Rates case goes to appeal  by Paul Campbell

A court date has been set for the Northland Regional Council to challenge the recent High Court order that left five years’ worth of Kaipara rates and penalties, worth more than $14 million, in limbo. After NRC asked for an urgent hearing, it has been set for the Court of Appeal on November 22 in Wellington, a little over a month after being filed. On September 14, the High Court ruled regional council rate arrears and penalties of $14.4 million in Kaipara collected between 2011 and 2016 were invalid but did not order a refund as it did not have that power in a judicial review proceeding. However, affected ratepayers can file legal action if NRC does not refund their rates and penalties. The amount unpaid by ratepayers for that period was $516,817 and if NRC wins the appeal, it could potentially take steps to recoup the sum or could seek a Validation Act to retrospectively legalise the rates, but would have to wait until the new government is formed and parliament recalled. The appeal grounds are that High Court judge Justice Ailsa Duffy erred in quashing the rates and penalties and by ruling any failures by the territorial authority to comply with the Local Government Rating Act 2002 were more than procedural or technical errors. NRC says replacement rates should have been set.

The appeal action is expected to cost council in the region of $190,000 in the face of a potential ratepayers claim from 14,437 property owners in Kaipara. Council lawyer, David Goddard QC says there is a prospect that further legal proceedings could be brought against NRC “in relation to the other two districts that constitute the Northland region, accompanied by claims for refunds of rates.” 

Outdoor ‘capital in the making’ “The Kaipara has the potential to be the walking and cycling capital of the country with its spectacular coastlines, beautiful native forest clad hills, quiet back roads, and underused walking tracks,” said Gordon Hosking of Mangawhai Tracks Trust. “We just need to build on what we already have, and promote it to the rest of the world. This gives us the road map and I hope we can now get out there and follow it.” The latest figures available show the economic contribution of New Zealand’s cycle trails in 2015 was estimated at $37.4 million. John Gardiner, Northland advisor of the New Zealand Walking Access Commission said the council’s strategy “is impressive. The district is blessed with an abundance of stunning scenic attractions, especially the Kauri coast from the Hokianga to Pouto Peninsula and across to Mangawhai and the strategy captures these in a number of exciting projects. “To gain the maximum benefits for Kaipara communities, a focus on those projects which will fire-up people to make it a must do walking/ cycling challenge, is certainly the way to go. As has occurred elsewhere in the country, these walking and cycling trails open up new business opportunities in the accommodation, transport and food sectors as well

as established business across the whole district.” The new strategy has been six months in the making in partnership with local and regional stakeholders. Antiques at the museum

New life for lodge

The Mangawhai Museum will be hosting an antique fair on October 7 and 8 with the hope of turning it into an annual fundraising event.

Dargaville’s Pono Lodge on Hokianga Road, has a new tenant — Tracy Horne and Lisa Schulz Knox’s ‘Yoga at the Lodge’ bringing new activity to the building that has been unoccupied for 18 months.

The driving force behind the weekend is longtime museum board member and volunteer, Grant Mitchell. “There will be a number of established antique dealers coming along to show an extensive range of antiques and everything that is on display will be for sale,” said Mr Mitchell. Items on display include coins, porcelain, Japanese swords, sterling silver, jewellery and small furniture pieces. “It’s not only a fundraiser, but an opportunity for the community to come and see a large selection of antiques

while keeping in line with the history side of the museum.” The fair will take place in the museum foyer and cafe as well as in the old Tara Road schoolhouse located next door in the pioneer village. “It is hoped this will become an annual fundraiser for both the museum and the pioneer village. The important thing is that there will be something for everyone.” Admission on the day is $6 for adults, $3 for children under 15 years with free entry to the museum also included. The fair will run from 10am-4pm. 

“It felt good to move here. It really has more personality and a good feel about it,” said Tracy. Originally built as a Masonic lodge and used by the Freemasons, the hall has been extended over the years and used by various community groups, such as the Dargaville Rotary. Yoga has been in Dargaville for over 20 years, and Tracy remembers her first tutor Birgitta Allen and later Mary Heerikhuisen-Beekman. It was when Mary retired 13 years ago, that Tracy became an instructor. Lisa then joined the studio two years ago to offer her

Northland Rescue Chopper out to raise $200k The 2017 Northland Rescue Helicopter fundraising appeal is underway – with the aim of beating last year’s superb total of $200,000 in public donations. W i t h t h e n e e d s o f t h e c hari t ab l e helicopter service constantly in the limelight - and the extraordinarily busy summer period looming - the timing of the appeal is critical. Paul Ahlers, Chairman of the Northland Emergency Ser vices Trust (NEST ), says funds raised contribute to general operating costs of the much-needed lifesaving service. “Donations help cover the costs of fuel, maintenance, insurance and more. The fact is we need these donations and the Trust continues to be humbled by the support of the Northland community in getting behind their rescue service. The service would not exist without their ongoing support,” says Mr Ahlers.

“We are delighted to have two local contractors who are doing the work, Jimmy Gent builders and Coast Two Coast painters,” said Dargaville Arts Association executive member John Pickworth. The association leases both floors of the old Municipal building with the renovations happening in the downstairs gallery. The four rooms in the gallery will be painted ‘gallery white’ and a cavity

batten system will be installed, making it easy to attach work to. The upgrade is with funding from pub charity. However, John said that “the renovations have exceeded funding, so we will meet the shortfall from our reserves. “This will give us a gallery space to a standard that any town or city would be proud to have. Police seek witnesses On Saturday, September 23, around 12.45pm, a middle-aged male was walking along River Road near Campbell Terrace in Dargaville. While he was talking on his cell phone, another male ran up behind him, snatched his leather shoulder bag and ran to a waiting white four door vehicle on Campbell Terrace. The vehicle drove off, turning left onto Logan Street. The victim suffered cuts and abrasions to his arms and legs, after falling in the process. Northland’s world-class air ambulance service is considered one of the most cost-effective operations of its kind in New Zealand. By necessity, it operates on an extremely tight budget and despite contending with an annual funding shortfall close to $1.5 million, continues to help people in their time of need – 24/7. After almost four years as Kaipara District Council’s community facilitator, Darlene Lang Gent has stepped up to her new role as parks and community manager.

Two new voices are gracing the Big River FM airwaves with the arrival of the station’s latest interns.

 Darlene Lang Gent is Kaipara District Council’s new Parks and Community Manager

“It felt really cool to get the job. It will give me a bit more influence as a manager, to make things happen with community initiatives. That’s what I like about working at council - working with the communities, and that is why this role really appealed to me.” No one day is the same. “This morning I was in Whangarei at a Te Tai Tokerau Northland economic action plan meeting, then I came back here for a budget meeting and then I was down at memorial park for Sportsville. It’s quite cool really.” While the first few months will be spent getting her head around things, she will soon need to find a new

community facilitator, a role that needs reassessing as it has really evolved, said Darlene. “We’ve done lots of work at our premier parks - Taharoa Domain, Pou Tu Te Rangi Harding Park and Mangawhai Community Park and I want to keep that momentum going. I also want to continue with our relationships with the community and to work in partnership with them. “They have got the capacity to do awesome community projects, they just need council support. That’s where I’d like to help and support them to achieve their goals. That’s the biggest thing I’m looking forward to being able to do.” 

Carolin Cullmann arrived in Dargaville last week to take a twomonth internship while Jordan Holland has been in town for three months and is half way through his six-month stint. Carolin is from Nuenkirchen in south west Germany and decided to apply for the position after studying literature and hoping to get into media. “I’ve done some internships with print media and press communications but I’m interested in radio as well so I applied and I got it. I have always wanted to visit New Zealand so now I can combine travel and work,” said Carolin. She hopes to visit some of the local spots during her time and learn more about the New Zealand culture. Having a few months to familiarise himself with the area Jordan is now settled into Dargaville life after completing his training at radio school in Tauranga. “It’s pretty good being on air every day — it’s something I always wanted to do. One minute I could be on air and the next minute I could be making advertisements so it’s a lot of transferring skills.” Both, along with many interns before are staying

The Mangawhai and Kaiwaka communities are coming together for a fundraising event at the Three Furlongs bar which will see some familiar faces shave their hair off. The event is to support local woman Janelle Penjueli who was recently diagnosed with inoperable bowel cancer. It has been organised by Cheryl Anderson and Three Furlongs manager Kyle Underwood. “Most of you will be familiar with local Kaiwaka identity Wayne ‘Pongo’ Leslie and his iconic mop of hair — well it’s all coming off,” says Cheryl. “Pongo has agreed to shave his head in support of Janelle and her family and will be joined by hotel staff members Kyle Underwood, Rhys Shadbolt, Corey Slimo and Samuel Stephens.” Janelle’s Givealittle page says ‘Janelle, former police woman, hair dresser, devoted mother and christian, who gives, gives gives. In 2008 I had been living with a serious lower back pain for many years due to two discs with serious degeneration and was scheduled for a double spinal fusion at a cost of $48,000. The Specialist had recommended many lifestyle changes including changing my profession, which was not practical as I own my own business. At the Waikato Home Show I experienced a demonstration on a Teeter Inversion Table by Dave and Nancy Hare. To me the effect was amazing, I actually experienced some serious relief which lasted for an hour or two, I was told that the relief would last longer with time as long as I used the table regularly, so with the surgery scheduled for 12 weeks time, having nothing to lose and a lot to gain I purchased a Teeter. Four years on I still use my table on a daily basis, my back is as strong as ever with very little or completely no pain, I am still at my same profession and working as hard as ever and most importantly I did not have the surgery. I consider the purchase of my Teeter has been one of my greatest investments, not only has it enabled me to avoid serious and costly surgery, it has kept me in my profession and it has brought my health back. IT IS PURE LOGIC AS TO HOW THE TEETER TABLE WORKS

Discs: It

uses gravity to apply traction, the traction gently opens the discs and as they open up they create suction, this suction draws fluid from the surrounding tissue back into the discs, re-hydrating them. This is the key! Discs do not have their own blood supply, they rely on transfer of fluid from the surrounding tissue to keep them healthy and hydrated and over the years as discs get thinner with age, they lose the ability to take on fluid (just like squeezing a sponge) and they start to de-hydrate. De-Hydrated discs are less flexible, they are harder, more prone to injury, they interfere with nerve roots creating pain and ultimately the de-hydration causes degeneration. The Teeter Inversion table slowly and gently brings the hydration back into the discs, plumping them up. This brings back lost height (most people will regain around 2 CM of height), it separates the nerve roots far more effectively and returns quality of life

Muscles: A lot of pain is muscular, when muscles are stressed they become tight which restricts the flow of blood and lymph through the muscles so toxins build up, Co2 and Lactic Acid. Traction opens up the muscles, Rhythmic Traction, is a gentle rocking motion that stimulates circulation and encourages blood flow through the muscles, which clears the lactic acid into your lymph system where it stimulates lymph flow and deals with it. Most people with serious neck issues see a large improvement after only one treatment.

Posture: Poor

posture is one of the major cases of pain and is a major contributor to the deterioration of the body with age. A difference in leg length causes most of the hip and knee issues, as they continue to place uneven loads on the joints; similar to the wheels out of alignment on your car. Trying to correct posture is extremely difficult due to muscle memory, as it constantly pulls the muscles back to where they were. At a level of 40 degrees or more on the Teeter, the muscle groups open up and eventually come back into alignment, using the table daily, does not allow the muscle memory to pull them back out of alignment and slowly the muscles start to lose their memory and go with the flow, allowing the body to come back into correct posture. Then using the table once a day will ensure it is kept there. This is pure logic, if a machine is out of alignment it does not last long, the only difference between the body and a machine is that the body is constantly repairing itself, however if the wear and tear on the body is greater than the body’s ability to repair itself, it is a slow decline. The Teeter slowly brings the body out of its decline and allows the body to repair itself, resulting in a far healthier life.

Paparoa’s Skin Image has put the town on the map once again after receiving third place in ‘best new clinic’ at the New Zealand Beauty awards.

Tucked away on Paparoa’s Valley Road, Country Blooms florist outlet is run by Raylee Over whose operated her business in the area for the last six months.

The event was held at Te Papa in Wellington recently with the awards criteria covering many aspects of the beauty industry. “Entering the awards forced me to step back and reflect on my past achievements and from that decide how I can practice what I’m passionate about and what I wanted for Skin Image,” said clinic owner and therapist Nina Quan. She said presenting at her finalist interview consolidated her vision of wanting to create a small reputable clinic that delivers “efficacious treatments using proven technology and products to help women achieve healthy, beautiful skin.” “To be at the top of your game, you have to train and refresh your training continuously as the industry is forever changing and improving.” Nina said receiving a placing at the awards was a feat and said it was special for a few reasons. “Skin Image Paparoa was the only Northland clinic that got placed in the Beauty Awards and it’s a tiny boutique clinic in a small town. It’s a fantastic achievement in just nine months” She said those nine months gave her enough time to completely renovate the old premises and introduce a very different business model that focussed

Farmers are resilient when it comes to inclement weather, but even they have been feeling the strain as incessant rain dampens down early Spring, setting back the schedule of planting and pasture prep. The good news — change is in the air, and Summer is predicted to be hot and humid. But in the short term, the change in the weather leaves only a short period of time to accomplish a host of Spring tasks. Usually by this time of year the focus is on getting a bountiful crop of maize or green pasture established — feed to be laid in as stores against lean times. This year, one of the wettest on record for the north of New Zealand, has made it hard to access pastureland and paddocks, even for the big, balloontyred trucks which deliver much-needed fertiliser. Smaller mini spreaders have been working overtime in those fleets which have such a tool in the shed, and helicopter and fixed wing aerial applicators have also been busy in the skies. Those in the industry predict that there will be a rush to accomplish as much as possible when the big dry-off finally gets underway. Right now, it’s all but impossible to get on with the business of aeration and harrowing, to turn the soil and prepare it for a fresh crop — that’s because to do so now may exacerbate over-moisturization of the layered ecosystem beneath. Even careful operators might also run the risk of compacting damp soil with their machines, despite modern advances in tyre technology to spread the load. Once the soil dries out enough for

From de-pugging and prep for undersowing on cattle farms, through to getting ready to cultivate maize and bring in silage, the tractors will be working overtime — in many case quite literally seeing as we have already passed the daylight savings watershed. There’s nothing like a bout of unseasonal weather to get people thinking. If not because of that extra time indoors, then because there are those of us who simply won’t take nature’s tantrums lying down. It’s in these conditions that ingenuity shines through, and there’s been a fair amount of that can-do attitude during this long, damp springtime. One which has stood out is the use of a tiny, versatile little four wheel drive truck out there on the paddocks, repurposed as a fertilizer spreader. Then there has been the similar platformed vehicle kitted out as a heavy-duty weed sprayer. Which got us thinking — is the small, four wheel drive farming truck platform under-appreciated? After all, it’s got a fascinating history and pedigree — and it’s rare to see one of the little units broken down. With their distinctive wide ‘tractor tyres’ and their diminutive profile, these trucks — largely produced by Japanese brands Suzuki and Daihatsu — have a very different life in New Zealand than they do in their home countries. Trucks like the Suzuki Super Carry began life as concept delivery vehicles, meeting Japan’s strict ‘K’ laws. These meant that machines with small engines were allowed to operate outside of Japanese anti-smog and anti-congestion charges. Hence the originals in this range were tiny vans and flat decks with sub-1000-cc engines. They were made to transport good through the perpetual traffic jams of Tokyo, but they found favour here as well. There are still even one or two alive and well here in Dargaville today. The move to the farm was brought about

by changes to Kiwi road-going vehicle rules as well as an expansion by the big Japanese names into south-east Asia. There, people were used to conducting lal their business on mopeds and scooters — a big engine was an investment too far. Four wheel drive versions of the Carry and Daihatsu’s comparable small vans and trucks were made to handle bad roads, big loads and monsoon season conditions. Which brings us back to this long, rainy Spring. And the fact that a small, farmgoing four wheel drive version of the mini truck or van can carry a whole lot without destroying paddocks. That it can potentially be the platform for a specialist vehicle that goes where others can’t in these conditions. And that,

unlike a quad bike, it has a roof, doors, a heater and a 12 volt supply for your electric thermos. With several importers around New Zealand, this halfway point between a rugged farm ute and a nimble side-by-side off roader is definitely for a niche market. It’s just that, right now, that niche is a bit ubiquitous. 

Spring is a time of riotous growth in the garden, so it’s the perfect time to celebrate all aspects of what just might be the oldest pastime in the world. Gardening is what allowed us to settle down and build villages and towns. It’s what feeds the world. And it’s also a great way to get closer to nature, developing a little slice of Eden in your own backyard.
