The law does its best to guess who should inherit when a person dies without a Will but it is no substitute for a Will itself. This is illustrated in a recent case of Rakovich v Marszalek [2020] NSWSC 589 where a lot of cost and anguish could have been saved with a Will. The deceased died in NSW without family in Australia. He had emigrated from Germany more than 50 years ago. He had nephews and nieces in Germany whom he had never met. In the absence of a Will, however, they were entitled to his estate of nearly $1.5m. A male friend, not a lover, lived with the deceased providing him with comfort and support for many years and was living in the deceased’s home when he died. He claimed provision from the deceased’s estate. Was the friend telling the truth about his friendship? Since the deceased could
not give evidence, should the friend be believed? The Judge thought the friend to be a truthful witness. The Judge also took note of the cards sent by the deceased to the friend, medical records which showed the friend’s involvement with the deceased and some evidence from a neighbour. The Judge held the deceased had a social, domestic and moral obligation to make provision for his friend. He awarded the friend 45% of the estate sufficient to allow him to purchase his own home. Interestingly, although the friend had made offers to settle the case, the Judge thought that the German family were entitled to test the friend’s evidence and so the family was not penalised (legal costs-wise) for failing to settle the case. Liability limited by a scheme approved under Professional Standards Legislation
