By Sandra CLARK “WE DID IT!” an excited and exhausted Kerry Paterson told News Of The Area, after the Pearls group met their target at this year’s Buy My Wardrobe fundraiser, held at the Myall Festival event last Saturday. Their goal was to raise above last year’s total and give even more funds to drought affected farmers. “We raised an astounding total of $4000.00 from sales of second hand clothes, a raffle and donations,” Kerry said. The raffle winners were, First prize ticket Red A51 Dan Wells. Second prize ticket Red C87 to Deb and Third prize Blue ticket A15 won by Shirley. The Pearls would like to thank everyone in the local community for your generous support of their efforts, donating clothes for sale, to Emily and Ben at the Tea Gardens Hotel for allowing them to utilize the Dolphin Room and to Carole Richards for her energy and time with Pearls who modelled in the Pop up fashion parades.

Bulahdelah Show’s President, Mr Gary Gooch (OAM) said, “The Committee and I are looking forward to seeing you and your family at our annual show on and we have a bumper program in store for all.” The show will be opened by Mid Coast Council Mayor David West at 2pm on Saturday 16th November. It is common for a loan agreement to grant the lender an equitable charge or mortgage over the borrower’s property as security for the loan, particularly where the loan is between related parties or a registered mortgage already exists. The question which often then arises is whether the lender should register a caveat over the property to protect their interest. The simple lesson from the recent case of LTDC Pty Ltd v Cashflow Finance Australia Pty Ltd [2019] is that a caveat should be registered, otherwise the lender risks having a later loan or interest take priority over their loan. In this case, a loan was provided by Cashflow Australia (‘the first lender’) secured by an equitable charge over property however, the first lender did not register a caveat. Another loan was then obtained from

LTDC (‘the second lender’) secured by an equitable mortgage over the same property and the second lender did register a caveat. The borrower subsequently defaulted and the property was sold. A dispute arose between the first and second lenders as to which loan took priority. The first lender’s equitable interest arose first so, presumptively had priority. The second lender argued however that the first lender’s equity should be postponed because of its decision not to register a caveat. Justice Darke of the Supreme Court concluded that in the circumstances, the second lender had the better equity. The first lender knew that failure to take the simple and inexpensive step to register a caveat may lead to the creation of subsequent interests but chose to run that risk.

Safety and the Arts, the Hon Paul Fletcher, said in the digital age the sector is facing profound and continuing change and the funding will help regional publishers invest for the future. “The Federal Nationals in Government recognises the challenges facing regional publishers and local newspapers as they reshape their business models to deal with the digital landscape and put themselves on more sustainable footings for the future,” Minister Fletcher said. “These grants provide regional our publishers with the opportunity to invest in new technologies to support news gathering skills development and digital initiatives.”

LOCAL company Myall Coast Communications Pty Ltd which readers would know very well as News Of The Area (NOTA) has been awarded a Government Grant to support the sustainability of the local publishing activities, including news gathering, production and distribution. The small company which produces Myall Coast News of the area and more recently Port Stephens News Of The Area, is one of 62 small and regional publishers across Australia to share in around $9 million of funding under the Federal Coalition Government’s Regional Grant Opportunity program to support local journalism. Minister for Communications, Cyber

Federal Member for Lyne Dr David Gillespie, congratulated News Of The Area and said the funding will provide a much welcomed boost in journalism and news gathering for the region. “News Of The Area has demonstrated a solid business case to increase publishing activities for our region,” Dr Gillespie said. The Regional Grant Opportunity program is overseen by the Australian Communications and Media Authority (ACMA), which received 113 applications for the grants. Newcastle Newspaper Pty Ltd which produced the Newcastle Herald was also awarded funds. The full list of recipients is available on ACMA’s website at: www.acma. gov.au/innovationfund Each application was assessed according

to three merit criteria: public interest journalism; editorial policy and complaints handling process; and the quality of the business case. Of the 62 grant recipients, 25 will be funded in full and 37 will be part funded. News Of The Area published Michael Wright said the Grant provides a welcomed boost to ensure the longevity of the local community news source. “Delivering relevant local community information from an unbiased source is still well regarded and by people - this probably will be the case for a long long time,” Mr Wright said. “In ensuring this community news source is here for the long haul, it’s important for us to heavily increase our engagement within the Port Stephens and Myall Region communities.” “This Grant will go a long way to doing  that for us,” Mr Wright said.

Hunt for lost koalas MYALL Coast residents are invited to a special presentation by renowned wildlife ecologist George Madani, who has been tracking koalas in the area since last year. George will deliver the results of his intensive study to a public meeting in the Uniting Church hall on Myall Street, Tea Gardens, at 3pm on Thursday 7 November. In 2018, the Myall Koala and Environment Group invited George and a small team of ecologists and volunteers to carry out a

survey of Myall Coast koala habitat and their presence. The survey took place on local private land agreed to by landholders, on Council land and in parts of the National Park. As part of his public talk presenting his findings, he will also share many littleknown facts about koala biology and behaviour. There will be discussion about threats to the vulnerable koala populations in NSW. George Madani is a freelance wildlife ecologist who specialises in targeted

endangered species monitoring programs and remote area fauna surveys. While his chief passion is for illusive micro-bats and obscure frogs, he also scales tall trees to catch koalas for research purposes. Although George admits that battling belligerent, agile koalas in the heights of the canopy is not his favourite pastime, he certainly values their significance as an umbrella species for the protection of all other creatures that co-exist alongside them.



THE Myall Community Art and Craft Centre are again holding their annual Christmas gift appeal to aid the Salvation Army. In previous years this has been well supported by the local community. A Christmas Tree at the Craft Centre is waiting to be surrounded by gifts to be distributed to local families in need. The tree is located in Room 1 at the Centre and the Salvation Army will be picking up the gifts in early December, so call in and put a gift under the tree.

They are in need of new items for all ages, not gift wrapped as they need to be sorted into age groups for distribution. Janette Coppock from the Myall Community Art and Craft Centre said, “I am sure your generosity will be appreciated by the recipients of your gifts.” “If you haven’t visited the Craft Centre before, call in and check out the different craft groups on offer and browse through the craft shop,” she said. THE Tea Gardens Baptist Church on Myall Street is holding a fundraising market on 2 November from 8.30am-12 noon. Sue Roberts told News Of The Area, “The funds raised will go towards a mission in Indonesia that we support both overseas and locally.” The Tea Gardens Baptist Church supports missions both in Australia and overseas. “In Indonesia, we support a cafeteria which provides councillors within the ministry,” she said. People are welcome to put a car boot stall for a $20 donation. There will be plenty of bargains and this could be the place to start stocking up on special gifts for Christmas. There’s an emerging theme for this market and that is there is something for everyone, including: bicycles,household items, jewellery, toys, porcelain dolls, craft and general bric a brac stalls. Not to mention a great range of plants which you can use this sprint to freshen up your garden. Everything must go, and it is all going to a good cause with all proceeds going to those less fortunate than most. Sue encourages locals to drop by and while you enjoy the markets sample the sausage sizzle and free morning tea. Local Verdelho Wins Gold By Marian SAMPSON

BULAHDELAH’s Old Inn Road Winery is celebrating the success of its Verdelho which has just won two medals at international wine shows here in Australia. The 2019 vintage of Verdelho is putting the Mid North Coast on the map as a great region for growing Verdelho grapes.

Growing grapes depends on the ‘terroir” or the soil, and commonly defines the specifics of a place that influence how well grapes grow including climate, soil and aspect. The Old Inn Road Winery 2019 Verdelho won a gold medal at the Cairns International

Wine Show which is the first show of the season. It followed up on this success with a Silver Medal at the Australian Small Wine Makers Show which was held at Stanthorpe in Queensland competing against entries from Australia and New Zealand. Dale Bradshaw told News Of The Area, “For us the ultimate test of the wine is whether our customers like the wine, but the shows provide us with independent verification that the wine is good, results at the shows confirm what we are doing in the vineyard and winery is meeting customers expectations.” While the majority of the wine growing in NSW is based in and around the Hunter Valley, the Old Inn Road Winery on the Mid North Coast has shown that Bulahdelah has more than what it takes to make great wines. Verdelho pairs perfectly with shellfish and of course you couldn’t go past a bottle of Old Inn Roads 2019 Verdelho paired with freshly shucked oysters.

MIDCOAST Council’s economic development team is inviting local businesses to come along to the second of a two-part, free workshop designed to assist in building knowledge around Council’s tendering and procurement processes. Tendering for Council projects can open up valuable growth opportunities for businesses and these workshops are designed to help potential operators better understand the process, as well as identifying relevant and realistic opportunities. Workshop topics for part two include: - Engaging with Council. How to do it and what is different from other organisations. - Matching your submission to the Council’s requirements – understanding what’s important to Council’s procurement decision-making. - On-line tools - A walk -through demonstration of an on-line submission for MCC - Panels: what they are, how they are used, and what that means for suppliers. “The workshops will provide important insights into Council’s tender and procurement processes, as well as help local businesses to improve their capacity to supply goods and services for the many and varied projects we put out to market each year,” said MidCoast

Council’s Economic Development Coordinator, Robyn Brennan. “We appreciate the Council procurement process is quite specific and can be complex, these workshops are designed to break down the exercise and equip operators with the knowledge and confidence to put their business forward as a prospective supplier. Businesses interested in tendering for Council work should come along, even if you didn’t attended the first round of workshops” The second series of workshops will be held at MidCoast Council's Chambers in Forster from 5.30pm to 7.30pm on Tuesday 12 November, and at the Visitor Information Centre in Taree from 5.30pm to 7.30pm on Wednesday 13 November. Col Lange, one of Australia’s leading tender evaluation management consultants, will again facilitate the workshops. “We encourage local businesses to reserve their place at one of the workshops as soon as possible to avoid missing out on this great opportunity,” Robyn added. WITH 100 stalls lining Marine Drive last Saturdays Myall River Festival was the biggest ever. Stall holders arrived as early 6.00am coming from as far away as Armidale and Coffs Harbour to join representatives from many of our local artisans and community groups. I  think the first question you need to ask yourself is whether you want to be a dedicated follower of fashion or a fashion setter. Do you want to follow the status quo like a mindless sheep, or would you prefer it if people look at you with a sense of wonderment? The important thing is to own your look. I mean, Lady Gaga once wore a dress made of raw beef to the MTV awards, so I guess if you want to try something new you could slap on some veggie burgers and tofu and call it ‘sustainable statement wear’ Though I haven’t worn food as an outfit, during an extreme vague out, I did wear my pyjama top to Salamander shops and unfortunately ran into several people I knew. Now if it had been a slogan-free top, I probably would have managed to get away with it, but since it said ‘Bra Off. Pyjamas On’, all I could do was stand tall, push my chest out and throw caution to the wind in a sad, I’m free to do what I want, peri-menopausal kind of way. There are many outfits that have been fashion statements that are now cringeworthy, but they will undoubtedly come back in eventually – shoulder pads, taffeta, fingerless lace gloves, stirrup pants, fluoro shirts, happy pants, g-string leotards – and that was just the 80s. As someone who works from home, my dress standards have dropped to an appalling level, but I like to think I am so far ahead of trend that one day others will catch up. If you notice people wandering around Port Stephens in three-quarter trackies and Birkenstocks, or fetching Hare Krishna saris, just remember who started it. A very close contest on the next rink 14 all on the 16th end but Pam Gilchrist and Dot Dallas won the next 2 ends winning 16 v 14 against Judi Polak and Kayelene Pearson. Leona Clissold and Liz Kelly proved to be too strong competition for Dorothy Thompson and Judi McGavock, result 20 v 9. In fact Development assessment is not a function of the Local Government Act and thus not generally a function of councils. The power for councils to consider DA’s is delegated from the NSW department of Planning and that power can be withdrawn at anytime. Councils are only empowered

to approve or reject DA’s. It is important to note the process for DA assessment. 1. An applicant lodges a DA 2. Council staff check the DA and then notify the neighbours etc about the proposal seeking comments. 3. Council staff then assesses the DA against the development control plans and the submissions from the public and government agencies. 4. Staff then makes a draft determination to; reject it, ask for it to be amended, approve it under delegated authority or, if marginal or controversial, send it to the councillors to consider with a recommendation for approval or refusal. Councillors do not get to see the DA unless it comes before council. They are not allowed to be involved with a DA prior to that as it breaches the code of conduct and may be considered corrupt conduct under ICAC guidelines. Having said that, it is not wrong for a councillor to give general advice on what a submission should contain. Submissions should address the issues that council can only lawfully consider, such as height, bulk and scale, traffic, noise, shading, heritage

and public interest. It is important that any submission is lodged with staff and not councillors. It is a good idea though to email a copy to a councillor, so that they are aware of any concerns but be mindful that they cannot get involved until it goes before council which may be months away. .

The Rock Roadhouse

I am often asked if I know what is happening with the Rock. A DA has been lodged by Coastal Service Centre, for the reconstruction of the “rock” but not in its original form, (as it would not meet building standards) but is being rebuilt on the same footprint. The plans show the same area is being used for the petrol station and office which will be the existing tenant, (United). United is operating in temporary accommodation. The rest of the building is capable of containing various outlets as per any service centre. There is no particular brand indicated and council is not aware of any outlet that has indicated

intended occupation. It would appear that although the original construction will not be built it appears that it will be rock like. There is an approved service centre that is supposed to open at the end of the year at Nabiac that is suggesting it has several brand outlets ready to go in. There is a proposal for a service centre at Bulahdelah that has been lodged and is being assessed at state government level. This may account for some of the rumours that have been circulating regarding the Rock.

Community Conversations Council will be coming to Tea Gardens - Baptist Church - Tuesday 26 November, 6pm and Stroud - School of Arts - Tuesday 12 November, 6pm. Bulahdelah was last week and it was an excellent meeting with great input from residents.

On Tuesday 22 October the ladies at Hawks Nest Golf Club had a special day q Best dressed team: Marie Pegram, Carol Wiggins, Carol Maher, (Frances McClean not in photo) playing a team event with the theme for the day, ‘Pink/Teal’. Sixty-four ladies took part with some teams going to a lot of effort with their costumes with the best dressed team getting a box of Maltesers each. Every lady paid $2.00 for a metre ribbon which they could use instead of a stroke and Andrew our Pro hit balls over the dam for us for another $2.00 each, we were all thrilled to be nearly on the green for one shot; how good is he! There was lots of fun in the Clubhouse (ie) guess how many snake lollies in a jar, numbers competition and an auction of over

Bulahdelah Cricket Club By Erin MATHESON THE opening season for cricket started Saturday the 19th with our junior team participating in the U14's comp and the men's team playing in the 3rd grade division. We would like to acknowledge and thank our major sponsor Access Fuels as well as R and R Property and Barry Bros Butchery. Also, a special mention to the CWA for their kind donation. All of their support is vital in helping the players of our club to engage in a great summer sport and to represent our town in the Manning Competition. On Saturday, 19th October U14's were defeated by Great Lakes in the opening round of the season. Bulahdelah batted 1st and were 4/133 and Great Lakes were 4/157. Best batsmen of the day were Zane Pringle and Nate Redmam (19 runs each) and Charlie Matheson (16). Best bowlers were Kurtis

Barry and Nate Redman with 1/11. The 3rd grade team defeated Old Bar Harrington at Harrington. Bulahdelah batted 1st and were all out for 174 runs and dismissed Old Bar for 136. Round 2 took place on Saturday the 26th. U14's were defeated by Taree West in Bulahdelah. Bulahdelah batted first and were all out for 73 runs. Taree West then passed the total with only 1 wicket in hand. Best batsmen on the day were Charlie Matheson (17), Kurtis Barry (15) and Blake Matheson (13). Best bowlers were Blake Matheson 2/4 off 3, Charlie Matheson 2/12 off 2.3, and Isaac Redman 1/1 off 2. The 3rd grade team defeated Taree United in Taree. Bulahdelah bowled Taree United all out for 149 and passed the total with 1 wicket in hand. A great effort was put in by all players and the club wishes both teams a successful and enjoyable season.

Seleana Murphy announced as the Myall Lakes Young Person of the Year ON Saturday 26 October 2019, Tuncurry Beach Bowling Club hosted the Myall Lakes Community Awards hosted and presented by The Honourable Stephen Bromhead MP andaided by The Honourable Geoffrey Lee MP, Minister for Skills and Tertiary Education. Due to the ongoing bushfire emergency crowd numbers were down and Mr Bromhead acknowledged this by saying that the community comes first and that he’d like to thank allthe emergency service workers for their dedication to protecting the community. The nomination process was anonymous and open to anybody in the Myall Lakes electorateand the nominations were judged

by an anonymous panel who selected the recipient of each category: Myall Lakes Cultural Award, Myall Lakes Junior Sports Person, Myall Lakes Sports Person of the Year, Myall Lakes Community Group of the Year, Myall Lakes Young Person of the Year, Myall Lakes Senior Person of the Year and Myall Lakes Citizen of theYear. Local Fire Help to Forster By Sandra CLARK SATURDAY'S wild weather stirred up fires to our North in Foster and Tuncurry clearly visible from the Tea Gardens waterfront. Our local Pindimar Tea Gardens Rural Fire Brigade volunteers were deployed again on Sunday. Here are some of the comments left on the RFS website following operations that day in locations our firefighters attended. “I just wanted to thank all the fire fighters who fought the fires near our home in Tuncurry. Please give our heartfelt thanks for their brave efforts. I live in Crystal Waters Village in Tuncurry and always felt they were looking after us. Again, thanks for all your efforts,” Trevor and Maralyn.
