FAA’s new drone rule huge win for real estate industry License will be mandatory but becoming certified will be much less complicated
Commercial drone use in the real estate business got a boost in June with the release of the Federal Aviation Administration's final rule governing small unmanned aerial systems, or UASs, in the national air space. Drones are increasingly being used in commercial applications, but federal regulations have required commercial drone operators to apply for a "Section 333" waiver from the FAA before they can fly. Over 5,000 waivers were issued to commercial entities, a significant portion of which were used

FAA's announcement The marks a long-fought victory for the National Association of Realtors. Since early 2014, NAR has worked with the FAA and industry partners to integrate drones into the national airspace for commercial use. NAR wrote to the FAA on numer ous occasions to weigh in on the final Small UAS Rule, and testified before Congress to support the use of drones in real estate. Despite eliminating the requirement that operators hold a pilot's license, anyone looking to fly drones commercially will still have to comply with strict requirements designed to protect people on the ground. Drones are useful in a number of real estate-related applications, including marketing properties, assisting with appraisals, facilitating insurance claims and overseeing utility work. While many real estate professionals with pilot's licenses have already put drones to use in these arenas, the new rules are expected to open the door for additional operators
to do the same. Despite the significant progress made in the FAA's final rule, NAR's work on this issue will continue. NAR is calling for eased restrictions on a "micro" category of drones; drones in this category weigh less than four and present a much pounds smaller safety risk than certain drones in the pound category covered by under-55 the rule released today. there is an ongo NAR also believes ing need for a drone strategy that al lows for "beyond visual line-of-sight" flights, or those where the operator cannot physically see the drone throughout operation. the entire These flights are particularly important for aerial photography across large buildings or tracts of land. Brexit vote could send rates lower on fixed-rate mortgage Brexit, the shorthand term for the British vote to pull out of the European Union, has roiled the financial markets around the globe and that includes the possibility of even lower mortgage rates in this country. Already hovering at a three-year low, at a national average of 3.73 percent for a 30-year fixed rate mortgage, according to Bankrate.com, mortgage rates are expected to react to investor uncertainty as the Brexit controversy continues. Mortgage rates tend to move in the same direction as U.S. Treasuries, Bankrate.com reported, and the speculation now is that the yield on treasury notes will fall below the 1.47 percent they were the last week of June. If that already sounds complicated, it gets worse. Also part of the equation are the laws of supply and demand as well as what the Federal Reserve does with interest rates. Although a slight increase in the fed rate was seen as possible by the fall, economists are now saying that December is more likely, and that assumes that the economy is strong enough to warrant it. In the meantime, investors who have put their money in British markets are now looking for a safe haven for their
money, and at the moment nothing is safer than U.S. treasuries. "Mortgage rates will tumble," Greg McBride, chief financial analyst at Bankrate.com, told Realtor Magazine, "possibly hitting new record lows. If you're a borrower, don't wait to lock in your rate, as this opportunity may not last long." However, Realtor Magazine also reported that Fannie Mae Chief Economist Doug Duncan said low rates because of economic uncertainty could last for a while. Bankrate mortgage survey Mortgage rates rebounded modestly the last week of June, with the benchmark 30-year fixed mortgage rate rising to 3.73 percent, according to Bankrate.com’s weekly national survey. The 30-year fixed mortgage has an average of 0.19 discount and origination points. The larger jumbo 30year fixed erased last week’s move, returning to 3.71 percent, and the average 15-year fixed mortgage rate bumped up to 2.97 percent mark. Adjustable mortgage rates were mostly higher, with the five-year ARM inching higher to 3.06 percent and the 10-year ARM climbing to 3.44 percent. After falling for three weeks in a row, mortgage rates reversed course and posted modest increases as ten-
sions in financial markets about the looming Brexit vote eased somewhat. Investors hate uncertainty and rates had been driven down as nervous investors clamored for the safety of U.S. government bonds. Mortgage rates are closely related to the yields on long-term Treasuries. But stock markets around the globe staged a relief rally, as investors sensed that the United Kingdom would remain in the European Union. The vote, however, went the other way, leading Bankrate to forecast a renewed bout of market volatility that would push mortgage rates back down. At the current average 30-year fixed mortgage rate of 3.73 percent, the monthly payment for a $200,000 loan is $923.96.

May sales nationwide show significant upsurge Student loan debt seen as reason for underperforming share of first-time buyers Existing home sales sprang ahead in May to their highest pace in almost a decade, while the uptick in demand this spring amidst lagging supply levels pushed the median sales price to an all-time high, according to the National Association of Realtors. All major regions except for the Midwest saw strong sales increases last month. Total existing-home sales, which are completed transactions that include single-family homes, townhomes, condominiums and co-ops, grew 1.8 percent to a seasonally adjusted annual rate of 5.53 million in May from a downwardly revised 5.43 million in April. With last month’s gain, sales are now up 4.5 percent from May 2015 (5.29 million) and are at their highest annual pace since February 2007 (5.79 million). Lawrence Yun, NAR chief economist, says existing sales continue to hum along, rising in May for the third consecutive month. “This spring’s sustained period of ultra-low mortgage rates has certainly been a worthy incentive to buy a home, but the primary driver in the increase in sales is more homeowners realizing the equity they’ve accu-
mulated in recent years and finally deciding to trade-up or downsize,” he said. “With first-time buyers still struggling to enter the market, repeat buyers using the proceeds from the sale of their previous home as their down payment are making up the bulk of home purchases right now. “Barring further deceleration in job growth that could ultimately temper demand from these repeat buyers, sales have the potential to mostly maintain their current pace through the summer,” he added. Surpassing the peak median sales price set last June ($236,300), the median existing-home price for all housing types in May was $239,700, up 4.7 percent from May 2015 ($228,900). May’s price increase marks the 51st consecutive month of year-over-year gains. Total housing inventory3 at the end of May rose 1.4 percent to 2.15 million existing homes available for sale, but is still 5.7 percent lower than a year ago (2.28 million). Unsold inventory is at a 4.7-month supply at the current sales pace, which is unchanged from April. “Existing inventory remains subdued throughout much of the country and continues to lag even last year’s deficient amount,” Yun said. “While new home construction has thankfully crept higher so far this

According to Freddie Mac, the average commitment rate for a 30year, conventional, fixed-rate mortgage inched backward from 3.61 percent in April to 3.60 percent in May, which is the lowest since May 2013 (3.54 percent). The average commitment rate for all of 2015 was 3.85 percent. Properties typically stayed on the market for 32 days in May (39 days in April), which is below a year ago (40 days) and the shortest time since NAR began tracking in May 2011. Short sales were on the market the longest at a median of 103 days in May, while foreclosures sold in 51 days and non-distressed homes took 30 days.
