GENERAL RULES AND REGULATIONS

ABSOLUTELY NO PETS ALLOWED AT THE SALE 1. When the gavel falls, whoever holds the last bid is the owner of the item or the owner of the horse. The purchaser assumes all the risk and expense incurred after the fall of the auctioneer’s gavel.

2. Checks to consignors will be mailed by the 10th business day following the sale. 3. All sales payable in U.S. currency or equivalent. NO exceptions. All foreign currency will have the current exchange rate applied. 4. If you are due $5 or less after commissions are deducted from the sale of your items, you will NOT be issued a check. 5. All returned checks will be charged $50.00. 6. We accept VISA, Mastercard, Discover and American Express as payment. A 3% processing fee will be added to the total charge when this method of payment is used. 5

RULES & REGULATIONS - TACK & EQUIPMENT

1. All tack & equipment should be in clean and presentable condition. Tack & Equipment will be sold as is. 2. Tack and equipment consignments will be accepted until 11:00 AM on Thursday, October 7, 2021. 3. The sale committee reserves the right to refuse any tack and equipment it deems unsuitable and ask that it be removed from the sale grounds. 4. Vehicles and trailers offered for sale must have a clear title. 5. ‘NO SALES’ WILL NOT BE ALLOWED. Bid-ins will be charged 20% of the last bid; with a maximum charge of $100. 6. Tack and equipment commission is as follows: If your proceeds total:

7. If you are due $5 or less after commissions are deducted from the sale of your items, you will NOT be issued a check.

RULES AND REGULATIONS – HORSES 1. NEGATIVE COGGINS ON ALL ANIMALS WITHIN THE CURRENT CALENDAR YEAR (2021) REGARDLESS OF AGE INCLUDING FOALS. INTERSTATE HEALTH PAPERS ARE REQUIRED ON ALL OUT OF STATE HORSES. PROOF OF RABIES VACCINATION ADMINISTERED IN 2021 PRIOR TO ARRIVAL AT THE SALE. ALL PAPERWORK MUST BE IN THE ORIGINAL FORM --PHOTOCOPIES WILL NOT BE ACCEPTED.

2. The Sale committee has the right to reject any animal it deems unsuitable and ask that it be removed from the sale grounds. 3. Horse consignments will be accepted until 11:00 AM on Friday, October 8, 2021. 4. Commission for non-catalogued horses will be 7%. Commission for catalogued horses will be 5%. 5. Bid-ins will be charged 10% of the last bid with a maximum of $100.00. 6. Each consignor makes his own guarantee in writing. 7. Cataloging fee of $25 per horse, refunded in your commission. No shows will forfeit the fee. A photocopy of the registration must accompany each cataloged registered consignment. 8. Consignor must furnish ORIGINAL registration papers and signed transfer blanks on all registered horses, INCLUDING FOALS, on the day of the sale, or they will be sold as grade animals. NO horse will sell as eligible to be registered or registration pending. a. Consignor will pay all transfer fees on registered horses. b. Consignor to pay service fees on all bred mares. 9. All cataloged horses will sell in order not before 10:30am, followed by the remainder of non-cataloged draft horses & draft ponies, then the driving horses, followed by the saddle horses and ending with the ponies & minis. Uncataloged horses will begin selling at 10 am. If your horse is consigned AFTER your category has finished selling, your animal will be sold at the end of the auction. 8


10. A ten ($10.00) non-refundable consignment fee will be charged on all non-cataloged horses. 11. NO substitutions for cataloged horses. 12. Consignors are responsible to get their own horse in the sale ring 13. A good halter and lead rope will be on each horse or will be supplied and the cost added to the commission of the consignor. 14. Stalls and bedding furnished on a first come, first served basis. Hay will be available to buy. 15. All horses that have already been consigned must be in the barn by 9:45 AM on sale day. 16. Once a horse is sold it needs to be returned to the barn until all paperwork is finalized. 17. NO horses shall be removed from the sale barn before noon on Friday; ALL horses must be removed from the sale barn before 12:00 noon on Saturday, October 9, 2021

Hitching: There will be a wagon available for hitching anytime on Thursday October 7, 2021 and Friday October 8, 2021 but must be completed by 9:30 am on Friday, October 8, 2021. Driving or riding will be permitted only in the horse arena.

Auction Ring: All horses consigned will go through the auction ring, no matter where you are on the draw list. There will be no pass outs for any horse consigned. Once you bring your horse in our sale barn, that horse must go through the auction ring. Anyone wanting to take their horse out before going through the auction ring will be charged $200 per horse, paid in cash, no checks accepted. We cannot sell all horses early – some have to be first and some last. 9

GUARANTEE Each owner or consignor will make known the guarantee or warrant he desires for his animal, and will be solely responsible thereon. Such a guarantee or warranty will be announced when and as the animal is offered for sale. The Sale committee reserves the right, at all times, to announce any unsoundness or other conditions it may observe. Neither the New York State Draft Horse Club, nor the Sale committee guarantees or warrants the condition or soundness of any animal offered for sale. If no such announcements are made, the animal will be sold; the buyer assumes full control, the responsibility and expense for the animal immediately upon the fall of the auctioneer’s gavel. No statement of warranty of seller and/or the Sale committee shall be subject to challenge or question. NOTICE By consigning any item for sale at auction, the consignor guarantees that the items consigned are the sole property of the consignor, free and clear of all liens or mortgages of any kind whatsoever, and that the consignor has the full authority to sell and convey the items unto any potential buyer. The consignor agrees that neither the New York State Draft Horse Club, the auctioneer, nor their officers, employees or agents is responsible for the care or security of the consigned items, either before or after the items are sold by the auctioneer. By consigning any item or items, the consignor releases, and agrees to defend and indemnify the New York State Draft Horse Club, the auctioneer, and their officers, employees and agents from all liability whatsoever resulting from the theft, vandalism, fire, or other circumstances causing damage or loss to any items consigned

Civil conduct is EXPECTED from EVERYONE attending the sale. Anyone not conducting themselves in an appropriate manner may be asked to leave or will no longer be allowed on sale grounds, some conduct may result in being banned for an extended period of time as deemed by the sale committee. Everyone is cautioned to exercise care while attending the sale. All persons entering the premises during the time of the sale do so at their own risk. The New York State Draft Horse Club Sale and all members of the Sale Committee shall not be liable for any injury sustained by anyone attending the sale. All persons entering the grounds upon which the sale is held expressly release the New York State Draft Horse Club and all members of the Sale Committee from any liability or responsibility of injury sustained by them during the attendance of said sale. The New York State Draft Horse Club and the Sale Committee shall not be liable for any cause of action of any kind or nature arising from the sale of said horses.
