The Second Amendment of the United State Constitution provides: "A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.” With strong 2A rights woven through the fabric of Oklahoma values and now 6% of Oklahomans having acquired their medical marijuana patient license, it’s critical to notice that the 2A rights are stripped from licensed medical marijuana patients due to existing laws. I. Recent Changes in Oklahoma Patient and 2A Rights In March 2019, HB2612 (the “Unity Bill”) went into effect, expanding patient protections and providing: “A medical marijuana patient or caregiver licensee shall not be denied the right to own, purchase or possess a firearm ammunition, or firearm accessories based solely on his or her status as a medical marijuana patient or caregiver licensee.”

In Oklahoma, firearms dealers must initiate the background check required by federal law by contacting the FBI directly. Private sellers, however, are not required to initiate a background check when transferring and/or selling a firearm.

To comply with the Act, an applicant must answer application questions honestly and comply in good faith with the Act, which would include responding honestly to the questions posed on the application. Due to the present State and federal laws surrounding cannabis, an applicant who answers “yes” to the question “Do you unlawfully use, or are you addicted to, any controlled dangerous substance?” will be denied their handgun license by OSBI. The application specifically warns applicants that marijuana is a Schedule I controlled dangerous substance under federal law, and medical marijuana patient license holders should answer “yes” to unlawfully using a controlled dangerous substance which may ultimately preclude such individual from handgun licensing federally and in the State of Oklahoma. Any person making any false or misleading statement on an application for a handgun license will be denied and shall, upon conviction, be guilty of perjury. The Bureau of Alcohol, Tobacco, and Firearms (“ATF”) provides that any federal firearms licensee whom uses marijuana, regardless of whether his/her State passed legislation authorizing medical marijuana, is an unlawful user of a controlled substance and is prohibited by federal law from possessing firearms or ammunition. A patient may reside with a handgun licensee as federal law prohibits the patient from having possession of firearms. A person whom has been adjudicated as a mentally incompetent is generally disallowed from handgun licensing eligibility. Other mandatory health preclusions to Oklahoma handgun licensing include: “An attempted suicide or other condition relating to or indicating mental instability or an unsound mind which occurred within the preceding ten-year period from the date of the application for a license to carry a concealed firearm or that occurs during the period of licensure”, and if a person is “currently undergoing treatment for a mental illness, condition, or disorder”, meaning the person has been diagnosed by a licensed physician as being afflicted with a substantial disorder of thought, mood, perception, psychological orientation, or memory that significantly impairs judgment, behavior, capacity to recognize reality, or ability to meet the ordinary demands of life. We should note that because patient records are confidential and afforded protections, OSBI and the FBI are unable to determine whether a person’s physician recommended medical marijuana due to such person’s mental health afflictions or symptoms like the ones listed above, which would preclude handgun licensing. Looking forward, patients will likely have to decide whether their handgun eligibility is worth disclosing necessary physician recommendation records to prove mental capacity. Until changes are made, Oklahomans will continue to have to navigate their patient and 2A rights and ultimately, choose between licenses.

On February 6th, patients, business owners and advocates from across the state turned their attention once more to the Capitol in Oklahoma City, and with good reason: despite the success of the medical cannabis industry in the almost two years since S.Q. 788 passed, there has still be a significant effort within the legislature to make it more difficult and more expensive to open a cannabis business, limit where patients can medicate in public, and more. It’s become apparent to pretty much everybody who’s involved in the industry and community that the opposition has no plans to simply give up without a continued fight, and while it’s a slap in the face to many, it’s also brought out that determination that the canna-community is building a reputation for. That determination was in full force on that Thursday. Despite the poor weather the day before and the low temperatures that still lingered, people came. Despite the traffic, the bad parking, and the long drive for many, people came with signs, with shirts, and with their stories.

Even Ron Durbin, an Oklahoma attorney known for his staunch commitment to the cannabis industry and community here as well as an organizer of this event along with Darrel Carnes and the help of others, didn’t let a recent health problem stand in his way (once he’d been cleared by his doctor, of course). Every person with their own reason and story that brought them there, and every person eager to come together for further progress, hundreds of Oklahomans came to make one thing clear to the legislature: we’re paying attention. Before State Question 788 passed, any gathering of procannabis people like this would have been laughed off with a sneer; typical ‘potheads’ just trying to get high without getting in trouble. Sound familiar? It’s a stereotype that every one of us has likely battled in one way or another over the years, and it’s part of how the cannabis community has been kept down over the years. Now, with the freedom that 788 brings to card holders, that crowd of protestors and activists can no longer be simply brushed off as a group of stereotypes or criminals. The people carrying signs and wearing shirts in support of cannabis were coworkers, family members, friends, and community members, working together to support something that is open to anyone who takes the time to get a medical card, and has been a life changer, and saver, for thousands.

The bills being protested, that day and beyond, are substantial ones that could have lasting impacts on the industry. One of them, that has since been withdrawn, would have increased licensing fees for those interested in commercial growing, processing, or dispensary licenses from $2,500 to $10,000. Another would prevent dispensaries from being located near churches, and another still would give cities and towns more power to regulate marijuana businesses in their city limits. These are just a handful of examples of some of the thirty or more bills that have been brought forward this year, and every one would impact patients and businesses alike. It’s become clear that many within the legislature are no friend to the cannabis industry or the patients themselves, and it’s apparent that for these opponents of cannabis, the current medical cannabis law isn’t harsh or strict enough for their liking. Once, they could have silenced any further whisper of medical cannabis and moved on to other topics, but that determination that pushed 788 through with a 57% vote has taken root and grown into a fierce line of defense for cannabis in Oklahoma. Whether it’s in marches on the capitol, at town hall or city council meetings, industry gatherings or even just through various forms of social media, cannabis patients, industry members and supporters have become incredibly vocal about their views and their rights in regards to using cannabis for their health.
Once, it was considered taboo to even whisper about it among friends in public. Now? Not only is it discussed, it’s often celebrated; people are not only stepping out of the cannabis closet, but they’re tearing the walls down to open it up to the world. It’s not uncommon to see videos of people trying out a bong for the first time on Instagram, or a snapshot of somebody with their first batch of edibles on Facebook. It’s becoming normalized in a way that opponents never expected, and that normalization is what fuels things like the March on the Capitol: people are finally dropping the shame they’ve carried, and they’re picking up signs, and petitions, and educational booklets, and they’re taking action to protect their hard-earned rights as cannabis patients. More than likely, this batch of bills that inhibits a thriving cannabis market won’t be the last set we see of this nature here in Oklahoma. Two years in, the opposition shows no sign of letting up, and the good news is, neither does the cannabis industry and community. The strongest defense we can put up against those who continue to oppose cannabis regulation and medical programs is a united community and industry; we’ re far easier to divide and conquer if we’re at odds with ourselves. The March on the Capitol is a shining example of the things that can be achieved when we’re united, as we were during the final push to pass 788, but it could also become a reflection of what once was if discord and disagreements continue to run rampant through the community. We’ve come so far, and now is the time to show that we’re still in this for each other, not just ourselves.

Spring is finally here and not a moment too soon. After a long winter and what felt like weeks of assault on your finances and sanity, the holidays (and most of the miserable weather) are finally behind you. It is time for rebirth‌ for growth. You can smell the fresh, cool soil as the grips of winter release their hold on the earth. The sun is warm, radiant, and not yet trying to blister your skin. There are small, bright buds popping up on plants everywhere you turn. Birds are whistling out odes to the sky and you want in on this party too. Why not launch a cannabis garden in your backyard?
Gardening hobbyists and novices alike can utilize this new, fertile earth and brilliant sunlight to cultivate a cannabis garden to be proud of with just a few simple steps. There are some key factors to keep in mind when growing cannabis and with a little guidance, your homegrown meds are sure to bring you a personal satisfaction that no storebought medication could ever provide. There is something spiritual about growing cannabis. Watching the seedling burst its apical taproot and meristem feels like watching a complicated magic trick in person. Tilling your soil gives you a connection to the earth, something we all need more of, as well as an honest workout.
Pruning and shaping your plants to maximize yield provides hours of meditation that are unparalleled, just add music. Oh, and that sweet harvest this fall? That’s unadulterated pride right there.

The two components you are going to need to put the most effort into are soil and water. It cannot be stressed enough that you need healthy soil and clean water. You don’t have to spend a fortune and you don’t have to get very complicated with it. After that, you might need some pot food, a couple good gardening tools, some cannabis seeds or clones, and some sunblock. First things first though: where to plant. This factor depends on what you are growing. There are two choices in this decision tree, auto or photo? Autoflower varietals will produce buds no matter where you plant them. They are essentially the plug and play option for cannabis growers. They grow as they flower and produce smaller yields because their life cycle is limited. They can be pushed to provide marginally more flower when they get tons of light but these plants will not get beasty, which might be the perfect fit for your growing space. Photoperiod plants require a little more attention but can produce plants with colas as big as your forearm, giving you plenty of meds to smoke or process into edibles or salves. Getting these plants into the soil in early spring will allow you to grow large plants with max yields. Photoperiod plants growing outdoors are triggered into flower by extended periods of dark. As the earth orbits the sun, the tilt of the earth moves into position so that the lower hemisphere is closer to the sun which causes the northern hemisphere to receive less light from the sun. As soon as your happy plants realize that they are getting twelve or more hours of dark, they begin to produce nodes that will eventually become that stinky flower you love so much.
If you are planning to grow photos, it is important to pick a spot outside that gets maximum sun well into the fall. Be conscious of how plants and structures in your yard cast shadows in the late summer and fall. You want your outdoor cannabis plants to get as much sunlight as possible during the day right up until you harvest them in order to maximize their production. Depending on the varietal, your outdoor cannabis plants will begin to flower sometime in August or September and develop into October and maybe even November. Shade that covers them can slow their growth and reduce yields and trichomes - the sticky sunblock that carries cannabinoids and terpenes to the buds. From experience, strong shade can even trigger your plants into flower. You’ve picked a sunny spot in your yard and the danger of winter frost is firmly behind you, now what? The answer is dig. Put on sunblock first then dig a decent hole in the ground and keep the soil – you’re gonna use it. Depending on the size of the root mass of your plant, your hole is going to vary. Dig the hole to be roughly six inches wider than your existing pot in every direction. Take the native soil and amend it with a few scoops of quality soil from your local hydro shop. Don’t use MiracleGro, it’s not ideal and is not cheaper or worth the potential burn to your plants. If you want to ensure healthy plants, mix some compost, guano, and castings into your soil. What are guano and castings? Bat and worm poo; you can get them from the hydro shop. Cannabis loves this shit! Grab some pulverized oyster shell and you are ready to rock out with your crop out. That was bad. I am sorry (not really). As soon as you transplant your precious cannabis plants into their new homes, they are going to need a drink. The holy trinity of cannabis is light, soil, water. Poor water will cause low quality bud. Don’t trust the city works department to give you clean water unless you would like to gamble with heavy metals, pH problems, or bacteria.

I have been traveling the United States since 2018. My exploration of Cannabis has been quite interesting. Out this way, in WA and OR, there are signs posted in parking lots: “$1 Joints” and/or “$12 Eighths”. Traveling through CO, I saw: “7a9a Early Bird Specials”. The one thing that I have noticed, consistently, is competitive pricing. Well, in all states except NV and CA- because the truth is: CANNABIS IS EXPENSIVE AS HECK IN THOSE STATES. In OK, there are over 2,000 dispensaries- more than the state of CA! How does a consumer choose the dispensary to shop at? Cannabiz, a Cannabis media company, says that: “California’s population is ten times the size of Oklahoma’s! This translates into one dispensary for every 2,356 people in Oklahoma versus one for every 67,972 people in California.”

Perks Program
So, is pricing the only way to remain competitive? It’s not! Pricing is important but there are multiple factors to consider. Let’s get into other ways to remain competitive in this booming industry.
Everyone loves perks! Your customers would appreciate a program that allowed them to benefit from their purchases. Through these programs, dispensaries can offer rewards for regular customers, special discounts, and free items with purchases. Not only that, vendor and/or farmer days- where customers can engage with local vendors and growers whose products are on dispensary shelves.
Products and Merchandise Options Does your dispensary cater to your local market? It’s important, like any retail operation, that your shelves/cases are stocked with products and merchandise that meet the needs of your local customers. Consideration; does your demographic prefer edibles over RSO? It would be a great idea to have more edibles options in your dispensary.
Online Presence It is 2020 and the screen reigns supreme! Is your business on any social media platform? Having your brand make a statement online will get customers in the door. The laws make this a bit difficult; Facebook and Instagram- wait Facebook is Instagram-no wait, Instagram is Facebook- ugh, let’s just say- Mark doesn’t like Cannabis.
Customer Service I am in dispensaries 3-5 times a week as a part of my work and because I’m a stoner. I will forget about the $12 gram if the service captures my attention. But let me be clear- $12 for top shelf. Less than the best for $12 a gram is not good service.
There has to be a balance found with marketing your Cannabis business and not having the platform police delete the dispensary account. Something to consider: don’t list prices and don’t use the words Cannabis and Marijuana.
I digress; customer service is super important. I want to laugh with my Budtenders. Learning and education can be fun. It helps when I can tell that they love their job (it also helps them love their jobs if they are being compensated fairly and have pleasant leadership), it makes my experience that much better.
Company Website Many times, consumers like to review the company website, prior to visiting the physical location. Sections that consumers are likely to look for when visiting a website: about us, products/services, location(s) and hours of operation, and the company blog. The site should definitely be user friendly and easy to navigate.

Cherokee Nation Protecting MMJ Patients WRITTEN BY KAYLA JOHNSON Oklahoma has made some incredible strides in the nearly two years since State Question 788 was passed by a majority vote. Many cannabis-based businesses have been welcomed warmly by their communities (while many others not, unfortunately), and with a massive number of patients in the state that rises daily, it’s safe to say that the Sooner State has gone green. However, due to the lingering federal illegality of the plant, members of Oklahoma’s many Native American tribes are still facing a ban on medical cannabis products and businesses on tribal lands, one that will, unfortunately, likely stick around until the federal government decides to get with the canna-program. However, that’s not stopping the Cherokee Nation from taking steps in favor of medical cannabis and protecting those who use it.
With approximately
11,000 employees in the state of Oklahoma, the Cherokee Nation is one of the largest employers here, especially in the northeastern part of the state. Yearly, the tribe’s economic impact on Oklahoma is substantial, with 2018 bringing in over $2 billion dollars.

The Cherokee Nation, along with the other tribes of Oklahoma, is an important cornerstone of Oklahoma and its history, and while their hands are tied for the time being in regards to cannabis due to the tribe receiving federal funding, they have also taken a step that many other large employers in the state have neglected to do: they fully protected their employees. Oklahoma is an at-will employment state, meaning in most cases, your employer doesn’t need to give you a reason for letting you go. It’s also a state that, even with medical cannabis legalized, has seen serious push-back against people with cards in certain jobs that could be labeled safety-sensitive. With these two factors, many people across the state, even with medical cards in hand, have a nagging sense of worry in the back of their minds that a change in company policy could suddenly have them jobless. For others, simply the fact that their employer has no policy explicitly offering job protection as a patient has been enough to cause sleepless nights. It’s been a topic of debate since medical cards were first distributed here, over what actions employers can take against employees with a card, and it’s one that the leadership of the Cherokee Nation has made its stance clear on. The Cherokee Nation changed their policy on January 15th to reflect the new green world: those currently working in Cherokee Nation jobs, and those applying for jobs, with a legal medical cannabis card face no consequences for a positive result for THC during pre-employment screening or other drug testing.
This shift in policy set a new precedent for employers to take note of; in one sweeping move, Principal Chief Chuck Hoskin Jr. brought the Cherokee Nation into the modern-cannabis-world as much as he was able to, and in doing so sent a message to every employee who benefits from cannabis: you are valued, not judged. What’s more, Principal Chief Hoskin Jr. also assembled a working group, with the sole purpose of studying how cannabis and hemp cultivation could benefit the tribe through health care, farming or commerce. While the results from this study aren’t expected until sometime in May, these small steps have the potential for large ripples. The Cherokee Nation is the largest tribe in Oklahoma, and the second largest in the United States; they’re one of the largest groups in the nation who receive federal funding, and while that does limit what they can allow on tribal land as far as cannabis products, they’re taking a firm stand against the federal government’s view of the plant as much as they can, drawing a green line in the dirt and standing behind those who choose cannabis.

It’s frustrating for me, as an outsider to the Cherokee Nation and other tribes, to see the federal government keeping tribal lands cannabis-free by extension. I can’t imagine how frustrating it is to be a citizen of one of these great Indian Nations and not being able to consume natural medicine, one that has a deep and powerful history with many tribes, in their own property. It gives me hope, however, to see the leadership of the Cherokee Nation taking a position that protects those who work for them, and to see them taking action to study how changing tribal law could prepare them for the opportunity to jump into cannabis when the federal position on cannabis is finally overturned. The federal change of cannabis from a Schedule I substance has been long overdue for all of us for decades now, but for the tribes who are left on the outs while the rest of the state moves forward with it, it’s especially past time to make changes.
Oklahomans have worked tirelessly for years to see medical cannabis get to where it is today, and it’s encouraging to see the work continuing to ensure the tribes of Oklahoma are able to benefit as well. State Question 788 was passed to help all Oklahomans, and until every part of the state allows patients to use their medicine of choice in their own home with the same protections as others, the job isn’t done. Principal Chief Hoskins Jr. has made impressive strides in relatively short order to keep the tribe in step with the times and ready for green opportunities to be available, and in doing so has forged a path for others to follow when the door is opened. Communities within tribal lands could benefit from new businesses as much as any other town in the state, and hopefully, as the Cherokee Nation’s efforts continue along with other tribes, that will become a reality.

LINALOOL As we navigate the exciting and ever-expanding cannabis world we find that terpenes are very beneficial in finding the perfect medicine for a particular medical patient's ailment. Terpenes have gained attention from the emergence of the “entourage effect.” This proposes that cannabis’ therapeutic benefits are improved by the addition of multiple cannabinoid compounds and terpenes found in a plant compared to single isolated cannabinoid it's own. Leafly.com has been quoted to say “It is now believed that terpenes directly affect brain processing by modulating the behavior of brain cells.” Even more of a reason to invest the time to look for the ones that fit you best.

OKLAHOMACHRONIC This month in our terpene series we will be discussing Linalool. This terpene is the most responsible for the recognizable marijuana smell with its spicy and floral notes. Besides in cannabis, Linalool is found in the plant kingdom in botanicals such as lavender, mint, cinnamon, parsley, cilantro, oregano, marjoram, wintersweet, and coriander. What’s interesting is that just like in those aromatic herbs, it has very strong sedative and relaxing properties. Were you aware that for centuries, lavender oil has been used to calm anxiety and relieve emotional distress—and Linalool is the reason? Linalool has the most powerful neuroleptic effect of all known terpenes. It has very useful antidepressant qualities of its own and also boosts the effectiveness of CBD in the central nervous system. Our nervous system is a system comprised of neurons, nerves, our brain stem, and our brain, which is very crucial to an understanding of the body as a whole. It seems essential that it bridges the gap between aspects of your brain and the rest of your body. So a combination of CBD and Linalool or finding them in the same cultivar has been found to have positive life-altering effects for people with nervous system issues, such as myself. CANNABIS AND TAXES For any business owner, tax season can be a bit of a headache. From hunting down pesky receipts to figuring out what you can deduct, or even just finding the time to sit down and go over everything, there’s a lot to keep up with. For those who own a cannabis-based business, it’s even trickier, because there are strict rules about what can be deducted as a business expense when your business is associated with a Schedule I substance. Chances are, if you’re in the cannabis business, you’re familiar with a tricky little IRS code known as 280E.
This is a federal statute that strictly forbids companies from deducting any business expenses that are associated with the trafficking of Schedule I or II substances.Since cannabis unfortunately remains firmly planted on that list, this means many traditional deductions are unavailable to cannabis business owners. For the history buffs out there, a lesson: 280E was created following a court case in 1982, in which a convicted cocaine trafficker asserted his right under federal tax law to deduct ordinary business expenses. The Reagan administration, where the ‘just say no’ attitude was born, took action to prevent any other traffickers from exploiting the loophole, and thus 280E was born.
While this bit of court history seems like common sense, the IRS code still applies to cannabis businesses, even if they are in compliance with their state’s laws. Most businesses get to deduct things that are fairly common sense: rent, electricity costs, employee salaries and the like. Cannabis businesses, however, are only allowed to deduct expenses that directly relate to making a profit, known as the cost of goods sold (COGS).

OKLAHOMACHRONIC Mistakenly deducting something or not being able to provide proper documentation significantly raises your chance of dealing with penalties or fees, and you run a high risk of being audited; just five years ago, MJBizDaily found that 6.3 percent of marijuana businesses were audited in 2015 versus just 1.4 percent of average businesses. The stakes are high, and so is the pressure for many. Many of the cannabis-friendly accountants and tax services here in Oklahoma are becoming exceedingly busy as the tax deadline creeps ever closer, and while time may be running out to make changes for 2019’s taxes, there’s no time like the present to begin preparing for a smoother experience next season as well. I spoke to two accounting and bookkeeping services here in Oklahoma, to bring you information straight from the horse’s mouth(s) on what you need to make sure you do before you submit 2019’s taxes, and what you can do now to be as prepared as possible when 2020’s tax time rolls around. Both tax agents, Laura Miller of Elite Bookkeeping & Tax in Broken Arrow and Rose Taylor of Redbud Advisors in Oklahoma City, are professionals in their field with experience and a passion for cannabis businesses, and while they offered different pieces of advice, there was one message in particular that I got multiple times from both women: have your receipts, and have them organized. This is one of the most basic tenants of tax time: keep your receipts and make sure you can account for every transaction your business made. OKLAHOMA CHRONIC

If you kept a so-so record of your expenses for 2019, make it your absolute goal for 2020 to have documentation such as receipts or statements for every transaction, and you’ll find that you’re much more prepared. For Miller, the enrolled agent for her business, seeing businesses that are under prepared has been a common theme, and in addition to a lack of strict receipt tracking, she said there has always been a steady line of questions as to what businesses can deduct. “The most common question I get regarding cannabis and tax time is definitely ‘do I have any write offs?’ There is so much that is misunderstood about the 280E rule, and what cost of goods applies towards in regards to each of the different kinds of businesses, whether a dispensary, a grower, or a processor. “ The complicated and tricky nature of 280E is something that snares many canna-businesses, though with help from the right tax professional, there are some things that businesses can possibly deduct, like a percentage of their dispensary’s square footage where sales actually take place. It’s important to always verify your potential deductions with a tax agent to prevent any penalties heading your way, which can add up quickly if there are multiple mistakes made. Beyond the constant train of write-off questions, Miller, a native of California who has seen cannabis impact both patients and her family members in the industry,
has dealt with her fair share of disorganized clients, and stressed the importance of keeping accurate records. “The IRS has been dealing with 280E situations for over twenty years now, they are incredibly rigorous in ensuring that every single transaction or charge has a receipt to back it up, especially if you’re under the microscope of an audit,” She said.” If you’ve lost a receipt, or you’ve never received a copy of an invoice or statement from another business, the time to reach out to those vendors is now, while it’s still a fairly recent transaction. If you wait until it’s a year from now, and your audit is happening, you’re going to be in a world of hurt.” Waiting too long to begin the process of getting state and federal paperwork together is another hazard Miller warned against, and she encouraged anyone with questions to make an appointment with their tax preparer now. “These returns take more time, and they’re very labor intensive in order to ensure that they have everything they need together. There are a lot of receipts and reports to keep track of, and it’s important that they work closely with their accountant to make sure they’re as ready as they can be,” she said. “ Making copies of everything may be an easy way to keep everything well-organized and easily read, since ink fades and papers can get damaged.”

Miller, who runs Elite Bookkeeping with her daughter, encouraged business owners with questions or concerns to reach out to a professional. “I think taxes related to cannabis are incredibly complex, and I believe the entire process is easier when you have detailed receipts, organized invoices, and an excellent accountant, someone who’s familiar with the industry that can assist in this often stressful process.”
While it may be too late in the season for many to properly prepare for this year, Miller had simple advice for those anxious about ensuring they had enough to pay what they owed. “Start now to prepare for next year. One of the most common ways people can find themselves in serious trouble come tax time is not setting aside enough money for their estimated tax payments, or not making the tax payments required. That’s why it’s so important to work on this all year so that you have the whole picture of what you need to expect.” While she’s passionate about the cannabis industry, Miller is also aware of the realities of what can happen if businesses don’t manage their taxes, whatever the situation is. “I think over the next few months, as people encounter audits and just a very different tax situation from any previous business they may have held, I suspect a lot will come out and many will run into issues, unfortunately. Over 40% of cannabis businesses closed in Colorado, and quite a bit of that was regarding the tax situation.”
Taylor, an enrolled agent at Redbud Advisors, stated that her firm has already begun to encounter businesses with tax problems. “We have encountered improper tax returns already and are filing amendments on behalf of clients. There is little guidance from the IRS, sadly, so many accountants are doing the best they can. We spend countless time and money on continuing education with top cannabis accountants and attorneys across the country, making sure we are always on the up and up.” Similarly to other bookkeeping and tax businesses in the state, Taylor said one of the most common questions that she and Redbud get from clients is about deductions. “Hands down, the most commonly asked question is what can be deducted, followed by what tax percentage a business will pay. 280E prevents a lot of traditional deductions, and that really throws people off.” Like Miller, Taylor stressed the importance of accurate recordkeeping, and said it was likely a mistake that many people within the industry could make.

“I think a lot of people will underestimate the seriousness of not having proper financial statements. Keeping those receipts and invoices is absolutely vital, and it may be what trips people up.” She went further, touching on the important aspect of estimated tax payments. “This is another huge mistake that we think many people in the industry will make. It’s a serious thing, and whether you pay through a bank account, cash or money order at a local IRS office, they need to be taken care of, or you risk massive penalties.” Taylor, a Long Beach, CA native who considers Norman home, noted an unfortunate trend that has been taking place. “Many businesses come with the wrong forms, or missing some important documentation, and unfortunately, we have found this to be fairly common.
OKLAHOMACHRONIC It’s not just cannabis businesses, it’s often entrepreneurs in general,” she said. “ It’s tough being the CEO, hiring people, marketing, ordering inventory, keeping doors open, staying compliant, and on top of that making sure your finances are in order too. We get it!” She encouraged business owners to reach out to an accountant, even if (or especially!) if they’re feeling overwhelmed by the taxmonster before them. “With the environment constantly changing, the red tape, the high risk of audit, the high tax liability, it’s so important that these businesses are keeping solid records, and have an accountant that not only understands the industry, but has their back too.” For Taylor, her passion extends to both the cannabis industry and taxes, and with family sprinkled across the west coast, when 788 passed, she recognized the battle ahead. “I was keenly aware of the challenges that this industry faces. Redbud Advisors was started immediately, and we haven’t looked back. We’re advocates for cannabis and only want to help business owners succeed.” That attitude is reflected in Taylor’s work, and she encouraged those who may be facing tax problems to reach out to an accountant sooner than later. “If you’re missing information, or have other mistakes and are nervous about how to proceed, do your due diligence. Reach out to accountants, ask questions, and be honest with us so we can help you. Try as best as you can to get documents from vendors to try and rebuild your financial statements, too.”
While those who choose to handle their own bookkeeping and accounting may get it right a vast majority of the time, Taylor noted the importance of having a professional check in, at least every once in a while, to ensure no nasty surprises pop up months later that could have been prevented. “Doing taxes for the cannabis industry is a lot more complicated than traditional businesses. The accounting method is far more complex. It’s nothing new to cannabis, but small business accountants generally do not perform accrual based accounting,” she said. “Then there are the added issues of inventory and Cost of Goods sold that make it more than just a simple tax return. Keeping all income reports and receipts is a great step to take, but if you’re performing your own bookkeeping, make sure you work with a qualified accountant at least quarterly to make sure everything is accounted for properly.” Taking steps to verify what you’re doing on occasion can save you big headaches (and big bucks) in the long run. Taylor further pointed to the help of a reliable accountant to help ease tax-season tensions at the office. “Your administrative assistant is not a bookkeeper, and often times, your bookkeeper is not a qualified tax accountant, and when there’s high stress, things can get complicated, with records becoming jumbled and other transactions mislabeled,” she said.
“Common issues we see is cash not being accounted for properly, inventory on hand is not being recorded as an asset, raw materials/finished goods are non-existent in most records, and shareholder equity is sometimes not recorded - needless to say, it gets really messy really fast. We call it the snowball effect, meaning that each month of improper or poor accounting practice that continues, the mess (or snowball) gets bigger and bigger, and it becomes more and more costly to untangle.” For Taylor, tax time isn’t the time to be sorting out messes; she prefers a preventative method that keeps business owners accountable and in the loop. “I always say that tax planning and tax preparation are two completely different things. By now, it’s often times too late to do anything proactive for 2019 taxes, but this is the exact time of year that you should be planning properly for 2020! Taking steps now will prevent similar or even larger headaches for next year.” She listed three things that all business owners could do to set themselves up for a better tax experience next year, and make the whole process far easier both on themselves and their accountants.

“I highly recommend people use accounting software, like Quickbooks or Xero, anything is better than nothing. Your point of sale, or seed to sale program is not an accounting system. I also recommend they work with a qualified accountant throughout the year, at least every quarter as previously stated, and those receipts and transaction records? Make digital copies of everything. Ink fades, and you don’t want to find yourself in an audit three years from now and not being able to read a receipt. Scan it in, and keep your scanned documents organized.” Tax time is a serious time for most people, and it carries serious consequences for business owners if the proper steps are not followed. That alone can be frightening, and when you’ve poured your life savings into a cannabis based business, it can be even more daunting. Even if your 2019 taxes haven’t gone as planned, what you do now can make the difference for next year. If you’ve made mistakes, learn from them and do something different in the future, and as Taylor and Miller both mentioned, it’s better to reach out and ask than stay quiet and potentially face problems that could have been easily solved. Taxes aren’t an easy thing, especially for cannabis businesses, but there IS help available. Qualified accountants can make all the difference, especially if you just keep your receipts.

If you have been in the cannabis rec world at all, you know that Vanilla Frosting is on everyone's mind.
“The vanilla frosting is super hyped and right now the yields most I have ever seen,” says Mr. D of Happy Dream Genetics & Happy Dreams Farms. So the farmers seem to really like it.
The flowers are silvery/green and have accented by hints of purple, and the creamy smooth aroma has notes of vanilla that end with a gassy finish. So it's an interesting blend of strong vanilla and fuel at the same time. The terpenes that can be found in Vanilla Frosting would include Myrcene, Pinene & Caryophyllene.
As far as the medicinal end I have heard mixed results because it's so new but words like “Blastoff” & “ Space Cadet” came up so enjoy. But for the newbie, maybe don't try it on a busy day. And for myself, I wouldn't say this is a go-to for anxiety. With that said it is absolutely my favorite to look at.

“The Bling” This strain is productive and fast-growing, pest and mold resistant that boasts both insane trichomes and a heavy dose of THC. “The Bling” is a cross of Humboldt Frost, Reserve OG, and Humboldt Gelato. Named after the abundance
of trichomes found on the green and purple buds, this cultivar has
“fuelly and sweet floral notes and tastes include pine, citrus, and earthy terpenes.” The flower itself is a majestic silver/green with hints of purple. “I love the purple stuff.”
We spoke to famous Mr. D who created the cultivar at his Certified Organic Family Dry Farm in Holmes, for the Humboldt Seed Company. His cultivar was a Phenohunt Mega Winner. We were lucky enough to catch him the night he was chopping
“The Bling” down and got the inside scoop.
Mr. D of Happy Dream Genetics & Happy Dreams Farms says its “Gassy but also sweet and floral with hints of lime.” This is because the terpenes that can be found in “The Bling” would include Alpha-Pinene, Myrcene, Limonene.
From the medicinal end, this high-potency cultivar has ethereal effects, making it great if one would be looking to elevate mood and float off for a while. It's said to be much more potent and intense, more ethereal than a sedative.
Secret Bonus to look for in 2020 “Bling Frosting” Well, it should come as no surprise that this would be the next one on the list. After getting to see how phenomenal it is, it should be at the top of your list for 2020.
Mr. D of Happy Dream Genetics & Happy Dreams Farms created this one too and from the looks of it, he's got another heavy hitter. Now he told us that “Bling Frosting is the 2020 release, it is being tested at Dry Farmed Organic Medicinals this seasoned and hasn't even been released yet” so don't tell anyone. He did share with us that “the terpenes are sweet lime with heavy gas a super high THC- last tests we saw 32% and super amazing frosty mega trichomes and super stoney OG effect.”
Productive is an understatement and the trichome density on this beauty out-shined the rest this year sounds like.
