Pasco Candidates Stump For Undecided Votes At Chamber Forum By Michael Smith At this point in the political season, with the November 2 General Election less than two weeks away, many people who are planning to vote have already decided who they’re going to vote for. Still, it was in the hopes of convincing those who are yet undecided that the candidates for the Pasco County Mosquito Control Board of Commissioners, the Pasco County School Board, the Pasco Board of County Commissioners and the District 61 seat in the Florida House of Representatives gathered for a roundtable-style forum at the Wesley Chapel Center for the Arts at Wesley Chapel High last month. The forum was sponsored by the Greater Wesley Chapel, Central Pasco and West Pasco Chambers of Commerce, and was moderated by editorial writers C.T. Bowen of the St. Petersburg Times and Tom Jackson of The Tampa Tribune, both of whom cover Pasco County. The pair asked questions of each candidate that had been sub-
mitted by some of the roughly 100 people who were in attendance, many of whom exhibited a definite antiincumbent attitude, judging by their responses to some of the questions asked of and the answers to those questions given by the candidates. Even questions posed to the candidates for the seemingly innocuous position of Mosquito Control Commissioner were not without the opportunity for some finger-pointing at the current administration, as each of the four challengers – Lester Cypher, Jessica Jordan Griffin, Michael Moore and Niko Tzoumas – mentioned the need for a secure storage facility for the chemicals that are used in mosquito control. Incumbent commissioner, the aptlynamed Matthew “Skeeter” Abbott, said, however, that a secure building has been “in the works for a while,” but its construction has been delayed by budget shortfalls. In addition, while he touted his stature as the candidate with the most experience, most of the others, such as Moore, seemed to be trying to

his home to the bank in Pinellas County and arrested him as he exited the bank after allegedly holding it up. Algood, who has a lengthy history of arrests for robbery, drugs and other charges, pleaded not guilty to all six counts as alleged in the indictment, but if he is found guilty, he could face up to 20 years in prison for each, prosecutors said. In addition, the indictment calls for Algood to repay the total amount he allegedly stole, $13,663, or to forfeit personal property in an equal amount, if found guilty. The date of his trial had not been announced at our press time.

A 33-year-old Tampa man faces an extended stay in federal prison after being indicted for a half-dozen bank robberies that took place in Pasco, Hillsborough and Pinellas counties during August and September. According to the indictment,

Norman Removed From State Senate Ballot & My Endorsements An editorial by Gary Nager Although I consider myself to be an apolitical person, I still have always felt that it was part of my job to do the best I can to help you sift through the candidates for important local (and state) offices every election cycle by interviewing as many of the candidates for those offices as possible and then endorsing at least some of those candidates in these pages. This year has been particularly difficult for me to do as many interviews as I have in years past, largely because I have had to begin doing ad sales, as well as handling my editorial duties for this publication and for its sister monthly news magazine in New Tampa. Even so, there is a General Election coming up on Tuesday, November 2, and I have gotten to speak with at least some of the candidates for these important seats in the State legislature and for the Pasco County Board of County Commissioners. Unfortunately, I did not get to interview as many of the candidates as I would have liked (some did not return phone calls) and a truly unique situation has arisen in one race for the State Senate that I can not ignore, even though the situation with this particular office may still change by the time you receive this issue in your respective mailboxes. heard about it, longtime Hillsborough County commissioner Jim Norman, who won the Republican primary in August for the District 12 State Senate seat (which includes Wesley Chapel) over former State representative Kevin Ambler, was removed from the November 2 ballot by a judge in Leon County (Tallahassee), who said that Norman violated Florida’s election laws because his wife bought a home in Arkansas in 2006 using about $500,000 given to her by the late Ralph Hughes, a known Republican power broker and building materials contractor who died in 2008. Hughes was known to donate money to political campaigns in exchange, usually, for support from those candidates once they were elected to office. I never met Hughes, but I have heard for many years about his influence over many local elected officials and I did know that Norman considered Hughes to be his friend. What I also thought I knew, however, was that Norman was one of the best friends New Tampa had on the Hillsborough County Commission, regardless of who was supporting his campaigns. Sadly, I took Norman’s word for it when Ambler (a lawyer and former friend of Norman) first brought the lawsuit challenging the primary result, that he (Norman) wasn’t involved in the home transaction. But, Judge Jackie Fulford didn’t buy Jim and Mearline Norman’s story after interviewing them for the lawsuit brought by Ambler, and she removed the Republican primary winner’s name from the Nov. 2 ballot, leaving the race with only two write-in candidates who did not return my phone calls. State election law says that Republican party officials can name anyone they wish as a replacement candidate — they can even name Norman or Ambler — although Judge Fulford would not
go so far as to put Ambler back on the ballot as the Republican nominee, because he lost the primary. Who actually ends up on the ballot may not be decided by the time you receive this issue, so I can not make an endorsement in this race. I do, however, support the two incumbents for Pasco’s BOCC that Wesley Chapel voters will help elect — Pat Mulieri (R) in District 2 and Michael Cox (D) in District 4. Both have helped ensure that Wesley Chapel will have the infrastructure it needs to continue to grow in a bad economy.
State House District 61 — This is the toughest race for me to call in a District that includes all of Wesley Chapel. I like the dynamic incumbent, Republican Will Weatherford, very much and believe he has done a good job in the office, but I have known his neighbor and Democratic opponent, retired U.S. Coast Guard officer Elena McCullough, for years and I believe that what Elena lacks in experience, she will make up for with an unfailing desire to serve our area and our state. By the slimmest of margins, I support Elena McCullough (D).

Army Corps Files Appeal In CTCC Permit Lawsuit By Michael Smith Just as this issue of The Wesley Chapel Neighborhood News was going to press, we received word that lawyers representing the U.S. Army Corps of Engineers have filed an appeal of the judge’s ruling in the lawsuit challenging the Corps’ issuance of a permit allowing the construction of the Cypress Creek Town Center in Wesley Chapel to commence. As you may recall, it was in June that Judge Royce Lamberth of the U.S. District Court in Washington, D.C., ordered Corps officials to go back and re-examine the permit that they issued allowing the Richard E. Jacobs Group of Ohio to begin work on the 1 million-plus-square-foot retail complex at the intersection of S.R. 56 and I-75. The judge also ordered that the Corps work with the developer to resolve the environmental issues that had been raised in the lawsuit, which was filed by the Sierra Club and other groups who had been opposed to the plan for the mall since it was approved by Pasco County officials in 2007. Among those issues were the

potential for damage to the Cypress Creek watershed area, which is a main tributary of the Hillsborough River, a primary source of the City of Tampa’s drinking water supply. The suit also alleges that by issuing the permit, the Corps ignored numerous procedural requirements for such permits as required by the National Environmental Policy Act and the Clean Water Act. The judge’s order gave the Corps and the developer 20 days to come up with an action plan to address those issues, but after numerous other motions and requests had been filed by attorneys on both sides, the final deadline for filing a notice of appeal of the June ruling had been extended to October 19 (or after this issue went to press, but before it is set to hit mailboxes on October 23). According to activist Clay Colson, who has been closely involved with the case (and who is now running as a candidate for the Pasco County Board of County Commissioners; see page 1), the notice that was filed on October 15 is not a full appeal, but rather what is known as a “protective notice,” which he says is simply a
notice of intent to file an appeal that allows the Army Corps of Engineers to reserve the right to file a full appeal at a later date. Meanwhile, the modified permit now only allows the developer to maintain the stormwater management system at the site in order to avoid any further problems with run-off into the surrounding wetlands and to continue work on extending S.R. 54 southward through the site, but not to move forward with the construction of the Cypress Creek Town Center mall
itself, which is also supposed to include residential, office and other components. A spokesman for the Corps declined to comment on the case, citing the pending litigation, and a spokesperson for the developer was not available for comment, but Jacobs Group spokespersons have previously said that they remain committed to the project, despite the fact that the case has seriously delayed the opening of the mall, which was originally scheduled for this year.

Continued from page 1 District in the next few years will be an estimated budget shortfall of more than $46 million, and each of the candidates talked about their plans for dealing with that shortfall. Common themes were streamlining the School District administration, looking for ways to increase efficiency at the schools themselves and stepping up efforts to find alternative sources of funding. “There are 27 different departments within the School District administration, so there’s got to be some belt-tightening that can go on,” Luikart, a former teacher and assistant principal, said. “But, the classroom should be the last place to be cut.” Despite the dire budget situation, however, most of the candidates said they also supported funding for performing arts programs and for the School District to provide transportation for students to attend the District’s Career Academies. They also answered questions about the county’s dropout rate and dealing with high-profile disciplinary cases. The incumbent bashing continued as the remaining candidates for the Board of County Commissioners (BOCC) took the stage, with challengers Clay Colson and Henry Wilson

Jr. looking to distance themselves from their opponents, current District 2 commissioner Pat Mulieri and Michael Cox, who represents the countywide District 4 seat on the BOCC. “I am not a politician,” said Colson, an independent who is primarily known for his role in environmental activism around the county. He promised to donate half of his salary, if elected, to local charitable groups and organizations. “I would also try to convince my fellow commissioners to take a pay cut, but we know that’s not going to happen.” Despite the “outsider” nature of their campaigns, however, both Colson and Wilson face uphill battles to unseat their opponents, both of whom have been involved with county government for a considerable length of time and enjoy widespread support, especially Mulieri, who has served on the BOCC for the past 19 years. Both of the incumbents pointed to their past work on issues such as regional transportation, business and economic growth and recycling, all of which were the subjects of questions posed by the audience, but the most telling division between themselves and their challengers became clear when the subject of replacing current Pasco County administrator John Gallagher was raised. While both of the incumbent can-
didates expressed their support for Gallagher, both of the challengers received applause for suggesting that he needs to be replaced. “I thought (assistant county administrator) Michelle Baker was brought in because John Gallagher was going to retire, but he hasn’t, so now we’re paying for two positions instead of one,” Wilson said. “In my opinion, if Baker knows how to do the job, then it’s time for Gallagher to go.” If the county commission challengers are underdogs in their respective races, that probably goes double for Elena McCullough, the first-time Democratic candidate who is looking to unseat incumbent District 61 State Rep. Will Weatherford, who is considered by many to be a rising star within the Republican party. Although the two actually are neighbors in the Brookside neighborhood of Wesley Chapel, they are miles apart in political philosophy. On the one hand, there is Weatherford, who enjoys both support and financial backing from the Republican party, and on the other there is McCullough, who admitted that while she does not have much money, she is running because she feels the voice of the common person should be heard in the corridors of state government. “Politics must be about service, not about building careers,” McCullough said. “I have very little money,
but I am very committed to service, and I will work towards a smaller, more efficient government.” Unfortunately, while McCullough may have shown a great deal of spirit and enthusiasm for the task at hand, she still seemed to unable to provide much in the way of concrete solutions for the issues that were raised, instead playing up her role as David facing off against Goliath. Weatherford, meanwhile, seemed very comfortable and relaxed as he talked about creating an environment in the state that would help to create jobs and stimulate the economy, while also working to improve the state’s educational system.

Local Business Helps Defend Your Home Against Foreclosure By Michael Smith While the Tampa Bay region was one of the fastest-growing in the nation during the housing building boom of the mid-2000s, it also has been one of the hardest hit in the subsequent economic downturn. Hundreds of homes right here in the New Tampa and Wesley Chapel areas have been foreclosed upon by lenders after the homeowners were unable to keep up their payments, and thousands more are close to the brink of being foreclosed upon today. Facing an imminent foreclosure can be a frightening experience, but thanks to Derek Woryn and the helpful and knowledgeable experts at the Foreclosure Defense Network (FDN), homeowners don’t have to go through it alone. Woryn says he and his wife Christine actually were involved in the home construction industry prior to starting FDN in July. “What we were finding, especially with the Florida market, was that there were a lot of homeowners that were either having trouble paying their mortgages or were being foreclosed on by the banks, and primarily, a lot of people that were trying to get loan

modifications that couldn’t get them.” For that reason, Derek and Christine started their new business, which he says is aimed at helping people defend their homes from foreclosure and trying to come up with an equitable and fair solution for them to keep their homes. “It seems that the scales are tipped right now in favor of the banks,” Woryn says. Woryn adds that despite the fact that many of the country’s largest lenders, i.e., banks, were given billions of dollars by the federal government, ostensibly for the purpose of helping homeowners who are struggling with their finances by offering new lines of credit or reduced interest on existing loans, that generally hasn’t happened. “Instead, they’re using the money to bail out themselves,” Woryn says. They’re also demanding that homeowners keep on paying on highinterest loans, even in cases where the value of the home is thousands, or even tens of thousands, of dollars less than what is owed on the loan. Then, when homeowners fall behind on their payments, it usually isn’t long before they receive a letter notifying them of the lender’s intent to begin foreclosure proceedings.

“The court wants to see a person answering each of the complaints that has been filed by the bank in the proper legal format. And that’s where we come in.” As opposed to an attorney who may charge thousands of dollars in retainers and ongoing fees to help a homeowner facing foreclosure, Woryn says that FDN only charges a flat rate of $299 for a professionally prepared legal response to the bank’s complaint. Woryn says that most judges would like to help homeowners if they can, because they know that many people are facing financial hardships, but their hands are tied if the person does nothing or doesn’t respond in the proper legal fashion. “Judges can’t rule based on emotions,” he says. However, once a homeowner does make that initial effort to respond to the bank’s complaint in the proper way, it can buy them the time they need to find an alternative solution. Woryn says that in some cases, the prospect of facing a lengthy court proceeding can even persuade a lender to work with the homeowner or perhaps even give them a loan modification that will allow them to continue making payments. “For less than the cost of a mortgage payment, we can help you stand up to the bank and put pressure on
them to give you a loan modification or renegotiate your loan and accomplish something long-term for you and your family,” Woryn says. FDN also can refer you to a local attorney to help you continue with your case if that becomes necessary. The bottom line, Woryn says, is that it’s important to know exactly what your options are, because the foreclosure situation is literally changing from week to week. For example, Woryn notes that GMAC recently was forced to discontinue filing foreclosure actions in the Florida because the company was caught falsifying documents in some cases. “The other thing we’re offering, beside knowledge, however, is peace of mind,” Christine says. “It’s a very stressful time when you’re going through a foreclosure, both financially and emotionally, and it really impacts your life. Chamber’s Fall Festival Brings Another Crowd To The Grove! Following on the heels of last year’s smash success of the Wesley Chapel Craft Fair, the Greater Wesley Chapel Chamber of Commerce (WCCC) recognized a good thing when they saw it and decided to offer an expanded weekend of crafts, food, entertainment and fun and renamed the weekend the “Wesley Chapel Fall Festival,” sponsored by Hyundai and Mazda of Wesley Chapel. Perfect weather and expanded lineups of crafters, “Restaurant Row” food vendors, performers, children’s activities and other new additions to the Festival, which returned to The Grove at Wesley Chapel, has all-but ensured that next year’s weekend will be even bigger. An obviously proud, but exhausted WCCC executive director David West and the dozens of Chamber volunteers who helped everything run smoothly agreed that the Festival “will continue to be Wesley Chapel’s signature event for years to come.” This year’s Festival featured another great “Battle of the Wings,” which offered only two prizes this time around — the “People’s Choice” award, won by Santo’s Italian Grill on S.R. 54, and just one winner selected by a panel of judges (which included such dignitaries as Pasco County commissioner Michael Cox, Tampa Tribune Pasco columnist Tom Jackson and five others) — Lexington Oaks Country Club, located inside the Lexington Oaks community off S.R. 54. New Tampa YMCA’s Annual Fundraiser Helps Those In Our Community By Melissa O’Brien Celebrating the spirit of sports and community is the key to the annual New Tampa Family YMCA fund raiser, “Saturday Night Lights,” which benefits the Y’s “Building Strong Kids” campaign. The 2010 edition of the football- and sports-themed fund raiser (the photo is from last year’s event) will be held on Saturday, November 6, 7 p.m.-11 p.m., at the New Tampa Family YMCA on Compton Dr. in Tampa Palms, and community members and local businesses are invited to participate and attend a gala evening that has become a signature affair in New Tampa – an event that gives back 100 percent of its proceeds to children and families in the New Tampa area. “This is a fun and exciting event where the people attending and contributing can have a direct impact on kids and families in the New Tampa area and our surrounding communities,” says New Tampa Family YMCA executive director Tom Goode. “The proceeds raised from this night will provide scholarships for children and families with special physical and financial needs who otherwise cannot afford the benefits of the YMCA.” “Saturday Night Lights” features an evening filled with dinner, cocktails,
entertainment, and a silent auction, and guests are invited to dress in their favorite team apparel and enjoy exciting televised football games on big screen TVs while dancing the night away. Food and refreshments at the event will be provided by the following restaurants: Ciccio’s/The Lodge, Stonewood Grill & Tavern, Beef O’Brady’s, The Brass Tap, Bella Vita Ristorante, Firehouse Subs, Wood Fired Pizza & Wine Bar and Chick-Fil-A. Individual tickets and MVP tables (ten seats per table) and sponsorships are still available (see below). There also will be a special appearance by the University of South Florida cheerleaders and their mascot, Rocky the Bull. “All of our scholarships allow young people to participate in our youth and team programs,” says Goode, who adds that about 35 percent-40 percent of the kids who take part in local Y programs receive some level of scholarship. “Our goal is to never turn a youth or teen away because of an inability to pay.” Goode says that most of the YMCA programs focus on building kids’ self-esteem. “For some kids, this may be their only opportunity to participate on a team,” he says. “Some may not get that opportunity at school. And, for some children, this is their
only opportunity to receive swimming lessons – a lifesaving skill. This is especially important in Florida, where drowning is a leading cause of death among young children. It is a huge priority of the YMCA to reverse that trend and it is great to be able to help kids and families enjoy water activities.” Emily Manwaring, the New Tampa YMCA’s community development coordinator, says she is hoping to have 250–300 people attend the event. “That is what we have maintained for a couple of years now,” says Manwaring. “Each year, we hope to reach a financial goal of around $35,000 raised through this campaign.” The local YMCA’s commitment to children is seen through the many programs it offers to young people in the community. One of those programs has made a huge impact for Kingshyre at Cross Creek resident Stan Hulett, and his son, Logan. The Huletts moved to New Tampa in 2000, when Logan was eight years old. Logan, who is autistic, learned how to swim through the Y’s adaptive programs (programs that assist physically or intellectually challenged individuals and help them adapt to mainstream society). Today, Logan participates on three swim teams, including his high school team at New Tampa’s Paul R. Wharton High.
“The adaptive swim program is open to anyone who needs it, from disabled veterans coming home from war to car accident victims and students like Logan,” says Hulett. “It is available at no cost and it has a tremendous impact upon those who participate in it. For Logan, it has helped him to feel more like a part of his age group and part of a team. The YMCA offers many of these types of programs for families who might not otherwise be able to afford to participate.” “Saturday Night Lights” will be held Sat., Nov. 6, at the New Tampa Family YMCA (16221 Compton Dr., Tampa Palms. Tickets are $50 per person in advance and $70 per person after Oct. 30. A limited number of MVP packages are available for purchase at $750 per table. A spectacular inaugural event was held in Miami last April, which successfully launched a unique campaign dedicated to raising awareness linking the strikingly similar statistics between breast and prostate cancers and urging couples to remind one another to go to their doctors for screenings. Newton-John is an 18-year breast cancer “thriver” who says, “I am so excited to return to support PB42 in Tampa and to co-host the evening with my friend and mentor, Lee Moffitt,” says Newton-John. “The evening will not only be filled with music and laughter, but will also help create awareness of the similarities between prostate and breast cancers.” Olivia’s nephew and founder of PB42, Emerson Newton-John, says that his aunt is proud that H. Lee Moffitt will be her co-host. As speaker of the Florida House of Representatives, Moffitt pushed through legislation that created the cancer center, which opened its doors in 1986.
Also making his first appearance for PB42 will be Tampa native Eric Darius, a No. 1 Billboard magazinecharting contemporary Olivia Newton-John jazz artist.
