Dan Meinders and his High Chaparral Development were on a roll. Take Sierra Station, south of Memorial Road just west of Interstate 35 in Oklahoma City. The cozy, heavily wooded, 20acre addition steadily advanced from the time Meinders launched it in 1994 through a second phase that started in 2000-01, and includes at least one home approaching 10,000 square feet. Covenants requiring indoor sprinkler systems helped make the exclusive, gated neighborhood even more attractive to upscale builders and buyers. Consider Whisper Glen, west of Douglas Boulevard just north of Waterloo Road in Logan County. Meinders bought the rural project, caught up in the 1980s oil bust, in 1992, building the first 13 homes, then concentrating on developing out the rest of the multiphase, horse-friendly neighborhood. Houses range from 1,400 square feet to 2,000-plus square feet. Take Sweetwater Springs, east of Douglas Boulevard, just south of Charter Oak Road in Logan County. The neighborhood, as carefully carved out of the Cross Timbers as the others, shares another trait with them, as well: country living, close enough to town — whether that means Guthrie, Edmond or Oklahoma City — for residents to have life both ways. Meinders started developing it in 2003. Take Charter Oak Hills, east of Douglas Boulevard on Charter Oak Road. Another rural neighborhood, with homes from 1,200 square feet to 1,700 square feet, within reach of the less-than-upscale homebuyer, started about the same time as Sweetwater Springs. Then there was Cedar Lake Estates, east of Broadway, north of Waterloo Road, which Meinders’ High Chaparral Development also started in the middle of the last decade. It, too, started during the national housing boom and took off fast with a half-dozen different builders. Almost all of the lots in the first phase sold immediately, said Phyllis Meinders, a Realtor who

ing, with city convenience in executive-level homes, acreage in Edmond schools and, being only 3½ miles off of Interstate 35, residents can get anywhere in the city quickly,” Hukill said. But now, of those six original builders, Meinders said just one,

First-time buyers need not settle for starter home A naval officer in her late 30s had an exciting international career before recently deciding to settle down and buy her first house. As a novice buyer, she kept her expectations low. But she was astonished at how far her money would stretch. Instead of the small, two-bedroom house she thought she could afford, she was surprised to learn that her salary let her buy a spacious four-bedroom place loaded with features such as a handsome fieldstone fireplace, a gourmet kitchen and a two-car garage. The naval officer’s experience is not uncommon, said Sid Davis, a seasoned real estate broker and author of “A Survival Guide for Buying a Home.” Of course, not all 20- or 30-somethings who are intent on homeownership can reach the big house goal post when they buy. loads for educational expenses, car loans and credit card debts are obviously limited in their capacity to borrow for a mortgage. But Davis said many young adults with steady jobs who’ve avoided excess debt are now positioned to buy better than a starter home the first time around. Here are a few pointers for first-time purchasers:
Make a mortgage office your first stop Eric Tyson, co-author of “Home Buying for Dummies,” said that the mortgage market has be-
come more stringent in recent years, due to the unusually large volume of mortgage delinquencies and foreclosures. Consequently, all home loan applicants are coming under greater scrutiny, he said. By seeing a mortgage lender early, you can gain pre-approval, which will give you a realistic sense of how much you can afford. A pre-approval letter is also a strong bargaining chip. “That’s because the sellers of the house you want will view you more positively if they know your mortgage financing is for sure,” he said.
Hunt for realistic sellers Although many neighborhoods now have a glut of unsold, high-end homes, not all sellers are equally motivated. Davis said one key to finding a
good deal is to locate a home with owners who are exceptionally eager to sell. One strategy for identifying highly motivated sellers is to examine statistics. Ask your real estate agent to determine the average “days on market” (from list to sale) for properties in the area where you want to live. Then look for homes in that price range that have languished unsold for a longer-than-average period. Before crafting an offer on the home of your choice, Davis suggested you also examine another set of numbers: the average list-to-sale price differential. If you note that most properties have recently fetched 90 percent of their list price, you might consider a first bid at a 10 percent discount off what’s being asked, assuming your research shows this is warranted, he said. “Also, don’t be afraid to
respond to a counter-offer if your first bid is rejected,” Davis said.
Avoid offending the owners’ pride “It’s nearly universal for people to have pride in the place where they live. Criticize the owners and you’ll only shoot yourself in the foot. The odds are they’ll take your comments personally and resist dealing with you at all — no matter the size of your offer,” Davis said. This is not to say that you and your home inspector shouldn’t be forthright in itemizing corrections that are needed to bring the property up to standard, such as repairs to the roof or the replacement of a malfunctioning water heater. Q: We put compact fluorescent floodlights in the recessed fixtures in our kitchen ceiling. We have found they do not last any longer than the old-fashioned incandescent ones. Why is that? A: Compact fluorescent bulbs are sensitive to heat and will burn out faster if they’re in a fixture where air can’t circulate, said Terry McGowan, a lighting consultant and director of engineering and technology for the American Lighting Association. That’s usually not a problem in recessed can lights that are open at the bottom, he said, but some have a glass lens over the opening that can trap heat. It’s also possible that you’re buying lesserquality bulbs. McGowan recommended buying bulbs with an Energy Star label, which ensures they meet certain quality standards. The packaging should have a phone number on it to call if the bulb burns out before it should. Save the packaging and write on it the date you installed the bulb, so you can call to complain if necessary.

business, Meinders said. Cedar Lake Estates has about 35 homes. Meinders said work in the estates section of the addition, where the minimum house allowed is 2,400 square feet, stalled when the market for upscale homes in the Edmond area froze during the national housing bust and the slowdown in upscale construction in the Oklahoma City area. In 2007, High Chaparral Development’s desire to develop state school land near Deer Creek School was thwarted when the Commissioners of the Land Office ended a controversial and complicated bidding process for the land, northeast of NW 206 and Rockwell. In 2008, the school land trust picked around High Chaparral’s bid to develop land at Northwest Expressway and Piedmont Road, awarding the project to another developer. Then, in February 2009, out of the winter sky, came a rare tornado, which didn’t help anything around Waterloo Road and Broadway. It damaged homes in nearby Oak Tree as well as in Cedar Lake Estates, where a wrecked home, tangled up in a complex insurance claim, sat unrepaired for months. The twister added insult to recessionary injury. “I’ve never had to look for builders before. They always came to me,” said Meinders, 49, but the recession and construction slump the past few years took that kind of toll, especially on the market for larger, upscale homes. Things appear to be turning around now, and while the general demand for big homes might have subsided, upscale Oklahomans have always thought bigger was better, so the normal pre-boom demand for living large is expected to revive. Cedar Lake Estates’ gates are open daily from 7 a.m. to 6 p.m. Lots three-fourths of an acre and up are available for $48,000 and $58,000. Meinders hasn’t just been biding his time. He’s put a different kind of mark on the intersection of Waterloo and Broadway: The Market at Cedar Lake, a 28,000-squarefoot shopping center, complete with a Subway sandwich shop — a national tenant to complement the 14 others, which include a bank branch, insurance agency, tanning salon and fitness center. “I’d been building houses for 15 years and just decided I wanted to do some commercial development,” he said. “Land was getting harder to secure, and it was more expensive.” Not only did he not sell the commercial corner to another developer, as many residential developers do, Meinders has been handling leasing himself for space at The Market at Cedar Lake. He started out years ago doing dirt work, which led to homebuilding, and he liked it. Building led to residential development, and he liked it, and that has led to commercial development and he likes that, too. Now, Meinders has taken to retail leasing — and the differences between it and building a house or developing a lot and selling it. “The thing about leasing that I like is you building something, and your income comes every month,” he said. “It’s not a one-time deal.”

Homeowner frustrated about ice dams Q: Our roof was redone three years ago, and they installed a ridge vent, and I replaced all the soffit vents, but we still get icing on the back (west side) where we always had it. What are your thoughts on power vents for the gable ends vs. adding more soffit vents? Do we look for an insulation contractor or a roofing contractor? Our insulation in the attic is still dry, but only because I’ve been removing snow from the roof to eliminate the ice’s fuel. I’m getting really tired of having to clear that area of the roof. Please let me know what you think. A: I’m not a fan of powered anything in the way of attic vents, because I haven’t seen enough evidence that the power consumed is offset by increased airflow. Beyond that, you’re talking about putting vents in two different places: the gable end, which is a high, or outlet, vent; and the soffits, which is a low, or intake, vent. For good attic ventilation, you need to have a roughly equal mix of both types of vents, so whether you need more of one or the other depends on what you already have. Also, I’m not talking about the number of vents so much as the area of the vents. Because
Paul Bianchina HANDY @ HOME high vents tend to be larger in area than low vents, you typically need more low vents than you do high vents. As far as what type of contractor, either one should be able to do the job for you, provided this person has a solid knowledge of weatherization and ventilation. Too many contractors simply throw in vents here and there without really doing the calculations as to how many are needed and where the best placement is. It sounds as if that may have been the case with your original roofer, since just installing a ridge vent isn’t enough if it doesn’t provide a sufficient amount of vent area to meet the needs of your attic. I would suggest that you contact your local utility company and ask whether they have recommendations of good licensed roofing or insulation contractors who understand energy and ventilation, and go from there. Because you have a spe-
cific problem with one side of your roof — in your case, the back — be sure the contractor pays particular attention to that area. There could be trees, neighboring houses or even topography issues that are affecting the airflow around your home, or you could have missing or blocked vents on that side. No matter what, the contractor may need to in-
crease the ventilation or change its placement. Q: We have a small rental house that measures 24 feet by 28 feet. It has a cement slab floor. We have a gas wall heater, which is unvented. We have a problem of excessive humidity. Some say I need more ventilation vents. I now have one 8 inches above the heater in the wall. Should I have more vents installed
in the ceiling? A: Unvented gas wall heaters are dangerous. Not only is the combustion creating some of the moisture vapor problems you’re dealing with, the potential for carbon monoxide poisoning is very real. You mentioned that this is a rental property, so you have a huge liability issue here. Rather than worrying about additional vents,
which would only be a Band-Aid, you instead need to replace the heater with one that’s properly vented to the outside. You also need to make sure that you have a CO2 monitor installed, to give the tenants warning of the buildup of any potentially dangerous fumes in the house. Remodeling and repair questions? In fact, some potential buyers who have high credit scores and hefty down payments may be surprised that even they are being targeted for higher “risk-based” fees. Consider these examples of how Fannie’s revised list of loan add-ons will affect borrowers. Say you want to buy a house that requires a $300,000 first mortgage. You have impressive FICO scores — above 800 — and cash for a down payment just under 25 percent. Purely on the basis of your credit score and loan-to-value (LTV) ratio, Fannie plans to charge an extra quarter of a percentage point of the loan amount, $750, to do the deal. During 2010, by contrast, your substantial down payment combined with your FICO score — signifying virtually no risk of default — would have cost you zero. Now take the same loan
amount but substitute a lower score and smaller down payment. Say your FICO score is 679, and you have down-payment money just under 20 percent, Fannie will soon begin hitting you for 2¾ percent in add-on fees, a staggering $8,250 extra solely attributable to your FICO and LTV. That’s up by $1,500 over what you would have been charged during 2010. But these fees are just the start of the multilayered, cumulative risk-based pricing system that both Fannie and Freddie use. Every perceived risk factor in a loan transaction receives its own separate addon fee, all of which gets totaled up for your final loan charges. Some fees are keyed to the type of real estate you want to finance. Condos, for example, are charged higher fees than stand-alone houses — a flat three-quarters of 1 percent by Fannie when the down payment
is less than 25 percent. Rental investment properties, manufactured homes, loans with interest-only payment features — all get separate fees that can mean significantly higher costs. What’s the justification for these add-ons? Though Fannie Mae declined to comment on its latest fee hikes, Edward J. DeMarco, acting director of the federal agency that oversees both Fannie and Freddie, called the add-ons “necessary to protect (the companies) from the costs and risks” inherent in the mortgages they buy or guarantee. Both Fannie and Freddie “underpriced mortgage credit risk” in the boom years, DeMarco said in a recent letter to Capitol Hill critics. It’s payback time. New home with cracks brings woes DEAR BARRY: We just signed a purchase contract for a newly built home. When we did our final walk-through inspection with the builder, we noted cracked tiles at the base of the bathroom wall. On the outside of the same wall, there is a corresponding crack in the foundation. A skim coat of cement was applied over this area, but the crack has appeared through this coating. The builder hired a structural engineer who said the cracks are normal and within acceptable limits. We don’t feel comfortable buying the home, but the builder refuses to refund our deposit. We don’t have a lot of money and are unsure what to do. What do you recommend? Ronald DEAR RONALD: Cracks such as you describe do not sound normal for a new home. A hairline crack in a foundation can be normal, but the tile cracks are not acceptable, and the skim coat on the foundation raises the suspicion of an attempt to conceal a significant defect. As for the structural engineer, who knows what conflicts of interest might be inherent in his relationship with the builder? Here are three things you need to do to protect your position: Hire your own structural engineer to evaluate the cracks. Hire a professional home inspector to evaluate all aspects of the construction, not just the cracks. And be sure to find an inspector with many years of experience and a reputation for thoroughness. A competent inspector will find additional construction defects that you would not discover on your own. If the builder is not willing to address the conditions reported by your home inspector and engineer, you may need advice from an attorney. DEAR BARRY: I was notified by the city building department that the lower level of my home was built without permits. As a result, I am required to tear out the walls, bathroom, carpet, etc. This is because my property is on the waterfront. What recourse do I have? Cheryl DEAR CHERYL: Locking horns with a governmental agency can be complicated, with no guarantee of a good outcome. Much depends upon a long list of variables, such as: Who did the addition? When was the addition built? Was it done by the people who sold you the home or by a previous owner? How long ago did you buy the property? The answers to these questions could determine whether the sellers are liable for nondisclosure. Aside from disclosure liability, there are other questions of consequence. For example, does the law mandate removal of the addition, or are other remedies available? Is it possible, under law, to obtain a variance that would allow a noncomplying condition such as the addition? Regardless of the answers, you need legal representation in this situation. It may be possible to find an attorney who specializes in administrative law, someone with particular experience dealing with bureaucratic agencies.
