AFTER being temporarily closed due to fire risk Myall Lakes National Park has reopened following recent widespread rainfall. Campgrounds, day use areas, beaches and roads in the National Park are now accessible by the public. Rainfall in the area since Thursday (16th Jan) has moderately alleviated the dry conditions in the national park reducing the immediate risk of bush fire. All NPWS campgrounds, day use areas, 4WD beaches and roads in Myall Lakes National Park have re-opened. NPWS managed roads, including Mungo Brush road and Violet Hill road, are now accessible. Waterways are open and boat-based access to land is now permitted. Tracks and trails located in Myall Lakes National Park are open except for: · the Mining Road fire trail · the Mungo walking track. Despite the rain a park fireban remains in place. During park fire ban periods, all campfire and solid fuel (wood, heat beads, charcoal, briquettes, hexamine) barbecues and stoves are prohibited. Fireworks are not permitted in the park.

Mr Gately said, “The Club was enormously proud of the lead role it had played in coordinating the efforts of golfers, the community and the local businesses to come together for such a worthwhile cause.” “Only 10 days in the making, this fundraising appeal had received extraordinary support from all levels and sections of our wonderful local community,” Mr Gately said. “The generous support of local businesses either in the form of cash donations, prizes or items to auction or to raffle was central to the success of the day,” Mr Gately added. Mr David Bright, Captain of the Tea Gardens / Pindimar Rural Fire Service said, “The members of both Rural Fire Services were enormously grateful for the funds that they will receive when the appeal fund is finalised over the next week or so.” Mr Bright highlighted how the local Rural Fire Services would now be able to replace and repair equipment vital to their capacity to respond to bushfire incidents. A number of key celebrities participated in the day’s activities and were integral to the success of the day. A COMMUNITY is sometimes at its best in times of need and despair. And sometimes it's ‘just what we do’ to support others within the community. Yet another act of generosity in our towns sees one of the Golfing Clubs raise money for the local RFS. Annette Benton President of the Hawks Nest Ladies Golf (HNLG) Club presented Sandy Snape of the Tea Gardens & Pindimar Rural Fire Service a cheque for $850. The funds were raised at the ladies' Christmas ‘break-up day raffle’. Ms Snape told News Of The Area, “As a volunteer organisation we receive the basic equipment to perform our duties.” “To receive this generous donation from the ladies will go towards upgrading some of our communication equipment that will further enhance the safety of our members on the fireground,” she said.

We are continuing on with our look at the tax implications of property division. So far we have looked at capital gains tax and stamp duty. Today I am looking at income tax ramifications. Where separating parties have an interest in a business they often decide that one person will continue with the business – and keep the company. To ensure the division between them is equitable it may be necessary for the other party to be “paid out” their interest – and the parties want this to be done by way of a payment or transfer from the company itself. This is something that parties can agree to and the Family Law Courts can make Orders about but it can have considerable – and unintended – tax consequences. The normal rule is that a payment of money or the transfer of property to a shareholder will be included

within the assessable income of the recipient shareholder under the ordinary receipt of dividend rules. But the Income Tax Assessment Act also provides that amounts paid/property transferred to a person who is not a shareholder but who is associated with a shareholder or to a former shareholder or associate of a former shareholder (and the payment/ transfer is made because they were a shareholder) are included in the recipient’s assessable income. It used to be that the Tax Office viewed payments/ transfer made as part of a family law property division as not falling within that definition but since 2013 it has considered that they do. Anyone separating should carefully consider legal and financial advice before agreeing to any property division.

Mans dies after car crash and hits tree A MAN has died in a single vehicle crash north of Raymond Terrace. About 1.50pm on Friday 17 January, a Holden vehicle towing a box trailer was travelling north along The Buckets Way, at Twelve Mile Creek, when it left the roadway and crashed into a tree. The driver and sole occupant, a 32-year-old man, was trapped in the vehicle. NSW Ambulance paramedics attempted to revive the driver, but he died at the scene. Officers from Port StephensHunter Police District attended the scene and commenced an investigation. Police are appealing for any witnesses or motorists who were in the area at the time and may have dam footage to contact Raymond Terrace Police Station.

MidCoast Region's Ambassador THE MidCoast community will come together to celebrate Australia Day in just over a week and who better to lead the way than our Australia Day Ambassador, Superintendent Kam Baker AFSM. Kam’s leadership has been tested over recent months as he drove the firefighting efforts across the MidCoast and beyond but in his true style he has met every obstacle, coordinated with understanding and tact and lead with compassion, care and tenacity. “I cannot think of a more deserving, more fitting Australia Day Ambassador for the MidCoast region,” said Mayor David West. “Kam is a prime example of a true Aussie hero and I know he will accept this accolade on behalf of his entire team and the many volunteers who continue to work tirelessly throughout this bushfire crisis.” It’s been a stressful and

difficult time for everyone at the RFS and Kam has been busy driving the local effort as Incident Controller at the control centre since August 2019. Supt. Baker joined the NSW Rural Fire Service (NSWRFS) as a volunteer member of the Patonga Beach Brigade of the Gosford District in 1979 and worked through the ranks to Group Officer. He then qualified as a Telecommunication Technical Officer and became a salaried Officer in the NSWRFS in 1993, taking on the Fire Control Officer role for the Gloucester Shire Council. Following the Council amalgamation, Kam was promoted to the role of District Manager for the MidCoast Rural Fire District that includes Port Macquarie Hastings, MidCoast and Lord Howe Island. Supt. Baker is a highly respected and decorated Officer of the NSWRFS,

specialising in Incident Command and aerial firefighting operations. He has been deployed Nationally and Internationally to assist in numerous firefighting efforts, including leading a full Incident Management Team into Alberta Canada in 2015 to combat fires within the Province. He was awarded the National Medal for Service in 1999, Canberra Emergency Medal in 2003, and the Australian Fire Service Medal in 2007, before being awarded

Boat ramps directed to Council Dear News Of The Area YOU may be aware that I wrote to Council last week re the condition of the boat ramp near the bridge. The

story is in last week’s Nota. I received a report, with photo evidence of damage incurred to a boat trailer when using the Moira Parade ramp. In addition, I received

The Southern Area Reference Group has listed our dissatisfaction over some years now, to be met with the fact that MidCoast Council recognises the need to modernise, however the project is Shire wide and that we must take our turn in the queue. Recommendation was made under the Better Boating Program by the

One has to wonder if litigation may follow for damage to property, or life and limb. The purpose of this note is to bring to community notice that we, a growing tourist mecca, centred around water activities is being poorly compared to our neighbours. Karuah now has a modern, safe ramp and Port Stephens Council has modernised their ramps throughout the Shire. Not only that! Our existing ramps are now in such disrepair that damage is happening to equipment –hopefully no personal damage and boaties are vetoing the ramps. The Myall River Action Group has been at the vanguard of this campaign with little success and maybe it is time for the wider community to voice their dissatisfaction. I WOULD like to comment on the recent jetty time limits, from my photo you can see the very negative impact it is having on jetty use. The photo attached is one of three I took over the busy holiday period, all reflecting very little jetty use with new signs in place. I personally enjoy the jetty use with my boats and when alongside we have so many interested people chatting and many comments on how quaint the variety of boats alongside are and how they make the waterfront so much more interesting. Unfortunately we have had one local put in a complaint to the council about jetty abuse, firstly the complaint was not true and I feel we the jetty users should know who the person is, do they own a boat and do they use the jetty? If not I really feel they have no right to put in a complaint and feel council should have talked to jetty users before reacting so quickly. The complaint was regarding a Sydney couple who spend 3 months of every year visiting our area, I have seen them alongside half a dozen times in that time period, they stay a day or two, support local businesses as do most of the boats that stay a bit longer. The complaint, as told to them, was that they had abused the jetty staying alongside for three months, which is completely untrue. The jetty can often be crowded and mostly users are very polite not abusing the privilege. Most smaller boats only stay a short while fetching a coffee perhaps but to go to a restaurant for dinner, brekkie or lunch need a longer stay. The couple involved were alongside for about 4 days because the wife had fallen

and quite badly hurt herself so could not lift their mooring where they would normally have stayed until healed, they were quite upset and I would not expect them to return with friendlier options offered in Lake Macquarie, an opinion shared by quite a few others. We have Tony, our very popular and very fair waterways guy, who I am sure would handle any one abusing their jetty privilege. I feel the council can set far better time limits to offer much fairer usage. Like most parking bays times vary according to the time of day, I would think setting a two hour time limit on the downstream jetty as has always been in place, a four hour limit on the new upstream jetty, these limits set between 10am and 4 pm, after 4 pm any boat is free to spend the night. There should be a set down and pick up area for very busy times allowing someone to be dropped to fetch coffee or lunch while the boat simply stands off until ready to pick them up, this should allow everyone fair access. If the jetties are empty then users can use common sense to stay longer simply being aware that they must move if more boats need space. Signs would be useful for jetty use as many new boaties are not familiar with mooring etiquette, often two tinnies are tied up spread along the jetty blocking others use. Once docked the owners of any vessel can simply move their boats along to offer as much clear space for other users as possible. I would be interested in the thoughts of other jetty users and an explanation by our local winger, hopefully offering constructive ideas for our council to adopt. Jeff Schionning

LEARN to play Bridge; your brain will say “thank you”. Now that’s a pretty provocative claim, so what are the facts to back it up? We live in a community which is blessed with ample opportunities for outdoor activities, however these activities alone are not enough to keep your brain active and healthy. “Like all our muscles, brains need exercise and it is an established fact that one very effective brain exercise is playing Bridge. Most sedentary activities like reading and watching TV simply don’t provide the necessary stimulation” said Leslie Falla from Hawks Nest Bridge Club. “Neuroplasticity is the brain’s ability to change and adapt by learning new things, and you have the power to increase your brain’s growth at any stage of your life” according to Elle Kaplan, a US financial expert and entrepreneur. She argues that meditation, video and card games and reading are all effective and that Bridge is “one of the most challenging and brain-stimulating card games”. Bridge offers something for everyone, from all walks of life, all ages and physical conditions, and has an important social component. According to Dr Melissa Rogerson of the University of Melbourne, board games are enjoying renewed popularity due to the following factors: they are social; they provide an intellectual challenge or an opportunity for strategic thinking; they are material and tactile; and they provide variety – just like Bridge! Playing is inexpensive, can be done in airconditioned comfort, and requires no special uniforms. Drought loans for farm-dependent small businesses THE Minister for Drought and Rural Finance David Littleproud has announced the new Regional Investment Corporation (RIC) loan for farm-dependent small businesses which is available from Monday 20 January. “As drought continues to hit small businesses across rural Australia, the RIC’s AgBiz Drought Loans will offer financial relief,” Minister Littleproud said. “Small businesses are the lifeblood of our regional communities and they’re doing their best to serve farm businesses also affected by this drought. “Those businesses - livestock transporters, equipment repairers, harvesting contractors – can use these small business drought loans to refinance existing debt or just keep their businesses going until the drought breaks. Loans of up to $500,000 will be available with a two-year interest free period. Following those first two years, concessional interest-only payments will apply before principal and interest payments are required in the final five years of the 10-year loan term. Guidelines and application forms for these new loans will be available on the RIC’s website www.ric.gov.au on Monday 20th January.

Rain welcome but still need more WATER restrictions will remain in place for the MidCoast region, even after good rainfalls so far. MidCoast Council has indicated that while any rainfall is very welcome, it doesn’t dramatically change the situation with water restrictions likely to continue through January. Council's Director of Infrastructure and Engineering Services, Robert Scott said, "If we get some river flow down to Gloucester, we are hopeful we will able to pump some water for the town's supply and adjust the amount of water being trucked in. This will be a cost saving and also reduce the impact of heavy vehicle movements on our roads.” Rain will reduce the immediate pressures on our water supply. Follow up rainfall over the coming weeks and a general change in the weather patterns will be required before restrictions can be reduced. Mr Scott said Council will be watching the water quality of any runoff very carefully, given the first heavy rain following fires or long dry periods can wash all sorts of things into our rivers, resulting in significant impacts.

Level 4 Water restrictions will need to stay in place to conserve available water until river levels rise and water quality is good enough to allow pumping to refill the Bootawa water storage. "We would like to thank the MidCoast community, and our holiday visitors over this summer, for the big effort everyone has made to comply with restrictions," said Mr Scott. They went down 15-24. The remaining game was a disaster for the   team of Col Saillard, Dave Perry, Col Amos and Mark Hair. They opposed; Barry Goode, Mark   Nightingale, Graham Reynolds and Ron Webster.  Mark’s team were left stranded in the starting  gate and were marking time as the Webster  combination amassed 17 shots in the first 6 ends. From there on it was one-way traffic as Ron’s    side completed the rout 31-10.     Ouch!   blunted   19 January: More rainfall any run in the grass green today as the final of the Club Championship Fours got underway just after a heavy  downpour. When the entries were first posted it was obvious that the team of John Parkinson, Peter Gurney, Ross Barry and Danny Johnson were likely to be the team to beat. Their opponents, Ron Webster, Barry Goode, Mark Nightingale and Grahm Reynolds, showed great form in the semi-finals and I had an open mind as to who would run out winners. Unfortunately, the final turned out to be a onesided affair with the John Parkinson team exerting their dominance on the tournament with a great win 24-9. Congratulations to the winning team and condolences to all the losing sides in the competition. There is always next year! In other news: There have been some good teams entered in the Club Minor Pairs so far, but there is still room for more. The nomination sheet for the Club Minor Singles will shortly be posted and will present a wonderful opportunity for new players to test their skills. It is hoped that there will be a good field for this one.    



Community Generosity Floods Fire Appeal WHAT an extraordinary day, what an extraordinary outcome and what an extraordinary contribution by

The Board of the Hawks Nest Golf Club will be finalising details about the event over the next week with a view to the allocation of the funds raised to the Tea Gardens-Pindimar Rural Fire Service, the North Arm Rural Fire Service and to the wider bushfire appeal. This enormously satisfying total was only achieved with the wonderful support provided by the local business community in Tea Gardens and Hawks Nest, and beyond, who got right behind this fundraising appeal by making cash donations and or donating items which could be raffled, auctioned or given as prizes for the golf event.
