That farmer, a Mr G. J. Bayly, owned a strip of land 14 miles long and one mile wide on the coast. The townies asked Mr Bayly if he would sell a few acres of his land for a camp where the members could put up holiday cottages. Mr Bayly agreed and so in 1914 the Baylys Town Camp Club was born. One hundred years later the descendants of those families came together over

the weekend to celebrate a century of living life next to the beach that bears Mr Bayly’s name. Among them are Brian Gaukrodger and his wife Nita. Mr Gaukrodger is now retired after many years as Dargaville’s pharmacist. Mrs Gaukrodger says that when the camp was set up rules were written, some of which sound quaint. “The camp was limited to 17 cottages. No dogs

were allowed because of the proximity to the farm and Mr Bayly didn’t want dogs chasing his sheep. No building operations were permitted between December 1 and February 14, while people with infectious diseases were not welcome between the same dates.” The camp’s rules and practices also encouraged social activities. continued on page 10 …

p She’s heading into her second century on the waters of the Kaipara Harbour, but this venerable old lady of the sea can flick her skirts at many of her juniors, and she showed how at the recent Pahi Regatta. Built in 1903, as a barge scow and after a variety of sea-going roles, Vesper is now seeing out her days as a fishing boat. But at the regatta, she came home with some silverware, cleaning up a couple of handicap launch races. Her skipper, Lance Matich, reckons he had his heart in his mouth a couple of times. Other competitors reckon Vesper’s triple skin kauri hull might be her secret of success.

We welcome the many exhibitors and thousands of visitors to Dargaville and the Kaipara District. This year marks a special milestone — Northland Field Days is 30 years old. We salute those who developed the original concept and those organisers and volunteers who have expanded the event from the initial 80 sites at the Dargaville Racecourse, to 550 exhibitors at today’s property on Awakino Point East Road. It is a credit to you all. The benefits to our district are numerous. Our agriculture, forestry and horticulture industries add immense value to New Zealand’s economy. They dominate our important export trade. While some have forecasted their demise from this position over the years, they have in fact just grown in strength and importance. Their growth has been accompanied by the striving for excellence by those in these sectors, to match the demands from customers abroad — for food products that are safe for consumers, for products that are organic, for products that consume renewable rather than finite resources. Budding artists will have the opportunity to express their creative colours through a series of new art classes to be held at Mangawhai Library Hall.

p Suza Lawrence is keen to provide a creative outlet for Bream Bay locals - and with the opportunity to get into drawing, sculpting, painting and illustration the possibilities are vast

Experienced teacher and multimedia artist, Suza Lawrence, moved to Bream Bay six months ago and is now excited to be able to share her talents and expertise with her new community. Suza has been teaching children and adults for twenty years and is passionate about community and continuing education. Now that she has moved north she is planning to offer weekly classes in drawing, painting, sculpture and children’s book illustration. “I followed my dream by moving North, I wanted to experience a country lifestyle and I’m really loving it,” says Suza. “I am keen to meet people and become part of the local creative community.” Have A Go @ Art is an introductory course exploring drawing, painting and clay modelling techniques, with Suza giving support and direction. The Children’s Book Illustration course is something that Suza has always wanted to do and she says it a great way for people to share stories with children, grandchildren and young friends.

“I’m also keen to hear from people who would like to join me for an informal life drawing group. We can draw, paint and sculpt the human form in a stimulating and creative environment and also share the rent and model fees.” German by birth, Suza grew up in Turkey and lived in both Italy and Germany before settling in New Zealand. She studied at Elam School of Fine Arts at the University of Auckland and is best known for her installations and interactive works at outdoor exhibitions such as Sculpture on the Gulf and NZ Sculpture OnShore. Sixteen women, with many levels of art experience, attended Suza’s first Have a Go @ Art day and the new classes have now started at Mangawhai Library Hall. Meet the teachers — Otamatea High School u by Joanne Speechly

The academic year is now well underway and Otamatea High are pleased to welcome three new teachers to the fold, Philippa Randell, Bruce Alison and Steve Davie-Martin. Phillipa, who recently moved with her husband, Owen, from West Auckland to Mangawhai, says she is delighted to be teaching at Otamatea High School. “We’ve been holidaying at Waipu Cove for years and love Northland. We left a 16 acre property in West Auckland, where I was an assistant principal and teacher at Riverhead, for a smaller three acre section in Mangawhai but the kune kune pigs, hens, dogs and cats have all relocated with us! “I’m really appreciative of the warm welcome that I’ve received by both students and staff at Otamatea. I am homeroom teacher for one of the Year 8 classes and also teach English, Maths and Inquiry. I love teaching this age group and know how important these years are. I look forward to getting to know our community and to a wonderful year of teaching and learning. Bruce Alison has recently graduated as a teacher and says he is relishing the opportunity of working at such a fantastic school, where he’ll be teaching Physical Education. “I am interested in all sports and keen on outdoors activities. I fish, dive and hunt whenever I can, and I’m also an avid power-lifter, so I’m enjoying the wonderful community gym facilities the school has on offer. I look forward to working with students and parents and the great staff here at Otamatea High School.” Steve Davie-Martin has moved across the Kaipara from Dargaville to Otamatea High School and is looking forward to getting to know the community and students. “I am the new Ngapuhi Dean, Year 7 homeroom teacher and Geography and Tourism teacher. I have three teenage children, a 12 year old stepson to be and before this, I was teaching in Dargaville for 10 years.

“I was born and bred in the Warkworth area, where my parents had a dairy farm, attended Lincoln University and Dunedin College of Education and travelled extensively in Europe and the Middle East when I was in my 20s. Local government New and improved Baylys Beach walkway proposal stirs interest

A fixture for more than twenty years, Baylys Beach clifftop walkway has been receiving a much needed makeover of late, which will be officially opened with a ribbon ceremony on Saturday, March 8.

p Baylys Beach walkway is a wonderful natural asset — but it’s amazing how few Kaipara locals have taken the opportunity to enjoy the rugged beauty of the coast from this unique vantage point

The opening will coincide with national Seaweek, from March 1 to 9, providing the perfect opportunity for locals to get stuck in and help with a collective cleanup. The well-trodden path, which connects Baylys and Chases Gorges, had fallen into a state of disrepair but has now been widened, cleared of overgrowth and fitted with new steps thanks to the Baylys Beach Society. A sign featuring an aerial photo highlighting the track and the entrances will also be installed. “The track has been there for a number of years, and the first work was

carried out by people from rehabilitation programmes,” says Baylys Beach Society secretary, Graham Jones. “We put a proposal to council saying we would do the work if they provided the resources, and they agreed. “It has wonderful views but it’s amazing how many locals haven’t even tried it yet. The ones who have think it’s great, so we’d really like to get others along on our opening day. In turn, they can encourage visitors to have a go and have a look, which builds up the tourism aspect and overall enjoyment for everyone.” ¢

More than 1,300 Northlanders have taken the chance to put in submissions on the future structure of local government in Northland. Last year the Local Government Commission put out a proposal recommending the abolition of Northland’s three territorial local authorities and the Northland Regional Council, and replacing them with a Northland Council covering the whole region. Submissions on the commission’s proposal closed on Friday. However, commission spokeswoman Kathryn Street said submissions were still coming in. They would be accepted, provided they were postmarked no later than

Friday. She said an analysis of how many submissions supported or opposed the proposal had yet to be done. Nor had there been time to do a geographical breakdown of submissions, although a vast majority came from Whangarei. Ms Street says the commissioners will now come to Northland to hear oral submissions from those who requested to be heard. Dates have yet to be finalised, although it is likely to be in the first half of March. ¢

Setting the scene for the next year

This week the Commissioners will put finishing touches to work that has been underway to prepare an Annual Plan for Council for the year beginning 1 July 2014. This plan incorporates the Council budget. The final proposals will be available for your review in March. We will run workshops to answer any questions on the Annual Plan in March, and seek your comments on the priorities that we have set. The public submission period will run through to early April. The Annual Plan being proposed is consistent with the Long Term Plan that Council adopted last year. Importantly for property owners, we are proposing a plan that holds average rate increases down to inflation type levels. Across the District: The average rate increase in 2012 was 19.8 percent; The average rate increase last year was 9.3 percent; The average rate increase in the proposed budget for next year is 2.3 percent. Importantly for the confidence of investors, as we forecast out, we see no reason for average rate increases to be above inflation rates. It is important to realise also that the 2.3 percent average rate increase is just that. It is an average. Your property may receive a rate increase above or below this figure. The reason for this is that a rate is made up of several elements, including a land rate and several “network” rates, like stormwater, wastewater and water. Changes in the network rates vary according to the investments required to maintain or upgrade them. In this Annual Plan, investments are required in stormwater and wastewater renewals for Dargaville, Te Kopuru and Kaiwaka. Thus in the proposed plan, property owners in

these areas are being asked to bear a higher rate increase to cover these costs. If we accept the principle that the capital costs of such schemes should be paid for by those receiving the service, then capital renewals always will have this impact on ratepayers. Council debt

You may recall that when the Commissioners were appointed to Council, debt had been increasing rapidly. The Council had also been running large operating deficits, and this was contributing to the growth in debt. That has come to an end. Debt is now trending down and Council is breaking even or generating small operating surpluses. While debt is higher than we would like, it is manageable and the finances of your Council are in good shape. In a letter to the editor on 11 February, former Councillor Bruce Rogan of the Mangawhai Ratepayers and Residents Association claimed that the “true level of debt” of the Kaipara District Council “is about $106 million”. Mr Rogan is wrong. Council’s debt is now below $77.5 million, and declining. In his letter Mr Rogan also made extraordinary claims about a 300 percent rate increase coming up. Once again he is wrong. As discussed above, Commissioners are recommending rate levels for the next year that will represent an average increase of 2.3 percent. December quarter rates were due for payment last week. Most ratepayers pay their rates on time, and that is appreciated and important. Originally from the UK, Jean and Peter have been holidaying in the Kaipara for about six years and three years ago, decided to lay down some roots and build a house here. The couple found their second home after daughter, Kirsty, met and married Dargaville native, Greg Comber, in England and returned home with him. When the southern hemisphere winter starts to darken their days, Jean and Peter return to their Spanish villa in Murcia, which boasts a slightly warmer climate than the Kaipara. “I like the summers here — they’re not quite as hot as Spain but they’re

certainly warmer than England and we enjoy being near the family,” says Jean. “We really love the area and travel a lot around the North Island and we’ve made some very good friends here. “Peter has really taken to his artwork here and spends a lot of his time here painting and now has some of his work on display at Muddy Waters Gallery. He doesn’t tend to paint a lot in Spain as he says the paint dries too fast there!” Jean hosts online cribbage tournaments for an American company, which is a hobby she can take with her wherever she is based in the world. ¢

One of the biggest events on the Dargaville bowls calendar is set to hit the greens early next month. The Wilson Pairs is set to bring at least 41 pairs to the Dargaville Bowling Club for a two-day tournament on March 4 and 5. Olga Posa of Dargaville Bowling Club’s Match Committee says this is the 59th year the Wilson Cup has been played for. A tournament for women’s pairs, it attracts top players from throughout Northland and further afield. “They’re coming from here, there and everywhere. They’re coming from Russell, Whangarei, Mangawhai, and Wellsford. We’ve even got some coming from Te Kauwhata.” Mrs Posa says among those playing is the granddaughter of

Friends of a Dargaville man killed in a West Australian mine came together last week in a run to celebrate the life of a good bloke.

Wayne Fowlie, 59, died on February 15 following a rock fall at the Harlequin mine, 200km south of Kalgoorlie. Mr Fowlie had been a member of Dargaville’s Kauri Coast Hash House Harriers and had completed hundreds of runs with the group over more than a decade. Hash House Harriers organiser John Murray, who knew Mr Fowlie since 2000, described him as ‘a pretty happy guy’. “He had an Aussie twang and there was also lots of laughter.” He said Mr Fowlie was always very fit, starting as a swimmer in his younger days. In recent years he competed in Sport Northland events, and multisport and other endurance events. These included the Rotorua and Auckland marathons, the round Lake Taupo cycle race and races across Northland and to Cape Reinga. Fellow harrier Terry McDermott says Mr Fowlie will be missed. “He was a hell of a nice guy — a happy go-lucky guy.” Mr Fowlie had previously worked as a motorcycle mechanic in Dargaville and as an operator of heavy machinery. Last week the Hash House Harriers had their 700th run, which they dedicated to Mr Fowlie. About a dozen runners and walkers (and two dogs) braved wet weather to run and walk from the Northern Wairoa Boating Club to the Dargaville Museum and return. Mr Murray says the Hash House Harriers are also planning a run next week around the Kai iwi Lakes as an ‘official’ memorial to Mr Fowlie. ¢

Dargaville artist Patricia Mortensen says her new exhibition comprises ‘anything and everything’.

While lots of kiwis spent summer on the beach, Baylys Beach resident Josie Scott was drumming her way through two West African countries that many New Zealanders have never heard of.

The exhibition ‘Art from the Heart’ opened earlier this month at the Funky Fish in Baylys Beach. Mrs Mortensen says her style is “expressionism, Impressionism and everything else. I just love colour and textures. I just paint from the heart and the head.”

She and husband Allan started the Dargaville Arts Association four years ago. She says the association has encouraged the creativity of local artists like herself. “It gives us the opportunity to go out and do things as individuals we wouldn’t otherwise do.” The association had an exhibition at the Funky Fish last year at the invitation of owner Beth Kelliher, who gives local artists the opportunity to have two-monthly exhibitions throughout the year. Mrs Mortensen then booked herself for a personal exhibition. She admitted it got a little frantic as opening day came closer and the pressure to produce got stronger. “But it forces you to get your act together and be disciplined.” Her exhibition opened in early February with 26 works and will remain open until the end of March. Four pieces that were intended in the exhibition have been sold and replaced. All remaining works except one are still for sale. Mrs Mortensen says she has had positive feedback from people who have seen her work. ¢

Ms Scott is aficionado of African drumming. She and partner Northland Regional Council deputy chair Graeme Ramsey spent six weeks there in December and January. But it was hardly an unusual experience for Ms Scott. Her trip to Ghana was her fourth in the last 10 years. “One of the reasons I go back to Ghana is because I know that having lessons with local musicians supports them to keep doing what they love — and in fact helps the whole community, as everything is shared around.” This year she had the chance to travel to the inland nation of p Josie Scott (right) during a performance in Ghana Burkina Faso. “It’s much poorer than Ghana. Council proposes 2.3% rates rise u by Colin Patterson

Kaipara District Council is expected to propose an average rates increase of around 2.3% for the 2014/2015 year which begins on July 1. The council’s draft Annual Plan 2014/2015 will be considered for adoption by the commissioners at their meeting today (Tuesday February 25). If adopted, it will be released for public consultation on Tuesday March 4 with submissions invited up until 5 pm Tuesday 8 April. Chief executive Steve Ruru says council had signalled through its Long-Term Plan that average rate increases proposed for the period from 2014/2015 to 2021/2022 would be more in line with rates of inflation, after being higher for the last two years. He says the low average rates increase proposed is a reflection of the continued determination of the commissioners to run an affordable and balanced budget. “Council has delivered on that p Council Chief Executive Steve Ruru commitment,” Mr Ruru says. Camp families celebrate 100 years at Baylys Beach Every New Year there has been a special sports day for children, while there is an annual cricket match on the beach with the Dargaville Fire Brigade for the Toheroa Cup. The 17 cottages have mostly been handed down within families, as the club’s rules only allow sales on the open market after first being offered to family members and then other residents.

Mrs Gaukrodger says most of the camp’s residents live far afield, with many coming from Auckland for the summer. But they still have strong links to the Dargaville area. Among the initial members was local MP Gordon Coates who subsequently became Prime Minister. The centenary was marked by a Saturday night dinner for 160 people at the Northern Wairoa Golf Club. ¢

On Saturday March 1 Classic Hits Northland will be running gala games near the event headquarters allowing visitors to take part in a range of family competitions from wife carrying to dunking for apples. The team at Sheep ‘n’ Show will be holding sheep races and live shearing events with three races and two shearing displays each day. Previously appearing at the America’s Cup Village, the Royal Easter Show and the Aotea Centre the Sheep and Show team hosts the ‘grand national sheeplechase’ complete with full commentary, pre-race build up and the ability to win prizes by selecting the winning sheep. Lawn mower racing is back again having become a great attraction which is possibly the most affordable form of motorsport, allowing, anyone to get involved, compete and have fun in the process. Some of the machines are works of art, others more basic, but all have standard lawn mower engines and

gearboxes and must use at least one belt in the driveline. The chassis may be modified and all mowers must be fitted with axle brakes. The Waipu Lawnmower Racing Club organises this event and as a non-profit organisation any funds raised are distributed among local charities. The action takes place in Fieldpower Place. Northland Field Days have been running the tractor pull competition for more than two decades with a 100m

track for novices, experienced drivers and spectators to enjoy. This year will be no different. Join in and experience the fun that tests brute strength, skill and technique. The Northland Tractor Pull is the main event and drivers take to the track on Friday and Saturday to compete for a great prize pack. There is a $40 entry fee and it takes place in Totalspan Alley, testing the skills of operators in selecting the

Entrants will supply their own as long as it is a standard agricultural tractor with PTO output between 25–139kW (30–180hp). Scientifically calibrated sledges are weighted according to the power output and all tractors will be tested on the Dyno before each race. A kW of power output means 40kg of weight. Each competitor will also have the opportunity to compete in the three legged race. This race has great spectator value and a chance for you (if you have a driver’s licence) to challenge all comers on unfamiliar tractors which are supplied. This competition is for teams of three and designed to test drivers’ skill on three different and unfamiliar tractors. The best time carries on to a final play off. In the event of either of the tractors front wheels leaving the ground during the pull the entrant will be disqualified during the heats or relegated during the finals. Businesses also get in on the act in the Thursday Challenges. No rural show can be complete without the woodchopping events, even though the sport attracts dwindling numbers in the 21st century. Logging workers from all over Northland and New Zealand have gathered at the Northland Field Days for more than 20 years to take part in

out who is the best in the region. With sometime displays of uncanny ability, sheep are rounded up and penned to the demands of a good shepherd’s whistle. With competitions being run since 2008 the field days continuously attracts Northland’s top dogs and shepherds. Democracy at its best? Why good governance matters in local government reform. Are the present problems with local government performance and service delivery the result of the system, or of those who govern the system? Much of the difficulties faced within the current system are the state of governance and leadership elected within the current system. A classic example of this is the huge financial problems faced by Northland’s Kaipara District Council. Poor governance leading to poor oversight on the management function was a key driver of their financial crisis. Our current democratic system allows for councillors or a Community Board member to be elected by their community. While many bring passion, enthusiasm and commitment, many will also have limited, or no governance experience or knowledge of a council’s specific regulatory or legislative requirements. There needs to be a major change to the Local Government Act that would require councillors and senior staff to be more accountable and liable where there has been a clear breach of fiduciary duty to the wellbeing of ratepayers. We see an opportunity to strengthen

corporate governance with the inclusion of professional directors appointed by central government working alongside elected representatives. Growing attention has been placed on changes to Local Government and how it should be organised. There has been much criticism of local government performance and central government seem to have the notion that the only answer is to amalgamate on the basis that bigger is better. Right of centre politics believe that large provides efficiency and economies of scale while left of centre believe greater power delivers effective decision making. Few analyse and identify the problems within local government and fewer still determine with any real clarity what the appropriate role and function of local government should be. Councils are required under the Local Government Act to ensure that all decisions enhance the economic

and social wellbeing of their ratepayers. Any consideration of local government reorganisation should not be limited to proposals floated by the units of local government nor limited to one or two proposals. Other proposals and alternatives should also be considered. Options should not be limited to those that adhere to the current legislation but be determined by what actually best fits a region’s needs. The key questions are how meaningful representation is achieved, how we can ensure good governance, how greater vision and leadership can be fostered, the improvement of delivery of services and the cost reductions that can be achieved. Any reorganisation must be predicated on the basic requirement to meet the tenets of Section 10 of the Local Government Act 2002 with the emphasis on ‘local’. Purpose of local government The purpose of local government is:

(a) to enable democratic local decision-making and action by, and on behalf of, communities; and (b) to meet the current and future needs of communities for goodquality local infrastructure, local public services, and performance of regulatory functions in a way that is most cost-effective for households and businesses. (2) In this Act, good-quality, (in relation to local infrastructure, local public services, and performance of regulatory functions), means infrastructure, services, and performance that are: (a) efficient; and (b) effective; and (c) appropriate to present and anticipated future circumstances A starting point must be consideration of a modified status quo and any changes must be decided by a binding referendum giving the people of a region the right to make the final decision. This would be democracy at its best.

A dry summer has reduced intakes into the Kaihu River, leading Kaipara District Council to ban the use of hoses and sprinklers with the aim of safeguarding supplies for the rest of summer. Council operations engineer Brian Armstrong said the first week of restrictions saw a drop in usage from 3,500 cubic metres a day to 3,300. But hot weather last week saw usage shoot up, reaching 3,800 cubic metres on Saturday which was an all-time record. Rain through most of Wednesday appears to have had little effect, with continuing hot and dry weather since. And with Field Days later this

Northland Agricultural Field Days The team that makes it happen Northland’s agricultural Field Days is no small task to organise — even after 27 years of successful events. Partly, this is because the nation’s secondbiggest rural festival of business, culture and fun keeps on growing, storming ahead from its humble beginnings in 1985 to become the three-day powerhouse it is today. Back in 1985 the very first Field Days was held at Dargaville’s equestrian

racecourse, the brainchild of the local Jaycees. That year saw the event saturated by torrential rain — something farmers definitely appreciate. Spirits undampened, the event was a roaring success, attracting over 80 exhibitors. Year after year the festival grew, moving to its new and current home just up the road. This prime highway-side spot became the official property of the Field Days in 2006.

Even though the Jaycees are no longer the single driving force behind the Field Days, a spirit of community co-operation and volunteer grit is still what gets the job done as the huge event gets ready to launch. Volunteers pitch in across all aspects of Field Days organisation, from the most important to the most prosaic. Some would say that there are certain jobs which fit both descriptions!

Community involvement is not just limited to those selfless folks who give freely of their time. The Field Days is now an incorporated society, registered with the New Zealand Charities Commission, and each year many not-for-profit groups are invited to take part as a vital part of their fundraising. The Field Days also gives back in the form of research grants and scholarships, driving innovation and growth in the rural sector. ¢

“Now we’re the only one. People need to support their local businesses. Otherwise they’ll have to go to Whangarei for everything.” Dargaville Ford will have three sites at Field Days displaying 22 vehicles. “Our range is absolutely amazing,” says Lindsay. “They start with the small Fiesta all the way to the Ranger. We’ll have special offers and finance people who can tailor-make a deal for you.” While few sales are made at Field Days, Lindsay says being there helps create interest among potential buyers. “Last year I didn’t sell very much because of the drought. But we did 19 sales in March. I attributed them all to Field Days.” Being at Field Days is an expensive exercise. “There’s the cost of three sites. Then we’ve got to order stock three or four months in advance. Once you do that there’s no going back.” He and his fellow staff expect a busy time at Field Days. “When we’ve made such a big commitment we hope for the support of the district.” ¢

She says previous owner Greg Newman had been at Field Days for some years and she and her husband have continued that tradition. “It’s one of the places we can showcase what we do. It’s important for finding potential customers.” The Dargaville-based company specialises in finding engineering solutions, mostly for the rural sector. Field Days is a once-a-year opportunity to highlight their ingenuity and skill to an attentive audience. Mrs Bishop says Newman Engineering will be highlighting three of its signature implements at this year’s show. “The first is the Land Plane which is three implements in one. It’s local kiwi

ingenuity designed by local farmer Ross Whatmough and Greg Newman.” They will also be promoting Newman Engineering’s range of incinerators — particularly important in this year’s dry summer and accompanying fire ban. Their final implement will be the deCrap-it, an effluent scraper that can be fixed to the front of a tractor. Newman Engineering also offers a mini de-Crapit that can be carried at the front of a quad bike. Going to the Field Days is a big commitment for a small locally-owned business. But Mrs Bishop has no second thoughts. “There may not be a lot of sales. But there’s a whole new year ahead and we’re looking positive.” ¢

We all work to accumulate wealth and security for our families. It’s important to know that everything you have strived so hard to achieve is protected in the years to come. But, it’s not just about passing on wealth. It’s about realising ideals and hopes for the future and cementing property that you have worked hard for and passing it on to future family members. How may a trust work with asset and estate planning? Why should you plan how to deal with your assets? Essentially, the reasons for estate planning may include: • Protecting your assets against future creditors to which you or your family could be exposed; • Tax savings on beneficiary income; • Enhancing your eligibility for government entitlements; • Protecting your assets from the possible reintroduction of estate duty or a capital gains tax; • Protecting your assets against relationship property claims, including the interests of your children against claims by their spouses or partners; and • Controlling succession of your estate to your children or other beneficiaries. So what is a trust? A trust is an obligation imposed on a person (the trustee) to hold property or income on behalf of and for the benefit of another person or class of persons (the beneficiaries). Discretionary trusts are trusts in which trustees have the power (discretion) to pick and choose among many beneficiaries (often defined as a class

e.g. ‘all my children and grandchildren’) each time they make a decision to distribute money or property from the trust property. The beneficiaries do not have a right to compel the trustees to distribute the trust’s assets in their favour, only a right to be considered in respect of any distribution. This is a very common family trust type and will generally cover most trust needs for basic asset protection. How Is A Trust Set Up? A trust can be created a number of ways. The most practical way to create a trust is by the execution of a trust deed by the settlor and trustees. The Trust Deed outlines who the trustees and beneficiaries are, the name of the trust, for how long the trust will operate, how the trust property will be invested and the rules that are to apply to the trust. Finally, as part of an overall estate and asset plan, you should ensure that you have a valid and recent will. The will is used to ensure assets go to where you intend. There are formal requirements of a will. Failure to comply with these formalities may render the will void. If you die without making a will the costs of administering your estate are increased by the need to apply to the High Court to administer the estate and you have no control over who will attend to these matters or who will ultimately benefit from it. Pia Sunderland is looking forward to cooking up a storm at the Funky Fish. She has just started as the night chef at Baylys Beach’s favourite eating place. Originally from Whangarei, Pia comes to the Funky Fish after working at Arcade Meats and studying at NorthTec. “Before that I was a farmer’s wife.” So what attracted her to the Funky Fish? “I love the people and the music. We have great bands and live performances. I love the beach. And I live out here — that’s a bonus.” At NorthTec Pia learned new ways of presenting food. “I’m planning on creating a new menu. And I’m keen to use what I’ve learned to funky up the menu.” As to her favourite part of the Funky Fish dining experience, Pia says it is easy to choose. “Our desserts. We make delicious desserts.” She says the Funky Fish is so successful because it remembers its local roots. “We always try and use local produce. And I want to keep the menu beachy — light and fresh.”

meeting with the Northern Wairoa Hotel’s John Collins changed the nature of their trip to a working holiday. Figuring that working in a historic Kiwi tavern would be a great story to tell the folks back home, the qualified bartenders (who already packed in a lot of experience in their home nation) signed up — and the rest is history. “They’ve set the bar for waitressing here,” says John, who along with the management and staff of the Northern Wairoa is sad to see the pair leave. “They’re certainly not afraid of hard work!” The next stop on Sarah and Sanna’s delayed tour of New Zealand takes them south to Coromandel, then

eventually on to Christchurch, in order to see the wonders of the South Island before they become locked in snow. Coming from Scandinavian climates, they explain “we’ve seen enough snow!” The pair plan to return when they can, and take with them good memories of Dargaville and its unique ‘characters’. Certainly there are those who frequent the popular tavern and restaurant who will miss their humour, wit and skill. In their absence, another globetrotting team of wait staff — this time from England and Ireland — will take over, adding their names to the register of international guests who have, at least temporarily, called Dargaville home. ¢
