 The playing fields of Te Kopuru School became a temporary home for a bevy of farm animals during the week as the school held its Pet and Project Day. Some children bought their calves, lambs or goats to school and paraded them before a group of interested judges, watched by parents and classmates. While some animals were a little less than perfectly behaved, their young charges showed grace under pressure, receiving applause from all present. Commission considers options for council reform  by Colin Patterson

Kaipara residents may have to wait a little bit longer to find out how their council might change under local government restructuring. The Local Government Commission held a series of meetings throughout Northland in August after receiving a reorganisation proposal from the Far North District Council. The commission had received more than 40 submissions regarding the proposal. After the meetings finished, the commission put out a media statement saying it would release a draft proposal later in the year — sometime after the October 12 local body elections. Last week, commission spokeswoman Kathryn Street said the commission had yet to set a release date for its draft proposal. “We’re still hoping to meet our preChristmas deadline.” Ms Street says once the commission releases its draft proposal, it will call for further submissions. That will be followed by public hearings. The commission

will consider the information and views received before issuing a final proposal. Once a final proposal is issued there is a period of 60 days for 10% of the electors of any district covered by it to sign a petition for a poll. If a poll is held, it will cover the entire area subject to a reorganisation proposal. Unless a majority of those voting oppose the proposal, it will be enacted. Ms Street says the commission is working toward a proposal that could come into effect in 2015. If that happens, a transitional authority will be set up with representation from all affected councils. However, Ms Street says the commission could also decide not to issue a final proposal. If that happens, existing structures will continue unchanged.

Disability no barrier to getting together  by Colin Patterson

A social group for Kaipara people with disabilities kicked off on Friday night sponsored by Dargaville’s Greenways Trust. Greenways’ community facilitator Jenny Blair-Casey says Fabshack was set up following a recent hui at the Dargaville Town Hall. Representatives from The Cube, an Auckland-based organisation that works with young people with disabilities outlined its programmes. She says people agreed something similar was needed in Dargaville. Fabshack is likely to start with 30 to 40 people meeting every fortnight. Ms Blair-Casey says it will fill a gap. “Transport issues are huge. People in wheelchairs feel very isolated.”

A steering group has come up with ideas for activities. They include dances, mini golf, pool nights, going to the Kai Iwi Lakes and riding quad bikes. However, these activities will cost money, so fundraising is also planned. Greenways are holding a garage sale on December 5 and 6. Ms Blair-Casey says anyone with surplus goods that are in a saleable condition are most welcome to donate them. Donations can be left at the Greenways office, 16 Edward Street, Dargaville. A common enough sight on the Kaipara Harbour is ‘the sand barge’ which makes a daily run from Helensville to Pouto Point, collecting fine sand for the Auckland construction industry. It’s actually very hard to miss — at 50 metres long and 17 metres wide. But it is not often that one gets a close-up and personal look at the behemoth. I was recently invited aboard by skipper, Pete Cullen, who was aware of my coastguard training courses, and the experience was an eye-opener. After an early morning start, it soon became apparent that the 560-tonne Kaipara Karrier V1 was a far cry from the small boats I am used to. Kaipara Refuse employs approximately 30 staff of which around half live at the Kaurilands Skills Centre. The Centre is a residential facility for intellectually disabled adults. Some of these Kaurilands residents are employed as rubbish collectors and others are employed to sort the recycling that comes back into its Kaipara Refuse premises. to announce the appointment of Kaipara District Licensing Committee (DLC) to take responsibility for local decisions relating to the sale and supply of alcohol.

From 18 December 2013 all local-level liquor licence decisions — new and renewal of premises licences, managers’ certificates, special licences and temporary authorities — will be made by the DLC. The Committee will be chaired by Commissioner Peter Winder. The other committee members comprise Commissioner Colin Dale, Mr Mark Farnsworth, Mr Gordon Lambert, and Mr Mark Vincent who will share the decisionmaking responsibilities. Mr Farnsworth lives in Mangawhai and is a former Chair of the Northland Regional Council and a Resource Management Act Hearings Commissioner, Mr Lambeth lives in Dargaville and is a former Police Officer, and Mr Vincent lives in Paparoa and for several years managed the liquor licensing service for Council. The appointment of the DLC results from the significant changes made to New Zealand’s alcohol laws last year. Expressions of interest in DLC membership were called for in August/September with a total of eight candidates indicating their interest in the positions.

Race gives boaties big river experience  by Colin Patterson

A bunch of lucky sailors will race from Ruawai to Dargaville this weekend in a race organised by the Northern Wairoa Boating Club. Boats on the River on Saturday November 9 is an event for small dinghies, says club commodore Kelly Hansen. He says the event will be run over 15 nautical miles from Ruawai Wharf to the boating club’s headquarters in Dargaville. This is the first time the event has been held. Mr Hansen says the club is hoping for at least 20 entries. “We’ve got six so far. People are just waiting for the weather.” He says scrutinising will take place at 12 noon with the race kicking off at 1pm. He says the fastest boats will make it to Dargaville between two and two and a half hours, while the slowest should finish in about three hours. “We’ve planned it so

the sailors benefit from incoming tidal patterns.” Safety is paramount and launches will act as safety boats. The Wairoa River is sheltered so is ideal for younger yachties. Mr Hansen says the club will hold a prize giving after the end of the race. Later in the evening the fireworks will be on next door in the gardens. “The clubrooms are an ideal place to watch it. We’ve got a special licence, so we’ll be open to the public.” Anyone interested in taking part in the race should call Mr Hansen on 021 122 8136. Entries cost $10 for a boat with up to two people. Additional passengers are $5 a head with a maximum of four people per boat.

Hooves will pound the track and turnstiles will click at the Dargaville Racing Club at its next meeting on November 15. One of the country’s smaller clubs will be holding one of just two race days it hosts each year. That makes it a big event for a club whose history dates back to the 19th century. The man bringing everything together is club secretary Basil Smith. He formerly ran Dargaville’s Commercial Hotel and has had a longtime interest in racing. About eight years ago the previous secretary stood down and Mr Smith took over. For much of the year Mr Smith’s job is ‘very part-time’. “I do it as a hobby. I only get busy when the races come up.” The November 15 race meeting  has eight races on the card, including the Northland Cup which has a stake of $8,000. Mr Smith expects between 1,500 and 3,000 people through the gate and an on-course turnover between $110,000 and $150,000. “We get coaches from Kaitaia, Mangonui, Taipa, Whangarei and Warkworth.” Mr Smith says there will be two good food outlets and four bars will be operating. There will be entertainment for all ages and a Fashion in the Field competition for the best dressed. He says the track is in perfect condition. “Our track manager has put hours and hours into getting it right. I wish we were racing today.” All other arrangements are in place. The only

uncertainties are the weather and the horses. Nominations close on Tuesday and acceptances are issued on Wednesday, meaning fields will not be known until 48 hours before racing begins. Recent weather has been good. “But on race day it’s all in the lap of the gods.” While racing has struggled in recent years, Mr Smith says it has a bright future. “Racing is still holding its own — it’s hanging in there. There’s something about horse racing that people love. And it’s a really great day out.” 

Museum gets fresh lick of paint  by Colin Patterson

One of Kaipara’s most visited attractions is getting a fresh new look thanks to local tertiary students and a big name in paints. Dargaville Museum opened in 1985. But 28 years later much of its exterior paintwork is original and has started to fade. Museum manager Pene McKenzie says people do notice the faded exterior. But with the museum largely reliant on volunteers and community funding, there was no money in the budget to do anything about it. However, she successfully applied to a nationwide Resene Paints scheme that donates paint to community groups. Local Dargaville company Fosters Home Decorating also helped out.

The paint is being applied by NorthTec painting and decorating students. Tutor Mathew Watti says they became involved after NorthTec put an ad in the paper seeking work experience opportunities for its students. He says there are 14 students involved in the project. They will continue on the job until their course finishes in early December. A fresh intake of students will return next year to finish the job. Ms McKenzie says the museum’s roof which has the words ‘Dargaville Museum’ painted on it is in good condition and will not be repainted. 

Best blooms go on display in two towns

Gardeners in Mangawhai and Ruawai are testing their green fingers with the best flowers and roses going on display as the two towns host garden shows.

FRIDAY 15TH NOVEMBER

Meanwhile, competition is hotting up for the best flowers and roses in Ruawai as the local Garden Club holds its annual Rose and Flower Show on Saturday (November 9). Noelene Gatehouse from the club says anyone can enter. The event will take place at the War Memorial Hall which will open to competitors at 9am so they can drop off their entries. Judges will then do their judging before the event opens to the public at 11am. 

Mangawhai Flower Show organiser Margaret Walshe says the event takes place on Friday November 15 in the Mangawhai Library Hall, corner of Moir and Insley streets. She says entries can be dropped off at the hall between 7pm and 8pm on Thursday and from 8am to 10am on Friday. “Judging starts at 11am so all entries must be received and on display before that time. Anybody at all can enter.”

Pioneer farm shows how settlers fared  by Colin Patterson

Pamela Parkinson wants 21st century people to understand the hardships pioneer settlers of this country endured. So Mrs Parkinson and her husband Less have turned Honeycroft, their 11-acre block 12 km southeast of Dargaville into a recreation of a pioneer farm. There she hand milks her seven cows, makes cheese, and tries to live a colonial lifestyle. “ We ’r e 21st-centur y pioneers,” she says. “It’s based on a crofting lifestyle in Scotland where my descendants came from. I was always fascinated how they could eke out a living.” When the Parkinsons bought their Arapahoe property it was part of a quarry. While her husband built a barn that  Pamela Parkinson hand milks Sarah, one of her cows became a garage and ultimately their home, Mrs Parkinson set to work every day by Mrs Parkinson. Independent contract milkers Dairy farmers employing contract milkers and having proceeds paid directly to the contract milker through their dairy companies, could find that their contract milkers are employed and bound under the 1937 Sharemilking Agreements Act which was introduced by statute of Parliament. This lower order Sharemilking Agreements Act allows men and women to be independent contractors without having to own dairy cows to enter into the New Zealand dairy industry. Many over the years have purchased their own farms. A dairy farmer employing a contract milker as an independent contractor, who receives his remuneration by so much a kilogram of milk solids (this is called a Walsh agreement), could if a dispute arises over the terms of the engagement, come under the jurisdiction of the 1937 Sharemilking Agreements Act and its terms. There is also the risk of the IRD not accepting that the employees are deemed as independent contractors and have sought PAYE reimbursement payments from farmer employers who have entered such agreements.

There is a big difference between the status of an independent contractor and that of an employee. The independent contractor must meet the control tests, the independence test, the organisation or integration test, the intention of the parties and the business test or the economic reality test. This involves whether the independent contractor works for other people or clients, supplies his or her own tools or equipment, has direct responsibility for the profits and risk of the business, hires or fires whoever he or she wishes to help do the job, pays accounts for taxes and government and professional fees and most importantly, advertises and produces a GST invoice directly to the farmer for the work that has been done. Any dairy farmer engaging an independent contractor to milk the cows or to do work on the farm, should ensure

that payments are made directly to the contractor on the presentation of a GST invoice and the contractor provides a payment receipt. The intention of the parties is important. This test looks at the intention of each party to the agreement regarding the nature of the relationship. The fact that a written contract states that a person is an employee or an independent contractor, may indicate the intention of the parties but is not determinative. If the actual circumstances point to an employment relationship, then simply labelling it an independent contract will not alter the actuality. The fundamental test looks at factors such as whether the type of business or the nature of the job justifies or requires using an independent contractor. Is there a time limit for completing a specific project. Can the worker be dismissed. Who is legally liable if the job goes wrong. Usually, an independent contractor agrees to be responsible for his or her work. He or she cannot usually be ‘dismissed’, although the contract can be terminated if it is broken.

Dairy farmers using contract milkers under the Walsh agreement, do so in an endeavour to circumvent the 1937 Sharemilking Agreements Act, because they feel that under the variable order the cost of labour is too high, particularly under 300 cows or less where a minimum of 22% milk price only, must be payable to the sharemilker. Walsh agreement payments have ranged from as low as $1 per kilogram of milk solids upwards, and in many cases this is not sustainable remuneration. Farmers of New Zealand encourages dairy farmers looking for managerial employees to use the Sharemilking Agreements Order 2011. It is still the best way to encourage the next generation into farm ownership with the support of the banks and the farmer retains management control and it specifies the relationship and the obligations that must be carried out by the dairy farmer employer and the sharemilker. Farmers of New Zealand provide free contracts and professional advice to our members. 
