Frequently Asked Questions NSW Real Estate’s experienced staff are available to answer any questions you may have at any time during the sale. The following section provides some basic information on some of the most commonly asked questions.

How long will it take to sell my property? We start preparing the marketing for your property as soon as you instruct us to proceed, thereby ensuring that your property can be placed on the market the moment we receive contracts from your legal representative. Within two days of listing we will commence photography, development of descriptive text and the design of other advertising materials. The average time taken by our agency to list and sell a property is between 4 and 6 weeks, however prior to placing your property on the market, we suggest that you allow an additional two weeks to prepare the property, marketing materials and contracts. There can also be seasonal factors to consider, as well as fluctuations in supply and demand caused by economic factors outside our control; however we devote all available resources into achieving the highest possible sale price in line with your particular instructions.

How much will my property sell for? In order to establish the sale price of your property we conduct extensive research into recent sales, market trends, and current supply and demand. What can I do to improve the sale price? Presentation of your property is a critical factor in achieving the highest possible price. This is similar to detailing a car before you sell it. The preparation you put into getting your property ready for sale can make the difference between getting a standard price and getting a great price. Our experienced sales staff will discuss property presentation and potential improvements that could result in substantial increases to the sale price. Similarly they may advise against certain improvements that may not be economically viable. We also have at our disposal skilled handypersons and tradespeople to immediately assist you if required.

Why are Exclusive Agreements best for vendors? We only work with Exclusive Agreements as opposed to Open Agreements (where a property is listed with more than one agency). We believe that if you have two or more agencies working on the same property, it works for the buyer not the vendor, as an agent who takes on an Open Agreement wants to sell the property as quickly as possible so that he/she gets the commission instead of the other agent. Therefore he/she is not committed to achieving the highest possible price for you. Our success is your success! Which sale method should I choose – Auction or Private Treaty (For Sale)? Each method has its own advantages and your agent will discuss the benefits of each in detail to ensure that the most appropriate method is selected for the sale of your property.

Our company successfully utilises both methods, however we have found sale by Public Auction to be the most effective method where a property is likely to attract more than one qualified buyer, allowing competitive bidding to increase the final sale price. The Private Treaty method is recommended when your property is within a comparable bracket similar to other homes that have just sold in your area. Therefore we can place an asking price on your property knowing that the sale price will be within a certain range.

When is the best time to sell? Buyers for good quality property can be found all year round. With the marketing process having become far more sophisticated than in previous times, the issue of timing is less critical today than in the past. Spring and summer months are generally our busiest as a large number of people choose to sell at this time, however the advantage of selling at other times of the year is that there are generally fewer properties available on the market.

Are ‘Open For Inspections’ necessary? We prefer to conduct both ‘private inspections’ and ‘Open for Inspections’, however the decision is entirely yours. Open for Inspections hold the following advantages over private inspections: •

They create an urgency factor from buyers observing other interested parties at the property.

They minimise inconvenience to you and give you the opportunity to best prepare the property for viewing.

The open for inspection times will be scheduled and advertised at a time convenient for both parties. It should also be noted that for security reasons, all persons wishing to inspect your property will be required to register before being allowed to enter, and that there will be an agent in attendance at all times. Any genuine purchaser, who cannot make the normal viewing times, will be accommodated via a private inspection. At all times we will call you first to give as much notice as possible and to arrange a convenient time.

The Sale Process – Step by Step One of the keys to our success is that we keep our clients informed and involved throughout the sale. The following section provides an introductory overview of the sale process from start to finish.

Appointment of Agent Once you have made the decision to appoint an agent, you will be asked to sign a Sale Agency Agreement. NSW Real Estate’s Agency Agreement clearly outlines the terms and conditions of our engagement as well as our fees and charges. This is a legal requirement before we can commence marketing your property.

Documentation and Contracts We will assist your solicitor or legal representative to prepare the Contract of Sale for your property. The contract is prepared in duplicate and contains information relevant to the property such as ownership details, inclusions, council approvals, zoning information, property surveys and details of any easements or restrictions. Preparation of the contract can take between one and two weeks depending on the specific nature of your property. It is also a legal requirement that the contract is completed prior to placing your property on the market.

Advertising and Marketing Materials Whilst the contracts are being prepared, we will photograph your property and prepare descriptive text for marketing. Our graphic design artist will then design layouts for newspaper advertising, brochures, window displays, internet and signboards so that advertising can commence as soon as we receive the completed contract.

Buyers Database Details of your property are entered into our ‘Console’ database and automatically matched to our list of pre-qualified buyers. As soon as we have received the completed contracts, we contact each buyer individually to inform them of your property entering the market.


The Sale Process – Step by Step Property Inspections Open for Inspections are scheduled early in the sale process in order to give you as much notice as possible. The majority of OFI’s are scheduled for Saturdays as this is the most convenient time for most buyers. Similarly, we will contact you to arrange suitable times and to give as much notice as possible for private inspections. All persons inspecting the property are required to provide us with identification and contact details prior to entering the property. Following the inspection we contact interested parties for feedback and to offer further information or assistance.

Enquiries We respond immediately to all telephone and internet enquiries relevant to your property. If for any reason your salesperson is unavailable, our sales assistants, receptionist and 24 hour phone service ensure that we are able to respond to all enquiries. We go to every length to ensure that we assist buyers with information about your property and the buying process.

Feedback We provide you with detailed feedback to keep you fully informed during every stage of the sale process. During the marketing campaign we will contact you regularly to discuss purchaser enquiries and the results of each inspection. Should you have any questions or wish to discuss any aspect of the sale with us, our salespeople are available to take your call 7 days a week, 24 hours a day.

Proposals and Negotiations It is our role to represent you in all negotiations with prospective buyers. When any proposal to purchase your property is made we will notify you immediately, before confirming the proposal in writing. If you do not wish to accept the proposal, you may opt to reject it or make a counter proposal at a price acceptable to you. We work closely with you throughout this process, to guide and assist you to achieve the best possible result.


Agreement to Purchase and Exchange of Contracts Once you have accepted a proposal, we contact your legal representative and the purchaser’s representative to arrange for copies of The Contract to be signed by both parties. We also administer any deposits paid by the purchaser into our trust account. The Contracts are signed once all building and pest inspections are satisfactorily completed and the exact finance is approved in writing. Each party signs their own copy of the contract of sale. The purchaser’s legal representative keeps the copy you have signed and your legal representative retains the copy they have signed. This process is referred to as the ‘Exchange of Contracts’. If you choose to sell your property at Auction, the successful bidder will be required to sign contracts on the spot and pay a deposit, normally 10% of the purchase price.

Building and Pest Inspection We will coordinate any building and pest inspections that may be required on behalf of the purchaser.

Cooling Off Once contracts have been exchanged there may be a cooling off period of five working days, in which the purchaser may withdraw from the sale. In the extremely rare event that the purchaser withdraws from the sale during the cooling off period they will be required to pay you the equivalent of 0.25% of the sale price. There is no five day cooling off period with an auction, when the hammer falls the buyer is committed to purchase.

Settlement The settlement date is the day on which you receive payment and the purchaser assumes possession of the property. In legal terms, settlement is the completion of the property transaction. On settlement day the balance of the purchase price is paid and the title deeds (legal documents stating property ownership) are handed over. Finally, the keys are handed over. This process is handled by your legal representative. Generally, settlement takes place some four to six weeks following the exchange of contracts.
