The Oklahoma City Orchestra League has only one request in the weeks leading up to the opening of the 2012 Symphony Show House: Pray for nice weather. “We like to utilize this backyard — it’s so beautiful,” show house co-chairman Debbie Minter said of the space, where brickwork circles the ground around the pool, closed now for winter, and an outdoor kitchen dominates one corner. Artists and designers will begin working their magic Monday, transforming the home at 440 NW 15 in Heritage Hills from grand family home to a Jazz Age manor for the 39th annual show house. It will be open May 1 for private parties and will open to the public May 5-20. All proceeds benefit educational programs for the orchestra league and the Oklahoma City Philharmonic. The scissortail flycatcher glasswork hanging in the outdoor kitchen will most likely be gone by the time the show house opens,

Don’t shirk in getting home prepared for sale Do you sense a revival of the real estate market in your area? Has good news on recent home sales persuaded you to put your home on the market this spring? If so, housing experts urge you to begin soon to prepare your place for the big show. Besides the core improvements you can do yourself — such as purging clutter and in-depth cleaning — real estate experts say you should identify all tasks that need to be done by contractors. “Too many owners are lulled into thinking they don’t need to change anything before selling. They’re either cheap, lazy or just don’t realize all the work that should be done,” said Sid Davis, a longtime real estate broker and author of “Home Makeovers That Sell.”
Remodeling sentiment rose to the highest level in five years, according to the National Association of Home Builders’ Remodeling Market Index for the fourth quarter of 2011. The index increased to 46.6 from 41.7 in the third quarter. The component measuring current market conditions rose to 48.4 from 43 in the previous quarter; the component measuring future indicators of remodeling business increased to 44.8 from 40.4. An index below 50 indicates that more remodelers report market activity is lower compared to the previous quarter than higher.

He estimates that only about 10 percent of homes entering the market have had all the repairs and improvements necessary to maximize their selling potential. Yet even small defects can hamper a good sale, he said. “Whether it’s a little peeling paint, a leaky faucet or a malfunctioning doorbell … buyers see these little issues and assume your place is in bad shape overall,” Davis said. Most buyers now hire home inspectors who will be able to discover unresolved problems, making
this an even more critical issue. “Suppose the inspector finds out your roof is shot. Chances are good your buyers won’t even ask you to replace the roof. They could just walk away from the deal and never look back,” Davis said.
Where to go for help Can you count on your listing agent to highlight all the work your house needs before it goes on the market? Not necessarily. Davis contends many agents fear that if they’re frank about a home’s problems they could lose business. Also, he said, you can’t count on an agent to catch hard-to-identify problems, such as major plumbing issues or electrical deficiencies. Eric Tyson, a personal finance specialist and co-
author of “House Selling for Dummies,” recommends that all prospective home sellers line up a preinspection of their place before the “For Sale” sign goes up. He said it’s far better for you to discover the problem before potential buyers do. “Whether your issues are small or large, you don’t want to give your buyers reasons to question the integrity of your house. That’s like going in for a job interview with a ketchup stain on your shirt and expecting the employer to hire you,” Tyson said. To locate a reputable home inspector, he suggests calling the inspector who checked your place before you bought it. Or go to the American Society of Home Inspectors online (www.ashi.org). Here are a couple of oth-
er pointers for home sellers: I Create a list of prospective contractors to do your work. Many people find locating contractors onerous. But R. Dodge Woodson, author of “Tips & Traps When Hiring a Contractor,” advises against using the Yellow Pages or online advertising for this purpose. A more reliable approach, he said, is to seek recommendations from friends or office colleagues who’ve had work done on their own homes. I Scout out names from your neighborhood. One novel way of getting referrals from nearby residents is to throw a neighborhood party and ask all who attend to bring along the name of at least one contractor they like. UNIVERSAL UCLICK
Following three consecutive months of gains, sales of newly built, singlefamily homes edged down 2.2 percent to a seasonally adjusted annual rate of 307,000 units in December, according to the U.S. Commerce Department. “December’s small decline in new-home sales follows three consecutive months of gains and means the fourth quarter was still stronger than the third,” said Bob Nielsen, chairman of the National Association of Home Builders.
PENDING SALES POSITIVE After reaching a 19-month high, pending home sales eased in December but stayed above year-ago levels, according to the National Association of Realtors. The Pending Home Sales Index, a forwardlooking indicator based on contract signings, declined to 96.6 in December from 100.1 in November but was above December 2010 when it was 91.5. eral Building, which was about a mile away. “I was upstairs doing exercises,” she said. “I was on my back ... then I was on my stomach.” She said she was sure one of the roofers working atop the house that morning had somehow fallen through. “It just shook me to my core.”
Timely move Peyton and her husband, thoracic surgeon Marvin Peyton, lived there for 28 years, raising their two children. The children are living their own lives now, though, and the home’s 10,000 square feet — spread over four stories — have become a challenge for hips and knees that eventually had to be replaced. “Basically, I’ve been looking for about 10 years for a house,” Sandra Peyton said. “And Marvin and I have finally found one we agreed on.” They moved last year to a smaller, single-story home in Edmond and put their Heritage Hills home on the market. And that was good news for the orchestra league, which had just lost the home it intended to showcase. “We were getting kind of desperate,” Minter recalled, “and someone was just out driving around and literally ran up on this home with a ‘for sale’ sign.” Minter and show house cochairman Polly Worthington said they were struck by the architecture when they first saw their new show house. Built in 1925, the Tudor Revivalstyle home features intricate brickwork, a steeply sloped roofline and arched doorways. Arched entryways look out over the enclosed front yard. Overall, the home has six bedrooms, six full baths and three half-baths, many sporting period tile work with the master bath paneled with mirrors. “It’s just so beautiful,” Worthington said. “And it’s in such beautiful condition.”

Dramatic features The Peytons were living just a few streets over on NW 18, and gradually renovating that house, when the one on NW 15 came up for sale in 1983. “He just went crazy — once in a while he does — and he wanted to buy it,” Peyton said of her husband. It was out of character for him, she said, “but I mean he just pursued it, and the next thing I knew, we’d bought it.” So they moved in. “We didn’t have nearly enough furniture at first,” Peyton recalled. “We carried furniture in here by the truckloads.” The furniture is long gone, but remnants of their life are not — not yet. The hallway still makes a dramatic opening statement with a soaring ceiling and a sweeping staircase curving past a tall window. The walls are soft pink with cream accents, and a pink marble staircase dominates the nearby living room. Upstairs, individual bedrooms are still stamped with individual tastes — black and white geometric patterns stretch across dark walls in one bedroom, while mirrors line a wall in the master bedroom. The Peytons raised two children among those rooms — and a lifetime of memories. Come Monday, designers and artists will swarm into those rooms to begin the transformation. “I’m excited to see what it’s going to be,” Peyton said. “I can’t say it’s not sentimental for us to leave, but we know we’ve made the right decision. So we’re interested to see what they’re going to do with it, who’s going to live here. We’ll always be interested in this house.”

New agency seeks disclosure on appraisal fees WASHINGTON — The new Consumer Financial Protection Bureau is working on a real estate issue that gets to the core of the agency’s purpose: bringing clarity and better disclosures about the often opaque and costly fees that homebuyers, sellers and refinancers face at closings. One of the disclosures under review might surprise you: appraisal charges. Why do they need clarifying? Doesn’t just about everybody who applies for a mortgage, whether it’s to buy a house or refinance, have to pay $450 to $600 — sometimes more — to find out what the property is worth? The reality is more complicated. Start with the fact that in three out of every four purchases or refinancings, according to industry estimates, the person who visits, inspects, measures and puts a market value on your property is receiving only a fraction of the money you are paying. Some are being paid less than half of the fee, while the balance flows to an enterprise you’ve never heard of — an appraisal management company — that assigns the job to the appraiser. That management company, in turn, may be wholly owned by or in a
Kenneth Harney THE NATION’S HOUSING joint venture or affiliate relationship with your lender, which in turn may be pocketing a significant portion of your appraisal dollars. Current federal settlement disclosures give you no hint of where that money is going. There is just a single line item for appraisal charges on the standard HUD-1 settlement statement. Say you’re charged $550. There is no hint that the appraiser gets $250 and the rest goes to the management company and the lender. The new bureau is considering whether to shed light on this by mandating two disclosures — what the appraiser is paid and what the management company is taking. Banks and mortgage lenders maintain there is no need for more disclosure, but appraisers, builders, realty brokers and others say the costs of appraisals to consumers have increased in the past two years, while the quality and accuracy of the
work have declined. In a poll of its members last year, the National Association of Realtors found that 70 percent reported consumers were being charged higher appraisal fees at closing — sometimes $100 or more than typical previously. At the same time, appraiser members reported sharp reductions in their own compensation by 40 to 50 percent per assignment. Many of those polled said they saw significant increases in the number of appraisers who were unfamiliar with local market conditions because they were from another area. The poll also found a growing incidence of sales transactions being derailed by appraisals that came in below the contract price agreed upon between the seller and the buyer. Critics say the drops in fees to appraisers combined with higher charges to consumers are byproducts of the rapid spread of management companies, whose growth during the postboom years has been fueled by rules from Fannie Mae, Freddie Mac and Congress aimed at ensuring “appraiser independence.” Frank Gregoire, a past chairman of the Florida Real
Estate Appraisal Board, which oversees and regulates the industry in that state, said that while appraiser independence is an important goal, banks and their affiliated management firms are raising the costs of appraisals to consumers without improving services. “The borrower receives no benefit from the (appraisal management) ‘service,’ ” he said in an email. “The lender is able to outsource a significant responsibility (the selection of an appraiser) to an affiliated subsidiary, and profit from that task by making the con-
sumer and the appraiser pay for the privilege. (This) business arrangement is concealed from the consumerborrower, and the charge is misrepresented as an ‘appraisal fee’ on the HUD-1. This is dishonest, deceitful and unfair.” Industry defenders of management firms, such as Donald E. Kelly, executive director of the Real Estate Valuation Advocacy Association, strongly disagree. Kelly said management firms perform the “back office” functions, including reviews and quality control, “that in the past were done
by lender staff and employees.” In other words, they earn the money they get. And there’s no pressing need for consumers to see additional disclosures. Which brings the matter back to the Consumer Financial Protection Bureau. The agency has a statutory deadline in July to produce an improved version of the HUD-1 settlement form. How it comes down on real estate appraisal fee disclosures — more transparency for consumers or not — will be a revealing early test. Send email to kenharney@earthlink.net. CHICAGO — The Illinois attorney general has filed a lawsuit accusing Standard & Poor’s of misleading investors by assigning its highest ratings to risky mortgagebacked investments during the years leading up to the crash of the housing market. The lawsuit from Lisa Madigan’s office alleges the agency compromised its independence by issuing high ratings for unworthy or risky investments as part of a strategy to boost revenue and market share. The lawsuit cites internal emails and conversations, including an instant messenger exchange in April 2007 in which an employee tells another that an investment “could be structured by cows and we would rate it.” “Publicly, S&P took every opportunity to proclaim their analyses and ratings as independent, objective and free from its desire for revenue,” Madigan said. “Yet privately, S&P abandoned its principles and instead used every trick possible to give deals high ratings in order to retain clients and generate revenue.” Madigan’s lawsuit singled out mortgage-backed securities, saying Standard & Poor’s misrepresented the risks by giving the investments its highest rating of AAA. A spokesman for Standard & Poor’s rejected the claims. “The case is without merit, and we will defend ourselves vigorously,” David Wargin said.
A spokeswoman for Madigan, Robyn Ziegler, said the attorney general began investigating Standard & Poor’s in early 2010. The inquiry is continuing, but Madigan determined it had progressed enough to file the suit, Ziegler said. Madigan previously had been involved in discriminatory-lending lawsuits against Bank of America subsidiary Countrywide Financial Corp. and Wells Fargo. The financial products singled out in the Standard & Poor’s lawsuit involve the bundling of a pool of mortgages that are then sold as securities. They are backed by residential mortgages, including the subprime mortgages that have been blamed for much of the economic turmoil set off by the housing crash in 2007 and 2008. Madigan’s lawsuit said S&P ignored the risks of those securities in giving them ratings that were favorable to the agency’s investment bank clients and its own profits. The performance of those investments had a significant impact on institutional investors in Illinois, including pension funds and 401(k) managers, the lawsuit said. “The mortgage-backed securities that helped our market soar — and ultimately crash — could not have been purchased by most investors without S&P’s seal of approval,” Madigan said. The lawsuit also cites testimony before Congress by a former managing director of the ratings agency who said “profits were running the show.”
