be close to Sophie,” Kylie said. “It had a huge impact on the whole family, and still does.” The Bulahdelah mum of six said although Sophie has beaten the cancer, she still suffers side effects of the radiation treatment. The Cancer Council estimates that every day more than 350 Australians find out they have a lifethreatening cancer, and one in two Australian men and women will be diagnosed with cancer by the age of 85. The survival rate for many common cancers has increased by 30 percent in

If you are thinking of terminating a contract that is of any significance, you must obtain legal advice prior to doing so. Too often we see people take action to terminate a contract as a result of circumstances that they consider entitle them to terminate the contract and suffer significant consequences as a result. If you terminate a contract or attempt to terminate a contract in circumstances where you are strictly not entitled to, or do so in an inappropriate manner, the other party may be entitled to treat your termination or attempted termination of the contract as a repudiation of the contract. A repudiation of the contract is usually categorised as conduct where a party no longer intends to be bound by the terms of the contract. If a party repudiates a contract, the other party may accept this repudiation and terminate the contract suing the repudiating party for damages. It all boils down to whether or not
your termination is valid. If your termination is not valid, you are at risk of the Court viewing your conduct as a repudiation. Therefore it is extremely important that you seek legal advice and take a considered approach prior to taking any action in relation to terminating a contract. An example of where a party acted too hastily in terminating a contract with dire consequences was illustrated in Dewu Pty Ltd v Fabiano [2015] NSWSC 1915. This was a building contract dispute where the owner (Dewu) purported to terminate the contract as it considered that the building works were defective. Dewu’s position was misconceived at law and the builder (Fabiano) accepted the owner’s purported termination as a repudiation of the building contract and in turn validly terminated the building contract claiming damages as a result. The builder was successful and was awarded damages in the sum of $511,762.00. Think and seek advice before you terminate!

Volunteers bring the Myall Coast and Cambodia closer
There are 7,000 kilometres between Tea Gardens and a tiny impoverished village in rural Cambodia, but some people in the Myall area are shrinking that distance fast.

THERE are 7,000 kilometres between Tea Gardens and a tiny impoverished village in rural Cambodia, but some people in the Myall area are shrinking that distance fast. For the past several years, they have been supporting Opportunity Cambodia, a small Australian charity that gives poor children in the Chikrend District south of Siem Reap the chance to attend school. Tea Gardens identity Lee Anderson sits on the Opportunity Cambodia Board, along with founder and CEO Carolyn Fletcher AM and former NSW Premier Nick Greiner AC, among others.
Lee and husband Rob Anderson support the children financially and at least once a year Lee travels to the project to help out locally. She visits the charity’s rural centre, its Siem Reap facility and the commune itself, which is supported by a pre-school and an animal husbandry scheme that helps villagers buy and raise pigs, chickens, ducks and even edible frogs. Earlier this year, Lee took their eldest son Ben and his 14-year-old daughter Zoe to visit the village school. Before leaving, Ben ran a fundraising event at his home to buy water filters, as polluted water is one of the greatest causes of death in
children. Ben ran a workshop to show how to use the filters as well as teaching basic science classes, something the children had never experienced. Joining Lee on recent trips have been Kerryan Griffin of North Arm Cove

Adrienne reckons it’s a worthwhile and special project. “All the people involved here in Australia provide their time and resources for free,” she says. “They pay themselves nothing, fund their own travel and accommodation and make sure that every dollar received goes directly to the project in Cambodia, paying the wonderful local staff and providing financial help and resources for the children and their families.”
Lee, Adrienne and Kerryan are now finalising plans for their next visit in late September and they say that anyone in the Myall area who wants to help can rest assured that any educational resources or financial donations will go 100 per cent to the children themselves. A ‘BOULDER Welcome’ will soon greet locals and tourists when they turn off the highway bound for the Myall Coast. The long running Rotary
project has been six years in the making. “Since the modified turnoff was installed during the construction of the dual carriageway, what should have been an attractive ‘Gateway’ to our Myall Coast,
has been sadly neglected,’’ Rotary’s Ian MackenzieSmith told News Of The Area. Last week, a very large 14 tonne basalt rock was carefully placed on the rise above the roundabout at the highway intersection.

The long running project has involved many sectors of the community. The boulder was donated by Hunter Quarries at Karuah. “I had picked out another rock and then the quarry was flooded and we couldn’t get at it,” Ian said. “But then they had another blasting and the Quarry said I’ve got another one for you that’s even better.”
A stainless steel sign saying “Welcome to Tea Gardens, Hawks Nest, Pindimar and Bundabah” is now being created by an expert in Inverell. The local Men’s Shed is on board to help with installing solar lights to illuminate the sign and MidCoast Council has sprayed the boulder with an anti-graffiti agent. Mr Henry added, “They served with absolute distinction.” Scott Beaumont recalled the protests that surrounded Australia’s involvement in Vietnam and the treatment returning servicemen were given. He noted, how those same Vietnam Veterans have ensured that no other Australian military personnel have been denigrated in the generations that have followed. Students from Tea Gardens Primary School were among those who laid wreaths at the memorial in Anzac Park. MYALL Lakes MP, Stephen Bromhead, hosted ‘Pollie in the Club’ at Bulahdelah Bowling Club last Friday evening. The National Party MP meet for informal discussions, and was even lucky enough to win a meat tray in the raffle. “It’s another way of
engaging with the community to listen to what they have got to say,” Mr Bromhead said. “Generally, people have been very receptive and it is a good way to hear directly what the local issues are.” Mr Bromhead moved throughout the crowd and discussed varied topics including funding and council rates.
“There is more money available to communities for local infrastructure and local programs than previously in the history of NSW,” he said. “People are excited at the opportunities.” Speaking with News Of The Area, Mr Bromhead said $2.6 million is available through the Stronger Country Communities Fund, with

additional funding available for cultural, sporting and job creation projects. MidCoast Council was recently granted $50,000 for the Great Lakes Remote Areas Flood Survey. “The southern area has a long history of flooding, and this is a study to help council identify the risks and work out their strategies to better manage them,” Mr Bromhead said.

dollar for dollar, to provide a $100 million roads and bridges package,” he said. “I have spoken to the Deputy Premier, I have had the Minister for Roads come to the electorate … I am hoping that they will announce that they will support the council and the community.” Mr Bromhead concluded his visit to Bulahdelah with a meal at the club with his wife Sue.

New wing opening THE new wing of the Peter Sinclair Aged Care Facility at Hawks Nest will be officially opened next Wednesday 30 August. Namesake, and former NSW Governor, Rear Admiral Peter Sinclair will be on hand for the opening. “There will also be a 25 year dedication ceremony,” Emma Creaswell, Assistant to RSL Lifecare’s General Manager to the region said. Federal Member for Lyne, Dr David Gillespie is expected to attend as well as local RSL sub branch
member and Peter Sinclair Liaison Officer Barry Whiteman. Students from Tea Gardens Primary School will perform a special reading. The redevelopment of the RSL Lifecare Facility cost $6 million and took over a year to complete. The new wing now brings the total beds at Peter Sinclair Gardens to 65. Many of the new rooms are already occupied. The redevelopment
has also created many new nursing and support jobs. The ceremony gets underway from 10am. Following the official opening ceremony, Dr David Gillespie will head to the Baptist Church in Tea Gardens for a meet and greet. The Federal MP has invited local residents to join him for an informal afternoon catchup and chat. The Assistant Health Minister will be at the Myall Street Church from 2pm to 3.30pm.

Hospital Angst Poorly Resourced Tomaree Hospital Causes Community Concern

THIS is the story of an unlikely bond between a disabled toddler and a retired great grandfather formed out of a chance encounter at this year’s Tocal Field Days. Three-and-a-half-yearold twin Carter Goodwin has cerebral palsy quadriplegia hypertonic spasticity. Bill Taylor is a 70-year-old volunteer firefighter and former paramedic, motorcycle cop, Air Force member and Army reservist. While both reside in Medowie, the pair had never met before the Goodwins decided to take the family to the popular field day at Tocal in May. “I was manning the Medowie rural fire brigade stall when Carter – along
with mum and dad Sam and Alex, twin Milla and older brother Hudson – came along and I immediately noticed his attraction to a replica model of a fire truck I had constructed years before,” Mr Taylor, who has survived bowel cancer and stroke, recalled. “Carter just loved the truck so after a while I asked for permission from his parents to build something similar as a gift.. “They approved and I got to work, spending six hours each day for the next week building a model replica Tiger Moth aircraft, based on the training prototypes used during World War Two. “I have grandchildren and great grandchildren of my own and had over 35 years’ experience working with disabled children, but
no child had affected the way Carter did. “He just broke my heart and the way his eyes lit up the day I presented him with the model plane was something else. “I received the biggest hugs and kisses.” For the Goodwin family, the unexpected gift has become one of Carter’s prized possessions. “We are so grateful for not only the gift but the strong bond that has developed between Bill and Carter,” mum Sam Goodwin said. “The structure is big enough for Carter to sit in and it is most appropriate for his needs.” It also allows Carter to forget about the daily grind of physio sessions and strenuous hospital visits. The Goodwins said they

Wendy Secco of Shoal Bay worked in the hospital health system for many years and during her recent admission to Tomaree Hospital she found it to be lacking. Wendy told News Of The Area, “I can’t get over how small and inefficient Tomaree Hospital is with no x-ray facilities; it leaves doctors frustrated and unable to effectively diagnose patients in their care.” Wendy also expressed real concerns over the volume are constantly amazed by the generosity and goodwill of family, friends and strangers from the Medowie

of bus traffic on Nelson Bay Road and the inability of the current facility to deal with a large scale traffic incident. Wendy’s elderly neighbour was recently transported to Bulahdelah Hospital and then to Taree Hospital for specialist assessment and x-rays. Kate Washington member for Port Stephens said, “This is an utterly unacceptable scenario, the community has been calling out for x-ray and ultrasound capacity at Tomaree Hospital for many years now.” “I’ve also raised it in Parliament, and the government has failed to act; the fact that aged and frail residents are having to travel 2 hours to Taree to get something as simple as an community, who continue to support Carter’s needs. They have set up a facebook page, called
x-ray is disgusting,” “This is what happens when the government doesn’t adequately resource the health system.” “Our hardworking doctors and nurses ought to have the tools they need so that they can tend to the health needs of our community; instead, the government is placing lives at risk by failing to provide basic diagnostic tools at Tomaree Hospital.” “Our community deserves so much better,” she said. While Wendy advocates for better equipment and facilities at Tomaree Hospital she praised staff on the quality of care she received which was fantastic. PLANNING is well underway for next year’s ‘Motorfest’, one of the biggest events on the Hawks Nest calendar. The Tea Gardens Hawks Nest Motor Club recently held its Annual General Meeting taking stock after its best ever Motorfest Community Aid Event day back in March. “The Club has being going from strength to strength with both an increase in Club runs and an increase in
membership with nine new members,” Phil Hoare said. Committee Members were also nominated and elected. Juergen Seil remains President, Ranald Mackay, Vice President, Graham Kelly, Treasurer, while Ross Anderson takes over as Secretary. Mr Seil paid special praise for Phil Hoare who stepped down as Secretary, although he remains the Motor Club’s publicity officer.
John Sharp was thanked for for his commitment to the Club as returning Officer for the Elections. Following this year’s Motorfest the club was able to donated $9,000 to local community organisation such as the Surf Club, Clinic Bus and Rural Fire Brigade. This year’s event attracted 355 entries, next year Graham Kelly is hoping to break the 400 mark. Motorfest 2018 will be held at the Myall Sports Oval Hawks Nest on Saturday 10 March.

Simone Aurino a carer for Port Stephens Koalas told News Of The Area that it is really important that anyone who is involved in a koala road accident stops and contacts the team allowing early intervention, which can make all the difference for the koalas survival. “The volunteers triage the injured koalas under the guidance of Veterinarian, Don Hudson of Noah’s Ark Veterinary Surgery who donate their service and assist injured koalas,” she said. Tea Gardens Women’s Bowling Club By Lynda RICHARDS TUESDAY 15th August: A good turn up of bowlers for a game of social bowls and Round 1 of the Club Championship Triples to be played. Format for social bowls was Triples. On Rink 6 Lynda Richards played “swinger “ lead. This was a close match from start to finish the eventual winners were Sheril Johnson and Maynie Roberts 18 v Bev Stephens and Kayelene Pearson 16, of course Lynda was a winner as well. Dawn Jones, Kerry Faber and Jill McBride had a big win over Dawn May, Christine Fossey and Carol Hayden 20 v 7. A similar story was unfolding on Rink 5 with Bette Saillard, Jo Younghusband and Olive McKeown having a score of zero on the 6th end. Their opponents Ingrid Luck, Dorothy Thompson and Caroline Bywater had amassed 14 points at this
stage. Olive’s team regrouped only going down by 10 shots, 24 v 14. The winners on the day, with the highest margin were Dawn Jones, Kerry Faber and Jill McBride. Round 1 of the Triples Championship saw Bev Rhodes, Wendy Brand and Elizabeth Kelly defeating Margaret Smith, Lynne Green and Lorraine Harvey 17 v 14. Elizabeth’s team had a 5 shot lead on the 4th end, the score was equal on the 7th end. At the completion of the 12th end Elizabeth’s ladies had gained a good lead of 5 shots but Lorraine’s team fought back. The score on the 17th end 14 all. Elizabeth’s team gained 3 shots on the 18th end, claiming victory 17 v 14. Karen Green, Robyn Webster and Kathie Rimmer proved to be too strong for Wilma Drake, Anne Mackenzie and Loretta Baker winning 23 v 11. The winners of these games progressed to Round 2. GLENN Grainger struck gold at the recent Zone Bowls Championships, taking out the Rookie Singles title and securing his place in next month’s NSW State Finals. Teammate Guy Rowe was also in top form, finishing in second position at the end of the two-day knockout competition, held at Sporties Tuncurry. Representing Bulahdelah Bowling Club, Guy and Glenn bowled their way through
a competitive field of 22 players in the early rounds. Strong performances from the local boys resulted in both finishing at the top of their respective draws. With a vocal team of local supporters behind them, Glenn and Guy faced off against each other in an all Bulahdelah Grand Final played over 23 ends, with Glenn claiming the win 17 to 14. “We had some awesome competition up there,” Guy said.

“Glenn bowled exceptionally well on the day, and deserved the win.” This was the first time Glenn has competed in the competition and came up against Rookies representing six Mid-North Coast clubs. “The other teams put up quite a fight,” Glenn told News Of The Area. “Bulahdelah finishing one and two is unreal, it has surpassed every expectation we had going into the competition.” The statewide Rookie event is for players with no more than two years’ experience in the game. Glenn now has a crack at the state finals to be played at Raymond Terrace next month.

16 August: The weather featured in all bowls played this week with the 50 players that turned out to compete in the usual Wednesday Nominated Triples experiencing the wrath of a screaming south-westerly. Both greens were in play with the grass running very nicely. The winners of the Queen’s Kitchen draw were; Lance Atkins, Pip Sullivan and Greg Pearson. The random winners were; Ken McKeown, Daryl Martin and Merv Mills. 18 August: Conditions today were all but impossible today but 12 players, who were later presented with courage awards for braving the elements, competed in
the Fabulous Friday Open Pairs. I do not have the results to hand but as the field was drastically reduced no jackpot draw was made. 19 August: The first rounds of the Club Mixed Pairs competition were played today with competitors braving the unrelenting wind Ultimately there were 15 teams entered and most teams enjoyed a bye in the first round. Three matches were played with the wind evening–out any bias there may have been between the teams in regard to ability. Setting the pace for things to follow were the husband and wife team of; Henk and Kerry Faber. They prevailed over Dale Winter and Leigh Hunt 1411.
