Streams of Melody By Marian SAMPSON EACH year the SeaSide Singers hold their Annual Concert. In 2019 the theme is “Streams of Melody”. The songs to be performed are inspired by the sounds experienced when rushing down the river, sailing across the ocean, and cruising on the sea. The Concert will be held in the auditorium of the Soldiers’ Point Bowling Club from 2.00pm on Saturday, 15 June. IT’S an oldie but a goodie, and our local Scouts will use the funds raised by doing your odd jobs to fund camps, equipment and activities for their local members. There are a host of jobs that the Scouts are happy to undertake for your donation. From lawn mowing, car washing and cleaning windows to ironing, weeding and woodchopping the Scouts are ready willing and able. There are some more modern takes on the Bob a Job with the Scouts able to undertake technology tutoring for locals. Raymond Terrace Scouts are happy to assist members of the public to organise Scouts to undertake jobs. Scout Leader John Doyle of Raymond Terrace Scouts told News Of The Area, “All the money raised will stay local for our local Scouts.” Scouts welcome all children and offer a host of outdoor activities. Bob a Job was named after
an old shilling or ‘Bob’. With inflation, the Scouts no longer earn a Bob for the jobs that they do but the traditional name for the fundraiser has stood the test of time. The donation to the Scouts usually reflects the time and effort
that the job has taken. “I hope that we can get some support for the children with this, but it is equally important it lets the community know that Scouts is alive and well in Raymond Terrace,” he said. You can book in the Raymond
for the year, and we invite the community to come along and support us, as we endeavour to continue providing quality and affordable entertainment to the residents of Port Stephens.” Tickets at $25, or $20 concession, are available from the Bowling Club, or can be purchased on the day at the door of the auditorium. Children under twelve are admitted free. “This concert is a prelude to a Choral Festival to be held

Hunter River High Girls Receive Trade Skill Boost

AUSTRALIA has only 5500 tradeswomen in it’s workforce and that’s set to change, thanks to the efforts of SALT (Supporting and Linking Tradeswomen Australia) who paid a visit to Hunter River High School’s year 8 girls last week. The students were put through their paces in a workshop designed to encourage and create pathways for increased women participation in the trade industries. Karina Chambers, Hunter River High’s community engagement Officer, described the
workshop as an important initiative to show the students what was possible for life after their schooling. “The purpose of the workshop was to encourage an entrepreneurial and STEM (science, technology, engineering and mathematics) pathway for our female students at Hunter River High School,” said Ms Chambers. “The workshop included a safety induction and students created a timber project from measuring up, cutting and assembling parts with SALT guidance.” The tools and skills involved included,
Andrew Cloughessy was nominated by a local business for being polite and respectful when he orders his lunch. Grahamstown Public School’s Paige Bergin was also nominated for being polite and respectful both at school and out and about in the community. Hunter River High School’s Montana Latham door knocked for the Red Shield Appeal and raised $116.00.
On Election Day Montana collected $339.60 with this money going to Salt Ash Public School. Raymond Terrace Public School’s Kaylee Blundell was nominated for an award for her sportsmanship and stepping up and taking on the role of referee at a recent soccer match. Kooriarna Smith of Salt Ash Public School was nominated by a parent for being caring towards younger
children. Cooper Randall of Seaham Public School shared out his old Pokemon cards with children who are collecting them as he has moved on. Mick Wright, News Of The Area Publisher and PBL supporter said, “All the PBL recipients this week are fantastic. We are proud to be associated with this program.”

It is a well-accepted practice in relation to the sale of land for there to be a physical exchange of signed counterpart Contracts to bind the parties to the sale. Once the exchange occurs, each party has an enforceable contract ‘signed by the party to be charged’ thereby satisfying the requirements of the old English Statute of Frauds of 1677 (now contained in section 54 of the Conveyancing Act 1919). Leases however do not usually involve a physical exchange of contracts. Normally, a lessee will sign the lease and post it to the lessor who then countersigns the lease, registers (where necessary) and returns the signed and registered lease back to the lessee. In these circumstances it is crucial for the parties to clearly understand when the contract is made and the parties bound. In the recent case of Realm Resources Pty Ltd v Aurora Place Investments Pty Ltd [2019], a dispute arose as to whether a sublessee was bound after signing and returning the signed sublease to the sublessor. After

The Court therefore held that the sublessee delivered the sublease in escrow, subject to the condition that the sublessor sign and then deliver the fully executed sublease to the sublessee. If the sublessee had not intended to be bound, it should have made it abundantly clear that the sublease was not intended to be binding until it had also been signed by the sublessor. The lesson from this case is that it is important that parties to a lease clearly define when they intend they will be bound by its terms. It is common for parties to stipulate that neither is bound until the terms of the lease are finalised and the lease executed by both parties. If however the parties intend to be bound at an earlier point in time which often occurs when a lessee is wanting immediate access, it is important that the parties clearly define in their correspondence as to when they intend to be bound to the terms of the lease

Conroy Park at Risk By Marian SAMPSON
CONROY Park is one of the most popular Reserves along the Salamander Bay foreshore all year round, particularly for community groups and those with disabilities. The Reserve has suffered after the extreme weather events of last week. Margaret Wilkinson is a local resident who believes that unless sandbags or some other temporary solution are urgently installed to address the multiple foreshore erosion issues at Conroy Park, the next weather event could be a disaster. Margaret Wilkinson told News Of The Area, “There is a huge tree growing within the Reserve that has its roots undercut. “Our community believes that this tree should stay and not be taken down as two others were a few years back when the same thing happened; when the sandbags were (once again) installed far too late.” “The bank now sits in line with the fence and to me at least, it seems like false economy to waste ratepayers money to move it back, yet again.” Sandbags are needed, regardless of any “time limit” likely to be placed on them by Marine Parks. beach from the Reserve is now a huge eroded gully. “This gully formed last year, and absolutely nothing has been done to stop that eroding further, regardless of my requests, both verbal and via email. “It is now a dangerous entrance to a popular beach and one used as an exit from the beach from walkers wandering along the beach from The Anchorage direction.” There is a Norfolk Pine which had been partly protected by sandbags, however its roots are now undercut. “The areas west of the “main” entrance to the Reserve are impacted with the illegal removal of native vegetation by the foreshore residents living
between Conroy Park and The Anchorage. That whole area will likely be impacted and the public land will be considerably reduced in size. “I have reported that on several occasions in the past and absolutely nothing has been done to address that issue either. “Similarly, east of the Reserve, I’m aware of another resident who has reported major damage to the foreshore and unless this too is addressed, public access will be impacted,” she said. Margaret believes that there needs to be a Plan B prepared to save this valuable Reserve and it needs to happen urgently. q Entrance to Conroy Park an eroded gully.

What are the new Domestic Violence Tenancy Laws? THE new laws have been introduced to aid in the protection of victims of domestic violence, living in residential rental properties. The tenancy can be terminated if they are proven a victim. This includes anyone experiencing circumstances of domestic violence, a dependent child, co-tenant or child of a cotenant. The offence can be physical, sexual, emotional or psychological abuse, verbal abuse, stalking, intimidation, damage to property, threats of violence or financial abuse. The victim can issue a notice of termination along with a copy of the certificate of conviction of the domestic violence, a relevant domestic violence order, a copy of the relevant injunction granted under the family law act, or a declaration by a competent person in the prescribed form (a relevant medical practitioner). Once issued, the victim is not liable for any amount of rent or fees. The victim will also not be liable for any damage to the property by the offender. This information cannot be placed on any tenancy database nor can it be shared for future reference checks, ensuring the victim secures another rental property without any negative impact.
