Landmark consumer protection law heavy with strong mortgage rules By Broderick Perkins RealtyTimes.com

President Obama recently signed the landmark H.R. 4173: Restoring American Financial Stability (RAFS) Act of 2010 which, in part, eliminates many of the lax mortgage lending practices that sparked the financial meltdown. Among its provisions, the far-reaching new law creates a new Federal Reserve-based watchdog, the Consumer Financial Protection Bureau to ensure consumers get clear, accurate information necessary to shop for mortgages, credit cards and other financial products. It also protects consumers from hidden fees, predatory terms and deception. It's not clear when all the provisions will roll out, but an over-

whelming majority of consumers demanded the protections. Often called Wall Street Reform, the RAFS Act has many provisions for those who live on Main Street, including a national consumer complaint hotline so consumers will have, for the first time, a single, toll-free number to report problems with financial products and services; a new Office of Financial Literacy; and a new U.S. Department of Housing and Urban Development (HUD) Office of Housing Counseling to boost homeownership and rental housing counseling. The bureau will be lead by an independent director appointed by President Obama and confirmed by the Senate, who will be able to autonomously write rules for consumer protections governing all financial

institutions, banks and non-banks, offering consumer financial services or products. The new director will oversee the enforcement of federal laws intended to ensure the fair, equitable and nondiscriminatory access to credit for individuals and communities. The new law governs banks and credit unions with assets of over $10 billion and all mortgage-related businesses (lenders, servicers, mortgage brokers, and foreclosure scam operators), payday lenders, and student lenders as well as other non-bank financial companies, including debt collectors and consumer reporting agencies. Banks and credit unions with assets of $10 billion or less will be examined for consumer complaints by the appropriate regulator. Among it's provi-

sions, the RAFS Act includes help for homeowners and home buyers, including: • Prohibiting unfair lending. It prohibits "yield spread premiums" and other financial incentives that encourage lenders to steer borrowers to more costly loans and pre-payment penalties that trapped so many borrowers in unaffordable loans. • Establishing penalties for irresponsible lending. Lenders and mortgage brokers who don’t comply with new standards will be held accountable by consumers for as much as three-years of interest payments and damages plus attorney's fees. The law also protects borrowers against foreclosure for violations of these standards. • Expanding consumer protections for high-cost mortgages.

The new law expands the protections available under federal rules on high-cost loans by lowering the interest rate and the points and fee triggers that define high cost loans. Also, lenders must disclose the maximum a consumer could pay on a variable rate mortgage, with a warning that payments will vary based on interest rate changes. • Requiring lenders to ensure borrowers' ability to repay. The act establishes a simple federal standard for all home loans: institutions must ensure that borrowers can repay the loans they are sold. • Requiring additional mortgage disclosures. Lenders must disclose the maximum a consumer could pay on a variable rate mortgage, with a warning that payments will vary based on interest rate changes.

• Emergency mortgage relief. Based on a successful Pennsylvania program, the new law provides $1 billion for bridge loans to qualified unemployed homeowners with reasonable prospects for reemployment to help cover mortgage payments until they are reemployed. • Foreclosure legal assistance. The law authorizes a HUD administered program for making grants to provide foreclosure legal assistance to lowand moderate-income homeowners and tenants related to homeownership preservation, home foreclosure prevention, and tenancy associated with home foreclosure. • Free credit scores. Consumers will get free access to their credit score if their score negatively affects them in a financial transaction or a hiring decision.

Can you use junk to keep your home decor fresh? (ARA) - As colder weather arrives, you are probably looking to freshen up your home decor. While it might be counterintuitive, a great way to do this is by using items you might not otherwise have a need for - or to put it bluntly, junk. You may have already heard about a

growing trend called “junking,” which involves incorporating junk in your home decor. This allows for imaginative selfexpression, endless possibilities for original design, and the ability to make your interiors stylishly green. Another plus is that you’ll save a little

green too, since you won’t be buying as many new items. Sue Whitney knows a thing or two about breathing new life into things some would consider junk. She’s been leading the trend for the last decade, founding the premiere junking website www.junkmarket-

style.com and appearing on NBC’s The Today Show as the junking expert. Whitney has also written three instructional books on the topic. “Integrating junk in your home decor is not confined to flea market decorating,” says Whitney. “I love flea market shopping, but there are countless other spots sweet on junk. Salvage yards, used restaurant supply stores and farm sales are just a few of the many alternatives.” The right products and tools are essential for crafting unique junk projects. Hammers, nails and super glue are good essentials to start with, in your junker’s toolbox. Gorilla Super Glue is the perfect adhesive if you are looking to embellish your finds with other objects. Trends for the season are all basic and neutrals. Galvanized metal, warm woods, whitewashed architectural salvage and weathered concrete pieces provide a stunning and timeless backdrop for your home. Tips for winterizing your home against indoor allergies (ARA) - Spring and fall are the most notorious allergy seasons, but as any of the estimated 50 million Americans who suffer from allergies know, winter can be just as uncomfortable. As we move our lives back indoors, we often seal up our homes to prevent the cold from seeping in. While that’s good for energy bills and staying warm, if you don’t take some precautions, it can cause problems for those with indoor allergies. To make sure that your home is a healthy one throughout the season, start taking action against allergens as you winterize your house. According to the Asthma and Allergy Foundation of America (AAFA), some of the most common indoor allergens are mold spores, dust mites and pet dander so pay special attention to preventing those. As the weeks pass, keep to a schedule of cleaning that will maintain a lower level of allergens. Here are some tips to help you make your home a haven where allergy sufferers will feel comfortable. • Don’t let towels pile up. Whether in

the kitchen or the bathroom, it’s important that damp towels aren’t left to sit in a pile. The moisture they retain can create perfect conditions for growing mold or provide an ideal home for mites. Hang towels so that they can dry fully and launder them in your washing machine at least once a week to get rid of mold spores. • Stop the fur from flying. AAFA notes that cat dander is the most common pet allergy. But whether you have a dog, cat or other furry critter, they can cause discomfort for any mem-

bers of your household with allergies, as well for any guests who come to town for holiday celebrations. To cut down on allergens from both dander and saliva, be sure to wash your pets’ toys and beds regularly. Vacuuming up pet hair is also an essential step. A vacuum cleaner like LG’s LuV300B Kompressor is a good option because its HEPA filter captures 99.97 percent of common household allergens. It has also been certified “asthma & allergy friendly” by AAFA. Giving your pets regular baths and brush-

ings can also help to cut down on the amount of hair and dander that they shed. • Make your bed and sleep in it. If your sleep is being disrupted by allergy symptoms, you need to make sure that your bedding isn’t part of the problem. Miteproof bedding and mattress or pillow cases can help cut allergens, but you should also remember that washing, cleaning and replacement are important. Some washing machines from LG feature the Allergiene cycle, a specialized steam cycle that helps to kill dust mites and their eggs; it’s the only such cycle that has also been certified by AAFA. While you’re washing your sheets and comforters, take time to vacuum your mattress with a HEPAfilter equipped vacuum. Pillows should be replaced every two years and it’s suggested that mattresses be replaced every 10 years. • Don’t forget decor. Vacuuming your floors is a given, but to really make an impact on the allergens in your home, you need to pay attention the rest of your decor as well. Area

rugs in the living room or bedrooms, as well as kitchen and bath floor mats need to be vacuumed often and, if possible, laundered regularly. Cleaning the upholstery on your couches and chairs is another essential step - pet hair and dust mites can settle there and irritate people with allergies. Large capacity washing machines that are certified “asthma & allergy friendly” are ideal for large items like throw rugs and slip covers from your couch or easy chair. If they can’t go in the washing machine, have them profession-

ally cleaned. And while they beautifully frame your views, your window treatments might be making your life uncomfortable. Make sure that you vacuum and launder them as well. “It’s important to remember that even in cold weather, allergies don’t go away,” says Mike Tringale, vice president of external affairs for AAFA. “And while cleaning your house to remove allergens won’t eliminate your allergies, it will have a significant impact on your health, during the winter and throughout the year.”
