Our guide's introduction YPRES SALIENT

The Ypres Salient came into being at the end of 1914 when static warfare replaced the war of movement. Had Ypres fallen, the Germans could have reached the channel ports in Northern France. Here, there was little let up in the fighting and as a result, this beautiful city was completely destroyed. Our itineraries usually focus on the events of 1917, the battles of Messines and Third Ypres, often known as Passchendaele, in which terrible casualties were taken by both sides.

THE SOMME

On 1st July 1916 the British suffered nearly 60,000 casualties, of whom approximately 20,000 died. About two thirds of these were from the New Army; many of whom were Irish and had answered ‘The Call’ in 1914 when war broke out. The campaign continued until mid-November with a maximum gain of seven miles. For the soldiers involved, the failure to break through and the relentless nature of the fighting marked the end of, “the age of innocence”.

Booking Conditions The following Booking Conditions together with the Important Notes contained in this Booking Form constitute the basis of your contract with NST Ltd (Company Number 240123, registered in Ireland; Registered Office: Santry Business Park, Swords Road, Dublin 9, Ireland). The ultimate holding company of NST Ltd., is Holidaybreak plc. Please read them carefully as they set out our and your respective rights and obligations. In these Booking Conditions, ‘you’ and ‘your’ means all persons included in the booking (including anyone who is added or substituted at a later date). ‘We’, ‘us’ and ‘our’ mean NST Ltd. “Group Organiser” means the adult named on the Booking Form as such who takes overall responsibility for your booking (including ensuring compliance with your responsibilities under these Booking Conditions). “Group Leader” means the adult who has overall responsibility for the group during the tour who will either be the Group Organiser (if travelling with the group) or another responsible adult designated as such if not. Please note that for the purpose of training and quality control, telephone conversations may be recorded.

1. Making Your Booking Bookings are accepted subject to these Booking Conditions. To make a booking, the Group Organiser must complete and sign our Booking Form. The Group Organiser must be authorised to make the booking on the basis of these Booking Conditions by all persons included in the booking (including anyone who is added or substituted at a later date) and if under 18 years of age, their parent or guardian. By signing the Booking Form, the Group Organiser acknowledges and confirms that he/she is so authorised and that all group members (and their parent or guardian if under 18) agree to be bound by these Booking Conditions. The Group Organiser is responsible for making all payments due to us. The completed signed Booking Form must then be sent to us together with the payments referred to in Clause 2 below. Once we have received your Booking Form and all appropriate payments, we will, subject to availability, confirm your booking by issuing a Booking Confirmation Invoice. This invoice will be sent to the Group Organiser. The Group Organiser must check the details carefully as soon as they are received and contact us immediately if any information on this document (or any other document) appears to be incorrect or incomplete as it may not be possible to make changes at a later date.

2. Payment In order to confirm your booking, a deposit for every paying member of the group (or full payment if you are booking on or after the date that the final balance would become due) must be paid at the time of booking. A receipt from us for your deposit does not, on its own, bring a contract into existence between us. If you wish to travel using the insurance policy we offer, all applicable premiums must also be paid at the time of booking (you must be insured – see Clause 7). Full payment terms are detailed in Table ‘A’ of the Important Notes section of this form. If we do not receive all payments due (including any surcharge where applicable) in full and on time, we reserve the right to treat your booking as cancelled by you. In this case we will be entitled to keep all deposits paid or due at that date. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in Clause 6 depending on the date we reasonably treat your booking as cancelled.

3. Your contract A binding contract between you and us which is subject to these Booking Conditions comes into existence when all appropriate payments and signed Booking Form have been received by us and we despatch our Booking Confirmation Invoice to the Group Organiser. We both agree that Irish Law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us (except as set out below). We both agree that any dispute, claim or other matter of any description which arises out of or in connection with this contract will be dealt with by referral to arbitration under the Arbitration Rules of the Chartered Institute of Arbitrators – Irish Branch (see Clause 12). Changes to these Booking Conditions or the Important Notes in this form will only be valid if agreed in writing by a member of our staff.

4. The Cost of Your Tour The price of our tours is, subject to the correction of errors, valid at the time of publication in our brochure or price list or on our website or when quoted to you. We reserve the right however to make changes to and correct errors in advertised or quoted prices at any time before your tour is confirmed. We will advise you of any changes or errors of which we are aware prior to confirmation of your booking.

The prices shown in our brochure or price list or on our website or quoted to you were calculated on the basis of the exchange rates shown in Table ‘B’ of the Important Notes in this form. (i) Tours by Coach and/or Ferry For tours by coach and/or ferry, the price of your tour is fully guaranteed and will not be subject to any surcharges. This means that once the price of your chosen tour has been confirmed at the time of booking, we will not increase the price. (ii) Tours by Air For tours by air, once the price of your chosen tour has been confirmed by us at the time of booking, we will only increase or decrease it (as applicable) after that point, subject to the conditions set out in this Clause, in the event of any increase or decrease in dues, taxes or fees payable for services such as landing taxes or embarkation or disembarkation fees at airports, scheduled airfares increasing or decreasing or aircraft fuel prices and our costs increasing or decreasing as a result. Price increases or decreases after booking will be passed on by way of a surcharge or refund. Even in the above cases, we will absorb increases in costs up to a total amount equivalent to 2% of the total cost of your confirmed arrangements (excluding any amendment charges). Only if the amount of the increase in our costs exceeds 2% of the total cost of your confirmed arrangements (excluding any amendment charges), will we levy a surcharge. We promise not to impose a surcharge of more than 10% of the total cost of your confirmed arrangements (excluding any amendment charges). A refund will only be payable if a decrease in our costs exceeds 2% as set out above. Where a refund is due, we will pay you the full amount of the decrease in our costs. Any surcharge must be paid with the balance of the cost of the booking or within 14 days of the issue date printed on the surcharge invoice, whichever is the later. We promise not to levy a surcharge within 30 days of the start of your tour. No refunds will be payable if any decrease in our costs occurs within this period either. Please note that arrangements are not always purchased in local currency and some atttpparent changes have no impact on the price of your holiday due to the contractual and other protection in place. Please note, changes and errors occasionally occur. You must check the price of your chosen arrangements at the time of booking.

5. Changes by You Should you wish to make any changes to your confirmed booking, the Group Organiser must notify us in writing as soon as possible. Whilst we will endeavour to assist, we cannot guarantee we will be able to meet any such requests. Where we can meet your request, a fee of €40/£25 per amendment will be payable together with any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers in making the change. You may add extra members to your group at any time up to the date that the final balance of the cost of your booking is due providing the Group Organiser first checks availability with us. You will be obliged to pay deposits in full in respect of each additional group member at the time of adding. The ordering of extra services (for example vegetarian meals, changes to your itinerary or requests for booking of visits) after the date on which the balance of the cost of your booking is due to be paid will also be subject to the payment of the amendment fee and other costs / charges set out above.

6. Cancellation by You Should you or any member of your group need to cancel your chosen arrangements once they have been confirmed, the Group Organiser must immediately advise us in writing. Your notice of cancellation will only be effective when it is received in writing by us at our offices. As we incur costs from the time we confirm your booking and may be unable to re-sell your arrangements, cancellation charges will be payable. These charges will increase the closer to departure we receive your notice of cancellation. See Table ‘C’ of the Important Notes in this form. If any member or members of your group, or the entire group, is unable to go for any reason or decides that he/she does not want to travel on the tour, you may transfer the place on the booking of the person(s) concerned or the whole booking to substitute group members / another group suggested by you and acceptable to us providing you write to us with full details of who cannot or does not want to go and who you would like to go instead so that we receive this information not less than two weeks before departure. If it is not possible to make the change, we will tell you as soon as possible. Where a transfer can be made, all costs and charges incurred by us and/or incurred or imposed by any of our suppliers as a result together with an amendment fee of €40/£25 per person transferring must be paid before the transfer can be effected. For flight-inclusive bookings, you must pay the charges

levied by the airline concerned. As most airlines do not permit name changes for any reason after tickets have been issued, these charges are likely to be the full cost of the flight. All bookings of substitute group members are subject to both these Booking Conditions and any other requirements which may apply to a booking. If the full price was due for settlement on the date of or before any request is made by you for any transfer, this payment must be made before the transfer can be finalised. Where any substitute group is smaller than the original group, cancellation charges will apply in respect of all places which are not filled by the substitute group. Paragraph (c) below will also apply. (a) Cancellation before final payment is due All deposits paid or due at the time of cancellation will be charged as a cancellation fee. If a substitute group member is accepted by us before the date that the final balance of the cost of your arrangements is due, the deposit(s) may be transferred. (b) Cancellation after final payment is due If any paying group member cancels after final payment is due, and no replacement is found cancellation charges will be charged as set out in Table “C” of the Important Notes in this form. (c) Cancellation affecting minimum size of group If any cancellation or transfer brings the group size below the minimum required for a particular price and/or set of concessions, the tour price and any concessions will be adjusted and you will be reinvoiced accordingly. Amendment charges are not refundable in the event of the person(s) to whom they apply cancelling. Depending on the reason for cancellation, you may be able to reclaim these cancellation charges (less any applicable excess) under the terms of your insurance policy. Claims must be made directly to the insurance company concerned.

7. Insurance We consider adequate travel insurance to be essential. It is a condition of these Booking Conditions that you ensure that there is in place a suitable and adequate travel insurance policy or policies to cover all members of your group. Please read the section on insurance in the Important Notes in this form.

8. Changes and Cancellation by Us We start planning the arrangements we offer many months in advance. Occasionally, we have to make changes to and correct errors in published and other details both before and after bookings have been confirmed. Very rarely we are forced to cancel confirmed bookings. Whilst we always endeavour to avoid changes and cancellations, we must reserve the right to do so. Most changes are minor. Occasionally, we have to make a ‘significant change’. Significant changes include the following changes when made before departure: a change of accommodation to that of a lower official classification or standard for the whole or a major part of the time you are away, a change of accommodation area for the whole or a major part of the time you are away, a change of outward departure time or overall length of time you are away of twelve or more hours and, in the case of inclusive tours, a significant change of itinerary missing out one or more major destinations substantially or altogether. If we have to make a significant change or in the unlikely event that we have to cancel the entire tour, we will tell you as soon as possible. If there is time to do so before departure, we will offer you the choice of the following options: (a) (for significant changes) accepting the changed arrangements (at an additional cost if applicable) or (b) purchasing alternative arrangements from us, of a similar standard to that originally booked if available. We will offer you, where possible, a tour of equivalent value. If this tour is in fact cheaper than the original one, we will refund the price difference. If you do not wish to accept the arrangements we specifically offer you or we are unable to offer a suitable alternative, you may choose any other of our tours that are available. You must pay the applicable price of any such tour. This will mean your paying more if it is more expensive or receiving a refund if it is cheaper or (c) cancelling or accepting the cancellation in which case you will receive a full and prompt refund of all monies you have paid to us. Please note, the above options are not available where any change made is a minor one. A ‘minor change’ is any change which, taking account of the information you have given us at the time of booking or which can reasonably be expected to know as a tour operator, we could not reasonably expect to have a significant effect on your confirmed arrangements. Please note a change of airport, airline or flight time of less than 12 hours are not significant changes unless otherwise expressly stated. If we have to make a significant change or cancel after the date that you are due to pay the balance of the cost of your booking, we will, as a minimum where compensation is due, pay you the amounts set out in Table “D” in the Important Notes section, depending on the circumstances and when the significant change or cancellation is notified to you subject to the following exceptions. Compensation will not be payable and no liability beyond offering

the above mentioned choices can be accepted where we are forced to make a change or cancel as a result of unusual and unforeseeable circumstances beyond our control, the consequences of which we could not have avoided even with all due care (which includes cases of ‘force majeure’ (see Clause 9)). No compensation will be payable if we cancel as a result of your failure to comply with any requirement of these Booking Conditions entitling us to cancel (such as paying on time). Please note that the above options and compensation do not apply to Festival and Tournament Tours, some of our Exchange Programme Tours or Study Visits if the tournament, fixture, festival, exchange or study visit you are due to take part in or attend is significantly changed or cancelled due to any reasons outside of our control. Please also see Clause 10 of the Important Notes section for further details. In all cases, our liability for significant changes and cancellation is limited to offering you the aforementioned options and, where applicable, compensation payments. We regret we cannot pay any expenses, costs or losses incurred by you as a result of any change or cancellation. No compensation is payable for minor changes or where we make a significant change or cancel before the date that you are due to pay the balance of the cost of your booking. Very rarely, we may be forced by ‘force majeure’ (see Clause 9) to change or terminate your tour after departure but before the scheduled end of your time away. This is extremely unlikely but if this situation does occur, we regret we will be unable to make any refunds (unless we obtain any refunds from our suppliers), pay you any compensation or meet any costs or expenses you incur as a result.

9. Force Majeure Except where otherwise expressly stated in these Booking Conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by or you otherwise suffer any damage or loss (as more fully described in Clause 10(i) below) as a result of ‘force majeure’. In these Booking Conditions, ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, actual or threatened terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control.

10. Our Liability to You (i) We promise to make sure that the tour arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care. This means that, subject to these Booking Conditions, we will accept responsibility if, for example, you suffer death or personal injury or your contracted tour arrangements are not provided as promised or prove deficient as a result of the failure of ourselves, our employees, agents or suppliers to use reasonable skill and care in making, performing or providing, as applicable, your contracted tour arrangements. Please note it is your responsibility to show that reasonable skill and care has not been used if you wish to make a claim against us. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers). We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following: the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or the act(s) and/or omission(s) of a third party not connected with the provision of your tour and which were unforeseeable or unavoidable or 'force majeure' as defined in Clause 9. In addition, we will not be responsible where you do not enjoy your tour or suffer any problems because of a reason you did not tell us about when you booked your arrangements or where any problems you suffer did not result from any breach of our contract or for any losses, expenses, costs or other sum you have suffered which relate to any business. Please note, we cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your hotel or any other supplier agrees to provide for you where the services or facilities are not advertised in our brochure and we have not agreed to arrange them and any excursion you purchase from someone other than us during your tour. For the avoidance of doubt all excursion and services organised by us and included in your arrangements will be detailed in your itineraries. Excursions, services, visits and activities not included in the itinerary are not included in our arrangements. In addition, regardless of any wording used by us on our website, in any of our brochures or elsewhere including verbally, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you. (ii) The promises we make to you about the services


we have agreed to provide or arrange as part of our contract, and the laws and regulations of the country in which your claim or complaint occurred, will be used as the basis for deciding whether the services in question had been properly provided. If the particular services which gave rise to the claim or complaint complied with local laws and regulations applicable to those services at the time, the services will be treated as having been properly provided. This will be the case even if the services did not comply with the laws and regulations of the Republic of Ireland which would have applied had those services been provided in the Republic of Ireland. The exception to this is where the claim or complaint concerns the absence of a safety feature which might lead a reasonable person to refuse to take the tour in question. (iii) As set out in these Booking Conditions we limit the maximum amount we may have to pay you for any claims for loss of and/or damage to any luggage or personal possessions (including money). Where we are found liable for such claims, the maximum amount we will have to pay you is a sum equal to any excess charge that applies or would apply to the claim under the policy of travel insurance included in your tour price per person affected. (iv) Where any claim or part of a claim concerns or is based on any travel arrangements (including the process of getting on or off the transport concerned) provided by any air, sea, rail or road carrier or any stay in a hotel, the maximum amount of compensation we will have to pay you will be limited. The most we will have to pay you for that claim or that part of a claim if we are found liable to you on any basis is the most the carrier or hotelier concerned would have to pay under the international convention or regulation which applies to the travel arrangements or hotel stay in question (for example, the Warsaw Convention as amended or unamended and the Montreal Convention for international travel by air and/ or, for airlines with an operating licence granted by an EU country, EC Regulation on Air Carrier Liability No 2027/97 (as amended by Regulation (EC) No 889/2002) for international and national travel by air, Athens Convention for international travel by sea or the Berne Convention for international travel by rail). Please note, where a carrier or hotelier would not be obliged to make any payment to you under the applicable international convention or regulation in respect of a claim or part of a claim, we similarly are not obliged to make a payment to you for that claim or part of the claim. When making any payment, we are entitled to deduct any money which you have received or are entitled to receive from the carrier or hotelier for the complaint or claim in question.

11. Complaints and Problems In the unlikely event that you have any reason to complain or experience any problems with your arrangements whilst away, the Group Leader must immediately inform the supplier of the service(s) in question. Any verbal notification must be put in writing and given to the supplier as soon as possible. If the supplier is unable to resolve the complaint or problem to your satisfaction the Group Leader must contact us immediately either at the office during working hours or via our 24 hour duty officer out-of-hours. Until we know about a problem or complaint, we cannot begin to resolve it. Most problems can be dealt with quickly. If you remain dissatisfied, however, the Group Leader must write to us within 28 days of your return to Ireland giving your booking reference and full details of your complaint. We undertake to deal promptly with all correspondence relating to complaints and in any case within the time limits set out below: (a) not later than 14 days from receipt for an acknowledgement to be sent and; (b) not later than 28 days from receipt for a full reply to be sent or a reply containing a detailed explanation for the delay. If you fail to follow this simple complaints procedure, your right to claim any compensation you may otherwise have been entitled to may be affected or even lost as a result.

The Group Leader and all accompanying adults are responsible for the good behaviour and discipline of your group and must ensure adequate supervision at all times in accordance with any applicable regulations or rules laid down by the management of any establishment. See also Supervision Clause in the Important Notes section. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your group behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the arrangements of the person(s) concerned or of the entire group as we reasonably consider appropriate. In this situation, the person(s) concerned or the entire group as applicable will be required to leave the accommodation or other service. We will have no further responsibility toward such person(s)/ the group as applicable including any return travel arrangements. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination. The Group Organiser is also responsible for completion of passport formalities and any other personal arrangements which may be necessary such as visa, currency and medical requirements. The Group Leader is responsible for ensuring that the group reaches the starting point of the tour at the correct time. Please note that in many countries it is illegal to consume alcohol on coaches. Please also note that some hotels/centres now charge a security deposit on arrival.

14. Conditions of Suppliers Many of the services which make up your tour are provided by independent suppliers. Those suppliers provide these services in accordance with their own terms and conditions. Some of these terms and conditions may limit or exclude the supplier’s liability to you, usually in accordance with applicable International Conventions (see Clause 10(iv)). Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier concerned.

15. Special Requests and Medical Problems. If you have any special request, you must advise us at the time of booking and clearly note it on your Booking Form. In some cases, a fee of €40/£25 per request will be payable together with any costs incurred by ourselves and any costs or charges incurred or imposed by any of our suppliers in meeting the request. We will advise the Group Organiser in advance where this is the case. Although we will endeavour to pass any reasonable requests on to the relevant supplier, we regret we cannot promise that any request will be complied with unless we have specifically confirmed this in writing. Confirmation that a special request has been noted or passed on to the supplier or inclusion of the special request on your Booking Confirmation Invoice or any other documentation is not confirmation that the request will be met. Unless and until specifically confirmed, all special requests are subject to availability. We regret we cannot accept any conditional bookings, that is to say any booking which is specified to be conditional on the fulfilment of a particular request. All such bookings will be treated as standard bookings subject to the above provisions on special requests. If any member of your group has any medical problem or disability which may affect your arrangements, the Group Organiser must give us full details before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. The Group Organiser must give us full details in writing at the time of booking (if not already confirmed in writing) and promptly update us of any changes. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking, cancel when we become aware of these details.

16. Passports, Visas and Health

12. Arbitration Any dispute or difference of any kind whatsoever which arises or occurs between any of the parties hereto in relation to anything or matter arising under, out of or in connection with this Contract shall be referred to arbitration under the Arbitration Rules of the Chartered Institute of Arbitrators – Irish Branch. (Details of the said Arbitration Scheme are available on request). Alternatively, claims for less than €1,270 or the Sterling Pound equivalent per Booking Form may be pursued through the District Court Small Claims procedure. All claims in excess of €1,270 or the Sterling Pound equivalent shall be referred to arbitration. The application for arbitration and Statement of Claim must be received by the Chartered Institute of Arbitrators – Irish Branch within 9 months of the day of return from the tour.

13. Behaviour and Responsibilities When you book with us, you accept full responsibility for any damage or loss caused by you or any member of your group. Full payment for any such damage or loss must be paid direct at the time to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made against us (together with our own and other party’s full legal costs) as a

Further information can be obtained from the Department of Health website at www.ehic.ie or www.dh.gov.uk/travellers. It is the Group Organiser’s responsibility to ensure that all group members are in possession of all necessary travel and health documents before departure. Except as set out above and in our Important Notes section, all costs incurred in obtaining such documentation must be paid by you. We regret we cannot accept any liability if you are refused entry onto any transport or into any country due to failure on your part to carry correct documentation. If any member of your group is not an Irish or British citizen or holds a non-Irish or non-British passport, you must check passport and visa requirements with the Embassy or Consulate of the country(ies) to or through which you are intending to travel. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on us or any of our suppliers, you will be responsible for reimbursing us accordingly.

17. Financial Security We are fully bonded and licensed by The Commission for Aviation Regulation. In addition we act as agents for ATOL number 3606 (Air Travel Organiser’s Licence issued by the Civil Aviation Authority). The bonds as administered by The Commission for Aviation Regulation and the Civil Aviation Authority ensure complete financial protection for clients which means you will be repatriated if already abroad in the unlikely event that your tour cannot be provided due to our insolvency.

18. Prices, Information and Accuracy Please note, the information and prices shown in any price list or brochure distributed by us or on our website or any price quoted to you may have changed by the time you come to book your tour. Whilst every effort is made to ensure the accuracy of information and prices at the time of printing, regrettably errors and changes do occasionally occur. You must therefore ensure you check all details of your chosen arrangements (including the price) with us at the time of booking. The information which we give in this brochure or on our website and other correspondence is in accordance with the latest information we have received. We cannot, however, be held responsible for changes made without notice. Please note that pressure on accommodation and other amenities is particularly high at peak holiday periods. Certain facilities may not be available on public holidays. Some amenities at resorts are seasonal, for example open-air swimming pools. In certain countries, places of interest are liable to closure without notice or days of opening may change. We will endeavour to rearrange itineraries to take account of such changes.

19. Delay at Port, International Railway Terminal or Airport of Departure In the event of a delay at the port, international rail terminal or airport of departure, we will ensure that you are informed of the reasons for and the extent of the delay as early as possible. Except for delays to flights, in the event of a delay in any travel arrangements included in your tour lasting less than 12 hours, we will either (1) make arrangements there and then as appropriate to reduce any discomfort (for example providing you with a meal voucher) or (2) we will provide retrospective reimbursement of reasonable costs you incur for refreshments on production of receipts. Both option (1) and (2) are subject to the following: If the delay causes you to miss a pre-booked meal where the delay exceeds 3 hours, your group will be entitled to light refreshments. In the event of a delay exceeding 6 hours, your group will be entitled to receive a main meal.

Please note that requirements may change and you must check the up-to-date position in good time before departure.

In the event of a delay to flights the responsibility to provide assistance lies with the airline concerned. Please see Clause 20 below for further details.

The passport and visa requirements applicable at the time of printing to Irish and British citizens for the arrangements we offer are shown in the Important Notes section of this form. A full Irish passport presently takes approximately 4 weeks to obtain. A full British passport can, at certain times of the year take up to 10 weeks to obtain.

In addition, in the event of a delay in any travel arrangements included in your tour at the port, international rail terminal or airport of departure exceeding 12 hours, under the terms of the insurance offered by us you would have the option, subject to your having taken out our insurance, of either making a claim for agreed necessary expenses and services incurred as a result of the delay or cancelling your tour and receiving a full refund of all monies paid less any policy excess. If you have not taken out our insurance but insured your group with an alternative insurer, we will not provide any food or refreshments in addition to those referred to above for delays of up to 12 hours as these should be covered under the terms of your alternative policy.

For travel to or via the United States: all passengers, including children must have their own machine-readable passport. Most Irish and UK Citizen passport holders can travel under the Visa Waiver Scheme but there are some restrictions and the Group Organiser must check these by looking at the US Embassy Irish or British websites. Information on health, including any mandatory and recommended health formalities (eg vaccinations and precautions) can be obtained from your GP, practice nurse or travel health clinic. Ideally you should seek this advice at least 8 weeks before departure. At present there are no mandatory health formalities for Irish or British Citizens for the destinations we offer but please bear in mind that requirements may change

existence of a “Community list” which contains details of air carriers that are subject to an operating ban with the EU Community. The Community list is available for inspection at www.ec.europa.eu./transport/air. In accordance with EU Regulations we are required to advise you of the carrier(s) (or, if the carrier(s) is not known, the likely carrier(s)) that will operate your flight(s) at the time of booking. Where we are only able to inform you of the likely carrier(s) at the time of booking, we shall inform you of the identity of the actual carrier(s) as soon as we become aware of this. Any change to the operating carrier(s) after your booking has been confirmed will be notified to you as soon as possible. However, the Republic of Ireland departure airport, overseas arrival airport, carrier/airline and flight timings cannot be guaranteed (even when they have been confirmed in our Booking Confirmation Invoice). Nor can we guarantee the means of transport and timings for each leg of the journey but these will be as near as possible to those set out in our Booking Confirmation Invoice. We will provide transportation from your original departure point to the relevant airport if the original airport is changed. The Republic of Ireland departure airport, overseas arrival airport, carrier and flight timings shown in this brochure or on our website or in any other promotional material and detailed on your Booking Confirmation Invoice are for guidance only and are subject to alteration and confirmation. The latest route, timings and carrier will be shown on your tickets or in your final travel pack which will be despatched to you approximately two weeks before departure. You must accordingly check your tickets and / or your final travel pack very carefully immediately on receipt to ensure you have the correct route, flight times and carrier. It is possible that Republic of Ireland departure airport, overseas arrival airport, carrier and/or flight times may be changed even after tickets have been despatched we will contact you as soon as possible if this occurs. Any change in the Republic of Ireland departure airport, overseas arrival airport, the identity of the carrier, flight timings, and/or aircraft type (if given) will not entitle you to cancel or change to other arrangements without paying our normal charges except where specified in these conditions. If your flight is cancelled or delayed, your flight ticket is downgraded or boarding is denied by your airline in circumstances which would entitle you to claim compensation and/or another remedy from the airline under EC Regulation No 261/2004 - the Denied Boarding Regulations 2004, you must pursue the airline for any compensation due to you. All sums you receive or are entitled to receive from the airline concerned by virtue of these Regulations represent the full amount of your entitlement to compensation or any other payment arising from such cancellation, delay, downgrading or denied boarding. This includes any disappointment, distress, inconvenience or effect on any other arrangements. The fact a delay may entitle you to cancel your flight does not automatically entitle you to cancel any other arrangements even where those arrangements have been made in conjunction with your flight. We have no liability to make any payment to you in relation to the Denied Boarding Regulations or in respect of any flight cancellation or delay, downgrading of any flight ticket or denial of any boarding as the full amount of your entitlement to any compensation or other payment (as dealt with above) is covered by the airline's obligations under the Denied Boarding Regulations. If, for any reason, you do not claim against the airline and make a claim for compensation or any other sum from us, you must, at the time of payment of any compensation or other sum to you, make a complete assignment to us of the rights you have against the airline in relation to the claim that gives rise to that compensation payment. If your airline does not comply with these rules you should complain to the Air Transport Users' Council on 020 7240 6061 or via their website at www.auc.org. uk. In the republic of Ireland contact the Commission for Aviation Regulation on (01) 6611770 or www. aviationreg.ie. IMPORTANT NOTES REGARDING AIRLINE INTERNET BOOKINGS Names must be EXACTLY as on the passport or Birth Certificate if using a group passport. The Group Organiser undertakes on behalf of the school/group to pay NST Ltd in full for all airline internet flights booked by NST Ltd on our group’s behalf, even for those passengers who subsequently cancel. Please refer to the relevant airline website for that airline’s Terms and Conditions of Travel. The Group Organiser should ensure that this information has been read and understood prior to departure. All information should be made available by the Group Organiser to all passengers prior to travel.

21. Itinerary Planning Please note that no itinerary planning will begin until we have received the signed and completed Booking Form.

The length of any delay is calculated from the scheduled departure time of the flight, train or sea vessel for which the group has a firm booking.

DEFINITIONS Arbitration is the settlement of a dispute by an impartial arbitrator. Arbitration is a private dispute resolution procedure and is a legally binding means of resolving such matter. An arbitration Agreement is an agreement to refer a dispute to arbitration, usually in the form of an Arbitration Clause as included in the standard booking conditions of the Organiser. A submission to arbitration is called a Reference and the decision of an arbitrator is an Award. APPOINTMENT OF AN ARBITRATOR If there is a dispute which cannot be mutually agreed, either party may apply directly to the Institute at Merchants House, 27-30 Merchants Quay, Dublin 8. Telephone 01-7079739, fax 01-7079751 or email ciarb@arbitration.ie, for the form “Request for Appointment of Arbitrator.” This form sets out the information to be submitted: names and address of the parties concerned, copies of the booking form and conditions (including the arbitration clause), details of any legal or other people who are to represent the parties in the arbitration and an administration fee of €75/£50. For claims involving personal injury, a separate form is required to be completed and a different fee applies, full details are available from the Institute. These forms refer to the Institute’s Arbitration Rules which will apply to the arbitration and which are briefly summarised as follows (copies of the Rules and the accompanying guidance Notes on Arbitration are available form the Institute). PROCEDURE Once an Arbitrator has been appointed he is in complete charge of the reference, deciding the procedure as he considers best, and the Institute’s Rules deliberately give him this flexibility. QUESTIONNAIRE FORM In this scheme, the Arbitrator will first send out a detailed form of completion by both parties. This will provide him with the details of the actual dispute so he can decide when and where to hold a hearing with both parties to present their cases. HEARING While an award may be made by an arbitrator based on the documentary evidence sent to him by the parties, it is open to both parties to present their case to him at an informal hearing. AWARD The Arbitrator’s decision is made formally in his Award which is sent to both parties. The Award is final and binding resolution of the dispute. ARBITRATORS FEE A fee is payable to the Arbitrator for the conduct of the arbitration. This fee is normally paid by the Tour Operator / Organiser but the Arbitrator has absolute discretion to award this cost as he thinks fit.

In this case we will be entitled to keep all deposits paid or due at that date. If we do not cancel straight away because you have promised to make payment, you must pay the cancellation charges shown in clause 6 of our Booking Conditions depending on the date we reasonably treat your booking as cancelled.

OUR TOURS DO NOT INCLUDE • Meals en route, unless specifically stated. • Entrance fees, boat trips, guides etc, unless specifically stated. • Drinks with meals, other than breakfast. • The cost of full passports as required by the countries to be visited or transited. • The cost of visas and immigration taxes. See also clause 12: VISAS. • Departure taxes, which can only be paid locally. • Transfers for excursions unless specifically included. • Gratuities or gifts for guides etc unless specifically included. 7. SIZE OF GROUP The minimum number for which we quote tour prices is indicated in our quote letter to you. 8. ACCOMMODATION FOR SCHOOL GROUPS NST has built up a detailed understanding of the requirements of school groups. Accommodation has been selected either by NST staff or by our agents with these requirements in mind. We indicate in the text either specific accommodation which is frequently used, or we describe the category of accommodation used. Occasionally, due to the pressure on accommodation, hotels and centres not named in the brochure but of a similar category will be used. In Central Europe and Russia, hotels are not always up to western standards. However, they are always clean and functional. Paying students: will normally be accommodated in two, three or four bedded rooms as described. Quads are used in USA ie two double beds and occasionally an additional ‘roll-away’ bed. Youth Hostels normally providing 4–8 bedded rooms are occasionally used. Accompanying staff: will normally be accommodated in two bedded rooms. Single bedded rooms are expensive and limited in numbers. Group leaders requiring single rooms will be charged a supplement including those travelling on free places. Special arrangements may apply for youth hostels. Additional paying adults: will normally be accommodated in two bedded rooms and will be charged an additional amount for each day of the tour to cover extra costs. The precise amount varies according to destination and time of year and will be advised prior to booking. The total number of adults: must not exceed 20% of the group size or additional charges may apply. 9. MEALS The standard meals basis of tours is outlined in your final quote letter. Extra meals can be booked where required. Where full board is indicated a packed lunch is normally provided. Many establishments will charge extra for a hot lunch. Not all establishments can provide hot lunches. 10. EXCURSIONS The provision of excursions varies from tour to tour. The following is a summary of our policy. 1. OPEN ITINERARIES For air and coach tours shown as open itineraries in your quote letter, no excursions are included in the tour price. NST provides a visit planning service for groups of minimum 25 paying persons or more. This is a service that will help you plan your visits and prebook transportation, entrance and guide services on your behalf. Normally guide services and transportation will be prepaid to NST with most entrance fees payable on the spot by the group. 2. INCLUSIVE TOURS Many tours include the provision of transportation for excursions. Some tours include the cost of entrance fees, guide or escort services in addition to transportation. This is clearly shown in your quote letter. NST will be happy to book any additional services required and advise you of the additional cost. 3. OPTIONAL EXCURSIONS AND ACTIVITIES For many destinations served both by coach and air, NST has prepared lists of optional services and visits together with prices. These can be booked and paid prior to departure. 4. INFORMATION PACKS Specially prepared Information Packs are available for most NST destinations. These expand on the visits available to groups and provide additional general information. 5. GUIDE BOOKS NST will provide the group organiser with a guide book on the selected destination. 6. GENERAL NOTE Most visits requested can be booked by NST. Should a large amount of research be required for visits not listed in the NST Information Pack, we reserve the right to levy an additional charge. You will be notified of the amount required prior to the visits being researched. 7. ADVICE FOR EXCURSIONS AND VISITS As described in our brochure, we operate a Safety Management System which has been developed in conjunction with RoSPA and is externally audited every year by a suitably qualified external organisation. Whilst it is not practical to inspect all visits and excursions, we will use reasonable endeavours to obtain, from providers of visits and excursions that are

included in tours, evidence that health and safety has been evaluated. We will also endeavour to obtain an outline of any potential remaining risks which the provider wishes to bring to the attention of school and youth groups. Additionally, the Department of Education and Sciene, DfES, LEAs and, in some cases, individual schools issue guidance on all aspects of school trips and outside activities including planning, risk assessment, organisation and supervision. If you are in any doubt, you can and should always seek specific advice in advance from the Department of Education and Science, your LEA or the DfES. 8. ITINERIES NOT GUARANTEED - FOOTBALL MATCHES AND CONCERTS Where we agree to organise attendance at or participation in football matches or concerts on your behalf we cannot guarantee the arrangements requested for particular venues or on particular dates. This is because we are dependant on the goodwill of the individuals that agree to provide facilities for these events. As these providers are not our suppliers and we do not have contracts with them for the supply of these services, they may choose to withdraw any offered facilities at any time and this is outside our control. In these circumstances we reserve the right to substitute alternative arrangements to those originally requested. Any such change will not be a significant change for the purposes of clause 8 of our Booking Conditions. 9. PREPAID THEATRE VISITS Please note that prepaid theatre tickets are nonrefundable. 1 1 . Collective passports for persons under the age of 18 are currently accepted by all countries for which tours are featured other than USA, South Africa, China, Egypt, India, Mexico, Turkey and Russia for both Irish and British citizens. Irish citizens also require full passports for Czech Republic, Israel and Russia. For all countries which require full passports these passports must be valid for 6 months after the date of travelling. All adults must hold full passports for all tours. Procedures for obtaining collective passports will be sent to group organisers. Please note that some countries require identity cards as well as collective passports. It is the group organiser’s responsibility to ensure that all group members have the appropriate documentation to enable the tour to be completed. Please refer to the grid on passport & visa information and notes underneath specifically for the Czech Republic. All first-time applicants for a UK passport who are aged 16 or over will have to attend an interview, which means that the application process will take longer. If a pupil is aged 16 or over and hasn’t yet got a passport, our recommendation is that you should apply for at least 10 weeks prior to departure, longer if a visa is required. 12. VISAS Non Irish / Non UK citizens may require visas / transit visas for which the individual is responsible and must apply for themselves. The following information is relevant to Irish and UK citizens only. Visas are currently required for China, Egypt, India, Russia and Turkey. A visa waiver scheme applies to Irish and UK citizens visiting USA. The cost of visas is not included in tour prices. NST will provide the necessary advice to enable groups to obtain visas. We recommend that all visa requirements are complete at least two months prior to departure. Please note we cannot accept liability if you or any member of your group is refused a visa through no fault of ours. The inability to travel due to incomplete visa requirements is not covered by insurance. (Please also refer to clause 17 of Booking Conditions). 13. INSURANCE INSURANCE SUMMARY The following insurance cover is provided for every tour participant and is included in the tour price. Full details of cover will be sent to group organisers. 17. SUPERVISION The Group Leader officially in charge of the group warrants that he or she will supervise the group in loco parentis. The Group Leaders are responsible for the good behaviour and discipline of the group throughout the tour. No group member under 18 years of age will be allowed to consume alcoholic beverages without the express prior written consent of the parent/guardian. No member of the group shall be permitted to smoke in bedrooms or otherwise cause fire hazards and all group members shall be made positively aware of the above obligations prior to the tour commencement. (Please also refer to Clause 14 of Booking Conditions).

20. FOREIGN OFFICE ADVICE Occasionally, the Foreign and Commonwealth Office finds it necessary to issue advice on the suitability of travel to certain destinations. Such advice can be found on the Foreign and Commonwealth Office’s website at www.fco.gov.uk/knowbeforeyougo. The Department of Foreign Affairs in Ireland follow the Foreign Office Advice on suitability of travel and refer people to their web site.

For the purposes of the Data Protection Act 1988, NST Ltd. (registered number 240123) are a data controller. In order to process your booking, we need to collect certain personal details from you. These details will include, where applicable, the names, address and age of group members, credit/ debit card or other payment details and special requirements such as those relating to any disability or medical condition which may affect the chosen arrangements and any dietary restrictions. We assume that you have any necessary permission from your group members to pass on their personal details. We need to pass on your group’s personal details to certain companies and organisations so that appropriate arrangements can be provided (for example your airline, hotel and other suppliers). Such companies and organisations may be outside the European Union if your tour destination is outside these countries or involves suppliers outside these countries. We would also like to store and use your personal details for future marketing purposes (for example, sending you a brochure or details of a promotion). If you do not want us to do any or all of these things, please let us know as soon as possible. We are entitled to assume you and the rest of your group members do not object to our doing any of the things mentioned in this statement unless you tell us otherwise in writing. Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us as set out above unless you agree otherwise. We have appropriate security measures in place to protect this information. You are generally entitled to ask us (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee of €15 to respond to such a request. We promise to respond to your request within 40 days of receiving your written request and fee.
