Catherine Cusack Sacked after crossing floor By Marian SAMPSON NSW Premier Premier Gladys Berejiklian, has sacked Member for the Legislative Council for the Hunter, Catherine Cusack, after she crossed the floor last week over the contentious koala policy. Ms Cusack has been the region's most recent representative on the Legislative Council. Prior to voting Ms Cusack stated that the bill had โzero to do with protecting koalasโ. Ms Cusack crossed the floor and voted with Labor, the Greens, the Animal Justice Party and Independent Justin Field in favour of the inquiry.
In crossing the floor, the bill was defeated 18 to 19. This is the second time that this bill has caused controversy with Nationals Leader and Deputy Premier, John Barilaro, having previously threatened to move his MPs to the crossbench over the policy. Cusack said in her speech to parliament, "It's to try to patch up a political disagreement, and I would dearly love to see that solved, but it is just too costly if it comes at the expense of koalas." Premier Gladys Berejiklian said in a statement, "Following her decision today to move a non-government amendment to a government bill, I have

of the man, police located and seized more than $1300 cash, methylamphetamine and a knife. They both remain before the courts. Following further inquiries, about 8am on Tuesday 17 November 2020, investigators arrested a 37-year-old man during a vehicle stop at Myall Way, Tea Gardens. In a subsequent search of the vehicle, officers seized 25g of methylamphetamine (ice), cannabis and $1470 cash. A short time later, strike force investigators executed two search warrants at homes at Hawks Nest and Barraganyatti, where officers seized further amounts of methylamphetamine (ice), cannabis and prescription medication. Officers also seized $4000 cash, prohibited weapons, mobile phones and two vehicles โ a silver Subaru WRX STI and stolen Toyota Hilux. All items seized will undergo further examination. The man was taken to Raymond Terrace Police Station where he was been charged with 18 offences; โ Supply prohibited drug (x6); โ Supply prohibited drug (indictable quantity x7); โ Supply prohibited drug on an ongoing basis (x2); โ Knowingly deal with proceeds of crime; โ Possess prohibited drug; and โ Deal with property proceeds of crime. Police will allege in court that the man has supplied more than 500g of methylamphetamine (ice) over a four-month period. He was refused bail to appear at Raymond Terrace Local Court on Wednesday 18 November 2020. Investigations under Strike Force Myanga are continuing.

$100 million announced for sports facilities By Doug CONNOR
LOCAL sporting groups and governing bodies have welcomed the announcement of a new $100 million Greater Cities and Regional Sports Facility Fund announced in the 202021 NSW Budget, designed to stimulate local economies, boost employment and promote healthy lifestyles across the state. Acting Minister for Sport, Multiculturalism, Seniors and Veterans, Geoff Lee said the multimillion dollar initiative would help create and rejuvenate sporting hubs in communities hit hardest by the COVID-19 pandemic. โRight across NSW, community sport is the heart and soul of our social fabric and we want to make sure we have the best infrastructure for our state,โ Mr Lee said. โ$100 million will be injected into improving facilities spaces across metropolitan and regional NSW to enable more people to participate in sport and active recreation. โBy investing in new and existing infrastructure we will encourage participation in grassroots sport and create employment opportunities as part of the
NSW governmentโs multibillion-dollar infrastructure pipeline.โ The funding will be delivered over two financial years, with $50 million on offer in 2020-21 and the second $50 million in 202122, divided equally between NSWโs major cities and regional areas. Northern NSW Football CEO, David Eland told News Of The Area the announcement was a great opportunity for local sporting groups. โIt is a great opportunity for football locally as the sport is really well positioned to take advantage of the fund. โThe timing is absolutely perfect because Northern NSW Football just released our State Infrastructure Strategy, and have also provided each of our member zones with their own strategy which identifies and prioritises projects. โThe outcomes of our strategy identified a significant need for improvements in lighting, pitches and changing facilities,โ Mr Eland said. โFootball Mid North Coast have a facility strategy as do North Coast Football. โWe have identified a whole host of projects which are required in those areas.โ

Bettyโs memoir is about resilience and strength, as a daughter reconciles the damage and trauma wrought on families by war. Betty grew up knowing very little about her father Antoni. She knew that he had fled Poland after WWII, that he had disappeared one night when she was a baby, and that his brief reappearance when she was a young adult had been harrowing and painful. Fifty-five years after he deserted her family, Betty became determined to solve the mystery of her absent father and discover exactly who was Antoni Jagielski. Bettyโs search took her to Poland, where she unexpectedly inherited a family apartment from a half-sister she had never met. Sifting through photos, letters, and other clues from her fatherโs life, she put together a more complete picture of Antoni:
Polish resistance fighter, a Catholic political prisoner, survivor of Auschwitz and Gusen concentration camps, an exile in post-war England, and a migrant to Australia. It appears being a model may not always be as glamorous as it seems. In 2015, Ms Nihill fell four metres onto rocks at North Head in Sydney during an unpaid photo shoot. Ms Nihill commenced proceedings in the District Court against the agent, Vivienโs Model and Theatrical Management, together with the photo shootโs photographer and videographer for negligence. Ms Nihill alleged the photo shoot required her to walk down a treacherous path to access the location, which involved abseiling a rock face and crossing a rocky ledge which subsequently led to her falling. The agent argued in the defence that Ms Nihill had engaged in a dangerous recreational activity at the time of the injury pursuant to section 5L Civil Liability Act 2002 (NSW). Ms Nihill asserted that the relevant activity was โmodellingโ which had no inherent risks. The Court disagreed, instead finding that it was a recreational activity by reason that Ms Nihill was required to journey through a National Park, and participate in an activity in a public space where people ordinarily engage in pursuits for enjoyment, satisfying the definition of section 5K(c) of the Civil Liability Act 2002 (NSW).

This finding serves as a reminder that not only will the nature of the activity impact on whether it is โrecreationalโ, but also the location of the activity will have a bearing. In order to consider whether the activity was dangerous, the Court examined both the likelihood of an injury occurring, as well as the potential seriousness of the injury. The Court noted that the plaintiff accepted both that a portion of the journey requiring abseiling and walking along slippery rocks on the seashore was dangerous and if she fell, she could be seriously injured. The Court found that the activity of walking along tidal rocks which could be slippery was a dangerous recreational activity within the meaning of section 5K of the Civil Liability Act 2002 (NSW). The Court determined that whilst the accident occurred in the course of the plaintiff undertaking modelling, the harm was caused as a result of her slipping and falling whilst walking on tidal rocks, and it was this risk of harm that was obvious. The Court found against Ms Nihill, entering verdict and judgment for the defendants: Nihill v Vivienโs Model and Theatrical Management & Anor [2020] NSWDC 131. Myall Lake Matters By Sandra MURRAY WE have reached the last week of November and summer starts next week with a wet one still forecast by the Bureau of Meteorology. This is due to the effect of โLa Ninaโ, a natural cycle that warms the northern waters and increases rainfall, at least until February. So, more summer storms on the way. Onto the beach and more dingoes are out and about, including in picnic and residential areas. Dingoes are still classified as wild dogs by the NSW State
Government. The management of dingoes seeks to balance the risks they pose with the need to preserve their important ecological role, such as eliminating feral pests. The NSW Department of Planning, Industry and Environment advises that feeding dingoes does not help, so let others know, especially visitors to our beaches and parks. Around to North Arm Cove, and โCove Coffeeโ opened at the community centre last Saturday 21 November, selling locally made hot drinks, scones and cakes.

Disaster assistance available DISASTER assistance is now available in the Mid Coast local government area in response to storms and flooding that occurred from 20 October 2020 onwards. Assistance is being provided through the jointly funded CommonwealthState Disaster Recovery Funding Arrangements (DRFA). Minister for Emergency Management, David Littleproud said the severe
thunderstorms, heavy rainfall and damaging winds caused widespread damage across the impacted councils. โThis was a series of serious storms which caused significant damage to local roads, businesses and residential properties, resulting in localised flooding and storms,โ Minister Littleproud said. โThrough the DRFA, a range of practical assistance measures are now available

Community Donations Policy feedback MIDCOAST Council is seeking feedback from the community about its revised Community Donations Policy. The revised draft Community Donations Policy, is being placed on exhibition for community feedback, to assist organisations to deliver projects and activities that support local connections
and the retention of unique, diverse and culturally rich communities across the MidCoast. While the policy was first adopted by Council in March 2019, the revised policy was submitted to Council in May this year, with minor amendments relating to wording in relation to eligibility. Councillors have since
workshopped the updated policy and it was decided at this weekโs meeting that it will go on public exhibition, with all feedback provided by the community to come back to Councillors. With the amendments the multi-faceted program proposed in the policy still aims to support social connections through programs and partnerships
and is designed to allow funds to be allocated to changing community priorities. Proposed changes to the policy are: - the inclusion of โInnovationโ as a principle guiding the implementation of the policy - the specific exclusion of schools and P&C organisations from eligibility - the inclusion of the applicantโs current financial position in the assessment criteria - changing โessential community servicesโ to โemergency servicesโ for eligibility for the Recurrent Donations Program (Rates and Fixed) to provide clarity around eligibility

ANY Myall coast commuters into Newcastle area are advised of changed traffic conditions from this weekend on Cormorant Road at Kooragang Island to carry out essential maintenance work to provide a smoother road surface. The fast lanes of Cormorant Road will be closed in each direction overnight from Sunday 22 November to carry out road repairs and concreting work. To minimise impacts to motorists, work will be carried out from 7pm to 5am from Sundays to Thursdays and is expected to be completed in four weeks, weather permitting. Traffic control and a reduced speed limit of 40km/h will be in place for the safety of workers and motorists. Motorists are advised to drive to the conditions, and follow the directions of signs and traffic control. Transport for NSW thanks motorists for their patience during this time. We have become so used to autocorrect that we no longer have to think and many people have become sloppy writers. Now, let's turn to your question. Tom, it very much depends on the context. I'll throw you some examples to illustrate: Counsellor Mufti Moo is an absolut moron. How'd he even get a job on counsel? In this example, the writer is being derogatory and negative, so you would have every right to say, look champ, for someone who has three spelling mistakes in two sentences, who are you to criticise? A social media argument would ensue with other people weighing in and you could happily spend your evening engaging in some wholesome argy-bargy until one of you gave up and decided cleaning the budgie cage or stabbing yourself with a blunt instrument was a more fruitful and satisfying way to end the day. If, however, the post was along the lines of: Dear neighbours, my 14-year-old Labarador has gone missing and I'm desprat to find her. Please let me know if you spot her. She answers to Lottie, it would be poor form to say, well, you shouldn't even have a Labrador if you don't know how to spell the breed. Maybe Lottie has gone to retrieve a dictionary to show you how to spell desperate. Writing that response is just nasty, but a quite clever insertion of the word retriever (get it? Golden Retriever?). The point I am trying to make is that there's a time and place for being a pedant. Maybe reserve your intelligence for a more worthy platform. Carpe diem, Jasminda.

Nationals claim budget success LOCAL Nationals representatives say that healthcare, roads and public housing in Myall Lakes are all receiving a boost thanks to the 2020-21 NSW Budget. Member for Myall Lakes, Stephen Bromhead, said the recent budget announcement is delivering vital funding for the redevelopment of Manning Base Hospital, Forster Public Hospital, the Northern Taree Gateway and both Aboriginal Housing and Public Housing in Myall Lakes, thanks to the community working together with the NSW Nationals in Government to get these important projects over the line. โLast week I announced $1.5million to progress the $100million dollar stage 2 upgrade at Manning Base Hospital and that planning for Forster Public Hospital would continue thanks to a $7.9million pool of planning funding. Today the proof was in the pudding,โ Mr Bromhead said.
โThe NSW Nationals in Government are also delivering $910 000 to upgrade the intersection as part of the Northern Taree Gateway project this will ensure better outcomes for businesses and families, whether transporting food and fibre, travelling for leisure, or driving home after a long day at work. โFunding was also following for housing with $485 000 committed for new Aboriginal Housing in Forster and $520 000 for capital works on Aboriginal Housing in Taree. โFunds are also flowing for Social Housing to both upgrade and new supply,โ Mr Bromhead said. โThe NSW Government are also delivering for Tourism and Hospitality by giving every adult $100 in vouchers to spend on dining and entertainment. โThis will provide a major boost bringing $5.5million into our local economy for the industries which were hardest

Not Much For Port In State Budget By Marian SAMPSON THE NSW Government has handed down its budget with a record spending spree aimed at creating jobs and reigniting the economy in the wake of COVID-19. Member for Port Stephens Kate Washington, told News Of The Area, โThe budget has plunged into deficit and the Liberal Government is being forced to borrow billions of dollars, but very little is making its way to Port Stephens.

people surveyed across the nation for the 19th annual Youth Survey, including 6,639 young people from New South Wales, the report provides evidence of young peopleโs highest concerns. NSW youth indicated Equity and Discrimination, COVID-19, the environment and mental health as the most important issues in Australia today. Nearly three in 10 young people from NSW reported they had been treated unfairly in the past year, most commonly due to gender. Other reasons for unfair treatment were race/ cultural background and mental health. Mission Australiaโs State Director Nada Nasser said, โThis year, weโre hearing very strongly that our young people see

wellbeing of young people. Significantly, close to half of young people in NSW felt stressed either all of the time or most of the time. Mental health also was highlighted as an important issue. In NSW, more than four in 10 young people are extremely or very concerned about coping with stress and over one third of NSW respondents are extremely or very concerned about mental health. โYoung people deserve every opportunity to not just survive, but to thrive and be heard. โUltimately, how we look after our young people now, will determine our countryโs collective wellbeing in the future,โ said Nasser. Port Stephens has a dedicated youth mental health service called Jupiter which offers free counselling.

Tea Gardens Womenโs Bowling Club TUESDAY 17th September: The Semi Final of the Open Consistency Competition and social bowls. Format for social bowls 2 games of 3 bowl Pairs 18 ends and a game of Triples 2 bowls 21 ends. Jan Coomer and Bette Saillard led all the way and had a convincing win, 22 v 7, against Leona Clissold and Judi Polak. Sheril Johnson and Jill McBride were winning by a margin of 7 on the 11th end in their match. With just 7 ends left to bowl Christine Fossey and Ingrid Luck were not willing to give up, scoring 6 shots over the next 2 ends and ultimately being the victors 19 v 15. Dawn Jones, "swinger" lead, Jean Glover and Bev Rhodes proved to be too strong an opposition for
Dawn, Lyn Nightingale and Judy McGavock winning 17 v 11. The winners on the day winning with the lowest margin were Christine Fossey and Ingrid Luck.

In the Open Consistency Competition, Maynie Roberts and Robyn Beaumont battled for 29 ends. Maynie holding a narrow lead in the early stages of their contest, by the 16th end this lead had increased to 24 shots 92 v 68. Robyn wasn't going to give in easily, by the 25th end Maynie was ahead by just 6 shots, 128 v 122 still
anyone's game. On the 27th end Maynie 137 and Robyn 133, the spectators were by now "sitting on the edge of their seats.โ Congratulations to Maynie who won the next 2 ends, added 15 shots to her tally winning 152 v 138. I believe this is the 11th time that Maynie has won this Competition. Many thanks to both bowlers for such a thrilling Final, a great demonstration of draw bowling by both especially under the extreme windy conditions. Saturday 21st November: Dolphin Day and the 'shirts v the skirts.โ Prior to bowls Noel Jackson, President of the Menโs Bowling Club spoke a few words in remembrance of past bowlers. The annual โDolphin "Day was held today commencing with some time out to remember the bowlers who have passed on. Before play, a short commemoration was held around the Club flagpole with the flag at half-mast. Members from the Tea Gardens Womenโs Bowling Club then took on the male members in a โShirts V Skirtsโ, Trophy competition. It will be remembered, although many men are trying to forget, that the ladies won this event last year and they were out for revenge! The bowling was fierce with no quarter taken or conceded.

Hawks Nest Rezoning Proposal Proposal: Changes are proposed for land adjoining the Hawks Nest Golf Club at Sanderling Avenue Hawks Nest (Lot 1 DP1234229) (the land). The proposed changes to Great Lakes Local Environmental Plan 2014 will result in the land being rezoned from the RE1 Public Recreation Zone to the R3 Medium Density Residential Zone. In respect to the land, the proposal will introduce a maximum permissible Floor Space Ratio of 1:1, change the maximum allowable Height of Buildings from 8.5m to 12m, include a minimum dwelling density of 30 dwellings per hectare, place a minimum lot size for subdivision of 1,000m2 and include the land as an Urban Release Area. A draft Planning Agreement has been prepared and is also on exhibition. Council is the local plan making authority for this plan.

Unmanned Aerial Vehicle (UAV) training By Sandra MURRAY
THIS summer, three local surf lifesavers will be honing their piloting of UAV drones at Hawks Nest beach. UAV drones improve the surveillance capability of surf life savers. They help detect sharks and other marine life; support the identification of rip currents and other hazards; and improve the surveillance of swimmers and other beach users by Life Saver patrols. Nicole Young, the President of the Tea Gardens-Hawks Nest Surf Life Saving Club, told News Of The Area, โOur new UAV surveillance program will be in operation at Hawks Nest Beach from the19 December until the 27 January 2021. โThree of our members, Annie, Reece and Margaret, have all undergone extensive training and will be applying their piloting skills to improve beach safety this summer.โ
Beach users need to know about some changes to support this important program: โ UAV pilots will establish clearly marked exclusion zones which from within they will operate the drones. โ Beach users are requested to remain outside the exclusion zones and watch the UAV drones from a safe vantage point. โ Beach users are requested not to interfere with the UAV drones. The initiative, by Surf Life Saving NSW, currently provides two separate UAV programs across NSW. The first UAV program was funded through the $8 million NSW Government Shark Management Strategy announced in June 2020 by the NSW Government. This expanded program provides for greater patrol surveillance for improved beach safety and to gather data and footage on shark behaviours.
