For Carla and Charlie Flournoy, the past four years have been all about rebuilding. Rebuilding the Heritage Hills home they bought in 2006 and gutted, but more importantly for Carla, rebuilding her health after a successful fight against the breast cancer she discovered that year. The Flournoys’ restored gem, at 206 NW 18, is one of four historic homes and two private gardens featured in this year’s Heritage Hills Home & Garden Tour noon to 5 p.m. Oct. 9-10. Tickets are available for $15 from participating merchants or at www.heritagehills.org. Carla Flournoy, a Denver native, said she “always wanted to fix up an old house” like the one she grew up in. “When our son attended Bishop McGinnis (High School),” she said, “I would drive through Heritage Hills looking at houses, thinking ‘someday.’ ” When their sons graduated from college — Spencer from University of Tulsa and Payton from Oklahoma State University — Carla said she knew the time was ripe to move into a “grown up house.” That’s when the house at 206 NW 18 came into the picture. A 2,200-square-foot, three-bedroom plan built in the Prairie Style, the foursquare layout had “great bones.” But, Carla said, “It was so awful. As soon as we closed I thought, what have I done?” That was June 2006. As the Flournoys sized up the renovation job that awaited them — hiring a contractor, drawing plans and demolishing several decades’ worth of outdated or downright bad decor choices — Carla, a registered nurse who works as disease manager at Oklahoma Heart Hospital, received life-changing news. She was diagnosed with breast cancer and immediately dove into a monthslong series of aggressive treatments. Suddenly, she said, “I needed a project. Something I could build up from zero.” The renovation at 206 NW 18 took on a whole new meaning. Through several surgeries and during “constant doctor’s ap-

pointments” Carla had the remodeling project to give her focus — spending every free moment at the house, checking on the progress of contractor Jerry Dickson and his crew. One of the first jobs was removing outdated shag carpet from the living room, revealing the beautiful oak floor underneath. Researching Frank Lloyd Wright’s Prairie Style architecture inspired Carla to uncover and restore original touches that had been lost. In the downstairs fireplace, for example, Dickson created a new oak mantel to accent a restored arched-brick-and-tile facade. The Flournoys discovered opportunities to accent the house with further Prairie Style touches, as in the outside accent painting and the addition of period-accurate stone flowerpots. The kitchen was fully rebuilt, from the maple floorboards up. Carla wanted a “very plain, very 1920s kitchen, with no appliances, even” — which is where, her husband said, “I interceded.” The couple settled on a design that is stunning in its open, light simplicity, but with a vintagestyle (yet modern) gas range and a Carla and Charlie Flournoy bought their Prairie Style home in Heritage Hills in late 2006, gutted it and restored it. One story or two? Lifestyle can provide answer The company manager and his wife were torn between buying a ranchstyle house or a two-story Colonial. He loved the ease and convenience of onelevel living; she craved the traditional feel of a formal floor plan with the bedrooms upstairs. “Each person insisted on the kind of house they grew up in and neither would compromise,” recalled Sandy Jurich, the real estate broker who represented the couple in their housing search. So strong were each partner’s preferences that a deep divide developed between them, reflecting major differences in their values and thinking. “After looking at a dozen or so properties, they gave up on their house hunt,” and eventually split up, Jurich said. The couple’s housing conundrum is not uncommon. Many prospective purchasers disagree on

whether to buy a vertical or horizontal home. Even single people often can’t decide which is their better option, said Jurich, who’s affiliated with the National Association of Exclusive Buyer Agents (www.naeba.org). Despite the economic downturn, land costs remain high in many popular residential areas. And because a two-story house requires a smaller “footprint” on its lot, builders often favor vertical properties over horizontal ones. Moreover, Jurich said, vertical homes can be more energy efficient than horizontal ones. But there are a number

of advantages to a singlestory home. Chief among these is efficiency of movement; you can go from room-to-room without climbing the stairs. Plus, “it’s a lot easier to clean and vacuum a single-level house,” Jurich said. Mark Nash, a real estate broker and author of “1001 Tips for Buying and Selling a Home,” said homebuyers who are ambivalent about housing styles should be sure to visit at least two vertical properties, as well as two horizontal ones. Here are pointers for homebuyers struggling between vertical and horizontal living: Try to make your choice with an eye to the future. Whatever your age, it can be hard to picture your future housing needs. Yet Nash recommends that homebuyers look at least three to five years ahead. “Planning for the future

is especially important if you’re approaching your late 50s and anticipate retiring in the next few years. In this age range, health or mobility problems can start to develop at any time,” Nash said. Keep in mind the advantages of a second-floor “hideaway area.” Do you already telecommute from a home office or expect to begin doing so in the next few years? Or do you expect to start a home-based business? If so, Nash recommends you consider the advantages of an out-of-theway second-story office where you can concentrate with few interruptions. Likewise, many homeowners may convert an upstairs bedroom to a space where they can pursue a hobby. Steer clear of a property that would require you to build on an addition. Are you past age 50 and starting to experience ar-

thritis in your knees and hips? Suppose you’d like to buy a traditional two-story place; should you consider purchasing a vertical house with the intention of building on a first-floor master suite later? Nash would tell you to reconsider. Don’t try to replicate your parents’ lifestyle. Perhaps you were raised in a family that always lived in two-story houses. Though you may be geared toward buying this type of home, you may find that the simplicity of one-level living is better suited to your hectic lifestyle. If that’s so, Nash encourages you to step outside your comfort zone and consider a ranch house. “This is not about buying a clone of your parents’ house. It’s about embracing a positive transition for your own life,” he said.

First-time homebuyers are contributing to an increase in demand for smaller and less expensive new homes, according to research from the National Association of Home Builders. About 41 percent of the 8.4 million households who bought homes between 2007 and 2009 were first-time buyers, according to a study using data from the most recent biennial American Housing Survey conducted in 2009 by the Department of Housing and Urban Development and the Census Bureau. The market share of first-timers was up from 35 percent in both 2005 and 2007.

The 44th annual Heritage Hills Home & Garden Tour will be Oct. 9-10 from noon to 5 p.m. Tickets for the tour are $15, and are available at area merchants, or will be available for purchase on the days of the tour at any of the featured houses. Proceeds from the tour support historic preservation efforts. Homes on the tour are: Benn Home and Garden, 207 NW 18 — This 1922 Colonial Revival home has been owned by John and Debbie Benn since 2004. Renovations by the Benns have made use of lavish colors and eclectic decor collected by the owners. The three-bedroom home features a quaint garage and guesthouse. Flournoy Home, 208 NW 18 — A Prairie Style, Jeff and Dana Hirsch’s garden at 300 NW 19 is one of two three-bedroom home completely renovated since on the Heritage Hills Historic Home & Garden Tour. concealed refrigerator and freezer hidden in custom cabinetry. Nods to the period’s original finish materials include granite and marble countertops, a farmhouse sink and vintage drawer pulls. The backyard is a quiet, landscaped retreat with a path leading to the remodeled, 360-square foot garage apartment, which serves as a home office for Charlie Flournoy, a petroleum engineer with Unit Corp. As Carla’s health was restored, so was the house. The Flournoys’ home was ready for move-in by December 2006 — though, Charlie said, there are always plenty of new projects in an old house. “As they say, the only thing that works in Heritage Hills is the owners,” he said with a laugh.

Stiffing the lender strategy may backfire WASHINGTON — Are you delinquent on your first mortgage but still making monthly payments on your home equity credit line or second mortgage? If so, a finance and real estate professor from DePaul University has some controversial advice for you: Stop paying on your second immediately. Rebel Cole believes you simply are throwing good money after bad. If you are seriously delinquent on the first mortgage, you’re likely headed for foreclosure unless both of your lenders agree on a modification or principal reduction plan. But since you continue to make payments on the second, the bank that holds that revenue-producing note may have minimal motivation to participate in a workout, he believes. Cole estimates that between 1 million and 3 million homeowners are in this position. By abruptly stopping payments, according to

Cole, you force the bank holding your second mortgage to set aside additional capital for loss reserves. Contrast that with that bank’s current situation: It reports your home equity loan as “performing” for accounting purposes, requiring no extra capital allocations, he claims. This is despite the fact that the delinquent first mortgage — which takes payoff priority over the second and may well be underwater — probably renders the true market value of your home equity loan around zero in any foreclosure.

Bank the money Once the bank is forced to set aside additional cap-

ital — as high as 100 percent of the face amount of your equity line — “it starts to really feel pain,” Cole said in an interview. Now you should find it more willing to negotiate with you and your first mortgage holder to work out a loan modification, principal reduction or short sale. And if not, simply bank the money you’d otherwise be paying on the second mortgage. It may take a year until a foreclosure filing, and 350 days or more, depending upon your location, before you actually have to vacate the house. Meanwhile you’ll be saving money every month. Sound like a smart financial strategy? Cole has been pushing the idea in analysis and opinion articles, but what are the real pros and cons for consumers? Start with the core idea that banks will be vulnerable to big hits to capital for loss reserves if you stop

paying on your second mortgage — thereby softening them up for principal reductions later. That’s not likely to happen, according to banking executives and financial regulators, because current federal loss-reserve rules already require institutions to set aside additional reserves on seconds once there is any hint that the associated first mortgage is in distress — whether through delinquency, a loan modification or other indications. Also, Cole’s estimate of as many as 3 million homeowners with paid-up seconds but delinquent firsts appears to be far overstated, according to new data from the Office of the Comptroller of the Currency. Recent bank examinations found that about 235,000 second liens may be in that position, a substantial number, officials concede, but nowhere near Cole’s estimate of the size of the problem.

Personal impact Even more important, the personal impact on you when you stop paying a second lien could be severe. Your credit scores will definitely take a hit. Since you’re behind on the first loan, your scores are probably depressed already. But stiffing the lender on your second mortgage will push them down even more, further limiting your access to new credit in the future. Worse yet, in some states, even if you go through foreclosure, the bank could legally pursue you for full payment on the face amount on the unpaid second. The bigger the outstanding home equity loan, the more likely the pursuit. Asked for comment, federal financial regulators bristled at Cole’s proposals. Timothy Long, senior deputy comptroller of the currency, called the professor’s recommendations misguided.

“That kind of advice to borrowers is dangerous,” Long said in an interview. Top officials of major banks generally were reluctant to talk on the record about Cole’s ideas, but Dan Frahm, a Bank of America spokesman, said his company’s “approach has been not to let secondlien issues prevent us from modifying” mortgages, including “making principal reductions, even when the second lien is owned by a third-party investor and has not been modified.” The bank also said stopping payment on a second would not enhance a borrower’s chances of a modification or principal reduction. Bottom line here: Follow Professor Cole’s advice at your own peril. There is little evidence it will be effective in convincing your lender to do anything. Undisclosed defect causes homebuyer problem DEAR BARRY: We just bought a home and discovered a major undisclosed foundation problem after moving in. The seller insisted on an as-is sale, so we relied on the home inspector to find any serious problem. In the basement, he noticed old water stains in an alcove that had been paneled and carpeted. We asked the seller to replace the paneling and carpet, but he refused to do any kind of work on the property. So we agreed to replace the stained materials after the sale in exchange for material costs. But when we removed the paneling, we found a foundation wall that was crumbling and leaning. A contractor friend tells us that the patio will need to be removed and the exterior excavated to enable replacement of this wall. Do we have any recourse with the seller for nondisclosure? Marci DEAR MARCI: The seller had the right to an as-is sale, but he also had the obligation to disclose all known defects. The underlying question is whether or not he knew about the faulty foundation. If the paneling was installed during the time he owned the property, he was probably aware of the damage and should have disclosed it. When you agreed to do the repair work yourselves, you should have removed the paneling before completing the purchase. That would have been part of your discovery process. Then the extent of the

problem would have been revealed before you bought the property. Home inspectors often recommend evaluation of concealed conditions before the close of escrow, especially where evidence of past leakage is apparent. Now that the extent of the problem is known, you’ll have to decide whether to pursue the seller for nondisclosure or simply accept the outcome

as a learning experience. A real estate attorney can advise you regarding the costs and likely outcome of pursuing the seller. In some cases, a strongly worded letter is all that is needed. DEAR BARRY: My husband and I bought our home about a year ago. It was inspected, and no major defects were found. The previous owner renovated the interior, including the basement, and installed a French drain system. We asked if there was ever a problem of water in the basement, and the seller said there never was. But now, we get water in the basement every time it rains. There’s no way the

previous owner did not know about this, especially if he installed a French drain. Do you think he is liable for the cost of repairs? Valerie DEAR VALERIE: If your state requires seller disclosure, the seller should have informed you of this condition, especially if the question of drainage was

raised at the time of the sale. You should notify the seller of your concerns immediately and ask that he address this problem. Communication should be made by certified mail so that you have documentation. To determine the cost of repair, the problem should be evaluated by a geotechnical engineer or a licensed

contractor who specializes in drainage repairs. If the cost of repair is within the range of small-claims court, you’ll have the seller in a vulnerable position. Flushing water-heater sediment may help flow Q: (I have) no pressure when the hot water is turned on in the sinks. It doesn’t matter if it is a one-lever operation or a faucet with two handles. This house is 12 years old, and it started when I had the vanities raised. Then, in the utility room, we replaced the faucet with a new one and, lo and behold, the hot-water side has, once again, no pressure. What’s with the hotwater side after minor work? A: Since the pressure is OK on the cold side, it sounds like you might have sediment in your water

heater tank. In a 12-yearold house, I assume you have individual stops (shut-off valves) at each of the sinks. When the stops are shut off in order to replace the faucets and then turned back on again, I suspect some of the sediment from the water heater is lodging in the valves and partially blocking the

flow. I would suggest the following. First, flush the water heater to be sure that any sediment that’s accumulated in it has been removed. Here are the basic steps: Begin by shutting off the power by switching off the circuit breaker (electric water heater) or shutting off the valve controlling the gas supply (gas water heater). Next, shut off the cold-water supply to the water heater, which is a valve located above or next to the heater. Near the bottom of the water heater is a drain

valve. Attach a garden hose to the valve, and route the other end to a safe location. Open the drain valve all the way and let the water heater drain. You may find it necessary to open the pressure relief valve on the tank to encourage things to get started, which is sort of like punching a second hole in the top of a can to get it to drain. When the tank is empty, turn on the cold-water supply valve. This will allow fresh cold water to run through the tank, stirring up and flushing out any remaining sediment. Unless you have a tremendous buildup of material in the

tank, it shouldn’t take more than about five or 10 minutes to completely flush it out. When the water is clear, close the drain valve and remove the hose. Leave the main cold-water supply valve open, and refill the tank. When the tank is full — and only when it’s full — restore the power or turn on the gas and relight the pilot. After that, close the main water shutoff valve that controls the water to the entire house. That will allow you to remove the hot-water stops on the affected sinks and replace them with new ones. Fi-

nally, remove the screens on the end of the faucets themselves, turn the main water back on, turn the new stops back on, and then open the hot-water side of the faucets to flush them as well. Clean the faucet screens if needed, and reinstall them. If all that doesn’t solve the problem, then the cause lies somewhere deeper in the system.
