Following KDC’s decision to approve a plan change necessary to allow the ambitious project to proceed, the public had the right to appeal through the Environment Court. One such appeal was forthcoming, made by the Te Raranga a Te Kuihi Trust. It must be heard and worked through if the development proceeds any further. “Procedurally, what will happen next is the Environment Court will appoint an environment commissioner to lead the court-assisted mediation,” said

A Kaipara Christmas banquet for those who may otherwise not be able to enjoy festive fare on December 25 is shaping up in Dargaville, with organisers praising the community spirit of those who have pitched in to help. “It’s fantastic to see so many people wanting to help, especially at this time of year,” said mayor Craig Jepson. “I will be there on the day, and I’m happy to give a little time on Christmas to serve my community.” Initially, Representatives from the Lions Club, the Justices of the Peace Association, Te Korowai o Ihu Karaiti Haahi (church), Man Up and Legacy tabled the idea of a free community meal for those facing hardship this festive season, but the response from others in the community has been enthusiastic, says mayor Jepson. The gathering will be held at the Church of the Nazarene hall, from noon on December 25. Organisations and businesses that would like to help make this meal, seeking to bring a proper Christmas to those who might otherwise be lonely, hungry or facing straitened circumstances during the holidays, can get involved by emailing kaiparachristmas@gmail.com. When should a gift really be a loan? u by Lina Khan and Courtney Clarke, WRMK Lawyers

From parents helping their children into their first home to a sibling helping another sibling start up a business, there are many reasons why whānau might want to lend money to each other. However, despite having the best of intentions, there is scope for things to go wrong if the loan is not properly documented. You may feel that you can rely on the word of a family member that they will repay the loan when you need the money or when they are able to pay it back, but unfortunately, this is often not the case. Let’s look at Jane’s scenario to see where lending to family members can go wrong and how you can be better prepared if you find yourself in a similar situation. Jane helps her daughter Sarah Sarah is in her thirties and keen to buy her first home, but she doesn’t quite have enough savings for a deposit. Jane has savings in the bank for her retirement and wants to help Sarah. Jane wishes to loan, rather than gift, the money to Sarah because she needs the savings for her retirement. Jane also doesn’t have the money to be able to give a similar gift to

her son, Ed, and she wants to keep things fair between her two children. However, Sarah’s mortgage broker suggests that the money is not documented as a loan, as this will affect Sarah’s eligibility for a loan with the bank. He advises that it would be better to call it a gift. Jane is unsure. She trusts Sarah but is worried that this may not be a wise decision. In the end, Sarah receives $100,000 from Jane, and neither of them signs any documents recording this as a loan. Sarah defaults on her mortgage After Sarah is made redundant, she is unable to repay her loan to the bank. Unfortunately, when the bank sells her house by mortgagee sale, the sale proceeds only just cover her debt, and there is nothing left over for Sarah to be able to repay Jane. Jane, who will soon turn 65, is starting to think about retiring and is counting

on Sarah repaying the loan to strengthen her savings, as she will soon be relying on the pension for her weekly income. Sarah now must break the news to Jane that she cannot repay the $100,000. Jane has also recently completed a will by which Sarah and Ed equally receive her estate, as Jane was counting on Sarah repaying the loan soon. It is very important to Jane that she equally benefit her children. What could have helped Jane? Jane and Sarah should have sought independent legal advice when they first began discussing the loan. Their lawyers would most likely have been able to advise them on a way to document the loan to satisfy Sarah’s bank and ensure Jane’s interest was protected, or if Sarah’s bank was not satisfied with the funds being a loan, then Jane would have at least received advice as to the possible risks of gifting Sarah the money. She could have made an informed decision about whether to give the money to Sarah. While you may wish to keep things informal between yourself and your

family on the basis you trust each other to keep any promises made, unexpected circumstances can arise that are beyond either party’s control. An agreement to record the loan can be simple and relatively inexpensive to prepare, giving you and your family confidence that you are on the same page regarding the terms of the loan and the process for dealing with any issues that may arise. “There is a group of us who have been volunteering to make knitted items for the Whangārei Women’s Refuge. Hospitals are always asking for donations, but there are other needs out there and it is nice to share with other communities. We will continue knitting, pack it up and give it to the refuge to use next winter,” says Viv. Viv has a passion for knitting, natural fibres, seeing young people in natural fibres, and has a heart for those less fortunate. Her appeal has been gifted balls of wool by the community to be made into toys, blankets and clothing items. “I am interested in looking after the women because often they go to

refuge with nothing. I encourage people to continue to donate.” She welcomes donations of knitted items and spare wool for the cause. It is an ongoing project. In recent months, the boutique was donated creations for the neonatal intensive care unit. Donors can drop goods off at The Little Wool Boutique in the Countdown Dargaville car park this Wednesday or after the summer break. Check the boutique’s Facebook page for opening hours and contact details. “We wish everyone a happy and safe Christmas. I am thankful to everyone and excited for next year. We will be back and want to give back to the community,” Viv said. ¢

Early education providers, primary and intermediate schools part of the Northern Wairoa Kāhui Ako spent the last teachers-only day learning about the Ministry of Education’s Refreshed New Zealand Curriculum.

This Christmas, Dargaville’s Tika Pono Toi Gallery team has come up with some community-minded ways to spread seasonal goodwill, especially to the young.

p Recently, Northern Wairoa Kāhui Ako educators gathered at the Dargaville Baptist Community Church to learn about how the refreshed curriculum will affect their teaching and students

“We had three presenters from the Ministry of Education unpacking the refreshed New Zealand curriculum for all of our schools. As an educator, it is exciting,” said NWKA co-leader Curtis Gaylor. Representatives from early childhood, intermediate and primary facilities from the NWKA attended. The presentation was run by Ministry of Education curriculum leaders Alison Booth, Te Riini Henare and Deanna Niha. The framework covered seven components of teaching youth, including connecting with the community, curriculum foundation and design, supporting progress, and creating a vision for students. Guiding principles and

weaving learning experiences across the subjects were also covered. “The 38 pages of the Refreshed NZ curriculum took seven years to design. We were there to inform teachers on how it could be implemented in schools,” said Alison Booth. It is designed to empower students to be informed, relate to big ideas, and be able to think and act on them. It takes direction from the Treaty of Waitangi and focusses on Māori knowledge. The new curriculum remains in draft form, with a final one expected by the end of this year. Once completed, the curriculum will be implemented in phases. According to the March 2023 draft, technology, the arts and science are due to be ready by 2024. ¢

“The idea has always been to give back to the community and create things that enrich living here. People kept saying there was not much for young people to do, and we also know that times are challenging for many,” says gallery founder Mark Lang. To address the latter issue, a huge Christmas tree has been set up in the gallery space next door to Dargaville’s library, and any presents donated under this tree will be given out to needy families, thanks to a collaboration with SOS Kaipara. Water plan presented despite coalition’s stance u by Andy Bryenton

Northland Regional Council presented an overview of proposed new freshwater protection rules to the Kaipara District Council at its November briefing. This presentation proceeded even though the foundations for the NRC’s freshwater management approach have been slated for a total overhaul by the new coalition government. Farmers’ advocacy groups have been vocal against the NRC’s proposals, saying more than 250,000 hectares would be targeted for livestock exclusion by the plan unless by consent to farm. This consent would have to be sought via a bureaucratic process. The Nationalled coalition wants to replace the National Policy Statement on Freshwater entirely. Prime Minister Christopher Luxon said such an update to the rules was about ensuring ‘those standards are working for all people who have an interest in water, of which there are many’. However, no matter what form the government’s new freshwater legislation takes, NRC policymakers say that environmental concerns will remain. “A change to the national direction on freshwater does not make our freshwater issues go away,” said NRC’s Justin Murfitt, when councillor Pera Paniora articulated the question of governmental ideological change in the space of environmental regulation. “There’s certainly a lack of clarity. The coalition government has signalled that this National Policy Statement that we’re working

Dargaville’s Floral Art Club has been busy creating posies to gift to the elderly and sick people to light up their Christmas. “One of our former members started providing posies to the rest homes at Christmas time. This year, we are gifting the posies to some residents at the rest homes and sick people in their homes through the Methodist church. I love seeing the joy on their faces, especially the ones on their own. It brightens up their day,” said Margaret Pinny. The ladies had the opportunity to make more than 10 small bouquets to bring some happiness to others. Chocolates and other sweet treats were also incorporated into the floral designs. Before Covid, the club would do two yearly Christmas displays in the Dargaville township. Margaret was part of the Northern Wairoa Federation of Country Women’s Institute, which used to hold floral art competitions. To learn how to craft a display properly, she joined the group and has been there ever since. “I wanted to win the institute’s competition, and after learning how to do it properly, I did. I have been part of the group for about 15 years because I love creating. The club consists of people

that some of her comrades have won the prize. The group welcomes anyone to join the creative clique. It meets on the third Wednesday of every month at 1pm at the Lighthouse Church, 78 Normanby Street. The image that comes to mind when you hear the words ‘laser scarecrow’ may be a fanciful one of the friendly straw man from the Wizard of Oz armed with science-fiction weaponry. Rebecca Brown, a University of Rhode Island professor of plant sciences, sought a new way to deter bird pests from corn in 2019 when she invented the laser scarecrow concept. “Birds rip up the husks, peck at the kernels, and make the ears unmarketable. Despite all the approaches the farmers have used to keep the birds away, it’s not uncommon for farmers to lose as much as 75 per cent of their crop. It all happens within about 48 hours of harvest.” Her answer was to update one of the oldest concepts in agriculture, the scarecrow. Rather than making some straw-man robot to patrol the fields, Professor Brown turned to the technology used in indoor stadiums to stop birds from roosting over the bleachers. In these spaces, lasers have been proven to deter nesting. The big challenge was in adapting laser technology to the sunnier outdoors and across bigger distances with large numbers of food-motivated birds. The key to her success was discovering that birds are frightened by flashes of

green light. It’s thought that this is a primal response from thousands of years of evolution. Flashes of green in the treetops would be caused, in the primordial forests, by predators stalking among the leaves and rustling the branches. Due to this, flickering green laser light makes birds panic and fly away. Armed with the knowledge of what scares avian pests, the next step was to make a prototype. “In the past five years or so, several things came together to make the technology possible,” said Brown. “LED-based lasers have become much less expensive they can now run off batteries that are more powerful and less expensive, and solar panels are available to charge the batteries off the grid. Firearms law changes are high on the list for the new coalition government, with some hunters and shooters applauding proposed measures while opponents issue dire warnings. “The full registration of firearms is a wasteful and dangerous exercise, and ACT will repeal it,” said ACT’s firearms spokesperson Nicole McKee. Now, it seems the registry idea is not all under the scalpel, as the newly minted coalition seeks to make sweeping changes. These include the repeal of section 6 of the Arms Act 1983 pertaining to clubs and ranges, and more, as indicated in ACT leader David Seymour’s coalition announcement. “We will immediately transfer responsibility for the Arms Act 1983 to

the Ministry of Justice and the Firearms Safety Authority away from police and review whether the Firearms Registry is improving public safety,” said Mr Seymour. Sports shooters have responded enthusiastically to the news that clubs and ranges will face less red tape. Many in the hunting and target shooting community have opined that safe firearm use and
