Picking her way through a buzzing construction site in high heels, Vanessa Shadix doesn’t look like someone who’d prefer to be swinging a hammer. But she is. “I would love to be out there with the hammer,” she said where husband, Mike, a homebuilder, has a house under construction in southern Logan County. “I mean that’s me.” Shadix, 54, has spent most of her life around construction. Her father was a commercial contractor in Shreveport, La., she said, “So I grew up loving, LOVING going to the job sites with him, working with him.” The home taking shape amid stacks of bricks and churning concrete in the Antler Ridge addition just north of the Oklahoma County line sports a sign out front bearing both their names. But the building part these days falls entirely on Mike Shadix. Vanessa Shadix has worked for Old Republic Title Co. of Oklahoma for the past 12 years, catching her footing there as their previous homebuilding company sank out of sight. Homebuilding has always been dear to her, and she is active in the National Association of Home Builders’ Professional Women in Building Council. The organization’s members returned the favor by naming her Member of the Year during a recent conference in Orlando, Fla. Each state gets one nominee, and she topped them all. “I was very honored, very surprised,” she said, “I don’t do it just because of that.” The homebuilding venture, she said, has brought the best out in her and her husband. “He liked doing the foundation and the plans and all that, and I love working with the subcontractors,” she said. “We just had a very good relationship.” The temptation is sometimes strong to go back and work together, she said, “but we just feel so secure.”

Job was ‘godsend’ Old Republic was American Guaranty when Shadix started work there as a closer. She moved into sales and for the past two years has crisscrossed the state as an agency account manager, talking to title companies about having Old Republic underwrite their title insurance. Title insurance covers a home’s title, as Shadix puts it, from “closing to the end of time” covering everything from forgery to a deed signed by someone incapacitated. “I’ve been very, very fortunate with Old Republic,” Shadix said. “It’s been a godsend to have such a great job.” But back in Louisiana, the builder’s daughter set out to go into architecture at Louisiana Tech.
That was in 1974. It didn’t work out. “They just didn’t want girls,” she said. “So I left there and went to LSU to try to figure out what I was going to do.” She ended up graduating with a degree in psychology. She moved to Oklahoma in 1986 when her first husband accepted a job in Oklahoma City. She was going through a divorce when she and Mike Shadix crossed paths at a dance studio 1989 — she was taking ballroom dancing lessons while he was learning country western. They were married three years later. “What’s hilarious, I think, is that in 16 years we haven’t danced at all,” she said with a laugh. “You know how that goes.”
Staying cautious Mike Shadix worked on a variety of projects after Shadix Homes closed up shop, but he returned to homebuilding full time in about 2005. They both returned to that world wiser, which Vanessa Shadix said kept the 2008 financial meltdown and subsequent mortgage crisis from becoming deja vu all over again. “This time we kind of learned, you know, to be just a lot more cautious,” she said. “We don’t have overhead, and Mike pretty much does everything himself with the exception of how I can help him.” They deploy a small band of trusted tradesmen as well to take

‘Beautiful view’ Perched on a seaside bluff, Bellosguardo — Italian for “beautiful view” — gazes out onto the same stunning panorama that Clark and her guests enjoyed at garden parties in the 1920s. The 23-acre estate is worth at least $100 million. Real estate brokers who specialize in luxury properties say Clark’s representatives have turned away overtures from at least two billionaires. There are rumors — maybe wishful thinking — that Bellosguardo will be given to the city, a school, a charity. Or perhaps it will sit in cloistered grandeur — like its owner — for years to come. Huguette Clark is the daughter of William Andrews Clark, who left behind a Rockefellerscale fortune. Her ex-husband is long gone,
and she doesn’t have children or close relatives. What she does have is an estimated $500 million and advisers who have been accused of mismanaging her wealth for their own gain. Her holdings are baronial. There’s a mansion in New Canaan, Conn., and two apartments — 42 rooms altogether — in one of Fifth Avenue’s swankiest buildings. And then there’s Bellosguardo. Today, a caretaker and a hired landscaping crew maintain the acreage. Long ago, the hillside was humming with 25 full-time gardeners and a large household staff. For a time, cows grazed at Bellosguardo; when the Clarks were elsewhere, fresh Santa Barbara butter was flown to them.

Fate of centenarian’s seaside estate uncertain SANTA BARBARA, Calif. — If Huguette Clark can remember her younger days, she may fondly recall the Santa Barbara estate where a private railroad car deposited her family every winter. At 104, she may linger on memories of debutante parties and society luncheons, or of musicales featuring the Paganini Quartet, equipped with Stradivarius instruments courtesy of her mother. Then again, she may not remember a thing. She resides at a New York hospital — her home for more than 20 years. By all accounts, it’s been at least half a century since she last set foot in the 22,000square-foot house that for years was tended as if a telegram might at any moment signal Clark’s arrival.
Night gardens have long been considered curiosities. But for people who work during the day, a garden that comes alive as night falls is one they can enjoy at its best. Garden writer Lia Leendertz covers the basics of night gardening in “The Twilight Garden: Creating a Garden That Entrances by Day and Comes Alive at Night.” The book helps readers design a garden that incorporates color, scent, lighting and water, and gives ideas for using that space for entertaining. ‘Idyllic’ times Barbara Hoelscher Doran, who lived in a house on the estate until she was 12, remembers those days well. The daughter of the property’s former manager relishes her memories of Huguette: “She’d call and ask my mother, ‘Can Barbie come over for tea?’ ” On the patio, Doran would take tea, often going home with exquisite dolls, children’s books in French and other gifts from Huguette and Anna. “They were the most lovely, kind, soft-spoken ladies,” said Doran, who, four decades later, manages an interior design business in SEE ESTATE, PAGE 2F

Estate: Built by mining tycoon FROM PAGE 1F
Montecito, Calif. “It was idyllic; I just didn’t realize it at the time.” Long before Bellosguardo became a little girl’s enchanted playground, it was a bauble for William Andrews Clark — a mining tycoon with a much younger wife, eight children from two marriages and a largerthan-life love of luxury. Already 84 when he acquired the grand home in 1923, Clark was accustomed to the finer things. His main house, on New York’s Fifth Avenue, had 121 rooms, Turkish baths, art galleries and a railroad spur for coal cars. In 1932, Huguette’s mother was adding a wing to the 30-year-old house. When her architect praised her for providing jobs in hard times, she decided to create many more by tearing down the entire home and rebuilding it in a French country style. One of her new workers was Doran’s father, an electrician who managed Bellosguardo until his death 50 years later.
Institutional care Doran lived at Bellosguardo until her parents separated. She summered there as a teenager and, until about 10 years ago, exchanged cordial, if infrequent, notes with Huguette. By then, the frail Clark had left her lavish New York apartment for round-the-clock institutional care. She collected dolls, directing her at-

torneys to pick them up at highstakes auctions. According to one report, she negotiated with an antiques dealer only through a closed door. But last year, an investigation by MSNBC.com thrust Clark and her holdings into the limelight. A series of reports suggested that she was being exploited by her longtime attorney, Wallace Bock, and her accountant, Irving Kamsler. As a result, three distant relatives asked a judge to name a guardian for her.
The relatives, whose request was denied, were upset that Kamsler had pleaded guilty to charges of e-mailing pornography to teenage girls. They also questioned Clark’s $1.5million donation to an Israeli settlement where Bock’s daughter lived with her family. In court documents, Bock called the relatives “officious interlopers … with whom Ms. Clark has knowingly and assiduously avoided contact for decades.” Clark’s gift was for the community’s security system, Bock said, reflecting her “continued interest in my daughter and her family’s safety.” Bock did not return phone calls. Kamsler’s attorney, Elizabeth Crotty, said he “has acted both professionally and diligently.” Still, prosecutors are investigating how Clark’s fortune has been handled, according to a New York law enforcement source not authorized to discuss the case publicly.
Hidden mansion In Santa Barbara, Bellosguardo remains, as always, hidden from public view. Doran said she last saw the house about 10 years ago, after writing Huguette for permission. The windows had been opened for her. There were dustcovers on the old furniture, and the double stairway was still adorned in gold leaf. “It could be a museum,” she said. “But it’s too fine. care of the details, a trusted painter, for example. But they also deployed a strong sense of reality. “And that was the thing that was pretty sad about the whole deal,” she said. “We both have such positive attitudes, that we knew we could pull it out. This time we were positive with reality checks.” Now with Old Republic anchoring her days, Vanessa Shadix said she confines her homebuilding activities to the off hours. Her husband draws all of his floor plans at home. “And every once in a while I’ll get in there and say, ‘You know what? You really need to put the washing machine on this side,’ ” she said. “You know, just the girl stuff, really.”
‘Functionest’ She said friends describe her and her husband as “the ‘functionest’ people, because I make him go to a lot of functions.” Off hours, between home plans and their beloved Thunder games, Vanessa Shadix works to raise money for a variety of charities — among them The Children’s Center in Bethany, Home Builders Care, a state builders program she said has raised about $500,000 for children’s charities over the past eight years, Central Oklahoma Habitat for Humanity and Edmond-based Citizens Caring for Children, which aids children in the state’s foster

care system. It’s a busy schedule, she said, and offers its share of networking opportunities. “But most of the stuff I do is just because I care about Oklahoma City, and I care about being able to give back,” she said. “We’ve just been really fortunate. So even through the bad times when the company went under, it wasn’t fun. But we’re still very, very lucky.”

Duplex offers seclusion of cottage The Philipsburg is a duplex with all the charm, and most of the privacy, of a country cottage. Garage walls are the only point of contact between the units, and even the covered patios are completely secluded. The two-story units are mirror images of each other. Slender posts set on wood-framed bases highlight and support an entry porch capped by a lowprofile gable. Wooden siding covers a half-wall that creates another secluded area in the porch section extending from the door to the outer post. Inside, a handy coat closet hides in an alcove hidden behind the front door. The living and dining areas are all of a piece, and open to the kitchen across a raised eating bar. Light washes into the living areas through wide multipane windows on the right. More beams in through a smaller window over the sink. MOORE — Home Creations has been awarded a 2011 Energy Star Partner of the Year award by the Environmental Protection Agency for its commitment to building all Energy Star-qualified homes. Home Creations received the award in the midsize homebuilder category.
“We’ve built over 2,000 homes since teaming up with Energy Star in 2006,” said Anita Wagoner, marketing and sales director. Home Creations has built 20 percent of all Energy Star-qualified homes in Oklahoma, she said. They have resulted in almost $1 million savings in cooling and heating cost for homeowners, she said.

IRS gives guidance on canceled mortgage debt WASHINGTON — With hundreds of thousands of homeowners having negotiated loan modifications or short sales or been foreclosed upon during the past year, the Internal Revenue Service has issued fresh guidance on how to handle canceled mortgage debt in the upcoming tax season. It’s a huge issue, widely misunderstood by consumers, and involves potentially billions of dollars of tax liability. When most debts are canceled by a creditor, such as unpaid balances on student loans or credit cards, the forgiven amounts are treated as ordinary, taxable income by the Internal Revenue Code. But under a special exemption adopted by Congress covering distressed home mortgages, many owners can escape the ultimate doublewhammy: Getting kicked while you’re down, hit with extra taxes because your mortgage went seriously delinquent or you lost your house. In its latest guidance, the IRS focuses on several key points owners and former owners need to know. Tops: Just because a lender wrote off a portion of your mortgage debt doesn’t mean you automatically qualify for special tax treatment. There are essential tests you need to pass to qualify: The debt your lender canceled must have been used by you “to buy, build or substantially improve your principal residence.” There’s a lot packed into these words, so it’s important to parse them carefully. Start with the house itself. It can’t be your second home, an investment condo, a weekend retreat or a seasonal home you occupy for less than half the year. It can only be your main residence, and fully documentable as such. Next, the unpaid mortgage balance your lender canceled as part of a modification, short sale or foreclosure cannot have been used for nonqualifying purposes, that is, for something other than acquiring or constructing the house or making capital improvements to it. Refinanced mortgage debt used for kids’ tuitions, vacations, buying cars or paying off credit card bills won’t make the grade. The IRS offers a hypothetical example of how borrowers can mess up chances for tax relief. A taxpayer took out a first mortgage of $800,000 when he purchased his home years ago. Thanks to strong appreciation in property values, the house was soon worth $1 million, and the owner refinanced the mortgage to $850,000.

The loan balance at the time of the refi was $740,000; the owner used the $110,000 in cash-out proceeds to buy a car and pay off credit card debts. Bad move. A year or two later — presumably well into the recession and housing bust — the home value had plunged to between $700,000 and $750,000. The owner then convinced his bank to allow a short sale for $735,000 and to cancel the remaining $115,000 of unpaid debt. Does the owner get tax relief on the full $115,000 under Congress’ special exemption? No way, according to the IRS. He only escapes income taxes on just $5,000 of the
$115,000 because he spent the other $110,000 on a car and credit card balances — neither of which counts as “qualified principal residence” debt. Greg A. Rosica, a tax partner with accounting giant Ernst & Young, said misunderstandings of the rules about mortgage debt forgiveness are “commonplace.” People often don’t know that “the equity line (money) you used for vacations” and other purposes “just will not qualify” under IRS rules. Taxpayers who walk away from their houses may be liable for taxes, Rosica said in an interview, if at some point the property “no longer was their primary residence” — say they rented it out for the period between their last payment and the foreclosure — effectively converting the house into rental property, not their principal home. The IRS highlighted
some other key points in its guidance: Mortgage cancellation relief is capped at $2 million for singles and married taxpayers, $1 million for married owners filing separately. Anyone who’s had mortgage debt cancellation as part of a loan modification or foreclosure should go to IRS.gov

and download Form 982 and IRS Publication 4681 for additional filing details. Alternatively they can call (800) TAX-FORM to request copies. Lenders who write off unpaid mortgage balances typically provide borrowers with a year-end IRS form 1099-C cancellation of debt statement, including the amount of the loan

But Carney cautions that the use of sleep medications for more than two or three months can be counterproductive and actually hinder the efforts of insomniacs to obtain sounder sleep. Give yourself a period of relaxation before bedtime. People aren’t programmed to downshift suddenly from an excited or stressful state of mind to the kind of relaxation that’s conducive to a sound sleep. For that reason, Carney recommends that those suffering from insomnia give themselves a “buffer period” before going to bed. “You need at least an hour to wind down,” said Carney, who’s been involved in sleep research for more than 15 years. During your buffer period, try to avoid work-related activities or discussions that could provoke worry or anxiety. Avoid using electronic devices in your bedroom. It’s no secret that the computer is a primary source of real estate information for those heading into the purchase or sale of a property. But using the computer for this or any other purpose can be counterproductive to restful sleep, especially for people prone to insomnia, Carney said.

She and other specialists say an increasing number of people are hindering their prospects for good sleep by bringing electronic devices into bed with them. Use a written guide to help you set a helpful sleep schedule. Sleep experts say the most effective ways to deal with insomnia involve behavioral changes that can’t be accomplished overnight. They require sustained effort over time. Because it can take weeks to reverse sleep habits, sleep experts recommend use of a sleep log. “The idea is to track your sleep habits until you can change them in constructive ways,” Carney said. Have a support system in place. Carney urges those with financial issues to seek help through cognitive therapy. This method helps patients modify their actions and beliefs in search of constructive solutions to their problems. “When you’re faced with such problems, it’s very important to have a support structure to deal with the underlying issues,” she said.
