An off-the-plan contract is used to sell property that does not yet exist. It is a popular way for buyers to enter the property market as they can commit to purchasing a property which will not be settled for some time while construction occurs, allowing them to lock in the purchase at today’s prices and additional time to save funds. In late 2015, the NSW Government introduced legislation to protect purchasers of residential property under off-the-plan contracts from developers delaying construction and then cancelling contracts for failure to meet timelines in a rising property market. In late 2018, the NSW Government passed further legislation to give off-the-plan purchasers greater certainty about what they are buying and builds on the 2015 reforms. The key changes introduced by the new laws include:• A new mandatory disclosure regime for off-the-plan contracts requiring developers to disclose key information and documents about the
development in a mandatory disclosure statement; • Developers will be required to notify purchasers of changes to a ‘material particular’ during the development. • Purchasers will have statutory remedies to cancel the contract or claim compensation where they are materially prejudiced by changes to the property. • Developers will required to provide final documents at least 21 days before settlement. • The laws builds on the 2015 reforms to sunset clauses by extending application to other events that trigger cancellation of the contract. • The cooling off period for off-the-plan contracts is extended to 10 business days and deposits must be held in a controlled money or trust account. The new laws are proposed to commence 1 September 2019 however this date may be delayed to allow the conveyancing and property industry sufficient lead time to prepare for the changes.

Rotary Revamp brings a night at the movies By Ann SCULLY
UNDER the new theme of Fun, Fun, Fun our local Rotary Club has been rebranded as the RotaryMyallCoast with its latest image bringing the Club into the 21st Century. Following in the footsteps of Rotary Clubs throughout the world, the general trend is moving in a direction of removing some, not all, of the formalities and introducing some fun and interesting activities for members to share with the locals in our area.

One of the changes is that the Club now meets twice a month instead of four times a month with one of the evenings taking the format of a meeting and the second get together being purely social. The first of these evenings entitled, “A Night at the Movies” which will be held in the Catholic Church Parish Centre on Monday 19 August, 6.30pm for 7.00pm. Format for the movie evening will commence with a glass of bubbles accompanied by an array of nibbles, after which time members and friends will sit back

Open Bowls Tournament with players from around the region
ON the weekend of 10-11 August, 72 bowlers converged on Tea Gardens Country Club to contest the 2019 Tooheys 2 Bowl Open Triples Tournament with over $5000 of prize money on offer. Players represented Clubs including Forster, Pacific Palms, Nelson Bay, Soldiers Point, Alder Park, Cardiff, Charlestown, Lorn Park, Lambton, Toronto Workers, Stockton, WindaleGateshead, East Maitland, Maitland City, Warners Bay, Karuah and Tea Gardens. In absolutely appalling conditions the men played 4 games of 10 ends on Saturday and 3 games on Sunday. With the westerly wind being the leveller on the weekend the team of Jake Graham, Chris Edmonds and Bill Rachel remained undefeated on Saturday night to hold a slim lead in the contest. Sunday proved even colder than the previous day with no respite from the winds. In a nail biting finish the favourites stumbled at the final game and were pipped by the fast finishing team of

Motocross rider hurt
ON Saturday, the Westpac Rescue Helicopter was tasked by NSW Ambulance to take flight to Nerong. A 23 year old male motocross rider had sustained serious injuries after a fall. The Helicopter Critical Care Medical Team assisted local Ambulance
Paramedics to stabilize the man on scene before flying him to the John Hunter Hospital. It is reported he is now in a stable condition as we wish him a speedy recovery.

Pearls Presentation to Preschool By Ann SCULLY
REPRESENTATIVES of the Pearls of Port Stephens ladies group presented a cheque for $500.00 to Judy Clarke, Director of the Tea Gardens Hawks Nest Preschool last Thursday with the funds being put towards a long-term goal of having an Aboriginal mural painted on the main preschool wall. A strong commitment has been made by the preschool in creating an educational and nurturing environment that welcomes all families and members of the community. Various practices have been incorporated into the Program with the children acknowledging the Worimi People each morning, Aboriginal/Torres Strait Island flags being displayed at the signin desk and the children using laminated Aboriginal flag placemats at each meal. “We approached Murrook Cultural Centre for an outreach program and their Education Officers now visit the preschool on a regular basis,” Judy Clarke, told News Of The Area. “For a long time now we have planned to have a visual welcome for everyone entering our Centre and have tried previously to have a mural painted on our wall. “At long last we have sourced a Worimi artist who has agreed to do this project and a special Dreaming story has been designed for our Preschool”, Judy said. “So this donation of $500.00 from the Pearls ladies will greatly assist with our project and I would publicly like to thank the ladies for their interest and ongoing support.”

TUESDAY 6th August: Round 2 of the Club Championship Major Pairs a win for Jill McBride and Lynda Richards 18 v Bev Stephens (sub for Jeanette Emmett) and Julie Kennedy 12. Carol Hayden and Loretta Baker were losing by 8 shots on the 12th end in their game against Kayelene Pearson and Karen Green. They bowled well ultimately going down by just 3 shots 16 v 13. A great comeback by Bette Saillard and Dale Winter losing by 8 shots on 9th end, to Dot Dallas and Kathie Rimmer. The next 7 ends belonged to Bette and Dale adding 16 shots to their tally, finally claiming victory 23 v 16. A close contest between Lorraine Murphy and Maynie Roberts v Bev Rhodes and Lynne Green all even on the 8 the end then Bev and Lynne forged ahead winning 17 v 13. Format for social bowls was 2 games of Triples,

The winner of the voucher for the Myall Bistro & Café was Bev Rhodes. Thursday 8th August: Semi final of the Major Pairs, a good win to Karen Green and Kayelene Pearson 27 v Jill McBride and Lynda Richards 9. I think all would agree the match of the day was Bev Rhodes and Lynne Green v Bette Saillard and Dale Winter. On the 11th end Bev and Lynne had an 11 shot lead, with just 7 ends left to bowl the "comeback queens" struck again resulting in a draw, 18 all on the 18th end. Another end to be played to establish a winner, Bette and Dale claiming a spot in the final of this competition winning 19 v 18. Thanks to Francis Betar for umpiring both days. Social bowls was

It was a close contest in very difficult conditions, wind at 46km/h gusting to 70km/h. The score was 12 all on the 17th end, but the Chicks gained 3 shots, winning 15 v 12.
