Paul Bendy, President of the Slipway Association, advised News of the Area, “Even though Crown Lands still have the restrictions on the use of the slipway, we now have their assurance that we are able to respond to emergency situations without the threat of prosecution.” “‘Sol Ray’ was safely put onto the slipway for inspection to ensure its hull’s integrity.” “This boat was also carrying 2000 litres of diesel fuel and we could not run the risk of the diesel polluting the Myall River had we not responded,” Mr Bendy said. Responsible pet ownership NEW laws come into effect in NSW on July 1 around the advertising of kittens, cats, puppies or dogs for sale in NSW. The law will require a microchip number, a breeder identification number or a rehoming organisation number to be included in all advertisements. MidCoast Council says it’s also law to ensure your pet is registered and microchipped and that those details are kept up to date throughout the animal’s life, as well as notifying Council if your pet passes away. MidCoast Council Pounds often end up with dogs that have been
microchipped, but because their owner has moved, rangers can no longer contact them. Details should be updated within 14 days of moving, to ensure if an animal does go missing or is picked up, the owner can be located as soon as possible. Stay updated on responsible pet ownership and view MidCoast Council’s Pound register, at their website www. midcoast.nsw.gov.au/pets. ROTARY prize winner, Loretta Baker, travelled to China for nine days as a result of purchasing a $20.00 raffle ticket to support the Rotary Club of Myall Coast. Loretta said, “I saw the Rotary people selling raffle tickets so I bought one and put it in a drawer at home and forgot about it. “On Christmas Eve at 11.30am, I received a phone call to say that I had won the prize.” Called China Terracotta, the trip included International return flights from Australia to China, International flights and transfers, a visit to the Giant Panda, Terracotta Warriors in the UNESCO World Heritage
Mausoleum of the First Qin Emperor as well as a tour of Beijing and a visit to the Great Wall of China. “The prize was for two people so I took my daughter, Vanessa as my Husband had to go into hospital to have a knee operation,” Ms Baker said. “We were on a bus with 35 Aussies and Kiwis and I have never laughed so much in all my life,” Loretta told News Of The Area. When News Of The Area contacted Peter Sivyer, President of the Rotary Club of Myall Coast, he said, “We thought it was an excellent prize and the money that was raised went to the Drought Relief Fund and also to other Rotary Community Programmes.”

It is a well-accepted practice in relation to the sale of land for there to be a physical exchange of signed counterpart Contracts to bind the parties to the sale. Once the exchange occurs, each party has an enforceable contract ‘signed by the party to be charged’ thereby satisfying the requirements of the old English Statute of Frauds of 1677 (now contained in section 54 of the Conveyancing Act 1919). Leases however do not usually involve a physical exchange of contracts. Normally, a lessee will sign the lease and post it to the lessor who then countersigns the lease, registers (where necessary) and returns the signed and registered lease back to the lessee. In these circumstances it is crucial for the parties to clearly understand when the contract is made and the parties bound. In the recent case of Realm Resources Pty Ltd v Aurora Place Investments Pty Ltd [2019], a dispute arose as to whether a sublessee was bound after signing and returning the signed sublease to the sublessor. After

The Court therefore held that the sublessee delivered the sublease in escrow, subject to the condition that the sublessor sign and then deliver the fully executed sublease to the sublessee. If the sublessee had not intended to be bound, it should have made it abundantly clear that the sublease was not intended to be binding until it had also been signed by the sublessor. The lesson from this case is that it is important that parties to a lease clearly define when they intend they will be bound by its terms. It is common for parties to stipulate that neither is bound until the terms of the lease are finalised and the lease executed by both parties. If however the parties intend to be bound at an earlier point in time which often occurs when a lessee is wanting immediate access, it is important that the parties clearly define in their correspondence as to when they intend to be bound to the terms of the lease

Coastal management prevents erosion damage MIDCOAST Council says proactive management of Jimmys and Old Bar Beaches has prevented any loss of assets during this week's weather event, which caused minor erosion at both locations. Severe weather events caused by east coast lows are common in winter months along the NSW coastline, frequently causing beach erosion at two of NSW's coastal erosion hotspots on the MidCoast - Jimmys Beach and Old Bar Beach.
On Tuesday 4 June, a storm event impacted both beaches, with Council evaluating the damage this week. Council's Coastal Management Coordinator, Andrew Staniland said, "We're pleased that at both locations, our coastal management planning has prevented any loss of assets." From ‘The Voice’ 2018 HENDO a Crowd Favourite DAVID McCredie is a gifted local acoustic artist who recently appeared on The Voice 2018 Australia. He is able to play sweet tunes to suit a relaxed atmosphere, and he can easily change his tone to suit a party style. His vibe and sound has been shaped by artists such as Ed Sheeran, George Ezra and Dean Lewis. David has always had a passion for singing & playing guitar from an early age, and for the last four years, he have been playing privately and corporately. He has also been involved with the Hunter Youth Alive Band for events such as Groundswell and other major events. David also writes his own songs: they are all about complex things and things that hit hard, such as love, family, home and heaven. You connect and sing along even though you've never heard the tune before. When David writes his own music, he turns

MIDCOAST Council is inviting feedback on its inaugural Youth Strategic Plan, a document which guides how Council, service providers and the broader community support and empower the area’s young people. While the plan has been developed specifically for the MidCoast Local Government Area, it aligns with local, state and federal priorities, focusing on creating opportunities, community connection, health, safety and wellbeing and empowering young people. The plan is the result of six months of consultation with local youth, service providers, schools and the broader community to develop an all-of-community approach. The Plan is available for viewing on Council’s Have your Say page and online submissions are welcome before 4.30pm on Friday 21 June. WATER resources on the MidCoast are being monitored as implementation of restrictions continue across the State with most of NSW drought-declared. MidCoast Council is continuing to closely monitor all conditions, and consider the options available in deciding how to respond to the unprecedented situation on the MidCoast. While the MidCoast is extremely dry, Council says that implementing low-level restrictions at the moment would not have an impact on water use, which is already low during cool weather. Council says it will keep everyone informed about the developing situation over the coming weeks, through local media, Council’s website and social media. MIDCOAST Council’s commitment on the services and activities the community can expect to be delivered during the 2019-20 year and proposed fees and charges is now on public exhibition. The 2019-20 Operational Plan, presented alongside the three year delivery program and 2019-20 fees and charges is open for community feedback until 4.30pm Wednesday 19 June. The document also includes the budget for the coming year and outlines how and where funds will be spent. Members of the public are invited to provide their feedback on these documents, which will then go back to Councillors for adoption. Once adopted these documents become an important delivery checklist across all areas of Council. The plans provide an overview of where Council is headed, a detailed outline of deliverables and the performance criteria against which progress is measured. Rain has been a dominating influence on the running of the Club Major Singles with players dodging showers to complete matches. Last Saturday, 1 June, an attempt was made to play the semi-finals but after one hours play the game was postponed to the next day. On Sunday, showers intervened again but the players persevered with Jeff Baker winning over Mark Hair, 31-18 and Doug Andrews sneaked a win over Col Saillard 3127. 7 June: In keeping with tradition, the Club held a post-pennant luncheon to thank the players that competed or assisted in the running of the 2019 Pennant season. What are the new Domestic Violence Tenancy Laws? THE new laws have been introduced to aid in the protection of victims of domestic violence, living in residential rental properties. The tenancy can be terminated if they are proven a victim. This includes anyone experiencing circumstances of domestic violence, a dependent child, co-tenant or child of a cotenant. The offence can be physical, sexual, emotional or psychological abuse, verbal abuse, stalking, intimidation, damage to property, threats of violence or financial abuse. The victim can issue a notice of termination along with a copy of the certificate of conviction of the domestic violence, a relevant domestic violence order, a copy of the relevant injunction granted under the family law act, or a declaration by a competent person in the prescribed form (a relevant medical practitioner). Once issued, the victim is not liable for any amount of rent or fees. The victim will also not be liable for any damage to the property by the offender. This information cannot be placed on any tenancy database nor can it be shared for future reference checks, ensuring the victim secures another rental property without any negative impact. We then saw a “master class” from Jeff Baker where he powered away playing with superb consistency and with the momentum in his favour, won the match 31-21. The many spectators enjoyed some really fine bowls and both players are to be congratulated on a fine game. The Club Major Singles Champion for 2019 is Jeff Baker! In other news: The last of the Club Championship events will be the Club Triples and nominations are open for this event commencing early July.

THE “Grey Nomad’s Cup”, a four person Ambrose event, with 76 keen golfers was held for the fourth time and attracted visitors from Castle Hill, Tanilba Bay, Raymond Terrace, Boat Harbour, Lower Belford, Dungog, Newcastle, Branxton and Sydney. Organiser of the event, David Gilbert said, “The Hawks Nest Golf Club was extremely grateful for the ongoing sponsorship support, provided by Palm Lake Resort, which enabled this event to be organised.” Following the heavy rain and inclement weather earlier in the week the Club was relieved when the winds had abated and milder, dry conditions had returned.
