Friday’s decision from Justice Paul Heath rejected the Mangawhai Ratepayers and Residents Association’s request for an order preventing the council pursuing disputed rates while the association’s appeal is heard by the Court of Appeal. Justice Heath ruled that although the council had acted unlawfully in signing a contract for Mangawhai’s EcoCare sewerage scheme, in undertaking complex financing transactions and in imposing additional rates to pay for cost blowouts on the scheme, the rates were validated by MP Mike Sabin’s Members Bill that was passed by parliament in 2013, while the financing transactions were protected transactions under the Local Government Act. MRRA chairman Bruce Rogan was not amused. “We were done like a dinner,” he says. “The judge has given councils from throughout the country carte blanche to ignore the law completely.” Kaipara chief commissioner John Robertson says the council was pleased at the judgement. “It reaffirms the court’s original decisions and that the council has a mandate to collect rates. “We’re keen to see this as an end of litigation and we would like the MMRA to reconsider its decision to appeal.” Mr Rogan says that will be up to MRRA’s members to decide. “We have lodged an appeal already. We have to check with our membership whether we should proceed. The decision will be whether we want the matters

The Northern Wairoa community came together over the weekend to thank emergency service workers who went above and beyond the call of duty during the recent floods and storms to restore essential services and keep everyone safe. Lines workers from Northpower and members of the Dargaville Volunteer Fire Brigade were among those who were at the Kaipara Vintage Machinery Club to receive the community’s thanks at an afternoon organised by local resident Joanne Williams.

The event also marked the 104th birthday of the First Dargaville Scout Troop, making it the second oldest in the country.

Bridge campaign gets boost

Replacement of Matakohe’s two one-lane bridges is likely to be listed in Northland’s regional land transport plan for 2015–18, says Northland MP Mike Sabin. But, even if that happens, he says it is still too early to say when the 80-year bridges on State Highway 12 will actually be replaced. Mr Sabin says the two bridges are a death trap. He has worked with local campaigners over the last two years in an effort to get them replaced and a public meeting in Matakohe last week attracted 180 people to hear from the MP and representatives from the New Zealand Transport Agency. “It was an outstanding turnout on a cold night,” Mr Sabin said. ‘This is a community that feels passionate about its infrastructure and has a degree of frustration that its concerns do not appear to have been listened to.” Bridge campaigner Sue Reyland said the meeting attracted a full house. “I’m absolutely thrilled. People are impressed
and satisfied that Mike is doing a lot of research and is going beyond and above the call of duty to get things done. But there’s still a long way to go.” Mr Sabin says NZTA is not behind the lack of action. “I’ve been working on this for two-and-a-half years. There’s a lot of frustration and anger directed at NZTA. But it does not make decisions on roading. Those are made by the Northland Regional Council transport committee as part of its regional transport plan.“ He added the committee is about to decide on its plan for 2015-18 and is confident the bridge replacement project will make it in. “We need to work together to get it over the line.” NZTA’s representatives at the meeting accepted that the current road and bridge alignment is not fit for purpose,
Pool will reopen this summer Dargaville’s Kauri Coast Community Pool will reopen this summer while talks continue with Sport Northland about taking over the pool’s management. Kaipara District Council proposed the transfer after the Kauri Coast Community Swimming Pool Trust told the council it was unsure of its ongoing capacity to run the pool. Council chief executive Steve Ruru says discussions with Sport Northland are continuing. “Sport Northland are concerned to ensure
that they have a reasonable level of certainty as to the level of funding they will receive to operate the pool, the need for adequate provision to be made for future maintenance costs, and depreciation and the management of risks associated with the current facility.” Trust chairman Vern Stevens says the pool will be open this summer while talks continue. He hopes that agreement will be reached, saying Sport Northland has paid staff with experience in managing facilities.

but Mr Sabin questions its $20 million replacement cost. “NZTA needs to look at its cost analysis. I reckon it could be done cheaper.” But even if the project makes the regional plan there were planning, resource consent, land acquisition, engineering and funding issues that will have to be addressed first. Public concern was emphasised dramatically
when just hours before the meeting, a truck and trailer unit collided with a car on the eastern bridge through Matakohe, injuring a woman and her two sons. They were treated at Whangarei Hospital. The crash caused major congestion on State Highway 12 at a time when State Highway 1 was closed due to a slip on the Brynderwyn Hills.

Along with wide areas of the Kaipara, the Waihue Valley was inundated by last week’s rainstorms, and this is amply illustrated in a remarkable photograph taken from a hovercam high above Waihue Road, by Dargaville contractor, Craig Woollams. “I imported the four-engine hovercam, with a stabilised 14 megapixel camera, from the US and will be carrying out aerial photography assignments,” he said.

Even though the district was spared some of the storm’s fury, such as the flooding experienced in Hikurangi, Morewa and Kaitaia, emergency services had their hands full with roofs blown off, felled trees and power lines down. Dargaville Volunteer Fire Brigade chief Jeff Palmer says it was the worst storm he can remember since Cyclone Bola in 1988. The brigade rescued one
motorist on the roof of his car who was at risk of being swept off his car near Titoki. In another callout, a portacom was severely damaged after a tree fell on it. Fortunately, no one was injured. Mr Palmer says the brigade had nonstop callouts on Tuesday. The brigade remained busy through the weekend, and again on Monday morning when a tree fell at Mt Wesley, once again cutting power to residents who had already
experienced a significant outage the previous week. High winds led to widespread power cuts on Tuesday night, with lines company Northpower calling in crews from other parts of the country to help repair broken lines and restore supplies. Dargaville Hospital went onto generator power when supplies from the mains were cut. continued on page 5 …

Teaching kids to sew is just one of the rewarding experiences which the staff at Dargaville’s Sewing and Curtain Centre have enjoyed over the past 20 years serving the Kaiapra community
The well-known local centre for the fabric arts and crafts is celebrating 20 years this week, under the management of Marion McEwing. Through the years — and three changes of premises — Marion has been ably assisted by all five of her daughters, along with sewing centre assistant Pat Dackers. Marion’s daughter Jessica assists in both the sewing side of the business, and the curtain manufacturing aspect which began three years ago. One of Marion’s daughters, a qualified teacher, formulated the idea of ‘Kidz Can Sew’ classes — a concept which has become a Dargaville institution, running for the last 15 years. That means it’s almost time for the second generation
of kids to come along and learn practical skills for life. A successful embroidery club has also been run by Marion for the last 13 years, with members travelling from as far away as Kerikeri to take part. It’s been an action-packed two decades of service to the local community, and Marion is quick to point out that she couldn’t have managed without the help of Pat, her family, and her supportive husband Brian. Or, indeed, without her loyal customers! As technology advances and a more people look to take up the fabric arts and crafts, the Dargaville Sewing and Curtain Centre is sure to be a local favourite for many years to come.

Entries for the Gilmore Brown 2014 Art Awards are now open and artists have until August 29 to submit their work. Judging will take place at the Kauri Museum on September 5, followed by a month-long exhibition. The five categories are painting and drawing; photography and printmaking; adornments, including jewellery and clothing; three dimensional, including sculpture, pottery, metal and glass; and wood. “The major change to the awards this year is that we now have a strategic partner in Gilmore Brown — rather than just a sponsor,” says awards committee chairman John Pickworth. “Correspondingly, the name of the awards reflects this. “We have moved away from ‘Kaipara’ and ‘community’ and it is my intention that the awards will become a national competition. The awards are now open to everyone, including independent artists and those from outside the
immediate region.” The awards are twofold — an exhibition and a competition — with a view to foster art and expose artists to outside influences and a competitive environment. “These awards provide a vehicle for the two principal art groups in the area — Dargaville and Mangawhai — but more than that, they are about making the community stronger and not just the Kaipara district either, but also surrounding communities. “The awards will evolve and already, they have grown from a councilfunded initiative, to an entirely selffunding exercise with the support of sponsors.” Entry forms are available from local art groups and the Kauri Museum. Winners of each category will receive $300, a kauri trophy, certificate and a rosette.

I then looked up Google Maps. ‘Oh God it’s so far away from home.” Claire returned home to France last week, saying her year here sponsored by the Rotary Club of Dargaville had been an experience not to be missed. “The best part was my host families who have been very, very good. Dargaville is good because everyone knows who you are.” Claire says she had been expecting to go to Australia because it is as far away from France as you can get. “I chose an English-speaking country because I believed it would be good for me and for my future.” Most of her time in Dargaville was spent staying with rural families, an eyeopening experience for a teenager from a suburban family. On the farm of Hal and Penny Harding she milked a cow for the first time. “I had never even touched a cow before. I now really enjoy milking. In the holidays that meant getting up at
5 or 5.30am.” Her time in New Zealand has also included a visit to a marae where she was introduced to Maori culture. Along with 26 other Rotary exchange students Claire undertook a three-week South Island tour, with the Routeburn Track and Milford Sound being the highlights. Her parents came over from France and Claire was able to show them some of New Zealand’s top attractions. “New Zealand was a not a country they would have come to if I hadn’t been here. They were pleased I was happy.” Claire also walked the Tongariro Crossing, took part in a Rotary District Conference and flew to Australia for the Rotary international Convention in Sydney. Claire says she has made lots of friends and saying goodbye has been difficult. But she says it is only a temporary parting. “I’ll be back — definitely.”
Lower beach speed A proposal to drop speed limits on Ripiro Beach to 30km/h has been given the green light from Kaipara District Council to go out for public consultation. vehicles are damaging sensitive sand dunes and shellfish beds. Police argued that a lower limit would only be effective if it could be enforced and enforcement would be more difficult in areas away from vehicle entrances. Most other beach users tend to congregate close to entrances and that is where most safety issues arise. Submissions are open from August 4 to September 4.

Part of our District has suffered badly from the rain and storm events of the past four weeks. Some farmers have had pasture under water for weeks. A flash flood in Maungaturoto left families suffering. There has been damage to homes and farm buildings. State Highway 1 was closed in two different places. The latest situation at the Brynderwyns meant that traffic was diverted onto our local roads, as the only way through to Northland

When events like this hit us, communities rally around those impacted most. Community support agencies get into action. For farmers badly affected, the Rural Support Trust becomes a guiding hand. In the last few weeks, the response in the farming community has been tremendous, including with feed being shipped in from outside of the District, and as well as from commercial firms that provide goods and services to farmers. Thank you to all who have helped. Pasture and feed management will continue to be a challenge for those affected, as the wet conditions persist. Thank you to those who work in the emergency services. You braved the elements to undertake your duties. We salute the linesmen who worked long shifts to restore power. And we regret the distress and loss of life in Northland that this event brought with it.

Extreme events like this illustrate the importance of the three Northland Local Authorities and the Regional Council working together on roading matters. We need a road network in Northland that is resilient. The maintenance on our network needs to be lifted. While we have been focussed on the immediate issues from the storm events over the past weeks, in the months ahead we need to engage with Wellington for the good of Northland’s roading network. Poor roading infrastructure holds back economic development.
In Court, again.
Your Council spent another half day in the High Court on Friday 18 July, defending further proceedings taken by the Mangawhai Ratepayers and Residents Association (MRRA). In his decisions released in May, following three days of High Court hearings in February, Justice Heath essentially denied MRRA the remedies they sought. In essence: • MRRA sought the return of millions of dollars of rates from 2006 to 2013. Justice Heath did not grant this. • MRRA sought damages from the Council — “public law compensation” — for promoting the Kaipara District Council Validation of Rates and Other Matters Bill to Parliament. Justice Heath did not grant this. • MRRA suggested that the Validation Act that Parliament passed last year should be interpreted narrowly and that the Annual and Long Term Plans supporting rating decisions had not been validated. Justice Heath did not agree. • MRRA challenged the ability of Council to service debt by striking rates. Justice Heath did not agree, though he encouraged Council to look for other means to deal to debt, in addition to rating. • MRRA sought costs. Justice Heath granted these, and invited each party to comment on the quantum of this. Soon after these rulings, MRRA lodged an appeal with the Court of Appeal. Immediately after lodging their appeal, MRRA approached the High Court again, seeking to injunct (prevent) the Council from taking enforcement action to collect unpaid rates relating to the wastewater scheme, until the Court of Appeal decision comes out. This request was heard by Justice Heath on 18 July. The Council opposed the injunction application. Last Friday the Court refused the injunction application by MRRA. Thus those withholding rates have no legal basis to do so. MRRA have had their day in Court. We continue to urge their executive to live with the earlier rulings of Justice Heath, and cease this costly litigation.

It takes a lot to impress the Kaipara Lifestyler’s most discerning consumer critic. There’s no place in such an environment for second best, and it’s only the very best which wins the approval of Billy (and of course his Boss, the farmer)! That’s why it’s good to know that the folks on these pages have passed a test more stringent than Euro-NCAP or possibly even All Black selection. They say that dogs are excellent judges of character, after all. And as the only dog in New Zealand smart enough to write his own fortnightly column, Billy
is perhaps even more qualified than the rest! You’ll see the pawprint ‘seal of recommendation’ gracing the advertisements of the people on these pages — Billy says that this is much better than any of the awards you can win on television, as it doesn’t come with a silly gold statue. Instead, all of these companies have proven themselves on the farm — or at least caught the famous border collie’s attention. Those kennels certainly look like a spot of palatial luxury — while there are few dogs who don’t enjoy having a good ride on a quad bike, or a bark at the local contractor’s digger while it’s working.

After the Komminwelth Games, we got the Genril Lection Games. “Ya see Dog,” he sed, “we gonna vote for a new guvmint and we gotta real strange lot of people to vote for. “We got that Jermyn bloke, Kim Dotty Kom, an’ he’s teamed up with that Honey Harawiri an’ some other strange people who want to get stroppy with old John Ki, tha prime minister. Also, it seems pretty dumb to have a politikal party — just to get some fast computas and suchlike. Mine you, Sharlene would like that ‘cos her computa here ona farm is pritty slow, she sez.” Boss was losing me attention a bit, talkin’ about computas. Me? Much more

An while it doesn’t realy affect me, cos I get me dinner meat killed here ona proppity, it means all me canine cussies in town will get cheeper dog rolls, an’ maybe a bit of real meat now an’ then. Good on yer Winnie! Then Boss told me about other Genril Lection party. (Must admit, wen Boss talks about a party I always reckin he meens ina woolshed with a keg ana muttin ona spit. I gotta concintrate an’ remember we havin’ a serius politikil discussion eh?) “Yep”, seda Boss, ”that Grin Party, well, I realy gotta wunda about them getting’ inta power. Latest thing they come up with was to tell tha United Nayshin’s they should give sum more munny to those poor people in Gaza. (I thort Boss was talkin’ about his mate Gazza atta pub, but remembered that TV, with them rockets and bombs.)

Meet BNZ Dargaville’s new milking, calf-rearing, tambourine-playing, yodelling bank manager. Sharon George says she wants to bring a bit of country spirit into banking and she is keen to let everybody know that despite the suit and heels, she is down-to-earth and just as happy in the cowshed as she is behind the desk. “I got into banking because I love numbers, I like talking and I am passionate about helping people achieve their goals,” says Sharon, who started her career in real estate. “In recent years, my husband Wayne and I have worked on dairy farms — sharemilking and relief milking — and Wayne is now a farm manager at Te Kopuru. It’s not unusual for me to feed the calves before coming in to work at the bank.” Sharon says BNZ is very community oriented and it is important that she, and the bank, is seen as accessible. “Sure, I can get busy but I want people to feel welcome and know that they can
just call in and say hi. I am really looking forward to getting to know people and being more involved with the community.” BNZ Dargaville is taking part in Closed for Good in September, which will see all stores close for a day so that employees can spend the day volunteering on local community projects. “On any given day, don’t be surprised if you see us out there Sharon George with your local BNZ team Bonnee O’Connor, Natalie McRae and Liz Tipene cooking a sausage for a fundraiser or in my case, yodelling.” Find

like Chunuk Bair, Passchendaele and the Somme — Kiwi soldiers acquitted themselves with bravery and distinction. A new sense of both New Zealand and Australia as nations in their own right, on an equal footing with Britain, emerged from the hell of the trenches. Enlistment numbers were high here in the Kaipara, as husbands, fathers, brothers and sons signed up for what many thought would be a great adventure, and a chance to prove their bravery. Overall, 120,000 men enlisted, including the 2200 soldiers of the Maori Pioneer Battalion, forerunners of the famed 28th Maori Battalion of World War Two. Early in the conflict Kiwi troops liberated German Samoa (now Western Samoa), and 460 Pacific Island soldiers joined the New Zealand forces as they were deployed to the front against Turkey and
Germany. At the time, the entire population of New Zealand was just over 1 million. The human cost, especially for a farming region such as the Kaipara, was staggering. With so many men committed to warfare, it was left to those who stayed behind to maintain the land and feed the demands of the war effort. It took decades for places like the Kaipara to recover from the toll of war, both in terms of actual casualties and in the sense of primary production. In many ways, New Zealand’s stand with Britain in what became known as the Great War was a terrible tragedy. But from out of this grim chapter in world history came a new sense of self, and selfassurance, which separated us forever from our colonial ‘mother country’, and forged an integral part of the national identity we recognise today.

This week marks the 100th anniversar y of the declaration of World War One in 1914, a proclamation made in England on the 4th of August. By the time the armistice was signed in 1918 New Zealand would have paid a grim toll. Standing shoulder to shoulder with Great Britain in a confrontation with the Ottoman Turks, Germany and Austria-Hungary, one in five Kiwi men would enlist and serve, with over 18,500 giving their lives in combat. More than 40,000 were seriously wounded or suffered the ongoing effects of poison gas, even when they returned home. But in this crucible of war a new national identity emerged for the men of ANZAC — the army corps made up of New Zealand and Australian soldiers. It was one of 12 regionally based mounted rifle regiments that, with a tiny regular force of professional soldiers, formed the basis of New Zealand’s army at the outbreak of the First World War. After weeks at sea on troop ships, the new soldiers would have been pleased with a landfall, at least until shots were fired in anger. They disembarked near Cairo, only to leave behind the horses they brought from New Zealand and find themselves landed instead as infantry at Anzac Cove. Almost 600 men died before they returned to the Middle East. The Kaipara men, along with others from around Northland who survived the Dardanelles and landed in Egypt were to become known with fear as the ‘Devils on Horseback’ by their Turkish foes. The role of Kiwis on the battlefields of Europe, in the horror of Passchendaele, Messines and Somme is now the stuff of legend. But our horsemen found themselves roaming the desert sands of the ‘Holy Land’, in search of the enemy. They operated behind enemy lines to defend the Suez Canal, fighting in many desert battles against a determined Turkish

Many of these young men, from a Maungaturoto farm, a Kaihu timber mill, or a Dargaville office found themselves in the 11th North Auckland Mounted Rifles, perhaps not surprisingly, given their rural experience with
foe in Sinai and Palestine. Their victories included taking part in the capture of Jericho and crossing the River Jordan to clear out the invading enemy. At war’s end, 521 members of New Zealand Mounted Rifles Brigade had died in the desert and 2000 were wounded, a huge and sad toll for a young nation on the far side of the world.
