Paso school board passes resolutionsymbolicabout gender specific titles Scattered applause and booing marked the end of a divisive 5 1/2-hour long Paso Robles Joint Unified School District board meeting. The majority of that Aug. 23 meeting was spent discussing a resolution stating that the district would not support any “mandate which replaces traditional gender-specific names such as mother and father, Mr. and Mrs., ladies and gentlemen, and boys and girls.”

The resolution stemmed from a leaked, but unadopted, proposal from the National Education Association that would have pushed educators to use “LGBTQIA-plus inclusive” language.“Theintent of the resolution is to clarify for staff, parents, and students guidance for addressing individuals or class or a group of students or parents with traditional titles. Individual students who have changed their name and gender must be afforded that right. But a staff member who mistakenly or inadvertently misuses the name, will not be disciplined unless the misuse is intentional,” district superintendent Curt Dubost said. The resolution comes amid controversy surrounding questions from the parents and the school board about teacher training at the high school following a LGBTQ-targeted hate incident in 2021. Earlier this month, school board members discussed proposed changes to the district’s policy on harassment and discrimination that would erase most specific references to LGBTQ-plus students in the policy. At the Aug. 9 meeting, the district alluded to the explicit protections as unnecessary because state and federal law already protect those students, but it ultimately opted to push the decision to a later date.Teachers expressed their frustration in an open letter signed by 17 teachers, calling out the school board for its actions.

According to the fictitious business name statement filed with the SLO County Clerk’s Office, Taft St. Coffee is registered under a limited liability company named California Coalition LLC. California Secretary of State filings show that the LLC was initially registered in June 2022 with the agent being Maria Antonia Meyers, Contreras’s mother. It noted Christian Contreras as the CEO of the business. Taft St. Coffee did not respond to New Times’ phone call and Instagram message requesting comment by press time. However, the shop’s Instagram account posted a statement on its profile.

Others, like board member Frank Triggs who voted to pass the resolution, thought it was a good first step. “A student accepts the reality of who they are and how they were born and has the proper self-esteem. No one should be bashed, and that’s atrocious. We need protections to keep that from happening. But suicide is not caused by using the terms mother, father, ladies, gentlemen, boys, girls. And we need to help everyone that has suicidal tendencies. It’s not just gay people, it’s heterosexual people [too]. The cause of [suicide] is not because we use mom, dad, or whatever,” Triggs said.
“The proposal was tabled pending a study session. The board continues to reveal an indifference to anti-gay bullying. Moreover, the board’s next proposed action is a resolution affirming the use of traditional nouns and pronouns, which was adjusted,” the open letter read. “With a board like this, who needs bullies? Teachers are frustrated. We want to know why the board would take away policies that further protect our students who are hurt by these protections?”Studentssuch as Paso Robles High School senior Tyler Perez advocated for the school board to stop making changes to the existing rules.“I’m just here to let you know that the rules already in place are doing nothing and harming no one. So why remove them. It makes no logical sense. Leave them alone,” he told the board. “Instead focus on adding new things like education for staff and students so that they become aware and educated of who we are and what we identify as. There is no benefit in removing these roles. Instead they will bring fear to the already scared community.”
Taft St. Coffee gets community pushback for links to alleged sexual abuser
On Aug. 19, Instagram was abuzz with reshares of a post made by a local resident asking community members to boycott Taft St. Coffee. The next day, some users received cease and desist letters via Instagram direct messaging (DM) from Taft St. Coffee’s account. One of them was Henry Bruington, the former manager at Kin Coffee, who said he quit that job soon after he heard about the assault allegations. Bruington said he knows roughly four others who also received the messaged letters.“What’s weird is people were sharing it in their [Instagram] stories. The cease and desists said we have five days to remove all posts but those posts disappear in 24 hours. So, I’m not sure what they’re trying to accomplish,” Bruington said.

“It’s pretty anxiety-inducing. It was one of the worst times of my life. The business that I had helped grow, to have something so terrible come out of it. My life got upended. But it’s also nothing compared to what was done [the sexual abuse complaints],” he said. “The main thing about reposting is that we have a new group of Cal Poly kids who just came into town who have no idea about the history and what happened. The cease and desist letter, signed by a public notary officer named Lola Wingate, told Bruington that he received it due to his “persistent actions including but not limited to (slander, defamation, and business profit loss) due to your social media activity regarding ‘Taft Street Coffee.’” The letter went on to state that if Bruington continues “slanderous comments and posts,” a harassment lawsuit would be filed against him. “I don’t think they would have anything actionable. If anything, I would want them to waste their money, not me wasting mine. I don’t think reposting that story is actionable,” Bruington said. “I understand that now, and it’s because they’ve been so cagey about it, Julian isn’t the technical owner of Taft St. Coffee but his brother is, and his brother is the co-owner of the first one. It’s more about that family profiting off something when nothing has been done to the 40-plus allegations against them.”


“I told Jeff during the June 3, 2019, council meeting that I had diligently paid TOT ever since the beginning of my short-term rental. He smiled and said, ‘The city of Grover Beach appreciates the money because you don’t have to pay that,’” Thompson said on Aug. 22. “In order for him to make that statement, he had reason to believe that payment of TOT is not required of STR operators. … Mayor Lee has let the cat out of the bag; the toothpaste cannot be put back into the tube.”Thompson said that he hasn’t charged his tenants for TOT since the end of 2019, adding that he focused on the phrase “tourist home or house” included in the municipal code’s definition of a hotel. He consulted an English professor about the meaning of the phrase. The professor told him that the phrase is an abbreviation of “tourist home” and “tourist house,” Thompson said, differing from the city’s interpretation of it to mean any house that temporarily lodges people.
City Attorney David Hale said at the hearing that single-family STRs like Thompson’s fall under the definition of a hotel, according to the municipal code.

SLO County Sheriff’s Office expands jail competency program
The jail consistently has 10 to 20 inmates awaiting placement in either the jail-based program or Atascadero State Hospital. The Sheriff’s Office said that once it’s able to place an inmate in a competency bed, its success rate is high: The jail-based program has been able to restore 85 percent of inmates for trial.
“We have to come up with something that people want, that’s OK with the McCarthys, and that we’re willing to maintain,” he said. “There’s always a solution, you just to have to keep chipping away at it.”
What is the definition of a hotel? The question plagued the Grover Beach City Council, members of city staff, and one frustrated resident who refused to pay transient occupancy taxes (TOT) for two yearsTherunning.groupengaged in a two-hour-long heated back-and-forth at the Aug. 22 hearing where short-term rental (STR) operator Allen Thompson attempted to present evidence as to why he was exempt from paying TOT based on his interpretation of the city’s municipal code. He added that city Mayor Jeff Lee told him he didn’t need to pay the tax.
“The program needs to be expanded to accommodate the inmates awaiting competency restoration,” the report read.
Franco said that the county is continuing to negotiate with the McCarthy family and trail advocates on a resolution for the Cave Landing end of the trail that works for everyone.

I asked her about a specific issue. The city wants to interpret the phrase ‘tourist home and house’ as having the standalone word ‘house’ in it so that they can apply this word to me and my single-family residence. She said that’s not what it means.”
The Cave Landing side of the Ontario Ridge trail is also a work in progress. That land is also privately owned, by the McCarthy family, and in 2021, the Coastal Commission denied a McCarthy plan to build a new home on the land and reroute the trail easement (which the county had signed off on).
Hale told the City Council that staff had requested to audit Thompson’s books to determine how much TOT he owed Grover Beach, but Thompson refused to give them the documents. An estimate from the city tax administrator initially claimed that he owed $15,284.26 in unpaid taxes, interest, and penalties. But an updated calculation as of July 31, showed that sum jump to $16,215.52.
A new San Luis Obispo County jail program that helps restore mentally ill inmates to competency for their trials is about to get more beds. The California Department of State Hospitals is providing $4.7 million to the Sheriff’s Office over the next three years to add three additional beds to the jail’s current five-bed program. It also plans to provide funding to reevaluate inmates’ competency while they’re waitlisted for beds.First established in response to the 2017 jail death of Andrew Holland—a schizophrenic inmate who died strapped to a restraint chair while awaiting transfer to Atascadero State Hospital— the SLO County jail-based competency program works by bringing psychiatric treatment and competency restoration directly to the jail.
On Aug. 23, the SLO County Board of Supervisors voted unanimously to approve the $4.7 million contract with the state. It would fully cover the program’s costs, which include two new correctional deputies, medical supplies and medications, and payments to the county jail’s health care contractor, Wellpath. “I know it can be a challenge to have that balance between property rights and what you can do for your community, but this is something we really believe in,” Spearman told the board. “It isn’t something we had to do, but we did it because we believe in our community and we could, so thank you for that opportunity.”
The hearing concluded with the three-person City Council (Mayor Pro Tem Karen Bright and Councilmember Anna Miller were absent) unanimously rejecting his appeal of an administrative decision ordering Thompson to pay outstanding TOT and revoking his STR permit.Kristin Eriksson, the city’s deputy city manager, told New Times that owners of revoked STR permits cannot reapply for two years. Plus, applications hinge on the availability of permits due to the cap on the total number of STR permits allowed in the “Forcity.non owner-occupied STRs, in which the owner is not present during the stay/vacation home residences, such as Mr. Thompson’s, the cap for STR permits is 60 in the non-coastal zone; 40 in the coastal zone,” she said. At the hearing, staff noted that the city’s system sends out alerts to STR permit-holders when they haven’t paid the tax. Thompson said that he couldn’t be certain if he received them. “Mr. Thompson was notified in mid2019 that he was obligated to pay TOT and TMD [tourism marketing district] tax for any rental of his STR,” Eriksson told New Times. “Mr. Thompson received monthly notices from Host Compliance throughout 2020 and 2021. In August 2021, city staff also began direct correspondence with Mr. Thompson to attempt to collect on his delinquent tax payments.”
“Having a jail-based competency treatment program at the jail has proven beneficial for the inmate population [by giving them access to] restoration treatment on-site rather than waiting for a state hospital bed to become available, which can often take three months or longer,” an Aug. 23 county staff report on the bed expansion read. According to the Sheriff’s Office, the Department of State Hospitals recently determined that the jail needs more beds to meet the local demand for treatment.

Ridge isn’t technically a trail. It’s unauthorized and encroaches on private property.“Essentially, the trail right now, as people are using it, is a trespass. There’s no formal right for the public to use it,” said Nick Franco, director of the San Luis Obispo County Parks and Recreation Department.Thatfinally changed on Aug. 23. Fulfilling a 16-year-old goal, SLO County inked easement agreements with two Ontario Ridge property owners—the Spearman and Cool families—which effectively formalize the trail. The easements received unanimous support from the Board of Supervisors on Aug. 23. Approval of the easements means that the trail can finally be brought into the county parks system and maintained to its standards. The “informal” trail that exists on the ridge now doesn’t conform to those standards, Franco said. But the public shouldn’t expect major changes to the trail, at least not anytime soon, Franco said. The long-term plan for the Shell Beach side of the trail (there’s also an entry/exit point at Cave Landing near Avila Beach) is to slightly reroute it to the intersection of Avila Beach Drive and Shell Beach Road. A new roundabout is planned at that intersection, so the rerouting will need to wait until construction of that project is complete. “I don’t see any massive changes [being made to the trail],” Franco said. “Where it would change is on both ends.”

The framework was presented at the beginning of the forum before participants were able to weigh in. As of right now, Paso only has one medical marijuana dispensary operating in town that’s limited to delivery only, and the only recreational dispensaries to the north are in Greenfield or King City. Otherwise, residents must travel south to cities like Morro Bay, Grover Beach, and San Luis Obispo. HdL Companies, the city’s contracted cannabis consultant, showed that one recreational cannabis storefront in Paso Robles could generate up to $4 million per year in gross receipts.
Existing state law subjects marijuana products from any retail storefront to “third party testing for mold, pesticides, and other contaminants,” according to a presentation by HdL Companies. State law also dictates that dispensaries cannot sell cannabis to people under 21 or 18 with a medical card and mandates ID verification prior to entry. HdL also said that the city can fund youth prevention services using cannabis tax revenues and routine inspections of facilities.

The ordinance—which got the goahead for an EIR from a divided Board of Supervisors early last year—would revise the county’s basin land-use regulations for the first time in a decade by changing the definition of what’s considered exempted water use, increasing it from 5 to 25 acre-feet per year (AFY). As the restrictions go today, any new irrigation above 5 AFY must be offset by an equal reduction in pumping. That, at least on paper, has capped the demand on the basin since 2013. But in 5th District Supervisor Debbie Arnold’s view, that setup was unfair from the start. “All along, I was never happy,” Arnold told New Times. “When the urgency ordinance was originally passed, there were clearly winners and losers, and for losers, it was through no fault of their own. We experienced an influx of irrigated ag and that was really the reason there was so much groundwater pumping. SLO County’s discussion about revamping the local basin ordinance is unfolding while emergency drought restrictions come down from the state and local stakeholders start to try to implement the Paso Basin Sustainability Plan—the document crafted to comply with the state’s Sustainable Groundwater Management Act (SGMA). Most of the EIR commenters noted that they preferred to use the SGMA process to develop new local groundwater rules. Burchett also pointed to a recent Gov. Gavin Newsom executive order on well drilling as the type of challenge that agriculture is grappling with from higher levels of Newsom’sgovernment.order requires that all new wells drilled over

“This ordinance is indisputably bad for agriculture,” the SLO County Farm Bureau wrote in a July 6 letter to the county. “It might help a handful of property owners, but it does so at the expense of the vast majority of growers in the Paso basin, and the mitigation measures it introduces set a dangerous precedent for new regulations on all farmers and ranchers in SLO County.”
On Aug. 18, Arnold, Burchett, and county officials met in person to discuss the ordinance, its EIR, and the Farm Bureau’s concerns. Arnold told New Times afterward that she was surprised, too, to see the mitigation measures in the draft EIR and hopes staff can find alternatives to replace them with in the final EIR. She declined to say whether she’d support the ordinance if it came back before the Board of Supervisors without changes.

“The initial concrete plan was to highlight the absence of good care, the stigma, the lack of education, the lack of adequate vaccines, and any other related issue in a way that we could put pressure to have them [medical officials] come around and to have there be a better response,” Laird told New Times.
Serrin Ruggles, the director of operations at San Luis Obispo’s Gala Pride and Diversity Center, remembers being gripped by fear when news of monkeypox first broke across the nation a month ago.

In 1983, Laird became the first openly gay mayor in the country as Santa Cruz’s top official. He then became a founding member of the Santa Cruz AIDS Project (SCAP), and vividly remembers being in the thick of the HIV/AIDS epidemic.

Laird mentioned Vito Russo, who wrote the book The Celluloid Closet about LGBTQ-plus portrayal in movies. During the AIDS crisis, Russo wrote a column called “Why We Fight” to encourage faster treatment plans. In it, Russo quoted from a New York Times article.
“I reread it recently. Two, three, four times, the New York Times said, ‘Don’t worry about HIV, it hasn’t reached the general population.’ That was just wrong on two fronts. No. 1: Was everyone then, with that view, and monkeypox now chopped liver politically or culturally?” Laird said. “Second, it didn’t face the real issue: this is about the spread of a particular virus and needs to be stopped.” ∆
Penny Borenstein, the SLO County public health director, told New Times that as of Aug. 18, the department had 24 JYNNEOS vaccines, and it anticipates receiving more. She mentioned that people under 45 years old bear the highest risk of contracting monkeypox, but the county will not cut off vaccination eligibility at that age.
“Right now, we’re only providing it to those [above 18 years] who have known contact with a case or who were in a setting where there was known to be monkeypox or maybe a lot of intimate contact but not necessarily known whether there was contact with a particular person with a case,” she said. “Also, lab workers. In our county, we’re the only laboratory that we know of locally that are testing for this virus.”
Recent research also shows that monkeypox can be caught through pets, like dogs. Borenstein recommended that infected people isolate from their pets at home, the same way they’d separate themselves from other members of their household. She added that Public Health plans on partnering with Gala and Access Support Network to expand vaccine availability. For now, Borenstein said, monkeypox isn’t considered an epidemic because of the low number of infections.
“The fact that the SLO Public Health Department reached out to me … a couple of hours after I first really heard about what was going on, that felt like a game changer to me. That felt like we were less alone this time around. As they walked me through all the data and helped me set up the event, and we did the informational session, I feel a lot more secure now,” they said. Through such a partnership, Ruggles and the Gala team hosted a virtual town hall meeting on Aug. 5 with county health officials prepared to serve as point people for members of the LGBTQplus community grappling with how monkeypox can affect their lives. Rare and belonging to the same family of virus that causes smallpox, monkeypox is an infectious disease that causes rashes around the groin and hands, feet, chest, face, or mouth. Other symptoms include respiratory ailments, fever, chills, and swollen lymph nodes. While it is sexually transmissible, it is not classified as a sexually transmitted infection because it can be spread through simpler means, too, like touching objects and fabrics that have been used by someone with monkeypox and through respiratory secretions.However, monkeypox data from the California Department of Public Health shows that MSMs are the most vulnerable demographic in terms of infection rates. As of Aug. 18, the state reported 2,660 total positive cases. Of these, 86.4 percent are from the MSM population. SLO and Santa Barbara counties reported one and five positive cases, respectively. But with article after article pointing out MSM as being behind the monkeypox spread, Ruggles is worried about potential discrimination.“Alotofthefear is that this will go ignored because the AIDS crisis went ignored for a long time. It wasn’t until we were seeing its effects in white, cisgender, heterosexual children specifically that we saw any kind of significant governmental response to it. There is also concern that the stigmatization of the disease will increase the spread,” they said. Ruggles added that some of the misconceptionsbiggestthat SLO Public Health addressed at the town hall meeting were comparisons to COVID-19.

“A lot of the misinformation comes from this being a developing situation. I’ve heard people be concerned about needing to continue to wear masks because monkeypox can be spread through water droplets. But they [SLO Public Health] were able to tell us that it really takes quite a long time for monkeypox to be transmitted in that way,” Ruggles said. “You have to be having a very close conversation with somebody for an extended period of time. It’s not like COVID.” Ruggles and other members of Gala are now encouraging support for domestic vaccine production at the federal level.
Other leaders also have plans in motion to safeguard the LGBTQ-plus community from being negatively affected by monkeypox misconceptions. State Sen. John Laird (D-Santa Cruz) who represents the 17th District that includes SLO County, sits on the Select Committee on Monkeypox with fellow Sens. Scott Weiner (D-San Francisco), Susan Eggman (D-Stockton), Rosilicie Ochoa Bogh (R-Yucaipa), Lena Gonzalez (D-Long Beach), and Richard Pan (D-Sacramento).
“I just had this terrible sinking feeling in my chest,” said Ruggles, who uses nonbinary pronouns. “I’ve read a lot on the AIDS crisis. … I just started crying. I was so worried we were going to be thrown right back to 1983 and be reliving it all, all over again. We lost so many people in the last generation, and I was scared that it was going to happen in this generation.” Their anxiety stemmed from a combination of factors: concern that monkeypox disproportionately affects men who have sex with other men (MSM population), worry that public health departments would be slow to react to a potentially ballooning infection rate, and an unease that general misinformation about the disease could further stigmatize queer people. But while American health leaders largely remained silent for years before sounding the alarm about the HIV/AIDS epidemic, efforts to mitigate monkeypox at the local level gave Ruggles some hope.

“When COVID hit, we lost all of our ability to produce anything, including fundraisers, operas, musicals, galas, educational outreach—the best we could do is we received a few grants for doing video work, which everybody was doing. But we needed something to keep us afloat,” Alhadeff said. “We had a few pianos that were already in inventory, they were donated, and they were good pianos. And I put them up for sale, and boom, they just sold instantly.” Anyone looking to sell a piano can contact him, and he’ll take a look at the piano and provide an estimate of how much the piano will be worth. Depending on the client’s fi nancial situation, the donor could get a tax deduction. The price of each piano depends on various factors, including the condition, any unusual details, and color, according to Alhadeff. Once the price gets calculated, Alhadeff takes the piano, refurbishes it, and resells it to the next willing buyer. Before you jump on the phone to donate your piano to Opera SLO, just know that all pianos are not created equally. Pianos must meet certain criteria before Alhadeff can take them. “We usually don’t take Spinet pianos over 50 years [old] or consoles. We’ll start to take studio and professional uprights. However, we do make exceptions for top brands such as Yamaha, Kawai, Young Chang, Baldwin, and Steinway,” Alhadeff said. If your piano is eligible for donation, then Opera SLO can pick it up. Once the piano makes it into classroom 108B, it goes through a transformation in the hands of Alhadeff and Carmen. “So we vacuum clean the exterior, we polish all the brass. We reassemble the hinges, reassemble the piano, and stain the piano in most cases. And then of course, disposal and cleanup. It’s kind of a fun little process,” Alhadeff said. Refurbishing pianos can be arduous. For a novice like Carmen, who has only fi xed up six pianos, simply polishing the piano could take up to five hours. But, she said, it’s all about the process.

This is where Brian Alhadeff, Opera SLO’s artistic and general director, runs a special program called the Nationwide Fine Piano Donation Program, which started in 2020 as a way to raise money for Opera SLO during the pandemic.

If Diablo Canyon closes in 2024 and 2025 there will be intensely increasing roving power outages. The need for more fossil fuels will greatly increase the emissions we are striving to reduce. Our electrical grid can’t yet sustain 100 percent clean, emission free power 100 percent of the time without steady 24/7 power from Diablo Canyon. Because Diablo Canyon is one of the most robust structures in the world, if there’s ever an earthquake strong enough to damage it, there’s no sense in worrying because every structure in San Luis Obispo County will be flattened. Everyone is entitled to their opinion, but opinions are not proof. If you haven’t had training in nuclear power, worked at Diablo Canyon as I have, there is no basis for the truth and your opinions have no basis for fact.
“Close Diablo Canyon Power Plant on schedule” (Aug. 18) is an opinion piece, and everyone has a right to an opinion. But when one expresses one’s opinion publicly, one must assume responsibility for the consequences of that opinion. For example, following are some consequences of the author’s opinion that Diablo Canyon should be closed. First there is the effect on climate change. According to California Energy Commission data, the entire contribution of in-state renewables to California’s power production was a little more than 24 percent last year. This includes an ongoing expansion of renewable capacity, especially solar. According to the same data, the renewables share of annual production over the last few years has increased at the blistering rate of about half a percent a year, which means that California can look forward to renewables serving 100 percent of in-state California power production in about 150 years. More importantly, this means that at least 75 percent of Diablo Canyon’s production will have to be replaced by something other than renewables. The only other possible substantial source of clean energy in California is hydropower, but hydropower capacity is not only not expandable, its current production has also been gravely reduced to a fraction of its capacity by prolonged drought. The bottom line is that at least 75 percent of Diablo Canyon’s production will be replaced by in-state fossil fuels, mostly natural gas, which will require a lot more fracking. By the way, imported clean energy does not count because it comes from existing sources, so there is no effect on reducing global carbon emissions. Emissions can only be reduced by expanding clean energy capacity to permanently replace carbon-emitting sources. Therefore, closing Diablo Canyon will reduce clean energy capacity, thereby increasing emissions.Thenthere are the social and economic consequences. In 2012 Diablo Canyon was generating more than $30 million a year in local sales and property taxes.

Given that one or both of the Diablo Canyon Power Plant’s reactors have been down more than 40 percent of the year for at least the previous three years (for problems and/or planned downtimes), PG&E claims that “the two units produce a total of 18,000 gigawatt-hours of clean and reliable electricity annually” are at best misleading statements. Does the governor and Legislature know the true downtime of these two obviously unreliable nuclear reactors? Extending the life of these unreliable reactors increases our risk for blackouts. We need a plan that keeps the lights on, not one that improves the odds we’ll have more blackouts. Let the California Independent System Operator (ISO) do its job as it was originally required by law, to develop a transmission plan to ensure there would be no blackouts without the Diablo Canyon nuclear reactors. Closing these unreliable nuclear plants should make Cal ISO’s job easier.

The concept of “trigger words” is that some people may have trauma that certain words trigger, so undergraduates may be given a warning they could hear a “trigger word” in a class discussion. No rational person has ever suggested politicians need “trigger warnings,” but I wrote to the council members and asked what my “trigger words” were (suspecting their trauma was actually trying to read the California Environmental Quality Act, with which they showed no familiarity).
Aaron Gomez never replied, Erica Stewart said she’d get back to me but never did, and Carlyn Christianson, to her credit, apologized, adding that she didn’t like the fact that I used the words “rich” and “poor”—which was ludicrous but at least honest. So we took our case to superior court instead, where the judge didn’t complain about trigger words. As I run for SLO City Council in 2022, I suggest to my fellow candidates that this time we have debates, to see whether we can discuss people’s legitimate concerns without just dismissing them.

Opinions about Diablo Canyon aren’t necessarily proof!
Continued operation could amount to hundreds of millions in continued in local tax revenue. The state has graciously offered some $80 million or so in compensation. Who will make up the difference? You guessed it … the local taxpayers. That means us. The closure of Diablo Canyon will also cost this community some 1,500 high-paying jobs and compel the relocation of a thousand or so families that have lived and worked in this community for decades.Asfar as the nuclear waste, it appears that thanks to politics the existing waste is not going anywhere soon, so what’s a little more? And nuclear waste is also far easier to contain and manage than the waste wafting into the atmosphere and being pumped into the ground from fossil fuel production. And why worry about the long half-life of nuclear waste when our entire civilization is not likely to last to the end of the century if something is not done about climate change. So, the last thing we should be doing would be to make it worse. We need the continued operation of Diablo Canyon.
Unfortunately, if you’re forbidden from disagreeing in an election, you never learn to sort through policy in any kind of productive manner if you’re elected. The last time I addressed the SLO City Council—on an appeal of a Planning Commission decision based on violations of the California Environmental Quality Act—rather than addressing the issues our citizens committee had brought up, three council members accused me of using “trigger words.”
When I ran for SLO City Council in 2020, I was puzzled that there was no event where candidates could address each other’s ideas—also known as “a debate.” Maybe this goes against our county civility code, which mandates “listening to understand, not listening to find fault.” It certainly goes against the city’s instructions for its advisory bodies: “The public meeting should not be used to express … disagreement.” (Presumably the Planning Commission is supposed to come together with developers and sing “Kumbaya” for two hours. Which, in fact, is pretty much what happens now.)

R oe v. Wade is dead. Now what? The impact in California and the other blue states is negligible, and abortion will continue to be available in those states. But more potentially impactful is the court’s finding that the “right to privacy” that the Roe court “discovered” in the Constitution does not actually exist. This has implications for other areas applying this right, such as contraception, medical care, and the regulation of sexual behavior. This reversal illustrates the pitfalls of using the judiciary to impose public policy. Judicially created policies lack the social legitimacy afforded to policy created through the political process, as most people can grudgingly accept being outvoted. And policies created by an unelected Supreme Court not only lack moral force, but also lack permanence. Here, a new right “discovered” by the Roe court was later “undiscovered” when the ideological composition of the court changed. Easy come, easy go. Congress is considering new laws to ensure access to abortion, but the outcome is far from certain. As the electoral defeat of same-sex marriage in uber-liberal California showed in two different elections, the electorate is often unwilling to embrace the left’s agenda. As inflammatory as the issue is, most moderate politicians in contested districts just wish the issue would go away and would rather be caught in the congressional cloakroom “mentoring” an underaged intern than take a stand on theSo,record.howdo you make a new right permanent? A constitutional amendment. Of course it is a difficult process, but the idea of a “right to privacy” would initially enjoy broad support among both liberals and conservatives, at least until the implications settled in. Liberals would want to protect abortion, samesex marriage, and other priorities, and cranky old conservatives like myself would enjoy getting government out of our lives. Few people like the idea of government injecting itself into their personal affairs. Many people believe that, even if the Constitution doesn’t have such a right, there should be a right to privacy—a right to be left alone. The initial problem would be defining the limits of any amendment that protected abortion. While the majority of voters reportedly support abortion in general, a majority also oppose abortions later in the term. Would the pro-choice absolutists, who demand complete bodily autonomy, be willing to support a limited right to abortion? After all, the Mississippi statue challenged in Dobbs v. Jackson, the case striking down Roe, provided for abortion on demand up to 15 weeks, and later upon a medical emergency or fetal deformity—limitations that the pro-choice forces found unacceptable and chose to challenge. The Mississippi law may more closely approximate the sentiments of the voters than would allowing all abortions without restriction.Atwistto consider is the fact that settling on terms might involve political compromises creating nationwide restrictions that limit the abortion rights currently allowed in less-restrictive blue states. Would pro-choice forces in those states be happy about any reduction of access?Thenext hurdle for such a constitutional amendment would come when people realized that a broad “right to privacy” or a “right to bodily autonomy” could be asserted by their ideological foes to permit behavior that they disapproved of. People would face the dilemma of deciding whether protecting their own privacy or autonomy was more important to them than indulging their urge to control the lives of others.

A recent commentary in this paper noted the contradiction between supporting a “right to bodily autonomy” as to abortion, while denying it to those who object to vaccinations (“Bodily autonomy,” June 30). Those who responded, arguing that vaccinations are a good idea and should be required, missed the point. If you create a broad universal right, it is going to be universally asserted in cases in which it is applicable, not just to those situations you approve of. Would cultural conservatives, with their love of old-fashioned values, be willing to tolerate abortion, same-sex marriage, gay and extramarital sex, or assisted suicide in order to limit governmental intrusion into their own lives? Tough choice! There are two strong opposing drives here: our desire to be left alone versus our emotional need to control “those people.” Are we willing to give up telling others how they should live in order to get others to leave us alone? Can we tolerate the annoying “wrongheadedness” of others and curb our urge to use government to correct them? Do we truly want a right to bodily autonomy if it applies to everyone, and not just to ourselves? ∆
Liberals, who prefer an expansive and often intrusive government, would find a lot of their agenda jeopardized. For example, the absolute right to bodily autonomy asserted in the abortion battle, might also be asserted to challenge mandatory vaccinations for COVID-19 or HPV, face masks, restrictions on the drugs we are allowed to use, the ban on polygamy, smoking restrictions, seat belt laws, the Obamacare insurance mandate, or various “nanny-state” laws.

Oh man, this martyr’s complex runs deep! City Attorney David Hale thinks the $16K tax bill is probably “woefully deficient” since Thompson has refused the city’s request to audit his books. Hale noted that it’s uncontested by Thompson that he runs a STR, rents it to transients, and collects revenue, which is the very definition of hotel despite what “an English teacher” told him. In fact, Hale argued, the tax is a tax on “transient people,” not the rentalAlso,structure.according to Hale, even if Mayor Lee told Thompson he wasn’t required to pay TOT, it doesn’t matter because Lee doesn’t have the power to revoke the TOT law. If Lee says murder is legal, don’t believe him, man! The real nail in Thompson’s metaphoric “death and taxes” coffin was when Hale reminded him that every year when he signs his STR permit with the city, he checks a box saying he’ll abide by STR rules, one of which says TOT must be paid. You freaking agree to it every year in “Ifwriting!wewanted to use the term fraud, it’s pretty close,” Hale said of Thompson’s behavior. Tax fraud and tax delinquency of more than three months are cause to revoke an STR permit, and he’s a couple of years in Thompsonarrears.couldn’t and wouldn’t let it go. He argued that he didn’t collect the tax from his guests because he didn’t think it was required, which means what? He lowered his rents? Come on, dude! You just made more money because you didn’t pay the TOT. Thompson also got surly about Hale’s depiction of his expert witness: “I sought the advice of a professional. Rather insultingly, he referred to her as an English teacher, maybe like he’s the guy that polished up the handle of the big front door. I don’t know.”
Yep, two boring hours later, by unanimous decision, Thompson was ordered to pay his back taxes. His STR license was also summarily revoked. You can fight City Hall. You can also lose. ∆

Oh boy! Technically she is an English teacher, and I bet dollars to doughnuts she didn’t interpret Grover’s hotel definition, only rendered her opinion that “tourist” modified both home and house, which isn’t germane anyway. So, guess what happened?
ccording to WalletHub’s survey that asked Americans what they’d rather do than pay taxes, a few top choices were to change a stranger’s baby’s diaper, fold 100 fitted sheets, clean public toilets, break their own arm, kill a stranger without getting caught, and explain sex to their children. Sheesh! Some people really hate paying taxes. Take, for instance, Allen Thompson, who owns a Grover Beach short-term rental (STR). He spent a good couple of hours trying to put me to sleep … er, I mean, explain to the Grover Beach City Council why his city-licensed rental isn’t subject to the transient occupancy tax (TOT) because—according to Thompson—three years ago when he told Mayor Jeff Lee he’d diligently paid the tax, Lee “smiled and said, ‘The city of Grover Beach appreciates the money because you don’t have to pay that.’” Did Lee say that? He seemed pretty cagey about it. Maybe he misspoke or was misunderstood, but does it matter? The point is the city told Thompson repeatedly he was required to pay the TOT and now he owes Grover Beach an estimated $16,215.52 in taxes, late fees, andArepenalties.youhaving trouble sleeping? Tune in to the Aug. 22 City Council meeting. Thompson starts droning on and on at about the one-hour mark. “Mayor Lee has let the cat out of the bag; the toothpaste cannot be put back into the tube,” he cliché-bombed the council at his administrative appeal hearing for failure to pay taxes. Good grief, man! For years you’ve been warned. Despite what you think Lee said, you are required to pay TOT, and now you’re coming before the city to argue your STR doesn’t fall under the definition of a “hotel” so you shouldn’t have to pay. Semantics: the branch of linguistics and logic concerned with meaning. It’s the mental yoga mat upon which Thompson contorted himself. When is a house a hotel? According to city ordinance, “Hotel means any structure, or any portion of any structure, which is occupied or intended or designed for occupancy by transients for dwelling, lodging, or sleeping purposes, and includes any hotel, inn, tourist home or house … .” Yada-yada—it essentially covers anything a transient can rent for less than 30 days. Thompson read this to the council and then argued, “The word ‘house’ doesn’t mean any old house, and my house is not a ‘tourist house.’” He even consulted “ Dr. Brenda Helmbrecht, who’s the associate chair of the Department of English at Cal Poly SLO,” to confirm that the phrase “tourist home or house” means “tourist home or tourist house,” and his is a single-family house, see? Not a “tourist house!” This dude is a world champion nitpicker! He’s also a special, one-of-a-kind snowflake. All Grover Beach STR owners understand they have to remit TOT except this guy, who went on to compare himself to the child in the Danish folktale willing to bravely stand up and say, “The emperor has no clothes.”

“Most importantly from my perspective or in my point of view is the model that it sets for the community,” Badiali says, adding that he wants young people to understand that if they have a passion for art and are willing to work at it, they can make a living off of making art—it just may not be conventional or full of money. “I think [The Place] has the exact effect that I was aiming for at the beginning. That is, people walk in here and they want to do something creative themselves.”

“If I amuse myself, I probably amuse a lot of other people along the way,” he says. “One of the best things you can do is get out of your head because your soul doesn’t reside in your head.”
Pearson says The Place has hosted about a dozen residents over the past five years, including a musician from Ireland and a ceramic artist from Denmark, who left behind a glazed porcelain flower for the koi pond. Inspired by a six-week residency that Badiali and Pearson did in China, the Place’s residency program is their way of exposing the Central Coast to something that hasn’t been here before, as well as introducing the uniqueness of South SLO County to artists from all over.

“I am not a traditional black and white photographer who chooses deep contrast, but rather uses, or creates, tonalities throughout the image to place value on all parts of the subject,” Canepa said in a statement. Canepa said he hopes his photography will inspire others to help preserve local sand dunes and wetlands, and the native plants and animals— including the threatened Western snowy plover—that inhabit these areas. He bought his first camera in 2004 and has loved photography as an art form ever since. “I find myself in awe of this art form each day. There is always something to photograph, always a different perspective, angle, or a change in the lighting,” Canepa said. “I am passionate about dune photography and have been ‘playing’ in the dunes for years. “I find something new each time I visit the Oceano dunes … I can be atop the highest dune, surveying the entire area and envisioning compositions as the sun rises or descends over the approaching hours,” he said. “People who have different perspectives,” Pearson adds. “The more out there the better, I think.” “And it’s good for the people around here to experience it.” In addition to the residency, The Place is a creative workspace for both artists, a gallery with art available for purchase, a teaching space, a plant nursery, and a place for the community to gather for events that include live music. Badiali says that the big idea is that art is where people can experiment and try things, which is exactly what The Place is—an ever-evolving creative space that gives everyone permission to make a mess, to try new things, and explore themselves and the world.

The slatted floor is still wet from being hosed off before opening. A fog-laden breeze drifts through the open front and out through the greenery-covered back patio. Giant plates, cauldron-like oblong pots clad in black, geometrical painted ladies, ceramic faces, typewriters in various shades of blue, electrified stoplights—there’s so much to look at. Some of it is a product of the Oceano art gallery’s founders: sculptor, ceramicist, and welder Badiali and muralist and painter Oscar Pearson. Other pieces come from a combination of Central Coast artists and resident artists from all over the world who have spent time at The Place creating, learning, and immersing themselves in southern SLO County.

Celebrating five years this summer, The Place weathered the COVID-19 pandemic and has started getting back to its roots over the last six months. Long Beach-based artist Narsiso Martinez, who met Pearson while they were studying art at CSU Long Beach, did a residency in Oceano earlier this year. One of the pieces he created during his time at The Place is now on display at the Museum of Latin American Art in Long Beach. “Just being in The Place just makes it feel like it’s special. It made me feel like I want to draw, I just wanted to stay there and draw. Anywhere you turn is another piece of art,” Martinez said later over the phone. “It was especially special to me because of the subject matter.”Hefocuses on telling the stories of agricultural workers, something he connects to because of the time he spent as a field worker in Washington state, which is how he put himself through both undergraduate and graduate school. Even though he was at a different place in life than most of the people he worked alongside, Martinez said he felt like they were all connected, working under the same sun and saving money to make their lives better.“Luckily, I was able to finish school and I don’t have to go back to the fields. But I feel like these people deserve some sort of recognition,” Martinez said. “So I just take these stories to different audiences, so they can—at the very least—acknowledge how our food gets to our tables.” While he was in Oceano, Pearson introduced Martinez to some local labor organizers, who in turn put the artist in touch with Oceano-based farmworkers they had helped. One such person, Don Audelio, worked in the fields for 40 years and is now retired. He told Martinez his story and demonstrated how he used to pick lettuce, pack it, and carry it to the truck. Audelio’s face now peers out from a produce box flattened against the wooden wall next to Badiali’s tomato-colored ape. Martinez used charcoal and paint on cardboard bearing the Pismo-Oceano Vegetable Exchange logo to capture Audelio carrying a lettuce box in shades of black and white.

Jean Smart and Hannah Einbinder are comedy gold in this HBO series that follows the aging career of stand-up comedian Deborah Vance (Smart) and her new writer Ava (Einbender) as they try to reinvigorate Deborah’s career after she loses her Las Vegas residency. Whip smart and with genuine humor, this dynamic duo has a love/hate relationship. They can’t stand each other most of the time, but they also know they’re better together. Ava is pushing Deborah to create new material, to talk about her past that has been both exaggerated and vilified by audiences over her Startingcareer.over at 60 isn’t easy, and while Deborah has all the wealth and possessions she could ever need, she’s lacking when it comes to human connection. She is prickly and a little bit hard to love, but beneath the thorns lies a true, human heart that is searching for love and acceptance just like the rest of us. This series is seriously a mustwatch! (18 26- to 35-min. episodes)—Anna
Attorney Liv has to get home come hell or high water. When she convinces two guys to let her hop on their private flight, she has no idea what she is in for. The men aren’t who they say they are, and when the plane crashes into a remote body of water surrounded by miles and miles of forest, she soon realizes that no one is coming for her—and if they are, they won’t be looking to save her.
If you’re a computer-generated lion whose entire pride is slaughtered by a group of evil but nondescript poachers, the obvious thing to do is go on a murderous rampage killing every human being you encounter, right? And if you’re a doctor and recent widower whose two daughters blame you for their mother’s death to cancer through your neglect and absenteeism, the obvious thing to do is take them on a trip to their mother’s homeland in Africa for a wildlife safari with an old friend, Martin Battles (Sharlto Copley), a game warden whose reserve is plagued by poachers, right? That’s the setup for Beast, an implausible but rollicking story that wears its B-movie heart on its sleeve. The older daughter, “Mer” (short for Meredith), is wallowing in teen angst and is super pissed at dad, while younger daughter Norah is more willing to get the family back together, so when Martin takes Dr. Nate and the girls out for a look at the part of the reserve (ominously) closed to tourists, with no cell service, and where even radio signals are spotty, what could go wrong? Um, everything? Yes! Anna I saw an ad for Beast that had Idris Elba looking right into the camera and saying, “There are three reasons to see Beast: action, adventure, and moi.” OK, Idris, calm it down. While this fi lm technically has action and adventure, that fact alone doesn’t make it good. We’ve got two young women grieving the loss of their mother to cancer, the oldest super bitter toward her “I’m too busy and important being a doctor” dad for breaking up his marriage before her mother’s illness. There’re the poachers and the lion and very busy and important doctoring work to do. Hey, fi lmmakers? You’re doing too much! Adding more ingredients to this mess of a soup isn’t going to save it! Beast is simply the last half of Cujo, but unlike Stephen King, the writers here gave us nothing in these characters to care about. I mean, I’m all for families healing trauma and working through their difficulties, but must we do it only when giant claws and razor-sharp teeth are threatening us? This premise is way too simple and yet somehow made overcomplicated. Glen Without the processing of a lot of complicated emotions amid the indiscriminate animal attacks, there wouldn’t be much of a story here, but you’re right. The fi lm tries to do too much. Dr. Nate, when he gets a moment to sleep (or passes out from his many claw and teeth wounds), dreams of his dead wife’s tribe in their tribal regalia, looking wise and noble and stuff. I think it’s supposed to add some soul to the story, but it seemed like a distraction that didn’t go anywhere. I had sympathy for Martin, Nate, the girls, the slain villagers, and the poached lions, but the story turned the main aggrieved lion into a devil, which didn’t seem very realistic. And hey, Idris, you’re a badass and all, but when you fight a lion with a knife and don’t die in the fi rst 60 seconds, I’m calling BS. Also, special effects department, blood seeps through bandages—don’t paint fake blood on top. Look, if you like dumb B-movies and/or Idris Alba, get thee to a theater. It’s your money. Anna There were defi nitely some moments that just felt plain lazy. Quite frankly, I would bet good money that a few pages of that script just said “panicked nonsensical dialogue.” There was more than one occasion when I found my head shaking and mouthing “what?” at the screen. It’s a 90-minute movie, and I’m grateful they didn’t try to drag it out any longer. As is my style, I was more interested in siding with the “evil” lion. That dude was just plain hurt and misunderstood. Plus, humans kind of suck a lot of the time, and poachers suck basically all of the time! I like Elba and Copley as well as the two young actresses, but there just wasn’t a whole lot of meat on these bones for any of them. To me, this fi lm is better saved for a watch at home when you’ve exhausted your “to watch” list. It’s OK, and that’s about the nicest thing I can say about it. At the end of July, I was lucky enough to attend a Moonshiner Collective outdoor show at Tolosa Winery, and it was one of those magic Central Coast nights where we were treated to a glorious sunset as multi-instrumentalist singer-songwriter Dan Curcio led his band—drummer/ percussionist Ryan House and eightstring guitarist Gary Wooten—through their paces. Curcio has a warm, distinctive voice, and all three members are monster players. This is Cali-folk-pop at its Thisfinest.

The showman Brooks Nielsen is best known as co-founder and lead singer of Southern California surf-psych act The Growlers, but with the release of One Match Left, his debut solo album, he’s reinvented himself as a “carnival barker, lullaby crooner, and rock ’n’ roll priest,” as his bio reads. Indeed, his ambitious 20-track project—currently available on cassette and digital download and accepting preorders for a vinyl double-album shipping in January—is a diverse mix of songs laced with comedy and tragedy. “There’s happiness in there,” Nielsen said in press materials. “The bands that I like have a sense of humor, like Television Personalities or Jonathan Richman, but there’s tragedy too. While the Pau Hana offers a more laidback atmosphere, Pono hasn’t forgotten its original reason for being: a more upscale dining experience, according to Annie Steil, Pono’s marketing and floor manager.“There is a tremendous need for fine dining here, and that’s something Ashlee and Preston noticed. They’ve lived in this area, worked in this area; we’ve all been in the restaurant and hospitality industry for a couple of years. Ashlee and Preston recognized the need and wanted to provide that for the community,” Steil said.
The main menu includes fan favorites, like the fried chicken and caviar. Dive into crunchy deboned chicken resting atop a bed of fragrant garlic fried rice and drizzled with kimchi aioli. The elevated surf ’n’ turf option includes briny pops of salmon roe placed in ruby red dollops over the chicken. It’s Tripp’s favorite item to cook. Alewine and Steil are partial to the seafood. Alewine loves the macademiacrusted mahi mahi—a generous slab of golden-brown fish slathered in a Thai peanut vinaigrette and mango salsa, seated on black forbidden rice. It’s fresh, light, and a true call of the tropics. “My favorite is the misoyaki butterfish. It’s a Central Coast catch, too. Butterfish is black cod. For the appetizer, there is a ton of love for the duck confit spring rolls. We probably sold 30 or 40 of those last night. The beef tartare with sea urchin is beyond incredible,” Steil said recently. Pono holds a coveted position when it comes to sourcing its uni (sea urchin). Working in the restaurant industry since he was 15, Tripp’s networking skills landed his kitchen the chance to receive a daily supply of sea urchins from Santa Barbara.

Hawaii-happy partners Preston Tripp and Ashlee Alewine felt compelled to bring an edible piece of the tropical Pacific Rim to San Luis Obispo County. An award-winning chef, Tripp conceptualized and whipped up dishes for restaurants from California to Oahu, Hawaii. Alewine’s Central Coast roots brought the couple back to the Five Cities—the place where they first met and now run Pono Pacific Kitchen in Grover“ThisBeach.hasalways been home for the most part for me. So moving back here seemed natural,” said Alewine, who runs Pono’s business side. “You’ll notice on the menu the inspiration taken from everywhere he’s [Tripp] lived, taken things from different restaurants that he has helped do menu consultations and creations with. I know there’s not another Pacific Rim in SLO County.” The Pacific Rim spans the lands surrounding the Pacific Ocean that include countries from Asia, the Americas, and of course, Hawaii. Pono’s menu reflects Tripp’s riff on theForRim.starters, there’s the Special Pau Hana menu that hungry visitors can tuck into from 4 to 5:30 p.m. Wednesday through Sunday. Alewine calls it a casual dining experience at the bar and (dog-friendly) patio—Pono’s “Hawaiian happy hour”—that serves up small plates different from the usual menu and knocks off $2 from draft beers and wines by the glass. Dig into dishes like the Pono Papas Bravas, a crispy fingerling potato, shichimi, and kimchi aioli medley; the spicy tuna crispy rice cake; and buttery garlic chargrilled oysters with asiago. “It’s a hang out, relax, and take a breath after work, get to know your neighbors [event] where you sit on a gorgeous patio and hear the waves in the background,” Alewine said. The ocean sweeps across Pono’s interiors too. Airy and sunny thanks to its open plan and big windows, the inside is resplendent with turquoise swatches, wood detailing, and cream and sunset orange accents. It echoes the serene meaning behind the word “pono”—living righteously and in perfect balance with all the elements around you.

“We have a lot of [wines from] Santa Barbara, Santa Maria Valley, and Santa Ynez. Most people go Paso, and I was all, ‘Let’s do something different.’ We of course have a ton of Paso wines. But when developing the wine list, I thought, ‘When I go tasting, where do I go? Edna Valley, Los Olivos, Santa Ynez.’ So I kinda reflected that in my wine list,” Alewine said. Alewine told New Times that 95 percent of the sea urchins that are fished in Santa Barbara are shipped to Japan, making Pono part of the enviable 5 percent. Tripp’s connections also gained Pono another signature ingredient: ahi straight from Hawaii. But a lot of the restaurant’s bounty comes from closer to home. They get bread from Grover Beach Sourdough next door. The team explores the Arroyo Grande Farmers’ Market on Wednesday mornings where they regularly purchase from Chavez Farms, Hayashi Farms, Righetti Ranch, and Harris Ranch. Alewine and Steil said they have an extensive wine program, too, where they feature local wines.

WHAT: Hearing to consider a request by Brad Boulton for a Vesting Tentative Parcel Map (SUB2017-00039 / CO 17-0227) to subdivide an existing undeveloped 10.01-acre parcel into two approximately 5-acre parcels for the purpose of sale and/or development. Each resulting parcel will have a designated building envelope which could support a primary residence, accessory structures and supporting appurtenances. Both parcels will be served by an existing shared well. Improvements include the construction of a shared driveway and a 24-foot-wide access road serving a single building site on each parcel. The project will result in a total disturbance area of approximately three and one-half (<3.5) acres, including 4,500 cubic yards (cy) of cut and fill. The project includes a request for an adjustment to the County’s Title 21 Real Property Division, design criteria, to allow for an exceedance of the maximum ratio of parcel depth to parcel width. The project site is located at 1688 Old Oak Park Road, approximately 1.5 miles north of the City of Arroyo Grande within the Residential Rural land use category. The site is in the San Luis Bay Inland Sub Area South of the South County Planning Area. Also to be considered at the hearing will be adoption of the Environmental Document prepared for the item. The Environmental Coordinator, after completion of the initial study, finds that there is no substantial evidence that the project may have a significant effect on the environment, and the preparation of an Environmental Impact Report is not necessary. Therefore, a Mitigated Negative Declaration (pursuant to Public Resources Code Section 21000 et seq., and CA Code of Regulations Section 15000 et seq.) has been issued on July 28, 2022, for this project. Mitigation measures are proposed to address Aesthetics and Visual Resources, Air Quality, Biological Resources, and Geology and Soils, which are included as conditions of approval. WHAT Hearing to consider a request by Ormonde Properties and DISH Wireless for a Conditional Use Permit (N-DRC2021-00006) to allow for the construction and operation of a new wireless telecommunications network facility consisting of six panel antennas, twelve remote radio units (RRUs), 3 surge suppressors, and associated equipment and hardware mounted on a 60-feet tall faux broadleaf tree (faux tree monopole). The proposed faux tree monopole and equipment area would be located within a 314-square-foot area. The proposed project would result in the disturbance of approximately 980 square feet (including utility trenching and access road improvements) on a 3-acre parcel. The proposed project is within the Commercial Service (CS) land use category and is located at 80 Wellsona Road, north of the city limit of Paso Robles.
