It was standing room only inside the Gallery’s new home on Marine Drive in Tea Gardens as guests roamed from room to room, admiring the dozens of new works created for the event. Next week’s trucking campaign will move half of that amount. “The aim is to provide a buffer and ensure that if another weather event is experienced that the buffer can be replaced,”

Emergency Salvage Meeting By Margie TIERNEY THE Community is being invited to an emergency meeting with Roads and Maritime Services this Thursday 14 June to find out the latest on the container ship spill off Port Stephens two weeks ago. The meeting is being held in the Tea Gardens Baptist Church on Myall Street, starting at 10am. A dedicated band of locals continues to scour Jimmy’s Beach and other Port Stephens coastal areas for debris from the 83 containers which were lost overboard from the YM Efficiency. The ship and the remainder of its damaged containers,, finally docked in Sydney last Wednesday. The Taiwanese owners of the vessel have apologised for the event, while their insurance company has engaged contractors to deal with the massive salvage operation. But warnings are still in place for fishing boats and other sea going vessels to remain on the lookout for the missing containers. Some commercial fisherman have decided not to risk heading out. “Whilst we believe the vast majority are very likely at the bottom of the ocean, we won’t know that for sure for some time yet,” Mr Mitchell said. A consumer purchased a bike helmet with a mirror visor from a retail website for the advertised price of $224.00. The money was paid and a receipt issued. Four days later the website contacted the purchaser apologetically cancelling the contract claiming the advertised price was an error and the helmet could not be supplied at that price.

The website relied on s15D of the Electronic Transactions Act 1999 (s15D) claiming an input error meant it was not bound by the transaction.

The tribunal found a valid contract had been formed and noted the website did not rely on any term or condition that may have rendered the contract void.

Rejecting the reliance on s15D the tribunal found that the section was a consumer protection to be used when a natural person made an input error in an electronic communication exchanged with the automated message system of another party. In other words, s15D covers situations where a consumer may have made a mistake and paid a trader the incorrect amount for goods on an automated service and the automated service does not provide the person with an opportunity to correct the error.

The tribunal offered the parties an opportunity to explore a compromise but this was rejected. The tribunal member therefore reinstated the original contract and ordered the helmet and visor be delivered in exchange for $224.00: Theo Theol v Bike Bug Pty Ltd [2014] NSWCATCD 123

STUDENT leaders at St Joseph’s Primary School in Bulahdelah, Ellie Watson and Jordan Grills, were recently awarded Leadership Medals in recognition of their achievements. The medals are an initiative of Myall Lakes MP Stephen Bromhead to acknowledge the potential of the next generation of leaders. “It’s about recognising that they are leaders and encouraging that leadership as they continue their education and then go out into the workforce,” Mr Bromhead said.

“At the same time, it is a message to all the students that they too can become leaders by getting involved in things, as it is through these life experiences that you become a good leader.” Ellie and Jordan are both members of the Student Representative Council, and have assisted with organising a disco, keeping the school grounds clean and chairing assemblies. Principal Mrs Joanne Trotter said a shared reading program with the younger students, peer support activities and tending to the school’s chickens are also amongst their many leadership roles.

Elected at the Club’s annual general meeting last weekend, Jeff Graham will lead the Board as President, with Darryl Harvey in the Vice-President position, Terri Stellema the Treasurer and Alan Benson the Captain. Completing the team, John Barry, Dave Brown, Barry Bishop, Graham Buck and Barbie Gordon were elected members of the committee. Acknowledging the “tremendous efforts” of the outgoing Directors, Jeff made special mention of the huge contribution from Terry Griffis, “who attended every raffle and every working bee over the past eighteen years”. Speaking with News Of The Area, Jeff said the newly elected Board has many challenges ahead. “We will be exploring

IT is very appreciative of Mid Coast Council (MCC) inviting comment on their 2018-2019 Delivery and Operational Plan, together with an outline of the Budget and Fees / Charges Structure. We have been asked to comment on a 405-page document on what is in store for us, the ratepayer. An impossible task, but,we will just have to put our faith in MCC, just like we did last year, when somebody arranged with somebody to have the Act changed, that allowed MCC ONLY, to increase our rates by a cumulative amount of 27% over the next 4 years. All other Merged Councils were DENIED any increase for 4 years. I will be paying $3200 in 4 years together with Mid Coast Water rate increases, makes it almost , an outrageous $5000 for both in 4 years.

We have 3 lots of administration, 3 lots of equipment, 3 lots of depots and 3 offices,sorry, I forgot, it is now 4 offices, since the purchase of the Taree Master’s building.We pay 3 different rate structures and operate virtually under 3 different organisations. Some amalgamation! In an area, strongly represented by a number of pensioners and self funded retirees, on fixed incomes, the extravagance displayed by MCC cannot be ignored. Debris Won’t Cost Residents By Marian SAMPSON THE impact of the waste that is washing up on Port Stephens beaches has the capacity to impact the pristine Port Stephens coastal environment and the Port Stephens–Great Lakes Marine Park. The level of plastic washing up amidst the debris is concerning as turtles, whales and larger marine life tend to mistake plastic as food. Member of the Legislative Council, and Parliamentary Secretary for Planning, the Central Coast and the Hunter Scot MacDonald told News Of The Area, “Port Stephens ratepayers will not be out of pocket as a result of this incident.” He believes that the immediate response and efforts of the local community to clean up the mess has been amazing, however it is the responsibility of the emergency clean-up crews that have been contracted locally to do the work. Reporting debris to RMS will see a coordinated response to the clean-up activities. Scot MacDonald urged the public to report all sightings of debris via the RMS website which will see the contractors sent to perform the clean-up. Port Stephens Mayor Ryan Palmer told News Of The Area, “The response from government to the emergency situation was fast, Scot MacDonald was straight on the phone advising that he had spoken with the Minister for the Environment to make sure that the residents of Port Stephens would not need to cover any of the costs of the clean-up.” Local company Varley has been contracted by the shipping company’s insurer to manage the clean-up. A spokesperson for Varley said “No expense will be spared to protect the environment and collect the debris.” There are warnings in place for boaters with one commercial fishing vessel reporting having snagged what they believe was a sunken container. Port Stephens local Pamela Smith has been organising volunteers to assist in cleaning up, she told News Of The Area, “The cleanup will be ongoing for a long time, there are still 82 containers unaccounted for out there. “The local people have been absolutely inspirational in how they have come together and willingly worked long hard hours in bleak weather on beaches and the isolated and rocky parts too. “We are determined to win,” she said. From foam that threatens to break into smaller particles on Wanda Beach to clocks and bumper bars at Fingal Beach bags, skips and bins are filling along the coast and the people of Port Stephens roll up their sleeves to protect and preserve our patch of paradise.

Junior Golf Scholarship HAWKS Nest Veterans golfers and Holiday Coast Credit Union have created and made available a new annual scholarship for Junior Golfers playing at Hawks Nest Golf Club. Each year the Club Professional, Andrew McCormack, will select one or two golfers aged between 12 and 18 years who are showing potential and commitment to the game. In addition to providing the next year’s annual club membership fees the scholarship will provide an amount that can be used for golf equipment and/or lessons with the club

Professional to a total value of $700. If shared between 2 juniors the scholarship will provide $350 each. The Men’s and Women’s Veterans committees are delighted that Holiday Coast Credit Union are able to support this initiative and look forward to awarding the first

scholarship in July this year. Normally the scholarship will be awarded in June of each year, in time to cover the upcoming year’s membership fees. This proved to be a tough contest on the 14th end the score was Sheril 11, Loretta 12. On the next 3 ends Loretta gained 7 shots, score now 19 v 11. Sheril sent down some great bowls and narrowed the lead to 2 shots on the 22nd end. Loretta claimed victory on the 27th end 27 v 20. On Rink 2 Pam Gilchrist bowled against Lynda Richards this also proved to be a difficult match. Lynda held the lead for the game but Pam didn’t give in. Great idea, suits bowlers who enjoy bowling but enjoy a shorter game for what ever reason.

Someone in my workplace is helping themselves to my packed lunch. There’s always bits missing when I go to eat it. I know that look you get when the office staff decide to pool their money for takeaway KFC. That self-righteous carbohydrate-free stare is not lost on anyone; I can assure you. Do you really believe that someone is desperate enough to pinch fruit and quinoa? I mean, really, Miss PL, have a think about it. A doughnut? Probably. A Snickers bar? Absolutely. Some leftover Thai food? Give it to me, baby. But quinoa? I think what is happening is that you are so hungry with your inadequate calorie intake, that you are actually walking to the tearoom in a trance and you are pinching things from your own lunchbox. Things like that can happen when you are malnourished. It’s okay to have a treat now and then. You are getting people offside and that isn’t helpful for workplace dynamics. The standout catch of the contest was a 15.4 kg Longtail Tuna landed by Bulahdelah Club member Greg Minett at Elizabeth Beach. “I was using a line that only had a small hook, I saw the seagulls in the area and thought it was some taylor,” Greg said. “The tuna put up quite a fight pulling me into the water, but I managed to eventually beach it after about an hour when a wave helped dump it on the beach.” Greg said it is quite rare to land a tuna from the beach as “most are caught out in the ocean or off the rocks”. “What’s even more surprising is that it was the first fish that I caught during the contest,” he said.
