Flamingo Festival Fun, set for Saturday By Sandra CLARK LAST minute preparations are all that remain, in readiness for this year’s big day out on the Tea Gardens waterfront. The twin towns flagship event has crept up on us this year, and is on this Saturday. One of the new events this year is a pink flamingo race off ANZAC Park. There will be 20 flamingo floaties, competitors have to register for the event with a gold coin donation at the ‘Ticket to Ride’ sign next to the main stage to be in the race. “It will be fantastic fun,” said Roz Meehan a Stallholder Co-ordinator. Registrations will be open from 10am to 1pm so

VOLUNTEERS make a world of difference to our communities and indeed our nation. Many people find great joy in supporting organisations which help the community. At Marine Rescue Port Stephens, the opportunity to support the boating community are many and varied allowing volunteers to learn new skills while drawing their own mixture of vocational and life skills. “Volunteering comes in many guises and being part of an organisation, which saves lives on the water, can be extremely rewarding,” said Unit Commander Colin Foote. “Right now, we are looking for volunteers with retailing skills to assist the Unit in the running of our main fund-raising arm, our Gift Shop at our Nelson Head base,” said Mr Foote. Marine Rescue Port Stephens needs to raise over $150,000 each year to fund its operations which include two state of the art rescue vessels and a 24 hour 7 day a week radio and operations room. “All our people give generously of their time to undertake the many, many jobs within the Unit. Our important work on rescue vessels and in the radio room is supported by equally important volunteers who help with training, administration,
building and facility maintenance and raising the funds needed to keep our Unit operational,” Said Mr Foote. Volunteering Australia defines volunteering as “time willingly given for the common good and without financial gain”. Marine Rescue Port Stephens is interested in hearing people who are willing to give some of their time to volunteer and contribute to saving lives on the water.

case arising from an incident at Karuah Aboriginal Land Council office. In July last year, the police were called to an incident involving protesters and Mr Roberts. His car had been blockaded. While Mr Roberts was leaving under police direction protestors rushed stood in front of Mr Roberts car. A protestor claimed Mr Roberts had run him over. Mr. Roberts was arrested and charged by Police despite insisting he ‘was the victim not the perpetrator’. Following a 2-day hearing in the Local Court, Mr. Roberts was found guilty of common assault- however, because of the extenuating circumstances the court did not proceed to a conviction. Despite there being no conviction, Mr. Roberts insisted that an immediate appeal against the finding of guilt be made, and this occurred. Solicitor Greg McInnes, acting for Mr Roberts, said advised that, in a Ruling delivered by HH Judge Gartelman SC on 15 October 2019, the Appeals Court ordered that the appeal be allowed on all grounds. Mr McInnes stated that the decision was ‘so unequivocal’ that it was ordered that “all orders of the Local Court be quashed”. “No element of the Local Court decision was allowed to stand,” he said. “This brings the matter to utter finality. There is no further avenue of appeal available to the Crown,” Mr McInnes said. “The judgement delivered was both

Legal correspondence often contains the term “without prejudice”. The term is one of the most used legal phrases, however it is often misunderstood. The term “without prejudice” is most familiar to litigation lawyers, but it is also frequently used by lawyers in transactional matters, and also by lay persons. The rationale behind the “without prejudice” rule is that, as a matter of public policy, parties should be encouraged to settle their disputes without going to Court. The term “without prejudice” refers to the legal privilege attached to a communication that is specifically used for the purpose of negotiating a settlement. It restricts any such communication from being relied upon in Court proceedings. A “without prejudice” communication is a
communication, either written or oral, made in the context of genuine settlement negotiations. Whether a communication is actually “without prejudice” requires a consideration of the circumstances in which it was made, and whether it was in the context of genuine settlement negotiations. Simply labelling the communication “without prejudice” will not suffice. Mediations or settlement conferences are often forums which are conducted “without prejudice”, as are written offers of settlement. It is not a requirement that a communication be labelled “without prejudice” in order to gain the protection of the rule. However, it is recommended that all communications made in the context of genuine settlement be labelled “without prejudice” if that is the intention of the party.

LOCAL AFL prospects are looking up with some junior players selected into both the Sydney Swans Academy and Hunter Sports Academy programmes for the upcoming 2020 season. Port Stephens Power AFL Club now has two Swans Academy players in Madison Jewell and Joshua Bohan, with Madison being selected to start her first year in the academy in 2020. Madison told News Of The Area, “Being in Swans Academy is a big step from club level, to me it means one step closer to fulfil my one big dream of playing in the AFLW competition.” Hunter Sports Academy also has a programme running and after recent trials, Power players Nash Cameron and Rhys Hay were offered positions. Progress Report By Gordon GRAINGER THE Tea Gardens / Hawks Nest Progress Association met on Monday 14 October and hosted a large number of residents wishing to express their concerns regarding the lack of progress to a second access road to The Grange / Palm Lakes residential area and the proposed new housing development on Booner Street Hawks Nest. Residents of the Grange and Palm Lakes are concerned of the safety aspects of only one access road in the case of emergency, particularly with the onset of a severe bushfire season. They report that 600 homes have been built since the year 2000, with over 1000 residents, 800 cars, caravans and trailers, dependant on one only access road in the event of fire. They have submitted a petition of in excess of 600 signatures and are waiting on response from Council. They believe Council were provided funds from a developer to provide a second access road and have asked Councillor Roberts to follow up. A local resident, with considerable experience in the subject has done a detailed analysis of the area and it was suggested he present his findings at the next Southern Area Reference Group meeting to be held 1 November. Residents and homeowners in Hawks Nest have expressed concern

over a proposed building development on the corner of Booner and Yamba Streets. There are many objections including height, traffic, street amenity and flora and fauna. Because of the diversity of concerns, it was suggested they form a group, elect a spokesperson and begin discussion with Council. That was agreed and a community meeting scheduled to be held in the near future. Other matters discussed at the meeting, included the following. • Put next Saturday, the 27th aside for the River Festival on Marine Drive. Many more stalls and fun activities for all. • Letters of support naming the 3 public wharves have been submitted to Council. The process will now involve Council initiative requesting public input, then follows submission to State Naming body. (nothing is easy) • The river clean-up will be held in March 2020. Details will be advised, following an exploratory dive in Jan • A local radio station licence has been obtained through the Chamber of Commerce. A committee has been formed and premises will shortly be decided. Enquiries have been made to Crown Lands on leasing the waterside building on Marine Dr. • The next round of Council and community meetings will soon begin. Tea Gardens meeting will be held on 27th November. • Footpaths, cycleways etc. are now grouped under a Council plan “Pedestrian Access Mobility Plan” or PALM for short. We would urge those in the community to bring their suggestions / concerns to the November meeting • The next Progress Assn meeting will be held on Monday 11th Nov. It will be the AGM and nominations will be called for all positions. All welcome

THE fishing event for the weekend had it all, the people, the fish and the ever needed rain we all so desperately need. Friday 11th til Sunday 13th October 2019 was the second family friendly Tea Gardens Country Club Fishing Club outing for the new 2019 - 2020 season. Rain, hail or sunshine didn't stop the recreational anglers. Juniors, ladies and mens divisions all weighed some fantastic specimens with only the most experienced topping the scales to win the weekend event.

The secret fish selected from the bag was a luderick and Bill Thrift had a bag of large luderick to win the biggest secret fish for the outing. Graeme Anderson won the secret weight of the total catch any club angler could strive for, leaving only the total points score for the outing winner. One hundred and ninety three points gave Bill Thrift another outing win and the win also credits the years of experience he has angled through-out his recreational angling hobby. Well Done Bill. Tea Gardens Men’s Bowling Club By The JAFFA VALE Colin Farrugia: It is sad to report that after a prolonged illness Colin Farrugia passed away last Wednesday. Colin was well known to most bowlers and was a devoted member of our Club for many years. He overcame many obstacles in order for him to continue bowling and stoically continued on with the sport that he loved in spite of those. He represented our Club during the Pennant season and enjoyed the companionship and camaraderie of fellow players. Bowlers are invited to attend Colin’s funeral next Friday 25 October at 2.00 pm at the Tea Gardens Catholic Church.
