Tender is the word to describe Emmanuel Garibay’s 2004 exploration of this timeless theme. A mother protectively holds and watches over her child, who is serene in sleep with one arm anchored over her mother’s hand as if in acknowledgement. There is a delicate strength in the way Garibay positioned the figures. His bold and thin lines, as well as his haphazard overlap of the red, yellow and green tones remind one of the Expressionist tendencies that flourished in prewar Europe.

In this mixed media work of print (of 1/1) and collage by Imelda Cajipe-Endaya, yellow forms resembling coconut leaves take position in the middle of a blue square. It is bordered with chevrons of lilac and yellow-oranges, while a wider border of red wedges complete the pattern that resembles those found in indigenous textiles. An abstract piece that induces a sense of the tropics, Imelda CajipeEndaya remains faithful to her recurring theme and imagery that is grounded in and is reminiscent of the Philippines and its traditions.

In Olmedo’s Las Señoritas, there is no distinction of where the skin of one ends and the other begins. With bodies merging into one another, three women of serious expression self-consciously face the viewer. A fourth figure, with the same profile as the other three, but with eyes closed and arms stretched, floats behind them at the leftmost portion. Despite the light and soft strokes, the somber tone of Expressionist painter Onib Olmedo persists.

Perfecto S. Mercado was a regional, self-taught artist from the Central Luzon province of Tarlac whose highly original and detailed works have earned him the respect of his peers and collectors. Born in 1950, Mercado was known for his eclectic styles and techniques which include, among others, the stained glass style and “psychedelic surrealism.” In this 2008 work, Mercado manifested a new visual idiom wherein faces make subtle appearance in his richly-colored and highlytextured landscapes. In the magic realist works that he painted a few years before his demise, Mercado ingeniously showed the “interior mystery” of his lush environs and his highly spiritual nature.

Extolling the modernist tradition in the Philippines, Oscar Zalameda provides a seamless fusion of modern form and traditional theme in capturing the domestic and banal activity that is fishing. Three men and one woman stand on the sea shore, each carrying a basket laden with the catch of the day. Several rocks and a boat complete this classic vista. Lines and figures filled with blocks of basic colors are set against a background of verdant green. In spite of the clean forms, Zalameda infused the work with movement as conveyed by the abstracted human forms.

Celebrated painter Nena Saguil’s primary fascination with the cross-sections of plants and microscopic organisms had earned her place in Philippine modern art movement. Her distinctive perspective of the world is made of delicate motifs and patterns, hidden from the naked eye. Saguil obsessively fills her paper with her ever-reliable dots, this time in various shades of gray, creating another fine piece of abstraction of the minuscule. Two imposing teardrop-shaped figures are formed diagonally over a sea of circles, that seem to push each other, as if fighting for space.

National Artist Federico Aguilar Alcuaz, while known for his large expressive abstract works of bold colors, is also much identified with his Manila landscape and genre scenes. In his homage to Manila Bay, he immortalizes and captures the transition of the day into dusk with his finely-applied paint. A pale pastel of a sky effortlessly merges into the sea, with only a thin line of flesh melding the two as horizon. Tiny boats and trails of land encroach at the sides, while the shore at the foreground unifies the whole picture.

Father of Philippine Modern Sculpture Napoleon Abueva created this piece a year after his proclamation as National Artist. Known for his innovative techniques and materials, this classic sculptural wall piece showcases the artist’s undeniable mastery of the craft. The iconic character of Francisco “Kenkoy” Harabas from the weekly comic strip Mga Kabalbalan ni Kenkoy first appeared in the Tagalog literary magazine Liwayway in January 1929. Initially created by writer Romualdo Ramos and father of Philippine comics Tony Velasquez as propaganda material during the Japanese occupation in World War II, it was eventually used as a promotional tool for the government’s health program. Kenkoy’s genius play of witty language, ridiculous yet grounded storylines and undeniable fashion sense presents a relevance that’s way beyond his time.

Jose Rizal’s 1894 allegorical clay sculpture about the country’s condition during the Spanish period was revisited by National Artist Guillermo Tolentino in his 1961 interpretation of the same name. Inspired by Rizal’s dog, Syria, who lost her pup to a crocodile, the National Hero decided to forge an alternate ending and in the process found a deeper meaning to the imagery. The mother dog represents the patriots, while the crocodile symbolizes the Spanish colonizers who had exploited the weak masses. Recreating similar figures of a mother dog attacking a crocodile in an attempt to rescue her pup, Tolentino recalled the martyrdom of all those who fought to save a helpless country against colonizers. Done during his peak years after a schooling abroad, Tolentino tamed the fire and heart of the Filipino spirit with the finesse and delicacy of European dexterity.

A native girl, with hair tied in a bun and folds forming at the sides of her dress, squats to do the laundry. National artist Guillermo Tolentino showcases the joys of everyday life, as what Jose Rizal did in his clay sculpture Oyang Dapitana in the late 1800s. Featuring a similar pose but using a different media, Tolentino’s depiction provides a certain classical refinement, in proportion and gesture, that is in stark contrast to Rizal’s rawness of figure.

(b) Catalogue Descriptions and Condition of Property Any information provided to prospective buyers in respect to any Lot, such as pre-sale estimate, whether written or oral, and information in any catalogue, condition and other report, commentary or valuation, is a statement of opinion and not to be relied as statement of fact. Such information is for guidance only and should be evaluated by personal inspection by the bidder or a knowledgeable representative. These statements, therefore, cannot be construed as representation, warranty or assumption of any liability on the part of Now Auctions. 3. AT THE SALE Prospective buyers must complete and sign registration forms and provide proof of identity in the form of government-issued identification before bidding. A bank reference may also be required. Now Auctions reserves the right to refuse any prospective bidder admission to the auction or participation in the sale and to reject any bid. Now Auctions has the discretion to withdraw a Lot any time prior to the commencement of the bidding for such Lot. Bidding may be done in person by paddle during the auction, in writing prior to the sale or by telephone. (a) Bidding in Person To bid in person, bidders need to register and collect a paddle at least one hour before the auction begins. All lots sold will be invoiced to the name and address to which the paddle has been registered and invoices cannot be transferred to other names and addresses. At the end of the auction, the paddle must be returned to the registration desk. (b) Bidding by Telephone Prospective bidders who cannot attend the auction may bid live on the telephone with Now Auctions’ staff members. This service must be arranged at least 24 hours in advance of the sale and is available for Lots whose minimum or starting bid is at least P100,000.00. Bidders are required to state their maximum bids, excluding the buyer’s premium and any applicable taxes, which Now Auctions can execute on their behalf in the event they cannot be reached by telephone. Now Auctions will use reasonable efforts to contact the participants in the bidding by telephone but does not accept liability for failure to do so due to technical errors or miscommunication. (c) Absentee bids For prospective bidders who are unable to attend the auction and cannot participate by telephone, Now Auctions can execute written bids on their behalf. Absentee bid forms may be scanned and sent via email to info@nowauctions.net or faxed to (+632) 555-0684 at least 24 hours in advance of the sale. Execution of written bids is a free service subject to other commitments at the time of the sale. Now Auctions does not accept liability for failing to execute a written bid or for errors and omissions in connection with it. Now Auctions will use reasonable efforts to carry out the absentee bids at the lowest possible price with due consideration to the reserve and other bids. The maximum bid must be indicated, excluding the buyer’s premium and any applicable taxes. Unlimited bid will not be accepted. If identical bids are submitted on particular lot and these are the highest bids, the earliest bid received will take precedence. (d) Liability for Bids By making a bid, a bidder accepts personal liability to pay the purchase price plus other applicable charges unless it has been disclosed in writing before the commencement of the auction that the bidder is acting as agent on behalf of an identified third party acceptable to Now Auctions. In such a case, Now Auctions will look only to the principal for such payment. (e) Reserve Unless otherwise indicated, all lots are offered subject to a reserve, which is the confidential minimum price below which the lot will not be sold. The auctioneer may place bids on behalf of the seller up to the reserve price. If the highest bid is below the reserve, the lot will be withdrawn by the auctioneer and no sale will be consummated. (f) Conduct of Auction The auctioneer has the absolute and sole discretion when it comes to the conduct of the auction. He may refuse any bid, advance the bidding in such a manner as he may deem appropriate, withdraw or divide any Lot, combine any two or more Lots. In the case of error or dispute whether during or after the sale, he may determine the successful bidder, continue the bidding, cancel the sale or reoffer and resell the item in dispute. If any dispute arises after the sale, the sale record of Now Auctions is conclusive. (g) Successful bid and buyer’s responsibility The highest bidder accepted by the auctioneer will be the buyer. The striking of his hammer marks the acceptance of the highest bid and the conclusion of a contract for sale for the seller and the buyer. Risk and responsibility for the Lot but not its title pass to the buyer upon the striking of the auctioneer’s hammer. 4. AFTER THE SALE (a) Buyer’s premium and VAT In addition to the hammer price, the buyer agrees to pay Now Auctions the buyer’s premium together with any applicable tax and charges. The buyer’s premium is 15% of the hammer price of each Lot. In addition, a Value Added Tax (VAT) of 12% is also imposed on the buyer’s premium. As such, the buyer’s premium and VAT (totaling to 16.8% of the hammer price) are payable by the buyer as part of the total purchase price. (b) Payment Buyers are required to pay for purchases within ten (10) days after the auction, unless other written arrangements are agreed with Now Auctions prior to the sale. The buyer will not acquire title to the lot until all amounts due (comprising the hammer price, buyer’s premium and any applicable taxes) are fully paid. Payment shall be made in Philippine Pesos or in other currencies acceptable to Now Auctions. Forms of payment can be cash, wire transfer, manager’s or personal checks. Checks shall be made payable to Now Gallery and Auctions, Inc. The buyer is required to provide his or her name and permanent address and, if so requested, details of the bank from which payment will be made. (c) Collection of purchases Lot will be released only to the buyer or the authorized representative when full and cleared payment has been received by Now Auctions. Proof of identity is required when collecting the Lot. Additional charges for removal, interest, storage and handling will be levied on the Lot if not collected within 30 days from purchase. (d) Export/Import license Obtaining any relevant export or import license is the responsibility of the buyer. Failure or delay in obtaining a license is not a ground to rescind the sale or a reason to withhold full payment for the lot.
5. REMEDIES FOR NON-PAYMENT In case of failure to pay in full within the time required by paragraph 4(b) above, Now Auctions has the absolute discretion to exercise one or more of the following rights or remedies (in addition to asserting any other rights or remedies available under the law) against the buyer, as follows: to charge reasonable interest on the total obligations; to commence legal proceedings for the recovery of the unpaid obligations together with interest, legal fees and costs; to cancel the sale, and, without prejudice to any other remedies, hold the defaulting buyer liable for any losses and damages suffered by Now Auctions, including the buyer’s premium and reasonable costs and expenses incurred; to resell the property publicly or privately under reasonable terms; the defaulting buyer shall be liable for payment of any deficiency between the total amount originally due and the price obtained upon resale as well as for all costs, expenses, damages, legal fees and commissions and premiums of whatever kind associated with both sales or otherwise arising from the default; to pay the seller an amount up to the net proceeds payable in respect of the amount bid by the defaulting buyer; in such a case, Now Auctions shall have all of the rights of the seller, however, arising, to pursue the buyer for such amount. to set off against any amounts which Now Auctions may owe the buyer in any other transactions; where several amounts are owed by the buyer to Now Auctions in respect of different transactions, to apply any amount paid to discharge any amount owed in respect of any particular transaction, whether or not the buyer so directs; to reject at any future auction any bids made by or on behalf of the buyer or to obtain a deposit from the buyer before accepting any bids; to exercise all the rights and remedies of a person holding security over any property in Now Auctions’ possession owned by the buyer, whether by way of pledge, security interest or in any other way; the buyer will be deemed to have granted such security to Now Auctions which may retain or sell such property as collateral security for such buyer’s obligation to Now Auctions and to the seller; to take such other action as Now Auctions may deem necessary or appropriate. 6. COPYRIGHT Now Auctions has copyright on all images, illustrations and written material produced by or for Now Auctions relating to a Lot. This copyright shall remain at all times the property of Now Auctions and shall not be used by the buyer, nor by anyone else, without its prior written consent. It is understood that the buyer of a property will not acquire any copyright or other reproduction rights in it. 7. SEVERABILITY If any part of these Terms and Conditions is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of conditions shall continue to be valid to the fullest extent permitted by law. 8. LAW AND JURISDICTION The rights and obligations of the parties with respect to these Terms and Conditions, the conduct of the auction and any matters connected with any of the foregoing shall be governed and interpreted by the Philippine laws. By bidding at auction, the buyer shall be deemed to have accepted these Terms and Conditions and submitted, for the benefit of Now Auctions, to the exclusive jurisdiction of the Philippine courts.
