Task Force Established to Educate “Owner as Contractor” Permit Pullers In an effort to educate the general public on what is involved when they apply for their own building permits, NABA along with representatives from 4 neighboring builders associations, the Association of Counties, Building Inspectors, municipalities, and other stakeholders have established a task force to create and implement a public awareness campaign. The ultimate goal of the campaign is to increase the professionalism of the industry and protect the public from the potential hazards of using unqualified contractors. Since January 1, 2008, contractors and remodelers have been required to obtain the Dwelling Contractor Qualifier credential in order to pull building permits in Wisconsin. However, property owners are able to pull building permits for construction or remodeling projects on their own property. Too often, property owners often do not realize the responsibilities and liability they are assuming as the applicant on a building permit. Code labels changing: Administrative codes previously under the authority of the Department of Commerce are being relabeled to reflect the authority of the Department of Safety and Professional Services. "Comm" codes will be "SPS" codes as of January 1, 2011. Also, the number "3" wll be added in front of all the current code numbers. For example, Comm 81 will be SPS 381. Comm 5 will be SPS 35. Change in which fire protection systems need plan review in Wisconsin A January 1, 2012, code change increases the fire protection systems which need plan review in Wisconsin. Previous to that date, fire protection systems which require plan review were identified as being in specific building types or occupancies which were named in Table 61.30-3 of the Wisconsin Commercial Building Code. As of January 1, Wisconsin has changed to review of most fire suppression and fire alarm system projects. Table 61.30-3 has been repealed. There are exemptions in the 2012 code for certain buildings that don’t require building plan review and there are exceptions involving lower numbers of fire sprinkler heads or alarm devices. The trigger date for fire protection system plan review is based on the overall building plan submittal. For example, if a Group B occupancy building is submitted for review prior to December 31, 2011, then the fire suppression and fire alarm components are not required to be submitted. If the same building is submitted on January 1, 2012, the fire suppression and fire alarm components would be required to be submitted for plan review. If a fire protection system is the only thing being added or altered, then the date (before or on/after January 1) in relation to the governing code language in Comm 61.30 will signal whether or not the system needs review. In other words, review is necessary for fire protection systems that are required in commercial, industrial, and other public buildings per what is the current Wisconsin building code as of the date of potential submittal. (a) Pre-engineered kitchen hood fire suppression systems shall be submitted with the HVAC component as part of the kitchen hood review. (b) Projects where only singleand multiple-station smoke alarms are required. (c) Hospitals and nursing homes, which are reviewed by the state Department of Health Services. (d) Per Comm 61.30(4)(b), the submission and approval of fire protection system plans is not required for a project involving the alteration or addition of the following components: 1. Twenty or fewer sprinkler heads to an existing automatic fire sprinkler system. 2. Twenty or fewer alarm devices to an existing fire alarm system. (e) Per Comm 61.30(4)(a), this requirement does
not apply to minor alterations where the building official agrees the nature of the work is such that review and approval of construction documents is not necessary to achieve compliance with this code. REMINDER: DOC Fines for Using Unlicensed or Unregistered Subs A rule change effective December 1, 2010 will authorize the Wisconsin Department of Commerce (DOC) to impose forfeitures on those who do not comply with certain licensing, certification and registration requirements, or those who hire persons or entities who have not registered or do not have required credentials. In 2009, DOC started to require various trades involved in building or modifying structures to register as a building contractor. However, those that hold certain credentials, such as contractors who have a dwelling contractor certification, are exempt from this registration requirement. This new rule will allow DOC to impose forfeitures on those who do not have their registration, or certain other credentials, such as a dwelling contractor certification. In addition, forfeitures may be imposed on an entity or individual who contracts with another entity or individual who fails to comply with licensing, certification or registration requirements. Thus, a general contractor who has its dwelling contractor certification may be subject to a penalty if the general contractor contracts with a subcontractor who does not have its certification or registration. WBA objected to this rule, arguing among other things that the forfeiture amounts were excessive. In final version of the rule sent to the legislature, the forfeiture amounts were significantly reduced. Under the revised rule, the forfeitures for failing to comply with the licensing/ certification/ registration requirements, or for contracting with an entity that does not meet these requirements, are as follows: first offense, $250; second offense, $500; and third offense, $1000. In addition to authorizing the imposition of forfeitures, as a result of a statutory change, this rule also expands the trades subject to registration to include those that construct, install or alter mechanical equipment and devices such as boilers, gas systems, piping and mechanical systems serving a building or structure. The requirement was also expanded to include those involved in the construction, installation or alteration of permanent devices or structures regulated under the amusement or sanitation code.

NEWS and UPDATES from National Association of Home Builders NAHB Makes Progress on Safety, Compliance Issues Raised With OSHA NAHB is making steady, albeit slow, progress in its discussions with the Occupational Safety and Health Administration (OSHA) on regulatory issues — especially on the issue of fall protection. However, builders still struggle to figure out how to comply with these requirements. NAHB First Vice President Barry Rutenberg has made OSHA regulations an advocacy priority — and because of NAHB’s efforts, OSHA officials delayed enforcement of its fall protection policy during the three month phase-in period from June 16 to Sept. 15 and agreed to additional enforcement concessions through March 15, 2012. In addition, OSHA officials visited an NAHB member job site to see first-hand why conventional fall protection practices don’t work for some residential construction activities and how alternative methods and safe work practices can ensure workers’ safety. While many builders have not been affected because their states have their own OSHA-approved safety programs that differ from the federal standards, or the state never adopted the Interim Guidelines, others are subject to regulations that largely mirror the confusing federal requirements. Now, the agency plans to develop a series of fact sheets to address these problem situations. In a meeting with NAHB leaders, senior OSHA staff said the agency fully intends to provide enforcement concessions to home builders who can demonstrate they are making a good faith effort to comply. In two separate meetings with NAHB members last week, OSHA leaders said home builders should work with their OSHA Area Offices to discuss challenges and develop shared solutions. NAHB urges home builders to look at the list to determine who their compliance officers are and engage them in discussion. Some members have also found that talking to their members of Congress about these onerous regulations helps — and NAHB staff members can assist in this outreach. Future Steps While making these local contacts can be an effective short-term solution, it will not address the consistency problem or the fundamental challenges of the regulations themselves, which is why NAHB leaders continue to work with OSHA on exploring longer-term solutions. NAHB has asked OSHA to revise the fall protection standard to make it more effective and less burdensome — and is hoping to meet again soon with agency leaders to look at next steps. As NAHB continues these discussions, association leaders must be able to explain to regulators what specific portions of the rule create problems and offer some solutions that can make it work, Rutenberg said. “We cannot successfully advocate for revisions to the rule with OSHA or Congress if we don’t know what revisions need to be made,” he said. “It is in our best interest to define very specifically what those changes should be, not OSHA.” NAHB is studying OSHA Subpart M to choose those compliance activities that, if removed or revised, would make a significant difference in terms of burdens and/or compliance. “Once we know specifically what we want, we are also more likely to receive Congressional support,” Rutenberg said. In the meantime, NAHB continues to proceed cautiously and
deliberately, relying on a few select Members of Congress as an avenue to reach the ear of OSHA officials. “A ‘storm the castle’ approach would likely backfire and impede progress,” Rutenberg said. Town hall meetings and other activities hosted by HBAs in St. Louis, Omaha, Lancaster, Pa., and others have clearly demonstrated the far reach of the issues and the fervor of our members in seeking workable solutions. These activities have not gone unnoticed by senior OSHA officials — and if scheduled judiciously, help encourage these national discussions to continue. NAHB Senior Officers will soon appoint a member task group to help identify the most problematic portions of the rule and develop suggested solutions to take to OSHA and possibly Capitol Hill. Once the group’s work gets underway this fall and we have the follow-up meeting with OSHA, NAHB will be in a better position to determine how best to proceed with these grassroots efforts. "The housing sector has been a significant driver of recovery from most recessions in the United States since World War II," he said. "This time, however, a number of factors -- including the overhang of distressed and foreclosed properties, tight credit conditions for builders and potential home buyers, and the large number of 'underwater' mortgages -- have left the rate of new home construction at only about one-third of its average level in recent decades.” Clearly, Chairman Bernanke understands the contributions that builders can make to the economy when given the chance, and throughout his tenure he has been willing to meet with our leadership on a regular basis to receive updates from us on the state of the housing market and discuss our concerns. In testimony before the Senate Finance Committee on Oct. 6, NAHB economist Robert Dietz warned lawmakers about the devastating impacts that eliminating or curtailing the mortgage interest deduction (MID) would have on middle-class families. "We believe that any policy change that makes it harder to buy a home, or delays the purchase of the home until an older age, will have a significant long-term impact on household wealth accumulation and the make-up of the middle class as a whole," said Rob. He also set the record straight about misleading claims that the deduction benefits only wealthy taxpayers and that only a small number of home owners utilize the deduction because they must itemize their deductions in order to claim it. In fact, he told Congress,70% of the tax benefits of the MID go to middle-class home owners who earn less than $200,000 annually. Moreover, a deduction that reduces the net cost of monthly house payments is particularly important to younger home buyers, who typically have large home loans and less equity while at the same time they are paying mostly interest in the early years of the mortgage. Our tax expert also stressed the importance of several other housing tax incentives, including the Low Income Housing Tax Credit, which is the most successful affordable rental housing production program in the nation's history and produces approximately 90,000 full-time jobs per year. Moreover, he explained that eliminating the MID for second homes could threaten the economic viability of second home and vacation markets nationwide. He noted that nearly every state has areas with significant numbers of second homes, with 49 states having a county where at least 10% of the housing stock consists of second homes. Tommy Thompson forms fundraising committee for U.S. Senate bid Former Governor Tommy G. Thompson recently filed incorporation papers to begin organizing a campaign and raising contributions for a US Senate race. Darrin Schmitz, a consultant for Thompson, said a formal announcement will be held in the future but the filing will allow the campaign to immediately start building the infrastructure to capture the Senate seat currently held by Senator Herb Kohl. “Governor Thompson filed incorporation papers for a campaign today, and he’ll begin raising funds and building a strong statewide organization for a US Senate race. A formal announcement will take place in the future,” Schmitz said. “We’re taking the necessary steps to properly launch a successful Senate bid.” Neumann exceeded U.S. Senate Fundraising goal Those running for federal office (Congress or U.S. Senate) were required to file a campaign finance report recently with the Federal Election Commission (FEC), and U.S. Senate candidate Mark Neumann announced he had exceeded his fundraising goal for this quarter. Neumann had set a goal to raise $250,000 for the period and actually was able to raise $300,000 during the period with no personal contributions from Mr. and Mrs. Neumann as part of that total. The FEC report turned in by Neumann contained over 1400 donors to his campaign for U.S. Senate. “This phenomenal number shows that our conservative message is resonating,” Neumann stated. “America faces a debt crisis of historic proportions. We will not get the private sector creating jobs until we cut spending and balance the budget.
